CIRCULAR

PROVISIONS ON SECURITY DOCUMENTS

 

Circular No. 02/2024/TT-BCA dated January 12, 2024, issued by the Minister of Public Security on security documents, effective from March 1, 2024, has been amended and supplemented by:

Circular No. 13/2025/TT-BCA dated February 28, 2025, issued by the Minister of Public Security to amend and supplement certain provisions of circulars regulating traffic order and safety on roads, railways, and inland waterways, effective from March 1, 2025.

Pursuant to the Law on the Public Security Organs dated November 20, 2018; the Law Amending and Supplementing Certain Articles of the Law on the Public Security Organs dated June 22, 2023;

Pursuant to Decree No. 01/2018/NĐ-CP dated August 6, 2018 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;

At the proposal of the Director of the Institute of Science and Technology;

The Minister of Public Security promulgates this Circular on security documents.[1]

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular stipulates the design, manufacture, production of security documents; confidentiality, provision, copying, photographing, storage, preservation, transportation, delivery, receipt, removal from storage, destruction of security marks; information regime, reporting, inspection, supervision, and responsibilities of agencies, organizations, and individuals related to security documents for police work.

Article 2. Applicability

This Circular applies to units and local public security organs and organizations and individuals related to security documents for police work.

Article 3. Explanation of Terms

In this Circular, the following terms are understood as follows:

1. Security is the protection of a targeted object with intent under the influence of tools, means, technology, and science and technology.

2. Security Documents are products designed, manufactured, and produced using high-tech means and techniques containing distinct security marks to prevent copying and forgery.

3. Security Mark is a character, figure, image, sound, or identification mark on security documents (including raw materials, materials, design software) through the use of information technology, software effects, machinery, equipment, tools, electricity, electronics, optical (photochemical, photo-mechanical), light, chemicals, colors, and other forms to create marks on documents in the form of: Design, film recording, zinc plate engraving, audio recording, printing, pasting, attaching, casting, stamping, pressing, carving, engraving, etching, and other forms (including electronic chip attachment).

Article 4. Principles of Design, Manufacture, and Production of Security Documents

1. Ensuring legality and compliance with assigned authority and tasks.

2. Ensuring confidentiality of design, manufacture, and production information of security documents and regulations concerning state secrets.

3. Ensuring feasibility, economy, effectiveness, and difficulty in forgery and copying.

4. Ensuring requirements for national security protection, social order and safety assurance, and environmental protection.

5. Ensuring security and safety in the storage and preservation of security documents.

6. Adhering to intellectual property rights regulations; not sharing design templates among different documents.

7. Ensuring a cadre team with sufficient quality, capability, and expertise to carry out the design, manufacture, and production of security documents.

Chapter II

DESIGN, MANUFACTURE, AND PRODUCTION OF SECURITY DOCUMENTS; CONFIDENTIALITY, PROVISION, COPYING, STORAGE, PRESERVATION, TRANSPORTATION, DELIVERY, RECEIPT, REMOVAL FROM STORAGE, AND RETENTION PERIOD FOR TECHNICAL DESIGN FILES OF SECURITY DOCUMENTS; DESTRUCTION OF SECURITY DOCUMENTS

Article 5. Design of Security Marks, Technical Design Files of Security Documents

1. The Institute of Science and Technology shall be responsible for designing security marks for the following types of documents:

a)[2] Identity cards, identity certificates;

b) Party member cards, People's Police identification cards; passports, travel permits, and related forms;

c) Seals of Party and State agencies;

d) Types of cards and emblems for Party, National Assembly, and State conferences;

đ)[3] Vehicle registration certificates; driver's licenses issued by public security agencies; various certificates and licenses; permits for use in police work;

e) Security documents of state agencies, political organizations, political-social organizations, and other organizations when required;

g) Other security documents assigned by the leadership of the Ministry of Public Security and security products serving economic and social activities.

2. Units and local public security organs may design or hire or place orders for the design of internal-use security documents and are responsible for managing the technical design files of such security documents. Public enterprises and public service units within the People's Public Security have the responsibility to manage the technical design files of security documents they design and hand over one set of files (copy) to the units and localities that hire or place orders for management and use of security documents.

3. Technical design files of security documents include: Legal documents assigning tasks by the heads of units and local public security organs or contracts with legal validity; technical design drawings; approval documents for technical designs; approval documents for the level of confidentiality of the documents (for technical designs listed in the state secret directory); complete product samples.

4. Cadres implementing technical design of security documents in the People's Public Security must have a college degree or higher in one of the following fields: Information technology, fine arts, industrial design, graphic design, printing.

Article 6. Manufacture and Production of Security Documents

1. The Institute of Science and Technology shall be responsible for organizing the manufacture and production of the types of security documents specified in Clause 1 of Article 5 of this Circular according to the tasks assigned by the leadership of the Ministry of Public Security or the regulations of specialized legal documents on those security documents or by agreement with the hiring or ordering party.

2. Units and local public security organs organizing the manufacture and production of security documents must meet the following conditions:

a) Assigned tasks for the manufacture and production of security documents by the head of the unit or locality;

b) Having appropriate equipment, machines, and processes for the manufacture and production of security documents;

c) Having cadres engaged in the manufacture and production of security documents with a college degree or higher in one of the following fields: Information technology, chemistry, printing, mechanical engineering, electrical engineering, electronics, electromechanical, optics;

d) Ensuring other conditions as prescribed by laws on security, safety, fire prevention and fighting, and environmental protection.

Article 7. Technical Security in the Process of Designing, Manufacturing, and Producing Security Documents

1. The heads of units and local public security agencies shall be responsible for organizing the implementation of technical security measures in the process of designing, manufacturing, and producing security documents.

2. Personnel assigned the tasks of designing, manufacturing, and producing security documents within the People's Public Security shall be responsible for implementing technical security measures during the design, manufacture, and production processes of security documents.

Article 8. Provision of Information on Security Indicators

1. The management agency of security documents shall be responsible for disseminating methods to recognize security indicators on security documents to users for verification and differentiation purposes.

2. Agencies and organizations requiring information about the design, manufacture, and production of security documents for investigative, appraisal work, and other operational activities according to their assigned functions and tasks must submit a written request to the agency managing the technical design and manufacturing, production files of security documents to request information provision.

3. Agencies and organizations receiving information about the design, manufacture, and production of security documents shall be responsible for maintaining the confidentiality of such information.

Article 9. Copying, Photographing, Storing, Preserving, Transporting, Handing Over, Removing from Storage, and Retention Periods for Technical Design Files of Security Documents; Destruction of Security Documents.

1. The actions of copying, photographing, storing, preserving, transporting, handing over, removing from storage technical design files of security documents must be approved by the head of the file management unit. For technical design files classified as state secrets, the execution of copying, photographing, storing, preserving, transporting, handing over, and removing from storage must comply with the laws on state secret protection.

2. Procedures for storing and utilizing technical design files of security documents:

a) Collecting documents;

b) Arranging stored documents;

c) Determining the retention period for files;

d) Storing document files in the archive;

đ) Exploiting and using document files;

e) Managing, monitoring, and updating document files;

g) Destroying expired documents.

3. Retention periods for technical design files of security documents

Technical design files of security documents shall be permanently retained or in accordance with the provisions of specialized normative legal documents concerning those security documents.

4. Destruction of Security Documents

The head of the security document management agency decides on the destruction of raw materials, materials used for testing, defective, excess products; intermediate defective, excess products; molds, samples not needed for reuse; surplus security documents during the manufacturing process; security documents collected after use (except those currently under investigation, verification, or appraisal) as follows:

a) Establish a destruction committee (including representatives of the agency, unit, organization heads and individuals related to the design, manufacture, and production of security documents to be destroyed) or directly assign subordinate units to carry out the destruction;

b) Methods and procedures for destruction: Burning, grinding, cutting, using chemicals, or other methods ensuring that security documents lose their original form, cannot be reused, and cannot be reconstructed or pieced together. The destruction unit must handle waste according to environmental protection regulations, and the destruction process must be documented in a record;

c) Destruction records include: Decision to establish the Committee or document assigning subordinate units to carry out destruction; list of items to be destroyed; destruction record; images of the destruction process.

Chapter III

ASSIGNMENT OF RESPONSIBILITIES AND INSPECTION AND REPORTING REGIMES

Article 10. Responsibilities of the Institute of Science and Technology

1. Take the lead and coordinate with local police units to advise the Ministry of Public Security on issuing regulations, plans, programs for research, and lists of materials requiring security protection for police work.

2. Organize research and application of scientific and technological progress in the field of security protection, cooperate with competent units, organizations, and individuals to design, manufacture, and produce security materials as stipulated in Clause 1 of Article 5 of this Circular.

3. Manage technical design files of security materials as stipulated in Clause 1 of Article 5 of this Circular.

4. Take the lead and coordinate with local police units to advise the Ministry of Public Security on building databases of security materials for management, exploitation, and use according to operational requirements.

Article 11. Responsibilities of Local Police Units

1. Implement and manage activities related to the design, manufacture, and production of internal-use security materials within their units.

2. Manage technical design files of internal-use security materials within their units.

3. Coordinate with the Institute of Science and Technology to advise the Ministry of Public Security on developing plans, programs for research, and lists of materials requiring security protection for police work.

4. When local police units have a need to purchase equipment and software to provide security solutions for designing, manufacturing, and producing security materials, they must submit a written request according to Form No. 01 issued along with this Circular to the Institute of Science and Technology for comments on technical features and usage effectiveness. The Institute of Science and Technology must provide a written response within seven working days from the date of receipt of the request from the local police unit.

Article 12. Information and Reporting System

1. Local police units involved in the design, manufacture, and production of security materials for police work shall be responsible for submitting regular annual reports according to Form No. 02 issued along with this Circular or ad hoc reports to the Ministry of Public Security for monitoring and summarization (through the Institute of Science and Technology).

2. Reporting data covers from December 15 of the previous year to December 14 of the reporting year.

3. Deadline for submission of reports: Not later than January 10 of the following year.

4. The Institute of Science and Technology is responsible for compiling and reporting to the leadership of the Ministry of Public Security on activities related to the design, manufacture, and production of security materials for police work.

Article 13. Inspection of Conditions for Manufacturing and Producing Security Materials and Technical Design Files

1. The Institute of Science and Technology takes the lead and coordinates with relevant local police units to inspect conditions for manufacturing and producing security materials and technical design files for police work on a regular basis or as required by the leadership of the Ministry of Public Security.

2. Heads of local police units organize inspections of conditions for manufacturing and producing security materials and technical design files managed by their units.

Chapter IV

IMPLEMENTING PROVISIONS [4]

Article 14. Effective Date

This Circular takes effect from March 1, 2024.

Article 15. Responsibility for Implementation

1. The Institute of Science and Technology is responsible for inspecting and urging the implementation of this Circular.

2. Heads of police units and localities and related organizations and individuals shall be responsible for implementing this Circular.

3. During the implementation of this Circular, if there are difficulties or obstacles, local police units and related organizations and individuals should report to the Ministry of Public Security (through the Institute of Science and Technology) for timely guidance../.

[1] Circular No. 13/2025/TT-BCA dated February 28, 2025 of the Minister of Public Security amending and supplementing certain articles of circulars regulating traffic order and safety on roads, railways, and inland waterways is based on the following grounds for issuance:

Pursuant to the Law on Inland Waterway Traffic dated June 15, 2004; the Law Amending and Supplementing Certain Provisions of the Law on Inland Waterway Traffic dated June 17, 2014; the Law Amending and Supplementing Certain Provisions of 37 Laws Related to Planning dated November 20, 2018;

Pursuant to the Railway Law dated June 16, 2017;

BASED ON THE ROAD TRAFFIC ORDER AND SAFETY LAW dated June 27, 2024;

Pursuant to Decree No. 02/2025/NĐ-CP dated February 18, 2025, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Public Security;

At the proposal of the Director of the Traffic Police Corps;

The Minister of Public Security hereby promulgates the Circular amending and supplementing certain provisions of circulars regulating road traffic order and safety, railway traffic, and inland waterway traffic.

[2] This point is amended in accordance with Clause 1, Article 13 of Circular No. 13/2025/TT-BCA dated February 28, 2025, issued by the Minister of Public Security amending and supplementing certain provisions of circulars regulating traffic order and safety for roads, railways, and inland waterways, which shall take effect from March 1, 2025.

[3] This point is amended in accordance with Clause 2, Article 13 of Circular No. 13/2025/TT-BCA dated February 28, 2025, issued by the Minister of Public Security amending and supplementing certain provisions of circulars regulating traffic order and safety for roads, railways, and inland waterways, which shall take effect from March 1, 2025.

[4] Article 14 of Circular No. 13/2025/TT-BCA dated February 28, 2025, issued by the Minister of Public Security amending and supplementing certain provisions of circulars regulating traffic order and safety for roads, railways, and inland waterways, which shall take effect from March 1, 2025, provides as follows:

Article 14. Implementation clause

1. This Circular takes effect from March 1, 2025.

2. The Director of the Traffic Police Corps shall be responsible for monitoring, guiding, inspecting, and urging the implementation of this Circular.

3. Heads of units under the Ministry, Directors of Public Security Departments of provinces and centrally-administered cities, organizations, and individuals concerned shall be responsible for implementing this Circular.

4. During the process of implementing this Circular, if there are difficulties or obstacles, local public security units shall report to the Ministry of Public Security (through the Traffic Police Corps) for timely guidance..
