PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to Decree No. 170/2004/NĐ-CP dated September 22, 2004 of the Government on the reorganization, modernization, and development of state-owned agricultural farms;

Pursuant to Decree No. 200/2004/NĐ-CP dated December 3, 2004 of the Government on the reorganization, modernization, and development of state-owned forestry farms;

Considering the proposal of the Minister of Agriculture and Rural Development and the Chairman of the People's Committee of Dong Nai Province,

DECISION:

Article 1. Approves the Plan for the reorganization and modernization of state-owned agricultural and forestry farms directly under the People's Committee of Dong Nai Province as follows:

1. For state-owned agricultural farms:

a) Continue to consolidate and improve efficiency, maintain the model of a Joint Stock Company with sole member, with the State holding 100% of the charter capital:

- Tho Vuc Joint Stock Company with sole member;

- Industrial Rubber Joint Stock Company with sole member.

b) Merge into the Dong Nai Food Industry Corporation:

- Song Ray Agricultural and Service Enterprise.

2. For state-owned forestry farms:

a) Forestry farms will be transformed into Forest Management Boards for Protective Forests:

- Vinh An Forestry Farm;

- Forestry Farm 600;

- Tan Phu Forestry Farm;

- Long Thanh Forestry Farm;

- Xuan Loc Forestry Farm.

b) Forestry farm will be transformed into a Forestry Center (a service unit with income):

- Bien Hoa Forestry Farm.

Article 2. Chairman of the People's Committee of Dong Nai Province:

1. Direct the implementation of the reorganization and modernization of state-owned agricultural and forestry farms as prescribed in Article 1 of this Decision; decide on the reorganization of Tho Vuc Joint Stock Company with sole member and Industrial Rubber Joint Stock Company with sole member appropriately when implementing the shareholding reform of Dong Nai Export Agricultural Products Processing Joint Stock Company.

2. Decide to adjust the area and boundaries of land allocated to agricultural farms, Forest Management Boards for Protective Forests, and Forestry Centers in accordance with the local agricultural and forestry development plan; the development plan of each agricultural farm and management requirements of each Forest Management Board for Protective Forests as proposed by the Ministry of Agriculture and Rural Development in the report No. 1952/BNN-ĐMDN dated August 4, 2006.

Article 3. The Ministries of Agriculture and Rural Development, Finance, Planning and Investment, Natural Resources and Environment, Labor - Invalids and Social Affairs, Home Affairs, and related agencies shall coordinate with the People's Committee of Dong Nai Province in implementing this Plan.

Article 4. This Decision takes effect 15 days from the date of publication in the Official Gazette.

The Chairman of the People's Committee of Dong Nai Province and heads of relevant agencies are responsible for enforcing this Decision ./.
