Pursuant to the Law on Telecommunications dated November 23, 2009;

Pursuant to the Radio Frequency Law dated November 23, 2009;

Based on Decree No. 132/2013/ND-CP dated October 16, 2013 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Information and Communications;

Pursuant to Decree No. 215/2013/NĐ-CP dated December 23, 2013, promulgated by the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

Pursuant to Decision No. 11/2014/QĐ-TTg dated January 27, 2014 of the Prime Minister on the organization and operation of the Vietnam Universal Service Fund;

Implementing Decision No. 2451/QĐ-TTg dated December 27, 2011 of the Prime Minister approving the Digitalization Project of Ground-Based TV Transmission and Broadcasting until 2020;

Implementing Circular No. 447/VPCP-KTTH dated January 20, 2015 of the Government Office regarding the use of funds from the Vietnam Universal Service Fund to support digital television receivers for poor households and near-poor households under the Digital Terrestrial Transmission and Broadcasting Project until 2020 in Da Nang City and Bac Quang Nam District;

The Minister of Information and Communications and the Minister of Finance issue this Joint Circular guiding pilot support for digital terrestrial television receivers in Da Nang City and 4 districts of Bac Quang Nam according to the Digital Terrestrial Transmission and Broadcasting Project until 2020.

Article 1. Scope of Regulation and Applicability

Article 1. Scope of Regulation: This Circular guides pilot support for digital terrestrial television receivers in Da Nang City and 4 districts of Bac Quang Nam according to the Digital Terrestrial Transmission and Broadcasting Project until 2020.

Article 2. Recipients of Support: Poor households and near-poor households according to the poverty and near-poverty standards prescribed in Decision No. 09/2011/QĐ-TTg dated January 30, 2011 of the Prime Minister on issuing the poverty and near-poverty standards applicable for the period 2011-2015. Article 3. Supported Area: Da Nang City and 4 districts of Bac Quang Nam including: Hoi An City, Dien Ban District, and areas within the DVB-T2 coverage area of Vietnam Television broadcasting from Son Tra, including communes in Dai Loc District (including: Da Phong, Da Minh, Da Tan, Da Thang, Da Cuong, Da Hiep, Da An, Da Hoa) and communes in Duy Xuyen District (including: Duy Thu, Duy Tan, Duy Hoa, Duy Chau, Duy Trinh, Duy Trung, Nam Phuoc Town, Duy Phuoc, Duy Thanh, Duy Vinh, Duy Nghia, Duy Hai).

Article 4. Timeframe for Implementation: In 2015.

In this Circular, the following terms shall be understood as follows: Digital terrestrial television receiver: Is a device capable of decoding digital terrestrial television signals with independent power supply from a television set, used to receive digital terrestrial television signals according to the DVB-T2 standard.

Article 2. Interpretation of Terms

Article 3. Conditions for Receiving Support

The recipients specified in Clause 2 of Article 1 of this Circular shall be eligible to receive support for digital terrestrial television receivers when meeting the following conditions:

Point 1. Listed in the list of poor and near-poor households based on the results of poverty and near-poverty surveys up to December 31, 2014 and approved by the competent authority.

Point 2. Currently using analog television sets without integrated DVB-T2 digital terrestrial television reception capabilities, without digital terrestrial television receivers, and not using any pay television services such as cable television, satellite television, or IPTV during the implementation of the support program.

Point 3. Submitting an application for support for digital terrestrial television receivers to the provincial People's Committee with a commitment not to sell, give away, or donate the supported digital terrestrial television receivers.

3. Submit an application to the People's Committee of the province requesting support for digital terrestrial television receivers, with a commitment not to sell, give, or gift the supported digital terrestrial television receiver.

Article 4. Level and form of support

The support shall be implemented on a household basis. Each household shall only be supported once with physical items consisting of 01 ground digital television receiver along with an appropriate antenna and a cable connection up to a maximum length of 15 meters (for outdoor reception) and shall be covered by a warranty for 12 months from the date the household receives the ground digital television receiver.

Article 5. Funding for implementation of support

1. The Vietnam Universal Service Fund (hereinafter referred to as the Fund) shall use the remaining funds after implementing the program to provide public telecommunications services until 2010 as stipulated in Decision No. 74/2006/QD-TTg dated April 7, 2006 of the Prime Minister to carry out the following tasks: a) Organizing the purchase and installation of ground digital television receivers for the supported recipients.

b) Monitoring and supervising the implementation of the pilot support for ground digital television receivers by the Ministry of Information and Communications.

a) Expenditure for activities serving the deployment, inspection, and supervision of support for ground digital television receivers at the local level: travel expenses, fuel, office supplies, and other directly related costs;

2. Local budget:

b) Based on the local budget capacity and other legitimate sources, deciding to support ground digital television receivers for households classified as poor or near-poor according to the local poverty standards and other eligible groups.

a) Expenditure for purchasing and installing ground digital television receivers based on the tender results;

3. Level of expenditure:

b) Other expenditure items shall be carried out in accordance with current regulations.

Article 6. Procedures for advance payment, settlement, acceptance, and finalization of funding for support of ground digital television receivers

1. The contractor shall be entitled to advance payment and settlement of support funding according to the contract for providing and installing ground digital television receivers (hereinafter referred to as the contract) signed.

The advance payment application file includes: Request for advance payment and a copy of the Contract.

2. Within 30 days from the end of the support activity for ground digital television receivers to the supported recipients in the province or city, the contractor shall be responsible for preparing the finalization payment request file and sending it to the Fund (details in Appendix 3).

3. Within 45 days from receiving the complete finalization payment request file, the Fund shall conduct verification and assessment of the number of supported ground digital television receivers, prepare the acceptance report of the contract performance results, finalize the funding, terminate the contract with the contractor, and submit the finalization payment request approval file to the Ministry of Information and Communications (details in Appendix 4).

4. Within 30 days from receiving the finalization payment request approval file from the Fund, the Ministry of Information and Communications shall approve the finalization of the funding.

5. Within 15 days from the Ministry of Information and Communications approving the finalization of the funding, the Fund shall settle the funding for the contractor.

1. The Ministry of Information and Communications shall be responsible for implementing, guiding, inspecting, and supervising the procurement of ground digital television receivers for the supported recipients in accordance with current legal regulations.

Article 7. Implementation Organization

2. The Ministry of Finance shall be responsible for coordinating with the Ministry of Information and Communications to guide and resolve issues related to funding for supporting ground digital television receivers in accordance with current legal regulations.

3. The People's Committee of Da Nang City and Quang Nam Province shall be primarily responsible for organizing the distribution of ground digital television receivers to the supported recipients as prescribed, including:

a) Developing and approving plans for distributing ground digital television receivers at the local level;

b) Confirming support requests from recipients meeting the conditions specified in Article 3 of this Circular according to Form 01/Request as stipulated in Appendix 1 attached to this Circular;

c) Compiling lists of recipients eligible for support as specified in Article 3 of this Circular according to Forms 03/DSHN-NC and 04/DSHCN-NC as stipulated in Appendix 2 attached to this Circular and submitting the list to the Ministry of Information and Communications and the contractor;

d) Confirming the list of recipients who have received ground digital television receivers provided by the contractor according to Form 07/HSQT as stipulated in Appendix 3 of this Circular;

đ) Inspecting and supervising the distribution and installation of ground digital television receivers for the supported recipients within their jurisdiction.

Article 7. This Circular takes effect from September 3, 2015.

2. In the course of implementation, if there are difficulties or obstacles, it is requested that relevant ministries, central agencies, and localities report to the Ministry of Information and Communications and the Ministry of Finance for study and resolution.
