CIRCULAR

Announcing the port waters within the jurisdiction of Binh Thuan Province,

the port waters of Binh Thuan-Ninh Thuan at Vinh Tan-Ca Na area

and the management area of the Binh Thuan Maritime Port Office.

At the proposal of the Director of the Department of Transport Infrastructure and the Director General of the Vietnam Maritime Administration;

Pursuant to Decree No. 12/2017/NĐ-CP dated February 10, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;

Pursuant to Decree No. 58/2017/NĐ-CP dated May 10, 2017 of the Government detailing certain provisions of the Vietnam Maritime Code regarding maritime activities management;

At the proposal of the Director of the Legal Department and the Director General of the Vietnam Maritime Administration;

The Minister of Transport hereby issues this Circular announcing the port waters within the jurisdiction of Binh Thuan Province, the port waters of Binh Thuan-Ninh Thuan at Vinh Tan-Ca Na area and the management area of the Binh Thuan Maritime Port Office.

Article 1. Announcing the port waters within the jurisdiction of Binh Thuan Province, the port waters of Binh Thuan-Ninh Thuan at Vinh Tan-Ca Na area.

The port waters of Binh Thuan within the jurisdiction of Binh Thuan Province, the port waters of Binh Thuan-Ninh Thuan at Vinh Tan-Ca Na area include the following water areas:

1. The port waters of Binh Thuan at Hoa Phu area.

2. The port waters of Binh Thuan at Phan Thiet area.

3. The port waters of Binh Thuan at Phu Quy Island area.

4. The port waters of Binh Thuan at offshore oil field Hong Ngoc area.

5. The port waters of Binh Thuan at offshore oil field Black Lion area.

6. The port waters of Binh Thuan at offshore oil field Golden Lion area.

7. The port waters of Binh Thuan at offshore oil field Thang Long-Dong Do area.

8. The port waters of Binh Thuan-Ninh Thuan at Vinh Tan-Ca Na area.

Article 2. Scope of the port waters within the jurisdiction of Binh Thuan Province, the port waters of Binh Thuan-Ninh Thuan at Vinh Tan-Ca Na area.

The scope of the port waters within the jurisdiction of Binh Thuan Province, the port waters of Binh Thuan-Ninh Thuan at Vinh Tan-Ca Na area is defined according to the highest tide level, as follows:

1. The scope of the port waters of Binh Thuan at Hoa Phu area:

Seaward boundary: delimited by straight lines connecting points HP1, HP2, HP3, HP4, HP5, and HP6 with the following coordinates:

HP1: 11°09'13,3"N; 108°31'29,4"E;

HP2: 11°08'43,3"N; 108°32'39,4"E;

HP3: 11°08'18,3"N; 108°33'08,4"E;

HP4: 11°07'09,3"N; 108°33'59,4"E;

HP5: 11°06'57,3"N; 108°33'48,4"E;

HP6: 11°09'01,3"N; 108°31'19,4"E.

Landward boundary: from point HP1 running along the coastline southwards to point HP6.

2. The scope of the port waters of Binh Thuan at Phan Thiet area:

Seaward boundary: delimited by straight lines connecting points PT1, PT2, PT3, PT4, PT5, PT6, and PT7 with the following coordinates:

PT1: 10°54'59,3"N; 108°06'22,4"E (Northeast Breakwater Head);

PT2: 10°53'48,3"N; 108°10'14,4"E;

PT3: 10°53'00,3"N; 108°10'14,4"E;

PT4: 10°53'00,3"N; 108°08'14,4"E;

PT5: 10°53'54,3"N; 108°05'45,4"E;

PT6: 10°54'39,3"N; 108°05'55,4"E (Shallow Bank);

PT7: 10°54'57,3"N; 108°06'08,4"E (Southwest Breakwater Head).

Landward boundary: from points PT1, PT7 running along both banks of Ca Ty River to the intersection of the 10°55'13,3"N latitude line crossing the river.

3. The scope of the port waters of Binh Thuan at Phu Quy Island area:

Seaward boundary: delimited by straight lines connecting points PQ1, PQ2, PQ3, PQ4, PQ5, PQ6, and PQ7 with the following coordinates:

PQ1: 10°30'12,3"N; 108°57'10,4"E;

PQ2: 10°30'02,3"N; 108°57'15,4"E;

PQ3: 10°29'38,3"N; 108°57'12,4"E;

PQ4: 10°29'23,3"N; 108°55'08,4"E;

PQ5: 10°30'40,3"N; 108°55'01,4"E;

PQ6: 10°30'00,3"N; 108°57'01,4"E;

PQ7: 10°30'11,3"N; 108°57'04,4"E.

Landward boundary: from point PQ1 running along the shoreline westwards to point PQ7.

4. The scope of the port waters of Binh Thuan at offshore oil field Hong Ngoc area: delimited by a circle with a radius of 01 nautical mile, centered at position HN with the following coordinates:

HN: 10°22'28,3"N; 108°30'07,4"E.

5. The scope of the port waters of Binh Thuan at offshore oil field Black Lion area: delimited by a circle with a radius of 01 nautical mile, centered at position STĐ with the following coordinates:

STĐ: 10°25'20,3"N; 108°23'44,4"E.

6. The scope of the port waters of Binh Thuan at offshore oil field Golden Lion area: delimited by a circle with a radius of 01 nautical mile, centered at position STV with the following coordinates:

STV: 10°21'49,3"N; 108°22'37,4"E.

7. The scope of the port waters of Binh Thuan at offshore oil field Thang Long-Dong Do area: delimited by a circle with a radius of 03 nautical miles, centered at position TL-ĐĐ with the following coordinates:

TL-ĐĐ: 10°08'02,3"N; 108°34'03,4"E.

8. The scope of the port waters of Binh Thuan-Ninh Thuan at Vinh Tan-Ca Na area:

Seaward boundary: delimited by straight lines connecting points CN1, CN2, and VT1 with the following coordinates:

CN1: 11^°18'22,2"N; 108^°54'53,4"E (Truong Mui Cape);

CN2: 11°16'43,2"N; 108°54'24,4"E;

VT1: 11°17'17,2"N; 108°46'35,4"E.

Landward boundary: from point CN1 running along the coastline southwards to point VT1.

9. The scope of the port waters specified in this Circular is determined on the Hydrographic Charts IA-200-10 reprinted in 2007, IA-200-11 reprinted in 2009 of the Vietnam People's Navy; Hydrographic Charts VN4VT00; VN4PT001, VN4PQ001, VN4HP001 produced by the Southern Marine Safety Assurance Corporation in 2016 and related hydrographic charts. Coordinates of the points specified in this Article are based on the WGS 84 Coordinate System and converted to the VN 2000 Coordinate System as set forth in the Appendix attached hereto.

Article 3. Pilot reception area, quarantine area, vessel turning area, anchorage area, cargo transfer area, typhoon shelter area, water areas, and other related water areas.

The Director of the Vietnam Maritime Administration shall organize the announcement of the pilot reception area, quarantine area, vessel turning area, anchorage area, cargo transfer area, and typhoon shelter for vessels entering and leaving the coastal port waters under the jurisdiction of Binh Thuan Province and the coastal port waters of Binh Thuan-Ninh Thuan at Vinh Tan-Ca Na area, and other water areas as prescribed.

Article 4. Responsibilities of the Binh Thuan Port Maritime Office and the Vung Tau Port Maritime Office.

1. Responsibilities of the Binh Thuan Port Maritime Office:

a) Implement tasks and powers according to the provisions of the Vietnam Maritime Code and relevant laws concerning maritime activities at wharves and coastal port waters under the jurisdiction of Binh Thuan Province and the coastal port waters of Binh Thuan-Ninh Thuan at Vinh Tan-Ca Na area;

b) Based on regulations and actual conditions regarding meteorological and hydrological conditions, draft depth, nature of cargo, and tonnage of vessels, designate specific positions for vessels to receive pilots, undergo quarantine, anchor, transfer cargo, and avoid typhoons in the prescribed water areas, ensuring maritime safety, maritime security, and environmental pollution prevention;

c) Process procedures for vessels entering and leaving the port according to regulations for vessels arriving at coastal port waters under the jurisdiction of Binh Thuan Province and the coastal port waters of Binh Thuan-Ninh Thuan at Vinh Tan-Ca Na area;

d) Inform the Vung Tau Port Maritime Office of the name, nationality, main technical parameters, and other necessary information of vessels requiring pilotage in the pilot reception area within the coastal port waters under the jurisdiction of Bria-Vung Tau Province at least two hours before the vessel enters the Vung Tau pilot reception area to coordinate management in accordance with the law; inform the Vung Tau Port Maritime Office of the movement of vessels departing from the position designated by the Vung Tau Port Maritime Office to enter the coastal port waters under its own jurisdiction at least one hour before the vessel leaves the position;

e) Coordinate with the Vung Tau Port Maritime Office to resolve incidents involving vessels entering and leaving the coastal port waters under the jurisdiction of Binh Thuan Province and the coastal port waters of Binh Thuan-Ninh Thuan at Vinh Tan-Ca Na area when such vessels operate within the coastal port waters under the jurisdiction of Bria-Vung Tau Province.

2. Responsibilities of the Vung Tau Port Maritime Office:

Based on actual conditions regarding meteorological and hydrological conditions, draft depth, and tonnage of vessels entering and leaving the port managed by the Binh Thuan Port Maritime Office but must receive pilots, anchor, and avoid typhoons in the coastal port waters under the jurisdiction of Bria-Vung Tau Province, designate specific positions to ensure maritime safety, maritime security, prevent environmental pollution, and at least one hour before the vessel arrives at the pilot reception area, notify the Binh Thuan Port Maritime Office.

Article 5. State Management Responsibilities for Maritime Affairs in the Sea Area Under the Jurisdiction of Binh Thuan Province and Ninh Thuan Province.

Outside the coastal port waters specified in Article 2 of this Circular, the Binh Thuan Port Maritime Office also has state management responsibilities for maritime safety, maritime security, and preventing environmental pollution in the sea area under Binh Thuan Province and the sea area under Ninh Thuan Province from latitude 11°25'00"N southward to the southernmost part of the sea area of Ninh Thuan Province.

Article 6. Effectiveness

This Circular takes effect from August 1, 2019. The Circular No. 51/2014/TT-BGTVT dated October 17, 2014, issued by the Minister of Transport on announcing the coastal port waters under the jurisdiction of Binh Thuan Province and the management area of the Binh Thuan Port Maritime Office, is hereby abolished.

Article 7. Responsibility for Implementation

The Head of the Ministry's Office, the Inspector General of the Ministry, the Heads of Departments, the Director of the Vietnam Maritime Administration, the Director of the Vietnam Inland Waterway Administration, the Directors of the Transportation Departments of Binh Thuan Province, Bria-Vung Tau Province, and Ninh Thuan Province, the Directors of the Binh Thuan Port Maritime Office, the Vung Tau Port Maritime Office, the Nha Trang Port Maritime Office, the Heads of relevant agencies, organizations, and individuals are responsible for implementing this Circular./.
