JOINT CIRCULAR

GUIDELINES FOR SOME PROVISIONS OF THE DECREE NO. 124/2013/NĐ-CP OF OCTOBER 14, 2013 OF THE GOVERNMENT ON POLICIES TO FAVOR AND SUPPORT PERSONS ATTENDING TRAINING IN THE FIELD OF NUCLEAR ENERGYDecision No. 10 of 2013 of the Government on preferential policies and support for persons undergoing training in the atomic energy field training in the atomic energy field

Pursuant to Decree No. 215/2013/NĐ-CP dated December 23, 2013, promulgated by the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

Pursuant to Decree No. 32/2008/NĐ-CP dated March 19, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;

Pursuant to Decree No. 124/2013/NĐ-CP of October 14, 2013 of the Government on policies to favor and support persons attending training in the field of nuclear energy;

The Minister of Finance and the Minister of Education and Training issue this Joint Circular guiding some provisions of Decree No. 124/2013/NĐ-CP of October 14, 2013 of the Government on policies to favor and support persons attending training in the field of nuclear energy.

Article 1. Scope of Regulation and Applicability

2. Applicability:

This Joint Circular guides the implementation of policies to favor and support persons attending training in the field of nuclear energy as prescribed in Decree No. 124/2013/NĐ-CP of October 14, 2013 of the Government.

This Joint Circular applies to students majoring in nuclear energy fields who have committed to being assigned work after graduation by the Ministry of Education and Training, Vietnam Electricity Corporation, and related agencies; higher education institutions tasked with training human resources in the field of nuclear energy (training institutions); and agencies and organizations related to the implementation of training policies in the field of nuclear energy.

Article 2. Favorable Policies for Students Majoring in Nuclear Energy Fields at Domestic Higher Education Institutions

1. Tuition Fees and Dormitory Stays:

Students majoring in nuclear energy fields in regular full-time programs at the associate degree, bachelor's, master's, and doctoral levels at training institutions shall be exempt from tuition fees and provided free dormitory stays.

2. Living Allowance Policy:

a) Associate Degree Level:

Students will receive a monthly living allowance equal to 1.5 times the base salary for civil servants, public officials, and employees (hereinafter referred to as the base salary) if they achieve excellent academic performance; and equal to 1.0 times the base salary if they achieve good academic performance.

b) Bachelor's Degree Level:

Students will receive a monthly living allowance equal to 2.5 times the base salary if they achieve excellent academic performance; and equal to 1.5 times the base salary if they achieve good academic performance.

c) Postgraduate Level:

Graduate students and research fellows will retain their salaries during the period of study and will receive a monthly living allowance equal to 3.5 times the base salary.

d) Duration of Living Allowance Payment:

For undergraduate and associate degree students, the living allowance will be paid for 10 months per academic year in two installments: the first installment covering five months will be paid in October or November; the second installment covering five months will be paid in March or April.

For graduate students and research fellows, the living allowance will be paid monthly based on the actual number of months of study.

In cases where undergraduate students, graduate students, or research fellows take extended leave, are suspended from studies due to disciplinary action, or are expelled, the training institution where they are enrolled will cease providing the living allowance. When these students are readmitted after the suspension period or disciplinary action ends, they will continue to receive the living allowance according to the regulations. Time spent repeating courses, retaking courses, suspending studies, or supplementing studies will not be counted towards receiving the living allowance.

3. Other Favorable Policies:

a) Undergraduate students who achieve good academic performance in their final year may be considered for selection to participate in six-month internships abroad in the final year of their program; graduate students and research fellows may also be considered for such internships.

Undergraduate students, graduate students, and research fellows selected for internships abroad will be guaranteed funding for airfare, passport and visa fees, airport taxes, transportation costs from the airport to the place of study and back, health insurance, and living allowances as stipulated in Joint Circular No. 144/2007/TTLT-BTC-BGDĐT-BNG dated December 5, 2007 of the Ministry of Finance, Ministry of Education and Training, and Ministry of Foreign Affairs guiding the issuance and management of state budget funds for overseas Vietnamese student training programs (hereinafter referred to as Circular No. 144) and Joint Circular No. 206/2010/TTLT-BTC-BGDĐT-BNG dated December 15, 2010 of the Ministry of Finance, Ministry of Education and Training, and Ministry of Foreign Affairs amending and supplementing Circular No. 144 (hereinafter referred to as Circular No. 206).

b) Graduate students and research fellows who meet the conditions regarding academic performance and research as specified by the training institution may be recommended by school leadership to attend scientific conferences and seminars in the field of nuclear energy abroad. The content and level of expenditure will be applied according to current state regulations on travel expenses for short-term official trips abroad for civil servants funded by the state budget.

c) Graduate students and research fellows will be supported financially with 30 times the base salary for each scientific work in the field of nuclear energy published in international scientific journals listed in the ISI directory.

d) Lecturers, managers, scientists, and technicians working in the field of nuclear energy will be able to participate in short-term specialized training and development programs organized by the Ministry of Education and Training. The content and level of expenditure will be applied according to current state regulations on budget planning, management, and utilization for training and developing civil servants.

Article 3. Preferential policies for students studying specialized fields in the atomic energy sector abroad

1. University students, graduate students, and doctoral candidates who are dispatched by the Ministry of Education and Training to study specialized fields in the atomic energy sector abroad using state budget funds shall enjoy the following preferential benefits:

a) Airfare provision:

- University students and doctoral candidates shall be provided with two round-trip economy class tickets during their study period for travel between Vietnam and the host country.

- Graduate students shall be provided with one round-trip economy class ticket during their study period for travel between Vietnam and the host country.

b) Provision of passport processing fees and visa fees.

c) Provision of living expenses at a rate equal to 1.2 times the highest full living expense allowance currently paid by the Government for overseas students dispatched for training abroad (excluding those studying atomic energy), as stipulated in Circular No. 206. For example, according to Circular No. 206, Vietnamese overseas students studying in the Russian Federation currently receive the highest full living expense allowance of 480 USD per month; therefore, Vietnamese overseas students studying atomic energy in the Russian Federation will receive a living expense allowance of 480 USD per month x 1.2 = 576 USD per month.

d) Purchase of minimum health insurance as prescribed by the host country for application to foreign citizens studying there.

đ) Provision of airport fees, transportation costs from the airport to the school and vice versa.

The contents, levels of expenditure, and procedures for reimbursement of the benefits specified in points a, b, d, đ of Clause 1 of this Article shall be implemented in accordance with the provisions of Circulars No. 144 and No. 206.

e) Maintenance of salary for graduate students and doctoral candidates during their study and research periods abroad.

2. Lecturers, management staff, scientific and technical personnel working in the atomic energy sector who are dispatched for short-term training abroad according to the annual training and development plan approved by the competent authority shall enjoy the level of expenditure and contents of expenditure as prescribed by the current State regulations on travel allowances for civil servants and public officials traveling abroad for short-term assignments, funded by the state budget.

Article 4. Source of Funds

The funding for implementing preferential and support policies for students studying specialized fields in the atomic energy sector shall be allocated within the annual budget for educational services of the Ministry of Education and Training. Specifically, as follows:

1. Educational institutions directly under the Ministry of Education and Training assigned the task of training in the atomic energy field shall be allocated the budget estimate for implementing preferential policies for students as stipulated in Article 2 of this Joint Circular simultaneously with the allocation of the annual state budget estimate to cover the expenses for students. When allocating the budget to educational institutions, the Ministry of Education and Training must clearly record the budget estimate for implementing preferential and support policies for students studying specialized fields in the atomic energy sector.

When withdrawing the budget estimate for implementing preferential and support policies for students, the educational institution must submit to the State Treasury Office where the unit conducts transactions a summary of the implementation budget (including the following items: Name of the student currently studying the atomic energy specialty at the school; tuition fee amount; dormitory fee of the school; living expense allowance given to the student, other related support items, and total budget requirement requested for payment to the student).

2. For educational institutions not under the Ministry of Education and Training assigned the task of training in the atomic energy field: The Ministry of Education and Training shall implement contracts to transfer funds to these educational institutions according to the contents and levels of expenditure stipulated in Article 2 of this Joint Circular so that the schools can provide financial support to the students.

In the first quarter of each year, the educational institution has the responsibility to submit to the Ministry of Education and Training a consolidated report on the budget requirements for implementing preferential policies for students in the atomic energy sector (including the following items: Name of the student currently studying the atomic energy specialty at the school; tuition fee amount; dormitory fee of the school; living expense allowance given to the student, other related support items, and total budget requirement requested for payment to the student) for the Ministry of Education and Training to transfer funds to the school.

3. The funding for implementing preferential policies for students dispatched for training abroad in the atomic energy sector (including dispatching for internships abroad in the final year for students at domestic educational institutions) shall be allocated within the total annual budget estimate of the Ministry of Education and Training to cover the expenses for educational institutions and students abroad as prescribed.

Article 5. Establishing and Approving Budget Estimates

1. Each year, at the time of building the state budget estimate, training institutions assigned the task of training nuclear energy specialties shall establish the budget estimate for implementing preferential policies and supporting students in the field of nuclear energy according to the guidelines set out in this Circular and submit it to the Ministry of Education and Training.

2. Based on the annual state budget estimate construction guidelines issued by the Ministry of Finance; based on the number of students admitted to nuclear energy specialties through full-time training abroad, the actual number of exchange students studying abroad, and based on the reports from domestic training institutions regarding the number of students expected to be sent for short-term internships and training abroad; the Ministry of Education and Training shall establish the budget estimate for implementing preferential policies and supporting overseas training for students in the field of nuclear energy, and consolidate the budget estimates for implementing support policies for students at domestic training institutions to be included in the consolidated budget estimate of the Ministry of Education and Training to be submitted to the Ministry of Finance for approval by the competent authority as prescribed.

3. Based on the annual budget estimate funding approved by the competent authority, the Ministry of Education and Training shall base its assessment and allocation of budget estimates to subordinate training institutions or transfer funds to non-Ministry of Education and Training training institutions under the form of training contracts, according to the actual number of students enrolled in nuclear energy specialties reported by training institutions and the proposed budget estimates for implementation at these institutions.

Article 6. Management, Use, and Settlement of Funds

1. Training institutions and units assigned the task of training in the field of nuclear energy shall annually be responsible for compiling lists of students by level of training to report to the Ministry of Education and Training for consolidation and submission to the Ministry of Finance, along with the amount of funds already expended; and send to the State Treasury where the unit conducts transactions as the basis for controlling and disbursing funds in accordance with the guiding documents for implementing the State Budget Law, current expenditure regulations, and specific provisions in this Joint Circular.

The heads of training institutions and units assigned the task of implementing training in the field of nuclear energy are responsible for the number and list of students reported.

2. The use of funds to implement preferential and support policies for students in the field of nuclear energy must ensure complete documentation as required by current laws; the settlement must be consistent with the source of funds used and consistent with the corresponding expenditure items in the State Budget and summarized in the annual settlement report of the training institution to be submitted to the Ministry of Education and Training for consolidation and sent to the financial authority for review as prescribed.

3. The State Treasury shall disburse, settle, and control expenditures for implementing support policies for students in the field of nuclear energy according to the student lists established and submitted annually by training institutions, in accordance with the specific provisions in this Joint Circular and related guiding documents for implementing the State Budget Law.

Article 7. Responsibility for Implementation

b) Inspect and supervise educational institutions in implementing vaccination work.

a) Take the lead in establishing the budget estimate for implementing support and preferential policies for students in the field of nuclear energy according to the guidelines in this Joint Circular: detailing the number, training methods (full-time training abroad, full-time training domestically, short-term training), training institutions assigned the training task, training plans, and human resource utilization, together with the annual budget estimate consolidation to be submitted to the Ministry of Finance for consideration and decision by the competent authority.

b) Monitor, evaluate the progress and quality of training, and supervise the acceptance and job placement after graduation of students; periodically summarize, evaluate the results of implementation, and report to the Prime Minister.

2. The Ministry of Finance shall be responsible for:

Annually, coordinate with the Ministry of Education and Training to consolidate and submit the total budget estimate for implementation for approval by the competent authority.

3. Training institutions assigned the task of training human resources in the field of nuclear energy shall be responsible for:

a) Annually reporting to the Ministry of Education and Training the training plan, admission results, and list of students in nuclear energy specialties.

b) Ensuring the quality of training in accordance with the requirements of the Ministry of Education and Training; managing and using the support funds for students in accordance with the financial policy and regulations.

4. Agencies and units sending employees for postgraduate studies and doctoral studies in the field of nuclear energy shall be responsible for:

a) Ensuring full salary benefits for students during their training period as stipulated in Decree No. 124/2013/ND-CP dated October 14, 2013 of the Government on preferential and support policies for those going to train in the field of nuclear energy.

b) Developing an annual plan for sending employees for training.

c) Arranging work for employees within six months after completing the training program. Beyond this period, if the agency or unit does not issue a decision to accept or arrange work for the employee according to their trained specialty, the agency or unit shall be responsible for reimbursing the entire cost of implementing preferential and support policies for students as specified in this Joint Circular to the State Budget. The reimbursement funds shall not be sourced from the State Budget.

The Minister of Education and Training shall issue a decision requiring agencies and units to reimburse training costs as prescribed.

5. Responsibilities of Students:

a) Completing the training program as prescribed.

b) Being responsible for fulfilling the required working period as directed by the competent state authority. In cases of non-compliance or failure to fulfill the required working period, they must reimburse the training costs. The reimbursement of training costs shall be carried out in accordance with the current national regulations on scholarship and training cost reimbursement.

Article 8. Implementation organization

1. This Circular takes effect from February 10, 2015.

2. During the implementation process, if the legal normative documents cited for application in this Joint Circular are amended, supplemented, or replaced by new documents, they shall be applied according to the new documents;

3. In case of difficulties or obstacles, units shall report to the Ministry of Education and Training and the Ministry of Finance for research and resolution./.
