Amending and supplementing certain provisions of Circular No. 13/2008/TT-BTTTT dated December 31, 2008 guiding the establishment and operation of representative offices and permanent correspondents within the country of press agencies and Decision No. 28/2002/QĐ-BVHTT dated November 21, 2002 of the Minister of Culture and Information promulgating the regulations on publishing bulletins, documents, leaflets; issuing press releases; posting and broadcasting news on electronic screens of foreign agencies, organizations, and juridical persons with foreign elements in Vietnam.

of foreign agencies and organizations, and foreign-invested legal entities in Vietnam

Pursuant to the Press Law dated December 28, 1989 and the Law Amending and Supplementing Certain Provisions of the Press Law dated June 12, 1999;

Pursuant to the Government Decree No. 51/2002/NĐ-CP dated April 26, 2002 detailing the implementation of the Press Law; the Law Amending and Supplementing Certain Provisions of the Press Law;

BASED ON THE GOVERNMENT DECREE NO. 187/2007/NĐ-CP OF DECEMBER 25, 2007 ON THE FUNCTIONS, TASKS, POWERS, AND ORGANIZATIONAL STRUCTURE OF THE MINISTRY OF INFORMATION AND COMMUNICATIONS;

Implementing Resolution No. 71/NQ-CP dated December 27, 2010 of the Government on simplifying administrative procedures within the scope of management functions of the Ministry of Information and Communications, the Minister of Information and Communications amends and supplements certain provisions of Circular No. 13/2008/TT-BTTTT and Decision No. 28/2002/QĐ-BVHTT as follows:

Article 1. Amending and supplementing certain provisions of Circular No. 13/2008/TT-BTTTT:

1. Amending points b and e, Clause 3, Section II as follows:

“b) A certified copy by the press agency of the Press Business License.”

“e) A certified copy by the press agency of the Journalist Card of the head of the representative office and permanent correspondent.”

2. Amending and supplementing Clause 3, Section II regarding the procedure for processing requests to establish a representative office of a press agency as follows:

"Within five (5) working days from the date of receipt of the dossier, the Department of Information and Communications shall check its validity and guide the press agency to complete the dossier."

Within thirty (30) working days from the date of receiving the complete dossier as prescribed, the Department of Information and Communications shall be responsible for examining and resolving the request so that the press agency can be established and organize the activities of the representative office in the locality. In case of disagreement, a written response stating the reasons must be provided."

Article 2. Amending and supplementing certain provisions of Decision No. 28/2002/QĐ-BVHTT:

1. Amending and supplementing Article 10 as follows:

"Agencies and organizations wishing to publish bulletins, documents, leaflets; issue press releases; post and broadcast news on electronic screens must submit a request to the Ministry of Information and Communications for permission. The dossier shall be submitted to the Department of Press, Ministry of Information and Communications."

"2. Amending two (02) forms issued together with Decision No. 28/2002/QĐ-BVHTT by two (02) new forms issued together with this Circular, specifically:

a) Form No. 1 - Application for Publishing Bulletin is amended to Application for Issuing Publication Permit for Bulletin.

b) Form No. 2 - Application for Publishing Document, Leaflet; Issuing Press Release is amended to Application for Issuing Publication Permit for Document, Leaflet; Issuing Press Release."

Article 3. Effectiveness

1. This Circular takes effect from September 1, 2011.

2. Relevant agencies, organizations, and individuals are responsible for implementing this Circular./.
