DECISION OF THE PRIME MINISTER
Regarding the pilot application of certain policies for the development of the Moc Bai Border Economic Zone in Tay Ninh Province

Pursuant to the Government Organization Law dated September 30, 1992;
Considering the proposal of the People's Committee of Tay Ninh Province at Document No. 975/TT-UB dated August 19, 1998 and the opinions of relevant ministries and sectors,
DECISION:
Article 1. Permitting the pilot application of certain development policies for the Moc Bai Border Economic Zone with an area of 21,292 hectares; including approximately 1,000 hectares of urban area within the administrative boundaries of the communes of Long Thuan, Tien Thuan, Loi Thuan, and An Thanh in Ben Cau District and the communes of Phuoc Luu, Binh Thanh, and Phuoc Chi in Trang Bang District, Tay Ninh Province.
12/2025/TT-BNNMT dated June 19, 2025 issued by the Minister of Agriculture and EnvironmentIn the Moc Bai Border Economic Zone, priority will be given to developing trade, service, and tourism industries, processing industries for agricultural, forestry, and aquatic products, production of consumer goods, and processing services for export in accordance with the laws of the Socialist Republic of Vietnam and international practices.
Article 3. The Government of the Socialist Republic of Vietnam respects and protects the legitimate rights and interests of domestic and foreign investors investing in the Moc Bai Border Economic Zone in compliance with Vietnamese laws, policies, and international treaties to which the Socialist Republic of Vietnam is a signatory or participant.
Article 4. Management of the Moc Bai Border Economic Zone shall be carried out on the principle of combining sectoral management with local management under the unified direction of the Government.
The People's Committee of Tay Ninh Province shall perform the function of coordinating and harmonizing the activities of state management organizations within its jurisdiction concerning economic activities in the Moc Bai Border Economic Zone and appropriately delegating authority and responsibility to the People's Committees of Ben Cau and Trang Bang Districts.
Article 5.In the Moc Bai Border Economic Zone, domestic and foreign capital sources shall be mobilized through appropriate forms in accordance with the law, and labor contributions shall be mobilized for the construction of necessary infrastructure projects and production facilities in line with the socio-economic development plan and national defense and security requirements.
To promote the construction of infrastructure in the Moc Bai Border Economic Zone, the People's Committee of Tay Ninh Province may establish a State-owned company for the construction and development of infrastructure within the Moc Bai Border Economic Zone.
Article 6.
During the period from 1999 to 2002, each year the State shall invest separately through the provincial budget for the construction of infrastructure in the Moc Bai Border Economic Zone according to the approved planning not less than 50% of the total tax revenue from import and export activities in the Moc Bai Border Economic Zone. The amount of investment and the list of infrastructure projects to be invested from the budget shall be proposed by the People's Committee of Tay Ninh Province and decided by the Ministry of Planning and Investment after obtaining the agreement of the Ministry of Finance.
The Chairman of the People's Committee of Tay Ninh Province may issue decisions approving basic construction projects of Groups B and C based on consensus with the Ministry of Planning and Investment and the opinion of the Ministry of National Defense to ensure national defense and border management at the border gate. For the use of funds mentioned in Clause 1 of this Article for investment projects in the Moc Bai Border Economic Zone, the People's Committee of Tay Ninh Province shall work specifically with the Ministry of Planning and Investment and the Ministry of Finance to allocate funds to ensure timely implementation.
Article 7. Diversification of business production forms on the territory of the Moc Bai Border Economic Zone shall be promoted. Issuance of business licenses and registration of businesses in the Moc Bai Border Economic Zone shall be carried out in accordance with current laws and the single-window mechanism.
The People's Committee of Tay Ninh Province shall be authorized to issue business establishment permits and register businesses such as private enterprises, limited liability companies, and joint-stock companies operating in the Moc Bai Border Economic Zone in accordance with the Law on Private Enterprises and the Law on Companies.
Article 8. Domestic and foreign investors are encouraged to invest in the development of production, business, and infrastructure construction in the Moc Bai Border Economic Zone in accordance with the Law on Encouraging Domestic Investment and the Law on Foreign Investment of Vietnam. In addition to enjoying incentives under the current regulations, they also enjoy:
1. Domestic and foreign investors investing in the Moc Bai Border Economic Zone shall be granted a 50% reduction in land rental fees compared to the current price framework applied by the State in the Moc Bai Border Economic Zone.
2. Foreign investors transferring profits abroad shall enjoy the lowest tax rate within the legal tax range.
Article 9. The People's Committee of Tay Ninh Province shall be authorized to issue permits for direct foreign investment projects in the Moc Bai Border Economic Zone with a capital not exceeding five million US dollars.
Article 10. Land and factories leased or purchased in the Moc Bai Border Economic Zone that have not been used for the purposes specified in the investment permit must renegotiate and obtain approval from the competent authority if there is a need to change the purpose of use.
Article 11. Within the validity period of the investment and business license, after obtaining the consent of the investment licensing authority, enterprises may transfer assets they have constructed on leased land or installed in factories to other investors in compliance with current Vietnamese laws. The transferee has the right and obligation to continue performing contracts signed by the transferor with partners.
Article 12. Trade, service activities, and production activities in the Moc Bai Border Economic Zone shall be conducted in accordance with current regulations, including:
1. Export, import, temporary import, re-export, transit cargo transport, bonded warehouses, duty-free shops, product display shops, border marketplaces, export processing, storage, banking, telecommunications, representative offices, and branches of domestic and foreign companies. These trade and service activities must comply with the following regulations:
Enterprises belonging to various economic sectors established in accordance with current laws, having their headquarters in the Moi Bai Border Economic Zone, may directly engage in export and import of goods (except those prohibited by the State). The export and import of goods subject to quota limits set by the State and those requiring specific conditions shall be carried out in compliance with current regulations of the State and under the guidance of the Ministry of Commerce.
Foreign goods temporarily imported into the Moi Bai Border Economic Zone but not yet re-exported must be stored in a bonded warehouse. When these goods are exported to another country, they must go through re-export procedures. If they enter the domestic market, the importer must pay import duties. If goods stored in the bonded warehouse at the Moi Bai Border Economic Zone cannot continue to be transferred, they must be returned to their place of origin in accordance with current regulations and international practices.
The Ministry of Commerce will provide guidance and authorize the People's Committee of Tay Ninh Province to issue permits for foreign enterprises establishing branches or representative offices in the fields of trade, tourism, and services within the Moi Bai Border Economic Zone, allowing such enterprises to organize international product exhibitions within the zone according to the Ministry of Commerce’s guidelines.
2. Production activities: assembly, processing of agricultural, forestry, and aquatic products; production of consumer goods, and processing for export must comply with the following regulations:
Enterprises, branches, and representatives of companies belonging to various domestic economic sectors established in accordance with the law, having offices located in the Moi Bai International Border Economic Zone, may produce goods for public consumption; they may also directly engage in the export and import of goods.
Raw materials and supplies imported into the Moi Bai International Border Economic Zone for the production of export goods or to replace imported goods must pay import duties and will be refunded upon export of the finished products in accordance with current State regulations.
Article 13. Management of entry and exit.
1. Cambodian citizens residing in Cambodian districts bordering the Moi Bai Border Economic Zone may enter and exit the Moi Bai Border Economic Zone using identity cards or border passes issued by authorized Cambodian authorities. Their temporary stay in the Moi Bai Border Economic Zone shall not exceed seven days. To enter other areas of Tay Ninh Province or other provinces/cities in Vietnam, they must apply for visas at the border gate through the Exit-Entry Administration Department of the Ministry of Public Security. Such permits are valid for one time only and shall not exceed fifteen days and cannot be extended.
2. Cambodian citizens residing outside the area specified in Clause 1 of this Article may enter and exit the Moi Bai Border Economic Zone using passports, exempt from visa requirements for entry into Vietnam, and allowed to stay in the Moi Bai Border Economic Zone for up to fifteen days. To enter other areas of Tay Ninh Province or other provinces/cities in Vietnam, they must have passports and apply for visas at the border gate through the Exit-Entry Administration Department of the Ministry of Public Security.
3. Foreign citizens (excluding Cambodian citizens) who hold valid residence permits are exempt from visa requirements when entering the Moi Bai Border Economic Zone and may stay for up to fifteen days. To enter other areas of Tay Ninh Province or other provinces, they must apply for visas at the Moc Bai Border Gate through the Exit-Entry Administration Department of the Ministry of Public Security, except in cases where bilateral visa exemptions apply.
4. Encouragement is given to tour organizations to arrange group tours for foreigners from the Moi Bai Border Economic Zone to other locations in Tay Ninh Province and other provinces/cities within the country. For Cambodian citizens and other foreigners permitted to enter the Moi Bai Border Economic Zone who wish to visit other areas in Tay Ninh Province and other provinces for tourism purposes, organized by Vietnamese travel companies approved by the Tourism General Administration, in groups of five or more, the Exit-Entry Administration Department of the Ministry of Public Security will expedite the necessary procedures at the Moi Bai Border Economic Zone.
5. Vietnamese citizens in the Moi Bai Border Economic Zone, Trang Bang District, and Ben Cau District are permitted to visit neighboring countries for a period equal to the validity of their identity cards or border passes issued by authorized Vietnamese authorities.
Article 14.
1. Cambodian road and river transport vehicles entering the Moi Bai Border Economic Zone with international multimodal transport permits are only required to stamp customs seals; if they lack such permits, they must complete temporary import and re-export declaration procedures.
2. If the aforementioned transport vehicles wish to proceed to other ports, wharfs, or border gates in Tay Ninh Province for cargo delivery or receipt, they must obtain permission from relevant management agencies and comply with current customs and tax regulations.
Article 15.
1. Recruitment of labor is conducted in accordance with current Vietnamese laws. Workers recruited to work in enterprises within the Moi Bai Border Economic Zone must submit registration forms to the competent authority. Recruitment must be conducted democratically and transparently, adhering to current regulations.
2. For jobs that Vietnamese workers cannot meet, enterprises may employ foreign workers for a limited period, not exceeding one year for positions that Vietnamese workers can potentially fill. When employing foreign workers, enterprises must have the Moi Bai Border Economic Zone’s competent authority verify their professional qualifications and certificates. During this period, enterprises must develop plans to train Vietnamese workers to take over these positions.
Article 16. The People's Committee of Tay Ninh Province is responsible for leading and coordinating with relevant ministries, ministerial-level agencies, and government bodies to conduct annual reviews and a comprehensive evaluation in 2002 on the pilot application of the above policies, and make recommendations to the Prime Minister for necessary adjustments and supplements.
Article 17. This Decision takes effect from January 1, 1999. Ministers, Heads of ministerial-level agencies, Heads of government agencies, and the Chairman of the People's Committee of Tây Ninh Province shall proactively prepare relevant conditions for implementation and bear responsibility for enforcing this Decision./.
