NUMBER 21/2000/PL-UBTVQH10 dated April 28, 2000
AMENDING AND SUPPLEMENTING CERTAIN PROVISIONS OF THE ORDINANCE ON CIVIL SERVANTS

Based on the Constitution of the Socialist Republic of Vietnam in 1992;
Pursuant to the Resolution of the Tenth National Assembly, Sixth Session on the Law and Ordinance Building Program for 2000;
This Ordinance amends and supplements certain provisions of the Ordinance on Civil Servants which was adopted by the Standing Committee of the National Assembly on February 26, 1998.
Article 1. Amending and supplementing certain provisions of the Ordinance on Civil Servants as follows:
1. Article 17 is amended and supplemented as follows:
Article 17. Civil servants shall not establish, participate in establishing, or manage or direct private enterprises, limited liability companies, joint-stock companies, partnerships, cooperatives, private hospitals, private schools, and private research organizations. Civil servants shall not provide consultancy services to businesses, trading organizations, service providers, and other individuals or entities within the country or abroad regarding matters related to state secrets, work-related secrets, matters within their jurisdiction, and other activities where such consultancy could harm national interests. The Government shall specify the details of consultancy services provided by civil servants."
2. Article 19 is amended and supplemented as follows:
"Article 19The head of an agency, deputy heads of the agency, spouses of these individuals shall not invest capital in enterprises operating within the scope of industries or professions that they directly oversee in terms of state management."
Article 2. Previous regulations contrary to this Ordinance are abolished.
Article 3.
1. The Government shall provide detailed regulations and guidance on the implementation of this Ordinance.
2. Based on this Ordinance, political organizations and political-social organizations shall specify the implementation details for civil servants under their management authority./.
