DECREE

Amending and supplementing certain Articles of Decree No. 103/2008/NĐ-CP

dated September 16, 2008 of the Government on mandatory civil liability insurance for motor vehicle owners

The Government promulgates this Decree to amend and supplement certain Articles of Decree No. 103/2008/NĐ-CP dated September 16, 2008 of the Government on mandatory civil liability insurance for motor vehicle owners,

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Law on Insurance Business dated December 9, 2000 and the Law Amending and Supplementing Certain Provisions of the Law on Insurance Business dated November 24, 2010;

At the proposal of the Minister of Finance;

Article 1. Amend and supplement certain Articles of Decree No. 103/2008/NĐ-CP dated September 16, 2008 of the Government on mandatory civil liability insurance for motor vehicle owners as follows:

"2. Insurance enterprises shall be responsible for allocating 1% of the annual revenue from mandatory civil liability insurance premiums for motor vehicle owners to the Motor Vehicle Insurance Fund."

1. Amend Clause 2, Article 4 as follows:

2. Amend Clause 9, Article 20 as follows:

"9. Allocate 1% of the annual revenue from mandatory civil liability insurance premiums for motor vehicle owners to contribute to the Motor Vehicle Insurance Fund."

3. Amend Clause 5, Article 21 as follows:

"Establish a management mechanism for the use, payment, and settlement of the Motor Vehicle Insurance Fund."

This Decree takes effect from February 10, 2014.

Article 2. Effective Date

2. Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairpersons of provincial People's Committees under the central government, and related organizations and individuals are responsible for implementing this Decree./.

This Circular takes effect from December 25, 2025/.

1. The Ministry of Finance shall provide guidance on the implementation of this Decree.

The Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of provincial People's Committees under the central government, and related organizations and individuals shall be responsible for implementing this Decree./.
