PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

Article 2. Applicability

Article 3. Explanation of Terms

In this Circular, the following terms are understood as follows:

3. RECORDING, SUBMITTING FISHING LOGS AND REPORTSArticle 4. Recording, submitting fishing logs and reports for fishing vessels

4. Clause 1. The captain of fishing vessels with a maximum length of 12 meters or more shall record fishing logs daily according to Model No. 01 Appendix I issued together with this Circular; submit fishing logs to the port management organization within 24 hours after the vessel completes unloading through the port.Clause 2. The captain of fishing vessels with a maximum length of 6 to under 12 meters shall record fishing reports according to Model No. 03 Appendix I issued together with this Circular; submit fishing reports to the port management organization on a weekly basis once every week.

5. Certificate of origin for wild-caught seafood is the certification by the competent authority that a consignment of exported seafood with wild-caught origin does not violate the regulations on illegal, unreported, and unregulated fishing.

6. Confirmation of commitment to imported seafood raw materials or products made from imported seafood raw materials is the confirmation by the competent authority that a consignment of processed seafood derived from imported wild-caught seafood does not have an origin from illegal, unreported, and unregulated fishing.

Chapter II

RECORDING, SUBMITTING LOGS AND REPORTS ON SEAFOOD HARVESTING

Article 4. Recording, submitting logs, and reporting on seafood harvesting for fishing vessels targeting aquatic resources

1. The captain of fishing vessels with a maximum length of 12 meters or more shall record the daily logbook of seafood harvesting according to Model No. 01 attached as Appendix I to this Circular; submit the logbook of seafood harvesting to the port management organization within 24 hours after the vessel completes the loading and unloading of seafood at the port.

2. The captain of fishing vessels with a maximum length from 6 to less than 12 meters shall record the weekly report on seafood harvesting according to Model No. 03 attached as Appendix I to this Circular; submit the report on seafood harvesting to the port management organization on a periodic basis of once every week.

1. The captain of fishing vessels with a maximum length of 12 meters or more shall record the daily logbook of seafood harvesting according to Model No. 01 attached as Appendix I to this Circular; submit the logbook of seafood harvesting to the port management organization within 24 hours after the vessel completes the loading and unloading of seafood at the port.

Article 5. Recording, submitting fishing logs and reports for fishery resource support vessels

1. The captain of daily fish purchasing and transporting vessels shall record the fishing purchase and transportation log according to Model No. 02 of Appendix I issued together with this Circular; submit the fishing purchase and transportation log to the fishing port management organization within 24 hours after the vessel has completed unloading at the port.

2. The captain of surveying, searching, and guiding fishery resource vessels shall record the surveying, searching, and guiding report on fishery resources according to Model No. 04 of Appendix I issued together with this Circular; submit the surveying, searching, and guiding report on fishery resources to the fishing port management organization within 24 hours after the vessel docks at the port.

1. The captain of daily fish purchasing and transporting vessels shall record the fishing purchase and transportation log according to Model No. 02 of Appendix I issued together with this Circular; submit the fishing purchase and transportation log to the fishing port management organization within 24 hours after the vessel has completed unloading at the port.

Chapter III

ANNOUNCEMENT OF DESIGNATED FISHING PORTS TO CONFIRM THE ORIGIN OF FISHERY PRODUCTS FROM FISHERIES; LIST OF ILLEGAL FISHERY VESSELS

Article 6. Announcement of the list of designated fishing ports with sufficient systems to confirm the origin of fishery products from fisheries

1. A designated fishing port with sufficient systems to confirm the origin of fishery products from fisheries is a fishing port that meets the criteria of Class I or Class II fishing ports and has been officially announced according to regulations.

2. Every quarter, the Department of Agriculture and Rural Development will review and report to the Fisheries General Administration the list of designated fishing ports with sufficient systems to confirm the origin of fishery products from fisheries according to Model No. 01 of Appendix II issued together with this Circular for consolidation and submission to the Ministry of Agriculture and Rural Development for announcement.

3. The list of designated fishing ports with sufficient systems to confirm the origin of fishery products from fisheries will be published on the Fisheries General Administration's electronic information website.

Article 7. Inspection of fishing vessels and monitoring of fishery product volume at fishing ports

1. Implementing agencies

a) The Department of Agriculture and Rural Development organizes inspections of fishing vessels at fishing ports;

b) The fishing port management organization supervises the unloading of fishery products through the port; arranges office space, coordinates to carry out inspections of fishing vessels at fishing ports.

2. Supervision of unloading fishery products through the port

Upon receiving a request to dock at the port from the vessel owner or the captain of the fishing vessel, the fishing port management organization will cross-reference with the list of illegal fishing vessels; if the fishing vessel is listed as an illegal fishing vessel, it will not be allowed to unload fishery products and will be reported to the competent authority for handling according to regulations; if it is not listed as an illegal fishing vessel, it will be arranged to dock at the port to unload fishery products and staff will be assigned to monitor the volume and species composition of fishery products unloaded through the port.

If the actual volume of fishery products unloaded differs by more than 20% from the declared volume before docking, a record will be made and handled according to authority or transferred to the competent authority for handling according to regulations.

3. Fishery product unloading receipt at the port

At the request of the vessel owner or the captain, the fishing port management organization will check the vessel information, fishing logbook, and issue a fishery product unloading receipt at the port according to Model No. 02 of Appendix II issued together with this Circular.

The number of receipts issued for each voyage is based on the request of the vessel owner or the captain, but the total volume of fishery products in the receipts must not exceed the actual volume unloaded at the port.

4. Inspection of fishing vessels docking at the port

a) Inspection targets: Fishing vessels with a maximum length of 24 meters or more; fishing vessels with a maximum length under 24 meters, inspect a minimum of 20% for tuna fishing vessels, a minimum of 10% for trawling vessels, and a minimum of 5% for other fishing vessels among the total number of fishing vessels docking to unload fishery products; fishing vessels showing signs of violating regulations on illegal fishing, non-reporting, and non-compliance;

b) Inspection contents: Checking the information recorded in the fishing logbook or the fishing purchase and transportation logbook against the volume and species composition of fishery products on board the fishing vessel, consistent with the type of fishing operation; cross-referencing the name and registration number of the fishing vessel with the list of illegal fishing vessels announced by the Ministry of Agriculture and Rural Development;

c) Inspection records according to Model No. 03 of Appendix II issued together with this Circular.

5. Inspection of fishing vessels leaving the port

a) Inspection targets: Fishing vessels with a maximum length of 24 meters or more; fishing vessels with a maximum length under 24 meters, inspect a minimum of 20% for tuna fishing vessels, a minimum of 10% for trawling vessels, and a minimum of 5% for other fishing vessels among the total number of fishing vessels leaving the port to fish;

b) Inspection contents

Cross-referencing the name and registration number of the fishing vessel with the list of illegal fishing vessels announced by the Ministry of Agriculture and Rural Development;

Checking documents: Certificate of fishing vessel registration; Fishery exploitation permit; Safety technical certificate of fishing vessel; Fishing logbook (according to model); certificates and licenses of captain, chief engineer, and engineer; Crew roster;

On-site inspection on the vessel: Navigation equipment, life-saving, fire-fighting equipment; communication and signaling system; voyage monitoring equipment; fishing gear; crew members; marking of fishing vessels;

c) Inspection records according to Model No. 04 of Appendix II issued together with this Circular.

6. In case of violations being discovered, the inspection agency will make a record and handle according to authority or transfer to the competent authority for handling according to regulations.

Article 8. List of fishing vessels engaged in illegal fishing

1. Fishing vessels to be included in the list of fishing vessels engaged in illegal fishing are those that have been administratively sanctioned for violations under any of the acts stipulated in Clause 1, Article 60 of the Fisheries Law.

2. Fishing vessels removed from the list of fishing vessels engaged in illegal fishing fall under one of the following cases:

a) Fishing vessels that have deregistered according to Clause 1, Article 72 of the Fisheries Law;

b) The owner of the fishing vessel specified in Clause 1 of this Article has fully executed the administrative penalty decision and completed measures to mitigate consequences as prescribed in the administrative penalty decision.

3. Weekly, provincial fisheries management agencies responsible for managing fishing vessels operating at sea shall review, compile, and prepare a list of fishing vessels under Clause 1 and Clause 2 of this Article, and report to the General Department of Fisheries to include or remove such vessels from the list of fishing vessels engaged in illegal fishing on the General Department of Fisheries' website.

Chapter IV

CONFIRMATION OF RAW MATERIALS AND CERTIFICATION OF THE ORIGIN OF FISHERIES PRODUCTS

Article 9. Competence to confirm raw materials and certify the origin of fisheries products

1. Port management organizations designated under Clause 3, Article 6 of this Circular shall verify the origin of domestically harvested fisheries products regarding quantity, species composition, fishing area, and time when requested for fishing vessels unloading at the port.

2. Provincial fisheries management agencies announced on the General Department of Fisheries' website in Appendix IV issued with this Circular shall certify the origin of domestically harvested fisheries products not violating regulations on illegal, unreported, and unregulated fishing.

3. The Quality Management Department of Forestry, Agriculture, and Fisheries Products shall confirm commitments or certify products made from imported fisheries raw materials not originating from illegal, unreported, and unregulated fishing upon request from regional fishery organizations or importing countries.

4. Veterinary authorities shall inspect and control the origin of imported fisheries raw materials according to Circular No. 26/2016/TT-BNNPTNT dated June 30, 2016, of the Minister of Agriculture and Rural Development on animal quarantine, aquatic animal products, and amendments and supplements to this Circular.

Article 10. Confirmation of domestic fisheries raw materials

1. Organizations and individuals requesting confirmation of domestic fisheries raw materials shall submit one set of application documents directly, via postal service, or through the internet (if available) to the port management organization where the fishing vessel unloaded its catch.

2. The application documents shall include:

a) A Raw Material Confirmation Form for Fisheries Products according to Model No. 01 in Appendix III issued with this Circular, fully filled out with all required information;

b) The original Receipt for Unloaded Fisheries Products issued by the port management organization, a copy of which should be submitted if the application is made online.

3. Within two working days from the date of receiving complete application documents, the port management organization shall verify the information provided about the quantity, species composition of the unloaded catch, fishing area, and time against the Vessel Arrival and Departure Logbook and the vessel monitoring system, and issue the Raw Material Confirmation Form for Fisheries Products according to Model No. 01 in Appendix III issued with this Circular. If the confirmation is not granted, the port management organization shall provide a written response stating the reasons.

In cases where the entire quantity of the product listed in the receipt has not been confirmed, the port management organization shall return the original receipt indicating the remaining quantity to the applicant. If the entire quantity has been confirmed, the port management organization shall retain the original receipt and file the application documents.

4. Organizations and individuals requesting confirmation shall pay fees and service charges as prescribed.

Article 11. Issuing and Reissuing the Certificate of Origin for Captured Aquatic Products

1. Organizations and individuals requesting to issue or reissue the Certificate of Origin for Captured Aquatic Products shall submit one set of application documents directly, send through postal service, or via online environment (if available) to one of the competent authorities as stipulated in Clause 2, Article 9 of this Circular.

2. The application for certification includes:

a) A copy of the Confirmation Certificate of Captured Aquatic Raw Materials with a description of the raw materials used according to Section B of Form No. 01 in Appendix III issued together with this Circular; in cases where captured aquatic raw materials have not been fully utilized, organizations and individuals requesting certification shall submit the original Confirmation Certificate of Captured Aquatic Raw Materials for the competent authority to confirm the unused raw materials. In cases where captured aquatic raw materials have been fully utilized, the competent authority shall collect the original Confirmation Certificate of Captured Aquatic Raw Materials and retain the file;

b) The Certificate of Origin for Captured Aquatic Products according to Form No. 02 in Appendix III issued together with this Circular for products exported to the European market or according to Form No. 03 in Appendix III issued together with this Circular for products exported to markets of countries under the International Commission for the Conservation of Atlantic Tunas or a certificate according to the requirements of the importing country's competent authority with complete information declared;

c) Additional information for aquatic products processed from Vietnamese fishing vessels and transportation information according to Form Nos. 02a and 02b in Appendix III issued together with this Circular.

3. The Certificate of Origin for Captured Aquatic Products shall be reissued in the following cases: the Certificate of Origin for Captured Aquatic Products is torn, deteriorated, lost, or has changed information. The application for reissuing the certificate includes:

a) An application for reissuing the Certificate of Origin for Captured Aquatic Products according to Form No. 05 in Appendix III issued together with this Circular;

b) The Certificate of Origin for Captured Aquatic Products according to Form No. 02 or Form No. 03 in Appendix III issued together with this Circular or a certificate according to the requirements of the importing country's competent authority with complete information declared;

c) The original Certificate of Origin for Captured Aquatic Products that is torn, deteriorated, or contains incorrect information (except in cases where the certificate is lost).

4. Within two working days from the date of receiving all documents, the competent authority shall check the information, review the file, and take the following actions:

a) Certify when the information in the Certificate of Origin for Captured Aquatic Products is fully and correctly declared in accordance with the information on fishing vessels, Fishing Permit, and Confirmation Certificate of Captured Aquatic Raw Materials; confirm in Section C of the Confirmation Certificate of Captured Aquatic Raw Materials when there are remaining raw materials, return one set of documents to the organization or individual requesting (including the original Confirmation Certificate of Captured Aquatic Raw Materials when there are remaining raw materials), and retain a copy of the file at the competent authority;

b) Not certify when the information declared in the file does not match the information on fishing vessels, Fishing Permit, and Confirmation Certificate of Captured Aquatic Raw Materials; in cases where certification is not granted, the competent authority shall respond in writing and clearly state the reasons.

5. The reissued certificate must have the same number as the original Certificate of Origin for Captured Aquatic Products and include the symbol "R" in the "certificate number" section; the issuing authority shall notify the relevant competent authorities about the reissuance of the Certificate of Origin for Captured Aquatic Products.

6. Organizations and individuals requesting certification shall pay fees and charges as prescribed.

Article 12. Confirmation of Commitment or Certification of Exported Aquatic Products Originating from Imported Marine Catch

1. Organizations and individuals wishing to confirm a commitment or certify exported aquatic products originating from imported marine catch shall submit one set of application documents and receive the administrative procedure result simultaneously with the issuance of the Food Safety Certificate for the batch of exported aquatic food products according to Circular No. 48/2013/TT-BNNPTNT dated November 12, 2013 of the Minister of Agriculture and Rural Development on inspection and certification of safety for exported aquatic products. The application for confirmation of commitment or certification of exported aquatic products originating from imported marine catch includes:

a) An original or copy of the Certificate of Origin of Marine Catch issued by the competent authority of the flag State of the fishing vessel;

b) A confirmation of commitment or certification of exported aquatic products originating from imported marine catch according to Form No. 03 or Form No. 04 in Appendix III attached to this Circular or another document with equivalent content as required by the importing country's competent authority or regional fisheries management organization that has fully provided the necessary information.

2. The competent authority specified in Clause 3, Article 9 of this Circular shall implement verification and confirmation of commitment or certification of exported aquatic products originating from imported marine catch based on the following contents:

a) Cross-checking information about the fishing vessel and other relevant information (flag State, quantity, type of aquatic product) in the Certificate of Origin of Marine Catch issued by the exporting country's competent authority for the imported raw material batch with the following information:

List of fishing vessels involved in illegal fishing activities as recorded by the exporting country's competent authority or regional fisheries management organization recognized by the importing country's competent authority;

List of registered fishing vessels authorized to fish (including information on species, area, season) by the regional fisheries management organization recognized by the importing country's competent authority (for countries whose fishing vessels are members of such organizations);

b) Cross-checking the quantity and type of imported marine catch raw materials for processing and export against the information on the imported batch verified and certified by the Veterinary Authority upon importation into Vietnam;

c) Cross-checking the quantity and type of imported marine catch raw materials for processing and export against the statistical record confirming the commitment of exported aquatic products originating from imported marine catch and the monitoring records during the inspection and certification of safety for the exported marine catch batch;

d) Cross-checking other requirements of the importing country's competent authority, the confirmation of commitment or certification of exported aquatic products originating from imported marine catch, or as requested by the regional fisheries management organization.

3. Within two working days after completing the verification, the competent authority shall confirm the commitment or certification of exported aquatic products originating from imported marine catch if the batch meets the provisions of Clause 2 of this Article. In case of non-confirmation, the competent authority shall provide a written response stating the reasons.

Article 13. Inspection of the Implementation of Raw Material Confirmation and Fishing Origin Certification

1. Inspection Authority: The Fisheries General Department, the Quality Management Bureau for Forestry, Agriculture, and Fisheries Products.

2. Inspection Targets: Provincial fisheries management agencies; port management organizations designated with a complete system for confirming the origin of fishing products; processing and exporting establishments that implement raw material confirmation and fishing product origin certification.

3. Content of inspection:

a) Inspect the procedures, formalities, and documentation for implementing raw material confirmation for fishing products and fishing origin certification.

b) Inspect the procedures, formalities, and documentation for inspecting fishing vessels entering and leaving ports and monitoring the quantity of fishing products loaded and unloaded at fish ports.

4. Handling of Inspection Results: In cases where violations are discovered, depending on the severity of the violation, the inspection authority shall handle according to its jurisdiction or recommend the competent authority to handle in accordance with regulations; recommend the Ministry of Agriculture and Rural Development to remove from the list of designated fish ports those port management organizations that fail to comply with the regulations on raw material confirmation from fishing activities leading to consequences such as batches being returned or systematic violations of the procedures for confirming raw materials and certifying the origin of fishing products.

Chapter V

RESPONSIBILITIES AND LIMITS OF ORGANIZATIONS AND INDIVIDUALS

Article 14. Fisheries General Department

1. Implement the contents prescribed in this Circular.

2. Organize training and professional development for organizations and individuals related to recording, submitting logbooks, and reporting fishing activities; inspection work, raw material confirmation, and fishing product origin certification.

3. Inspect the implementation of raw material confirmation and fishing product origin certification by relevant organizations and individuals.

4. Take the lead in resolving issues related to raw material confirmation and fishing product origin certification domestically; coordinate with relevant agencies to exchange information and resolve issues related to commitment confirmation or certification of exported seafood products originating from imported fishing products.

5. Publish lists of Vietnamese fishing vessels engaged in illegal fishing and lists of designated fish ports with a complete system for confirming the origin of fishing products on the Fisheries General Department's website.

6. Summarize and report to the Ministry of Agriculture and Rural Development the results of raw material confirmation and fishing product origin certification.

Article 15. Quality Management Bureau for Forestry, Agriculture, and Fisheries Products

1. Direct and organize the implementation, periodically inspect and supervise activities related to the inspection, confirmation of commitments, or certification of exported seafood products originating from imported fishing products.

2. Uniformly manage professional and operational matters; train and develop staff involved in the inspection, confirmation of commitments, or certification of exported seafood products originating from imported fishing products.

3. Lead negotiations with foreign authorities regarding cooperation, information exchange, and resolution of issues related to commitment confirmation or certification of exported seafood products originating from imported fishing products.

4. Report quarterly the results of inspections and confirmations of commitments or certifications of exported seafood products originating from imported fishing products to the Fisheries General Department for consolidation and reporting to the Ministry of Agriculture and Rural Development.

5. Direct the Regional Quality Control Center for Forestry, Agriculture, and Fisheries Products:

a) Implement commitment confirmation or certification of exported seafood products originating from imported fishing products as stipulated in Article 12 of this Circular.

b) Guide importers on the procedures, formalities, and contents related to commitment confirmation or certification of exported seafood products originating from imported fishing products as stipulated in this Circular.

c) Store records of commitment confirmation or certification of exported seafood products originating from imported fishing products for a period of 36 months from the date of confirmation or certification.

Article 16. Departments of Agriculture and Rural Development of provinces and centrally governed cities

1. Direct, publicize, guide, and inspect the implementation of this Circular within their assigned management areas.

2. Organize inspections and controls over fishing vessels engaged in illegal fishing activities at fish ports within their provincial territories.

3. Advise the provincial People's Committees to ensure funding, human resources, and related conditions for the competent authority's operations concerning the inspection of fishing vessels at fish ports, confirmation of raw materials, and certification of the origin of harvested aquatic products.

4. Review quarterly and compile a list of designated fish ports that have a system for confirming the origin of harvested aquatic products, report to the Fisheries General Department for submission to the Ministry of Agriculture and Rural Development to publish according to regulations.

5. Update and report to the Fisheries General Department on changes regarding organizational structure and personnel as stipulated in Clause 1 and Clause 2 of Article 9 of this Circular (stamp models, signatures) to notify foreign competent authorities.

6. Guide cargo owners, ship owners, and captains on the procedures, formalities, and relevant contents concerning the confirmation of raw materials and certification of the origin of harvested aquatic products as prescribed.

7. Require captains, ship owners, or representatives of ship owners and cargo owners to provide relevant information for inspection, confirmation of raw materials, and certification of the origin of harvested aquatic products as prescribed.

8. Update data from logbooks and fishing reports into the national fisheries database.

9. Coordinate with the Fisheries General Department to receive, process, and verify information related to the confirmation of raw materials and certification of the origin of harvested aquatic products upon request from foreign competent authorities.

10. Review, compile, and report to the Fisheries General Department a list of fishing vessels proposed to be included or excluded from the list of fishing vessels engaged in illegal fishing activities as stipulated in Clause 3 of Article 8 of this Circular.

11. Compile the situation of fishing from logbooks and fishing reports, work on confirming raw materials and certifying the origin of harvested aquatic products, and illegal fishing vessels and send them to the Fisheries General Department before the 20th of each month or when requested.

12. Report on the results of certifying the origin of harvested aquatic products according to Model No. 01 Appendix VII issued together with this Circular; retain relevant files concerning the certification of the origin of harvested aquatic products for a period of 36 months from the date of certification.

Article 17. Fish port management organizations

1. Update and report to the Fisheries General Department stamp models and signatures of authorized persons confirming raw materials of harvested aquatic products for publication and announcement on the Fisheries General Department's electronic information website.

2. Organize training sessions or send personnel to attend specialized training courses on the work of confirming raw materials of harvested aquatic products.

3. Ensure hygiene and food safety at fish ports in accordance with regulations.

4. Refuse to allow fishing vessels involved in illegal fishing activities listed in the illegal fishing vessel list to load and unload aquatic products and report to the competent authority for handling; refuse to confirm raw materials of harvested aquatic products if the organization or individual requesting confirmation does not provide complete and accurate information as prescribed.

5. Record daily and update the quantity and species composition of unloaded aquatic products at the port according to Model No. 02 Appendix VII issued together with this Circular; update monitoring data on the quantity of unloaded aquatic products at the port into the national fisheries database before the 15th of each month.

Access the national database system on lists of fishing vessels licensed for fishing, and the vessel tracking surveillance database to carry out the confirmation of raw materials of harvested aquatic products.

6. Comply with inspections and checks by functional agencies on the confirmation of raw materials of harvested aquatic products, coordinate with functional agencies in inspecting fishing vessels at fish ports.

7. Distribute fishing logbook and report templates to organizations and individuals with fishing vessels; collect fishing logbooks and reports; compile a list of fishing vessels that have submitted logbooks and reports and send it to the provincial fisheries management agency before the 20th of each month.

8. Before the 20th of each month, report to the Department of Agriculture and Rural Development on the results of confirming raw materials of harvested aquatic products according to Model No. 03 Appendix VII issued together with this Circular; retain relevant files concerning the confirmation of raw materials of harvested aquatic products for a period of 36 months from the date of confirmation.

Article 18. Master of fishing vessels and owners of fishing vessels

1. Record, enter and submit logbooks and reports on fishery production in accordance with regulations; provide accurate and complete information recorded in the Confirmation Certificate of Fishery Products Raw Materials, the Origin Certificate of Fishery Products for the consignee; sign to confirm and be responsible for the provided information.

2. Notify the port management organization before the vessel docks at or departs from the port as prescribed; provide information about the fishing vessel, service requirements, and expected volume of fishery products to be loaded or unloaded at the port.

3. Carry out fishery production activities in accordance with the provisions of the law.

4. Comply with inspection, examination, and control as required by competent authorities.

Article 19. Organizations and individuals requesting confirmation of raw materials and certification of origin of fishery products

1. Provide accurate and complete information recorded in the Confirmation Certificate of Fishery Products Raw Materials, the Origin Certificate of Fishery Products, and the Confirmation Certificate of Exported Fishery Product Commitment with Origin from Imported Fishery Products; sign to confirm and be responsible for the provided information.

2. Retain records of confirmation of raw materials and certification of origin of fishery products for a period of thirty-six months from the date of confirmation and certification.

3. Cooperate with competent authorities in providing information and clarifying issues as requested by the importing country's authority regarding the exported consignment.

Chapter VI

IMPLEMENTATION

Article 20. Transitional Provisions

The Confirmation Certificate of Fishery Products Raw Materials, the Origin Certificate of Fishery Products, the Confirmation Certificate of Exported Fishery Product Commitment with Origin from Imported Fishery Products, and the Origin Certificate of Exported Fishery Products with Origin from Fishery Products issued prior to the effective date of this Circular shall continue to be used.

Article 21. Implementation clause

1. This Circular takes effect from January 1, 2019.

2. This Circular replaces the following Circulars:

a) Circular No. 50/2015/TT-BNNPTNT dated December 30, 2015 of the Minister of Agriculture and Rural Development on the certification and confirmation of fishery products;

b) Circular No. 52/2013/TT-BNNPTNT dated December 11, 2013 of the Minister of Agriculture and Rural Development detailing the implementation of certain provisions of Decree No. 80/2012/NĐ-CP dated October 8, 2012 of the Government on the management of fishing ports and anchorage areas for fishing vessels.

3. This Circular abolishes Article 1 of Circular No. 02/2018/TT-BNNPTNT dated January 31, 2018 of the Ministry of Agriculture and Rural Development amending and supplementing Circular No. 50/2015/TT-BNNPTNT, Circular No. 25/2013/TT-BNNPTNT, Circular No. 02/2006/TT-BTS, Circular No. 62/2008/TT-BNN, and Circular No. 26/2016/TT-BNNPTNT.

4. Any documents referred to for application in this Circular, if amended, supplemented, or replaced, shall be applied according to the amended, supplemented, or replacing document.

5. During the implementation process, if any issues arise or difficulties occur, organizations and individuals shall promptly report to the General Fisheries Department or the Directorate of Quality Assurance of Forestry, Agricultural, and Fishery Products for consolidation and reporting to the Ministry of Agriculture and Rural Development for consideration and decision.
