DECISION OF THE CHAIRMAN OF THE GOVERNMENT

On issuing principles, criteria, and allocation standards for investment development expenditures funded by the State budget for the period 2007-2010

Based on the State Budget Law No. 01/2002/QH11 dated December 16, 2002, and Government Decree No. 60/2003/NĐ-CP dated June 6, 2003 detailing and guiding the implementation of the State Budget Law;

PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Based on Resolution No. 47/2005/QH11 dated November 1, 2005 of the National Assembly and the opinions of the Standing Committee of the National Assembly in Document No. 543/UBTVQH11 dated July 31, 2006;

At the proposal of the Minister of Planning and Investment.

The principles, criteria, and allocation standards for investment development expenditures funded by the State budget for the period 2007-2010 are hereby promulgated together with this Decision.

DECISION:

Article 1The criteria and allocation standards for investment development expenditures funded by the State budget stipulated in Article 1 of this Decision shall serve as the basis for compiling the investment development expenditure budget from the State budget for ministries, ministerial-level agencies, central agencies, and other central agencies; and the investment development expenditure budget from the State budget for provinces and centrally-administered cities.

Article 2. Responsibilities of ministries and ministerial-level agencies

Article 3. - The Ministry of Planning and Investment shall take the lead and coordinate with the Ministry of Finance to balance the total amount of investment development expenditures funded by the State budget to implement the criteria and standards prescribed in this Decision;

- The Ministry of Home Affairs shall be responsible for providing data on administrative units of provinces and centrally-administered cities currently existing, mountainous and highland administrative units, island areas, and border regions to the Ministry of Planning and Investment in September 2006. Announce periodically every six months about newly established or divided districts and communes to the Ministry of Planning and Investment;

- The General Statistics Office shall be responsible for providing population data and ethnic minority population data of provinces and centrally-administered cities in 2006 to the Ministry of Planning and Investment in September 2006;

- The Ministry of Labor, Invalids, and Social Affairs shall be responsible for providing poverty rate data of provinces and centrally-administered cities in 2006 to the Ministry of Planning and Investment before September 2006.

Provincial People's Committees and Municipal People's Committees directly under the Central Government shall base on the principles, criteria, and allocation standards for investment development expenditures attached to this Decision, financial capacity, and local conditions to formulate principles and criteria for allocating investment development expenditures for sectors and levels within their jurisdictions, and report to the People's Councils of provinces and centrally-administered cities for decision-making.

Article 4. This Decision takes effect from the date of signature. Previous regulations that conflict with this Decision shall cease to be effective.

Article 6. The Minister of Planning and Investment is responsible for organizing and implementing this Decision. The Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of People's Committees of provinces and centrally governed cities are responsible for enforcing this Decision.
