At the proposal of the Minister of Transport,

THE GOVERNMENT PRIME MINISTER issues this Decision on mechanisms and policies to incentivize the development of inland waterway transportation.This Decision stipulates mechanisms and policies to incentivize the development of inland waterway transportation in Vietnam.This Decision applies to agencies, organizations, and individuals involved in inland waterway transportation activities throughout the country.

Article 1. Scope of Regulation

Article 3. Mechanisms and policies to incentivize the development of inland waterway transportation

Article 2. Applicability

1. Investment in developing inland waterway transportation

a) Access to ODA funds and preferential foreign loans from the government for investment in developing inland waterway infrastructure to facilitate efficient connections with other modes of transport, particularly with the port system;

b) Prioritize allocation of investment capital for developing inland waterway infrastructure to improve and upgrade main inland waterway routes according to the Master Plan for Inland Waterway Infrastructure Development for the period 2021-2030, with a vision to 2050;

c) Provincial People's Committees shall review and plan river passenger terminals in areas with difficult socio-economic conditions that have not yet had the opportunity to develop other forms of transportation, ensuring new investments comply with Clause 2, Article 12 of the Public Investment Law 2020 when using local budget funds for investment.

2. Management and maintenance of inland waterway infrastructure

Allocate financial resources for economic services to maintain inland waterway infrastructure according to plans approved by competent authorities and the ability to mobilize resources, ensuring annual increases, with the goal of meeting funding needs according to plans approved by competent state management authorities by 2030.

3. Application of information technology

a) Prioritize allocation of state budget funds for investment in projects applying information technology to serve inland waterway activities;

b) Use regular state budget funds to manage, operate, and maintain information technology systems serving inland waterway activities after investment, including databases, software, and hardware.

a) Take the lead in implementing and evaluating the implementation of this Decision annually and summarizing every five years;

b) Coordinate with the Ministry of Finance and the Ministry of Planning and Investment in allocating state budget funds to implement the mechanisms and policies for developing inland waterway transportation as stipulated in this Decision;

Article 4. Organization of Implementation

1. The Ministry of Transport

c) Coordinate with the Ministry of Finance to guide the implementation of mechanisms and policies for developing inland waterway transportation as stipulated in this Decision;

d) Prioritize allocation of public investment capital for developing inland waterway transportation infrastructure according to the medium-term public investment plan already approved by competent authorities.

Take the lead in allocating financial resources for economic services for maintaining inland waterway infrastructure within the annual central budget expenditure as stipulated in this Decision.

a) Take the lead and coordinate with the Ministry of Transport and the Ministry of Finance to implement the mechanisms and policies for developing inland waterway transportation as stipulated in this Decision;

b) Take the lead in allocating investment capital for developing inland waterway infrastructure according to the Public Investment Law and the State Budget Law.

4. The Ministry of Natural Resources and Environment

Guide the allocation of land and water surfaces for inland waterway port construction projects in planning and land use plans.

Study and guide localities to establish specific conditions for investing in and constructing inland waterway transportation infrastructure, new and repaired inland waterway vessels outside the area, to ensure effective operation during the rainy season.

5. The Ministry of Agriculture and Rural Development

Coordinate with the Ministry of Transport in information dissemination to encourage investment in inland waterway infrastructure, new inland waterway vessels, and cargo handling equipment, contributing to promoting the development of inland waterway transportation.

7. Provincial People's Committees

a) Coordinate with the Ministry of Transport and the Ministry of Natural Resources and Environment to allocate land and water surfaces for projects constructing new and repairing inland waterway vessels and inland waterway ports in local land use plans;

b) Take the lead in allocating local budgets for developing inland waterway transportation under their management;

c) Prioritize allocating land for building container ports in the northern region and the Mekong Delta.

1. This Decision takes effect from December 25, 2022.

2. Repeal Decision No. 47/2015/QĐ-TTg dated October 5, 2015 of the Prime Minister on mechanisms and policies to incentivize the development of inland waterway transportation.

Article 5. Effective Date

Ministers, Heads of ministerial-level agencies, Heads of governmental agencies, Chairmen of provincial People's Committees directly under the Central Government are responsible for enforcing this Decision.
