CIRCULAR

Announcing the waters of coastal ports within the jurisdiction of Bình Thuận Province

 and the management area of the Bình Thuận Maritime Port Office

Pursuant to the Maritime Code of Vietnam dated June 14, 2005;

Pursuant to Decree No. 107/2012/NĐ-CP dated December 20, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;

Pursuant to Decree No. 21/2012/NĐ-CP dated March 21, 2012 of the Government on management of seaports and maritime channels;

Based on the opinions of the People's Committee of Bình Thuận Province at Circular No. 4066/UBND dated June 17, 2014, and the People's Committee of Bà Rịa - Vũng Tàu Province at Circular No. 1761/UBND dated May 26, 2014;

At the proposal of the Director of the Legal Department and the Director of the Vietnam Maritime Administration,

The Minister of Transport hereby issues this Circular to announce the waters of coastal ports within the jurisdiction of Bình Thuận Province and the management area of the Bình Thuận Maritime Port Office.

Article 1. Announcing the waters of coastal ports within the jurisdiction of Bình Thuận Province

The waters of coastal ports within the jurisdiction of Bình Thuận Province include the following areas:

1. Waters of the Bình Thuận Seaport:

a) Waters of the Bình Thuận Seaport at the Vĩnh Tân area;

b) Waters of the Bình Thuận Seaport at the Hòa Phú area;

c) Waters of the Bình Thuận Seaport at the Phan Thiết area;

d) Waters of the Bình Thuận Seaport at the Phú Quý Island area.

2. Waters of the offshore oil port at the Hồng Ngọc field.

3. Waters of the offshore oil port at the Black Lion field.

4. Waters of the offshore oil port at the Golden Lion field.

5. Waters of the offshore oil port at the Thăng Long-Dong Do field.

Article 2. Scope of the waters of coastal ports within the jurisdiction of Bình Thuận Province

The scope of the waters of coastal ports within the jurisdiction of Bình Thuận Province is defined according to the highest tidal level, as follows:

1. Scope of the waters of the Bình Thuận Seaport:

a) Scope of the waters of the Bình Thuận Seaport at the Vĩnh Tân area:

The seaward boundary is delimited by straight lines connecting the points VT1, VT2, VT3, and VT4 with the following coordinates:

VT1: 11°18'37" N, 108°48'32" E;

VT2: 11°18'35" N, 108°52'48" E;

VT3: 11°17'00" N, 108°53'55" E;

VT4: 11°17'20" N, 108°46'29" E.

The landward boundary runs from point VT1 along the coastline southwards to point VT4.

b) Scope of the waters of the Bình Thuận Seaport at the Hòa Phú area:

The seaward boundary is delimited by straight lines connecting the points HP1, HP2, HP3, HP4, HP5, and HP6 with the following coordinates:

HP1: 11°09'17" N, 108°31'23" E;

HP2: 11°08'47" N, 108°32'33" E;

HP3: 11°08'22" N, 108°33'02" E;

HP4: 11°07'13" N, 108°33'53" E;

HP5: 11°07'01" N, 108°33'42" E;

HP6: 11°09'05" N, 108°31'12" E.

Landward boundary: from point HP1 running along the coastline southwards to point HP6.

c) Scope of the waters of the Bình Thuận Seaport at the Phan Thiết area:

The seaward boundary is delimited by straight lines connecting the points PT1, PT2, PT3, PT4, PT5, and PT6 with the following coordinates:

PT1: 10°55'03" N, 108°06'15" E (North-East Breakwater Head);

PT2: 10°53'52" N, 108°10'07" E;

PT3: 10°53'04" N, 108°10'07" E;

PT4: 10°53'04" N, 108°08'07" E;

PT5: 10°54'43" N, 108°05'48" E (Shallow Bank);

PT6: 10°55'01" N, 108°06'01" E (South-West Breakwater Head).

The landward boundary runs from points PT1 and PT6 along both banks of the Cà Ty River to the intersection with the parallel at 10°55'17" N.

d) Scope of the waters of the Bình Thuận Seaport at the Phú Quý Island area:

The seaward boundary is delimited by straight lines connecting the positions of maritime navigation aids on the channel leading to Phú Quý Port;

The landward boundary is delimited by straight lines connecting the points PQ1, PQ2, PQ3, and PQ4 with the following coordinates:

PQ1: 10°30'12" N, 108°57'05" E;

PQ2: 10°30'11" N, 108°57'05" E;

PQ3: 10°30'10" N, 108°57'01" E;

PQ4: 10°30'11" N, 108°57'02" E.

2. Scope of the waters of the offshore oil port at the Hồng Ngọc field is limited by a circle with a radius of 01 nautical mile, centered at position HN with the following coordinates:

HN: 10°22'32" N, 108°30'01" E.

3. Scope of the waters of the offshore oil port at the Black Lion field is limited by a circle with a radius of 01 nautical mile, centered at position STĐ with the following coordinates:

STĐ: 10°25'24" N, 108°23'38" E.

4. Scope of the waters of the offshore oil port at the Golden Lion field is limited by a circle with a radius of 01 nautical mile, centered at position STV with the following coordinates:

STV: 10°21'52" N, 108°22'30" E.

5. Scope of the waters of the offshore oil port at the Thăng Long-Dong Do field is limited by a circle with a radius of 03 nautical miles, centered at position TL-ĐĐ with the following coordinates:

TL-ĐĐ: 10°08'06" N, 108°33'56" E.

6. The scope of the waters of the ports specified in this Circular is determined on Chart IA-200-10 published by the Vietnam Navy in 1980. The coordinates of the points specified in Clauses 1, 2, 3, 4, and 5 of this Article are based on the VN-2000 Coordinate System and are converted to corresponding coordinate systems in the Appendix attached to this Circular.

Article 3. Pilot reception and delivery zone, quarantine zone, anchorage area, cargo transfer area, storm shelter area

The Director of the Vietnam Maritime Administration shall organize the announcement of the pilot reception and delivery zone, quarantine zone, anchorage area, cargo transfer area, and storm shelter area for vessels entering and leaving sea ports within the jurisdiction of Binh Thuan Province and other water areas as prescribed.

Article 4. Responsibilities of the Binh Thuan Port Maritime Office and the Vung Tau Port Maritime Office.

1. Responsibilities of the Binh Thuan Port Maritime Office:

a) Perform tasks and exercise powers as prescribed by the Vietnam Maritime Code and relevant laws concerning maritime activities at wharfs and waters of sea ports within the jurisdiction of Binh Thuan Province;

b) Based on regulations and actual conditions regarding meteorological and hydrological conditions, draft depth, nature of cargo, and tonnage of vessels, designate specific positions for vessels to receive and deliver pilots, undergo quarantine, anchor, transfer cargo, and avoid storms in the prescribed waters, ensuring maritime safety, maritime security, and prevention of environmental pollution;

c) Process entry and departure procedures for vessels as prescribed for vessels arriving at the waters of sea ports within the jurisdiction of Binh Thuan Province;

d) Notify the Vung Tau Marine Port Office of the name, nationality, main technical specifications, and other necessary information of vessels requiring pilot reception in the pilot reception zone in the waters of sea ports within the jurisdiction of Binh Duong-Vung Tau Province at least two hours before the vessel enters the Vung Tau pilot reception zone to coordinate management in accordance with the law;

đ) Coordinate with the Vung Tau Marine Port Office to resolve incidents involving vessels entering and leaving sea ports within the jurisdiction of Binh Thuan Province when such vessels operate in the waters of sea ports within the jurisdiction of Binh Duong-Vung Tau Province;

2. Responsibilities of the Vung Tau Port Maritime Office:

Based on actual conditions regarding meteorological and hydrological conditions, draft depth, and tonnage of vessels entering and leaving sea ports managed by the Binh Thuan Marine Port Office but required to receive and deliver pilots, anchor, and avoid storms in the waters of sea ports within the jurisdiction of Binh Duong-Vung Tau Province, designate specific positions to ensure maritime safety, maritime security, prevention of environmental pollution, and promptly notify the Binh Thuan Marine Port Office.

Article 5. State Management Responsibilities for Maritime Affairs in the Sea Area within the Jurisdiction of Binh Thuan Province

In addition to the waters of sea ports specified in Article 2 of this Circular, the Binh Thuan Marine Port Office also has state management responsibilities for maritime safety, maritime security, and prevention of environmental pollution in the sea area within the jurisdiction of Binh Thuan Province.

Article 6. Effectiveness

This Circular takes effect from December 15, 2014. The Circular No. 02/2010/TT-BGTVT dated January 22, 2010, issued by the Minister of Transport on announcing the waters of sea ports within the jurisdiction of Binh Thuan Province and the management area of the Binh Thuan Marine Port Office, is hereby repealed.

Article 7. Responsibility for Implementation

The Head of the Ministry's Office, the Inspector General of the Ministry, the Heads of Departments, the Director of the Vietnam Maritime Administration, the Director of the Vietnam Inland Waterways Administration, the Directors of the Department of Transport of Binh Thuan Province, the Department of Transport of Binh Duong-Vung Tau Province, the Directors of the Vung Tau Marine Port Office, the Binh Thuan Marine Port Office, and the Heads of agencies, organizations, and individuals concerned are responsible for implementing this Circular.
