Von position, functions, tasks, powers, and organizational structure
of Committee for Deputies' Work
THE STANDING COMMITTEE OF THE NATIONAL ASSEMBLY
On the basis of the Constitution of the Socialist Republic of Vietnam;
Pursuant to the Law on the Organization of the National Assembly association No. 57/2014/QH13, which has been amended and supplemented by some articles pursuant to Law No. 65/2020/QH14;
RESOLUTION:
Article 1. Position and Functions of the Committee for Deputies' Work
The Committee for Deputies' Work is an agency under the Standing Committee of the National Assembly, established by the Standing Committee of the National Assembly, with the function of advising and assisting the Standing Committee of the National Assembly in deputies' work, organizational work, cadres and implementing other functions assigned by the Party Group of the National Assembly and the Standing Committee of the National Assembly.
Article 2. Tasks and Powers of the Committee for Deputies' Work
1. Regarding the election of National Assembly deputies and People's Council deputies at all levels:
a) Taking the lead in advising the Party Group of the National Assembly to draft the proposal on the direction of the election of National Assembly deputies and People's Council deputies at all levels;
b) Taking the lead in advising the Standing Committee of the National Assembly:
- Submitting to the National Assembly for decision the national election day for the election of National Assembly deputies and People's Council deputies at all levels; deciding and announcing the supplementary election day for National Assembly deputies; deciding the establishment of the National Election Council;
- Preparing and introducing candidates for full-time National Assembly deputies working at the central level; proposing and allocating the number of National Assembly deputies to be elected; determining the composition of those proposed as candidates for National Assembly deputies; stipulating the organizational structure of the National Election Council; deciding and announcing the supplementary election day for provincial-level People's Council deputies; receiving from the National Election Council the final report, files, and documents on the election of National Assembly deputies;
c) Coordinating with relevant agencies in advising the Standing Committee of the National Assembly:
- Issuing regulations and guidelines on elections within its authority;
- Receiving from the National Election Council files related to complaints and denunciations concerning newly-elected National Assembly deputies that have not been resolved for resolution or handling according to regulations;
- Organizing supervision over the election of National Assembly deputies and People's Council deputies;
- Performing other tasks related to elections within the authority of the Standing Committee of the National Assembly.
2. Regarding the activities of National Assembly deputies and Delegations of National Assembly Deputies:
a) Taking the lead in advising the Party Group of the National Assembly on opinions regarding the appointment of the Head of the Delegation of National Assembly Deputies of provinces and centrally-administered cities;
b) Taking the lead in advising the Standing Committee of the National Assembly:
- Approving the results of the election and the termination of service as Head or Deputy Head of the Delegation of National Assembly Deputies; approving full-time National Assembly deputies working at the Delegation of National Assembly Deputies; deciding the transfer of the Delegation of National Assembly Deputies;
- Considering and deciding on the acceptance of requests from National Assembly deputies to terminate their duties during periods when the National Assembly is not in session and reporting to the National Assembly at the nearest session or reporting for the National Assembly to decide during sessions;
- Considering and deciding on the request for arrest, detention, prosecution of National Assembly deputies, candidates for National Assembly deputies, search of residences and workplaces of National Assembly deputies during periods when the National Assembly is not in session or reporting for the National Assembly to decide during sessions;
- Considering and deciding on proposals from agencies, organizations, units regarding the removal, dismissal, termination of employment, or firing of employees who are National Assembly deputies at those agencies, organizations, or units; temporary suspension of the performance of duties and powers of National Assembly deputies; presenting to the National Assembly for removal or to voters for removal of National Assembly deputies;
- Directing the activities of Delegations of National Assembly Deputies and National Assembly deputies; considering reports on the situation of activities of Delegations of National Assembly Deputies;
- Specifying the name of commemorative medals, recipients, criteria for awarding commemorative medals, and organizing the implementation of the awarding of commemorative medals by the Standing Committee of the National Assembly; considering and giving opinions on the receipt of foreign individuals, organizations, and international organizations' awards by National Assembly deputies, former National Assembly deputies, and staff and former staff under the management authority of the Standing Committee of the National Assembly;
- Specifying and guiding the performance of duties, systems, policies, and other conditions ensuring the performance of duties of National Assembly deputies; issuing mechanisms and policies for the use of experts in the activities of the National Assembly;
- Establishing delegations of the Standing Committee of the National Assembly to localities to consider issues raised by National Assembly deputies and Delegations of National Assembly Deputies in areas within the functions and tasks of the Committee for Deputies' Work;
c) Taking the lead in implementing:
- Managing files and related documents of National Assembly deputies;
- Summarizing and reporting on changes in the number of National Assembly deputies during the term.
3. Regarding organizational work and personnel matters within the authority of the National Assembly and the Standing Committee of the National Assembly:
a) Taking the lead in advising the Standing Committee of the National Assembly:
- Submitting to the National Assembly for election, approval, dismissal, removal, trust vote, and confidence vote for persons holding positions elected or approved by the National Assembly;
- Specifying and organizing the management of cadres for full-time National Assembly deputies working at the central level, staff, and civil servants under the management authority of the Standing Committee of the National Assembly; specifying the system, policies, and other conditions ensuring the performance of duties of full-time National Assembly deputies;
- Specifying the competition, commendation, and reward system for National Assembly deputies, agencies of the National Assembly, agencies under the Standing Committee of the National Assembly, and staff and civil servants under the management authority of the Standing Committee of the National Assembly;
- Considering and giving opinions on the establishment of associations, participation in founding committees, or serving as heads of associations or international organizations by full-time National Assembly deputies working at the central level, staff, and civil servants under the management authority of the Standing Committee of the National Assembly, former full-time National Assembly deputies working at the central level, former staff, and civil servants under the management authority of the Standing Committee of the National Assembly, in accordance with regulations;
b) Coordinating with relevant agencies in advising the Standing Committee of the National Assembly:
- To compile the recommendations of the Chairman of the National Assembly's Ethnic Council and the Heads of the National Assembly's Committees to advise and assist the Standing Committee of the National Assembly in considering and deciding on the number, approving the list of members, and the decision to terminate membership of the National Assembly's Ethnic Council and Committees; decide on the number, approve the list, and the decision to terminate membership of Deputy Chairmen, Full-time Members, and Specialized Members of the National Assembly's Ethnic Council, Deputy Heads, Full-time Members, and Specialized Members of the National Assembly's Committees;
- To submit to the National Assembly for consideration and decision on the establishment of a temporary Committee;
- To implement monitoring and evaluating the effectiveness of the work of full-time National Assembly deputies at the central level;
- To monitor and implement the system and policies for full-time National Assembly deputies at the central level, cadres, and civil servants under the management authority of the Standing Committee of the National Assembly; to implement procedures and ensure the system for full-time National Assembly deputies at the central level, cadres, and civil servants under the management authority of the Standing Committee of the National Assembly when retiring or transferring jobs;
- To implement planning for full-time National Assembly deputies at the central level and planning for positions under the management authority of the Standing Committee of the National Assembly that are not National Assembly deputies;
- To decide on the establishment of delegations going abroad of the Standing Committee of the National Assembly, leadership of the National Assembly, the National Assembly's Ethnic Council, the National Assembly's Committees, and agencies under the Standing Committee of the National Assembly (excluding civil servants accompanying the delegation decided by the National Assembly Office); participation in delegations going abroad of full-time National Assembly deputies at the central level and cadres, and civil servants under the management authority of the Standing Committee of the National Assembly that are not National Assembly deputies;
- To establish, dissolve, and define the organization and operation of the Vietnam Parliamentary Friendship Organization and other organizations of National Assembly deputies;
c) Taking the lead in implementing:
- To draft proposals for establishing, dissolving, amending functions, tasks, powers, organizational structure, and reorganizing agencies under the decision-making authority of the Standing Committee of the National Assembly when assigned by the Standing Committee of the National Assembly; to compile, advise, and report to the Standing Committee of the National Assembly on the functions, tasks, and powers of advisory and assisting agencies of the National Assembly, agencies under the Standing Committee of the National Assembly, and the number, titles, staffing, and job positions of civil servants and officials under these agencies when assigned by the Standing Committee of the National Assembly;
- To organize the management of cadre files and related documents of full-time National Assembly deputies at the central level and cadres, and civil servants under the management authority of the Standing Committee of the National Assembly that are not National Assembly deputies according to the cadre management hierarchy;
- To propose competent authorities to consider granting commendation titles and forms of reward for full-time National Assembly deputies at the central level and cadres, and civil servants under the management authority of the Standing Committee of the National Assembly, agencies of the National Assembly, and agencies under the Standing Committee of the National Assembly in accordance with laws on commendation and reward;
- Tasks related to internal political security assigned by the Standing Committee of the National Assembly;
4. Regarding the activities of People's Councils:
a) To take the lead in advising the Party Group of the National Assembly on opinions regarding personnel holding the position of Chairman of the Provincial People's Council;
b) Taking the lead in advising the Standing Committee of the National Assembly:
- To issue guiding documents on the activities of the People's Council; to monitor and supervise the activities of the People's Council; to review reports on the results of the activities of the Provincial People's Council;
- To approve the results of elections, removals, and dismissals of Chairmen and Vice-Chairmen of the Provincial People's Council; to handle disciplinary actions according to regulations against Chairmen and Vice-Chairmen of the Provincial People's Council and former Chairmen and Vice-Chairmen of the Provincial People's Council who have retired or left their posts;
- To organize the annual national conference summarizing the activities of the Provincial People's Council, mid-term reviews, and term summaries; conferences of the Provincial People's Council based on administrative unit characteristics and special topics; other conferences of the Provincial People's Council as directed by the Standing Committee of the National Assembly;
c) Coordinating with relevant agencies in advising the Standing Committee of the National Assembly:
- To provide opinions on organizing meetings of the Provincial People's Council Standing Committee by region; to attend and direct such meetings;
- To consider and decide on the dissolution of the Provincial People's Council;
5. Regarding the training of elected representatives:
a) Taking the lead in advising the Standing Committee of the National Assembly:
- To issue plans, decide on framework programs, and draft proposals for training National Assembly deputies and People's Council deputies throughout the term and each year; annually revise, supplement, and update training content in line with the activities of the National Assembly; to propose a list of lecturers according to the training framework program; to issue Resolutions and documents on training elected representatives;
- To organize training on knowledge and skills for National Assembly deputies, candidates for National Assembly deputies, and those planned to be full-time National Assembly deputies;
- To stipulate, guide, and organize the implementation of training and development work for full-time National Assembly deputies and cadres, and civil servants under the management authority of the Standing Committee of the National Assembly that are not National Assembly deputies;
b) To take the lead in implementing:
- To report to the Standing Committee of the National Assembly on the results of training elected representatives annually;
- To build databases; to compile training programs and materials for National Assembly deputies and People's Council deputies;
c) To coordinate with relevant agencies:
- To organize training on knowledge and skills for People's Council deputies as requested by the Standing Committee of the Provincial People's Council;
- To organize training to improve the quality of advisory and assistance work for the National Assembly Delegation and the Provincial People's Council;
6. To assist the Chairman of the National Assembly in maintaining contact with National Assembly deputies; to assist the Standing Committee of the National Assembly in coordinating work with the State President, Government, Prime Minister, Supreme People's Court, Supreme People's Procuracy, State Audit Office, National Election Council, Central Steering Committee for the Fatherland Front of Vietnam, and related organizations on matters within the functions and responsibilities of the Representative Work Committee.
7. Chair the drafting or coordinate with relevant agencies to draft ordinances, resolutions of the Standing Committee of the National Assembly, or provide advisory assistance to the Standing Committee of the National Assembly to submit laws and resolutions to the National Assembly for promulgation on issues within the scope of the Delegation Work Committee's responsibility as assigned by the Standing Committee of the National Assembly; study and propose improvements to the organizational structure of the National Assembly when assigned by the Standing Committee of the National Assembly.
8. Carry out international cooperation tasks and other tasks assigned by the Party Group of the National Assembly, the Standing Committee of the National Assembly, and the leadership of the National Assembly.
Article 3. Organization of the Delegation Work Committee
1. The leadership of the Delegation Work Committee includes the Chairman and Deputy Chairmen appointed, relieved of duty, or dismissed by the Standing Committee of the National Assembly.
2. The Chairman of the Delegation Work Committee is responsible before the Standing Committee of the National Assembly for the organization and operation of the Delegation Work Committee. The Chairman of the Delegation Work Committee has the following duties and powers:
a) Organize management and direct the operation of the Delegation Work Committee to implement the tasks and powers stipulated in Article 2 of this Resolution;
b) Be subject to the leadership and direction of the Standing Committee of the National Assembly, the Chairman of the National Assembly, and the Vice Chairmen of the National Assembly; maintain relations with the Standing Committee of the National Ethnic Council, the Standing Committees of the National Assembly’s specialized committees, the Secretary-General of the National Assembly, the leadership of agencies under the Standing Committee of the National Assembly, the National Assembly Office, the National Assembly Delegation, National Assembly deputies, and related agencies and organizations in the implementation of the Delegation Work Committee's tasks and powers;
c) Coordinate with the Director of the National Assembly Office to define the organization, functions, tasks, and powers of units directly assisting the Delegation Work Committee;
d) Exchange and unify with the Director of the National Assembly Office regarding recruitment, transfer, secondment, rotation, training, promotion, evaluation, commendation, reward, punishment, and the implementation of regulations and policies for civil servants; the appointment, reappointment, relief of duty, dismissal, resignation, removal from office, and leadership and management positions of units directly assisting the Delegation Work Committee before the Director of the National Assembly Office makes a decision;
đ) Organize the implementation of external affairs and international cooperation of the Delegation Work Committee;
e) Decide on the use of funds allocated to the Delegation Work Committee;
g) Perform other tasks assigned by the Party Group of the National Assembly, the Standing Committee of the National Assembly, and the leadership of the National Assembly.
3. Deputy Chairmen of the Delegation Work Committee assist the Chairman of the Delegation Work Committee in performing tasks according to the Chairman's assignment. When the Chairman of the Delegation Work Committee is absent, a Deputy Chairman authorized by the Chairman shall perform the Chairman's tasks and powers.
Article 4. Conditions Ensuring the Operation of the Delegation Work Committee
1. Advisory and support services for the Delegation Work Committee are provided by departments, bureaus, and units under the National Assembly Office, specifically the Department of Delegation Work and the Training Center for Elected Representatives.
2. The Delegation Work Committee shall have a seal in accordance with the provisions of the law.
3. Operating funds, material infrastructure, and other conditions ensuring the operation of the Delegation Work Committee shall be guaranteed by the National Assembly Office.
Article 5. Implementation Provisions
1. This Resolution takes effect from September 1, 2022.
2. Resolution No. 575/UBTVQH12 dated January 31, 2008 of the Standing Committee of the National Assembly on the functions and tasks of the Delegation Work Committee shall cease to be effective from the date this Resolution takes effect.
This Resolution was adopted by the Standing Committee of the National Assembly of the Socialist Republic of Vietnam, the fifteenth term, on July 11, 2022.
