Decision No. 2070/QĐ-TTg On the establishment of the Management Board of the Economic Zone of Bình Phước Province

DECISION

Article 1. Establishing and defining the position and functions of the Management Board of the Economic Zone of Phuoc Binh Province.

1. Establishing the Management Board of the Economic Zone of Phuoc Binh Province (hereinafter referred to as the Management Board) based on the merger of the Management Board of Industrial Zones of Phuoc Binh Province (established pursuant to Decision No. 114/2003/QĐ-TTg dated June 10, 2003 of

The Management Board is an agency under the People's Committee of Phuoc Binh Province, performing the function of direct state management over industrial zones and border economic zones within the territory of Phuoc Binh Province; managing and organizing the provision of administrative public services and other supporting services related to investment and business activities for investors in industrial zones and border economic zones within the province according to the provisions of the law.

3. The Management Board has legal personality, has a bank account, a seal with the National Emblem, its office located in Phuoc Binh Province; it is the focal point for the provincial budget plan; it is balanced separately from development capital from the central budget. Administrative management expenses and operating expenses of the Management Board are funded from the state budget according to the provisions of the law.

Article 2. Tasks and powers of the Management Board

The Management Board performs tasks and powers as prescribed in:

1. Article 81 of Decree No. 108/2006/NĐ-CP dated September 22, 2006 of the Government detailing and guiding the implementation of certain provisions of the Investment Law.

2. Articles 37 and 38 of Decree No. 29/2008/NĐ-CP dated March 14, 2008 of the Government on industrial zones, export processing zones, and economic zones.

3. Other relevant legal documents.

Article 3. Organizational structure and staffing of the Management Board.

1. Leadership of the Management Board:

The Management Board has a Director and not more than three Deputy Directors.

The Director is appointed and relieved of duty by the Chairman of the People's Committee of Phuoc Binh Province according to the criteria set forth by the Ministry of Planning and Investment; Deputy Directors are appointed and relieved of duty by the Chairman of the People's Committee of Phuoc Binh Province upon the recommendation of the Director of the Management Board.

2. Organizational structure of the Management Board:

a) Administrative organizations include: the office, specialized departments, and representatives of the Management Board in industrial zones and border economic zones within the territory of Phuoc Binh Province;

b) Affiliated public service organizations

Based on the requirements and tasks of developing industrial zones and border economic zones within the territory of Phuoc Binh Province during each specific period, the Director of the Management Board shall take the lead and coordinate with relevant Departments and Agencies to submit to the Chairman of the People's Committee of Phuoc Binh Province for decision within his authority regarding the establishment of affiliated public service organizations under the Management Board.

3. Staffing:

a) The administrative staffing of the Management Board is decided by the People's Committee of Phuoc Binh Province within the total administrative staffing assigned, including: the Director, Deputy Directors, and staffing of the office, specialized departments, and representatives of the Management Board in industrial zones and border economic zones within the territory of Phuoc Binh Province;

b) The public service staffing of the Management Board is decided by the Chairman of the People's Committee of Phuoc Binh Province according to the provisions of the law on the delegation of administrative and public service staffing management and the staffing management mechanism for public service units of the State.

4. The Director of the Management Board shall submit to the People's Committee of Phuoc Binh Province for detailed regulations on the functions, tasks, powers, and organizational structure of the Management Board in accordance with the provisions of the law.

Article 4. Effectiveness

1. This Decision shall take effect from the date of issuance.

2. Abolishing the following decisions:

a) Decision No. 114/2003/QĐ-TTg dated June 10, 2003 of the Prime Minister on the establishment of the Management Board of Industrial Zones of Phuoc Binh Province;

b) Decision No. 205/QĐ-UBND dated January 28, 2008 of the People's Committee of Phuoc Binh Province on the establishment of the Management Board of the Hoa Lu Border Economic Zone, Phuoc Binh Province;

c) Decision No. 2734/QĐ-UBND dated December 31, 2007 of the People's Committee of Phuoc Binh Province on the Regulations on the Organization and Operation of the Hoa Lu Border Economic Zone, Phuoc Binh Province;

d) Decision No. 28/2008/QĐ-UBND dated June 25, 2008 of the People's Committee of Phuoc Binh Province on the Regulations on the Organization and Operation of the Management Board of the Hoa Lu Border Economic Zone, Phuoc Binh Province.

Article 5. Responsibility for Implementation

Ministers, Heads of Ministries equivalent to ministries, Heads of government agencies, Chairman of the People's Committee of Phuoc Binh Province, Director of the Management Board of the Economic Zone of Phuoc Binh Province are responsible for implementing this Decision./.
