CIRCULAR

Circular stipulating the delegation and demarcation of state management authority

in the field of meteorology and hydrology

On the basis of Law on Government Organization dated February 18, 2025;

On the basis of Law on Local Administration dated June 16, 2025;

On the basis of Law on Meteorology and Hydrology dated November 23, 2015;

Decree No. 35/2025/NĐ-CP dated February 25, 2025, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Decree No. Decision No. 131/2025/NĐ-CP dated June 12, 2025 of the Government stipulating the demarcation of authority according to the two-level local administration model in the fields of agriculture and environment;

Decree No. Decision No. 136/2025/NĐ-CP dated June 12, 2025 of the Government stipulating the delegation and demarcation of state management authority in the fields of agriculture and environment;

At the proposal of the Director of the General Department of Meteorology and Hydrology;

The Minister of Agriculture and Rural Development issues this Circular stipulating the delegation and demarcation of state management authority in the field of meteorology and hydrology.

Article 1. Scope of Regulation

This Circular stipulates the delegation and demarcation of authority and amends and supplements certain provisions of the circulars in the field of meteorology and hydrology including:

1. Detailed regulations and guidance for implementing Articles 48, 49, and 50 of Decision No. 136/2025/NĐ-CP dated June 12, 2025 of the Government stipulating the delegation and demarcation of state management authority in the fields of agriculture and environment.

2. Delegation and demarcation of authority in the field of meteorology and hydrology when organizing a two-level local administration.

3. Amending and supplementing certain provisions of Circular No. 09/2016/TT-BTNMT dated May 16, 2016 of the Minister of Natural Resources and Environment regarding the preparation and review of plans affecting weather.

Article 2. Applicability

This Circular applies to central administrative agencies, local authorities, and other organizations and individuals related to the field of meteorology and hydrology.

Article 3. Components of the application dossier and forms for procedures to exchange meteorological and hydrological information and data, climate change monitoring with international organizations, organizations, and foreign individuals

1. The application dossier for exchanging meteorological and hydrological information and data, climate change monitoring with international organizations, organizations, and foreign individuals includes:

a) Name and address accompanied by: certified copy or electronic certified copy from the original or copy with the original for comparison of legal entity identification documents for agencies and organizations (not applicable to companies, businesses, trading organizations that have been issued Business Registration Certificates in the National Enterprise Registration Database), personal identification number/card ID number/personal identification code of individuals who wish to exchange meteorological and hydrological information and data, climate change monitoring with international organizations, organizations, and foreign individuals in accordance with civil law regulations;

b) Purpose of exchanging information and data with international organizations, organizations, and foreign individuals;

c) Specific type and quantity of information and data exchanged with international organizations, organizations, and foreign individuals;

d) Name and address of international organizations, organizations, and foreign individuals receiving the exchange of information and data;

đ) Time period for exchanging information and data;

e) Form of exchanging information and data;

g) Duration of exchanging information and data.

2. The agreement document for exchanging meteorological and hydrological information and data, climate change monitoring with international organizations, organizations, and foreign individuals within the administrative boundaries of provinces and centrally-administered cities shall be implemented according to Model No. 01 in the Appendix attached to this Circular.

3. Within ten days from the end date of the exchange of meteorological and hydrological information and data, climate change monitoring with international organizations, organizations, and foreign individuals, the agency, organization, or individual responsible must submit a report according to Model No. 02 in the Appendix attached to this Circular to the People's Committee of the province or centrally-administered city that has approved the content of the information and data exchange; in cases where the duration of the information and data exchange exceeds one year, an annual report must be submitted before January 15 each year regarding the previous year's activities of information and data exchange.

Article 4. Components of the file and forms for implementing the procedure to approve weather modification plans

1. The file requesting approval of a weather modification plan includes:

a) A request for approval of a weather modification plan established according to Form No. 03 attached as an appendix to this Circular;

b) A weather modification plan attached with the file containing opinions solicited from the local community directly affected by the plan.

The construction of a weather modification plan and the organization of soliciting opinions on the weather modification plan shall be carried out in accordance with the provisions of Clause 2 and Clause 3 of Article 3 and Clause 2, Clause 3, and Clause 7 of Article 4 of Circular No. 09/2016/TT-BTNMT dated May 16, 2016 issued by the Minister of Natural Resources and Environment regarding the construction and review of weather modification plans; Clauses 1, 2, 4, and 5 of Article 5 of this Circular.

2. The form of a weather modification plan shall be implemented according to Appendix No. 01 stipulated in Circular No. 09/2016/TT-BTNMT dated May 16, 2016 issued by the Minister of Natural Resources and Environment regarding the construction and review of weather modification plans.

Article 5. Amending and supplementing some articles of Circular No. 09/2016/TT-BTNMT dated May 16, 2016 issued by the Minister of Natural Resources and Environment regarding the construction and review of weather modification plans

1. Amend the phrase "People's Committee of district, town, city under province, city under central直辖市人民政府"成"省、中央直辖市人民政府" at Point a Clause 1 Article 4.

2. Amend the phrase "District People's Committee" to "Provincial People's Committee" at Clauses 1, 5, and 6 of Article 4.

3. Amend the phrase "District administrative unit" to "Provincial administrative unit" at Clauses 1, 5, and 6 of Article 4.

4. Repeal Clause 4 of Article 4.

5. Amend and supplement Clause 1 of Article 6 as follows:

"1. The review of weather modification plans shall be conducted in accordance with the provisions of Article 44 of the Law on Meteorology and Hydrology.

Depending on specific cases, the Ministry of Agriculture and Environment or the People's Committee of provinces, centrally-administered cities may invite representatives of the Ministries specified in Clause 4 of Article 44 of the Law on Meteorology and Hydrology, relevant sectors, localities, scientists, and experts to participate in the review of weather modification plans."

6. Amend and supplement Clause 3 of Article 6 as follows:

"3. In cases where a weather modification plan reviewed through without requiring amendments or supplements, the reviewing agency shall submit the plan for approval by the Minister of Agriculture and Environment within their authority.

In cases where it does not pass, the Ministry of Agriculture and Environment shall send a notification letter explaining the reasons to the agency or organization that prepared the plan."

7. Add Article 8a before Article 8 as follows:

"1. The Chairman of the People's Committee of provinces, centrally-administered cities shall approve the adjustment of weather modification plans within the administrative boundaries of the province when the weather modification plan is adjusted in accordance with Clause 1 and Clause 2 of Article 8 of Circular No. 09/2016/TT-BTNMT dated May 16, 2016 issued by the Minister of Natural Resources and Environment regarding the construction and review of weather modification plans.

2. The file, procedures, and processes for reviewing and approving the full adjustment of weather modification plans within the approval authority of the Chairman of the People's Committee of provinces, centrally-administered cities shall be carried out similarly to the file, procedures, and processes for reviewing and approving weather modification plans stipulated in Article 4 of this Circular and Clause 2 of Appendix IX accompanying Decree No. 136/2025/NĐ-CP dated June 12, 2025 of the Government on decentralization and delegation of management powers in the field of agriculture and environment.

3. The file, procedures, and processes for reviewing and approving partial adjustments of weather modification plans within the approval authority of the Chairman of the People's Committee of provinces, centrally-administered cities

a) The file for reviewing partial adjustments of weather modification plans shall be carried out in accordance with Point a Clause 2 of Article 9 of Circular No. 09/2016/TT-BTNMT dated May 16, 2016 issued by the Minister of Natural Resources and Environment regarding the construction and review of weather modification plans (amended and supplemented by Circular No. 11/2022/TT-BTNMT dated October 20, 2022 of the Minister of Natural Resources and Environment amending and supplementing certain articles of several circulars related to business activities within the scope of the State management functions of the Ministry of Natural Resources and Environment);

b) The procedures and processes for reviewing and approving partial adjustments of weather modification plans within the approval authority of the Chairman of the People's Committee of provinces, centrally-administered cities shall be carried out similarly to the procedures and processes for reviewing and approving weather modification plans stipulated in Points a, b, and d Clause 2 of Appendix IX accompanying Decree No. 136/2025/NĐ-CP dated June 12, 2025 of the Government on decentralization and delegation of management powers in the field of agriculture and environment;

c) The review of partial adjustments of weather modification plans shall be organized by specialized agencies under the People's Committee of provinces, centrally-administered cities to solicit opinions from relevant agencies, organizations, and individuals related to the approved plan, compile and consolidate opinions, examine, and approve within their authority or submit to competent state agencies for examination and approval;

d) The time limit for reviewing partial adjustments of weather modification plans shall not exceed 11 days from the date the agency receiving the review file receives all necessary documents for the review request."

8. Amend and supplement Clause 1 of Article 11 as follows:

"1. The Ministry of Agriculture and Environment shall guide the implementation of this Circular.

2. Specialized units under the Ministry of Agriculture and Environment shall report to the Minister of Agriculture and Environment on the results of the implementation of approved weather modification plans within their authority.

3. The specialized agencies under the People's Committee of the province or centrally governed city shall report to the Chairman of the People's Committee of the province or centrally governed city on the results of implementing the weather modification plan and adjusting the approved weather modification plan within their authority; at the same time, they shall report the results to the Ministry of Agriculture and Environment for consolidation.

Article 6. Effectiveness

This Circular takes effect from July 1, 2025.

Article 7. Transitional Provisions

1. Decisions approving adjustments to weather modification plans that have been resolved as administrative procedures issued by the Minister of Agriculture and Environment before this Circular takes effect and which have not yet expired or reached their term shall continue to be applied and used until their expiration date as stated in the decision.

2. Organizations and individuals whose applications for adjustment of weather modification plans have been accepted by the specialized agencies under the Ministry of Agriculture and Environment before this Circular takes effect but have not yet received a resolution of the administrative procedure shall continue to be processed according to the law at the time of acceptance, except where organizations and individuals request implementation according to this Circular.

3. Within three months from the date this Circular takes effect, the specialized agencies under the Ministry of Agriculture and Environment shall be responsible for transferring files and data related to tasks and powers delegated and decentralized as stipulated in Clause 7, Article 5 of this Circular and files of administrative procedures as stipulated in Clause 2 of this Article to the specialized agencies under the People's Committees of provinces and centrally governed cities that have been delegated and decentralized.

Article 8. Responsibility for Implementation

1. The People's Committees of provinces and centrally governed cities when accepting functions and tasks delegated and decentralized by the Minister of Agriculture and Environment as stipulated in Clause 7, Article 5 of this Circular shall be responsible for:

a) Announcing the Decision on the list of administrative procedures within their jurisdiction to ensure smooth processing of requests for adjustment of weather modification plans after delegation and decentralization without interruption;

b) Inheriting all files, documents, steps implemented, and results of the specialized agencies under the Ministry of Agriculture and Environment that were completed before this Circular took effect. They shall not require individuals or organizations to resubmit already submitted files; nor shall they repeat steps in administrative procedures that have already been completed before decentralization;

c) Accepting and managing state administration over tasks that have been delegated and decentralized by the Minister of Agriculture and Environment before this Circular took effect;

d) Reporting annually to the Ministry of Agriculture and Environment on the results of the delegated and decentralized tasks before December 31 each year;

đ) Proposing the Ministry of Agriculture and Environment to adjust the content of delegation and decentralization in this Circular if difficulties arise during the implementation of the tasks;

2. The Ministry of Agriculture and Environment shall be responsible for guiding and supervising the implementation of delegated and decentralized tasks as stipulated in Clause 7, Article 5 of this Circular.

3. Ministers, Heads of Ministries equivalent to ministries, Heads of government agencies, Chairmen of the People's Committees of provinces and centrally governed cities, Heads of units under the Ministry of Agriculture and Environment, and relevant agencies, organizations, and individuals shall be responsible for implementing this Circular.
