DIRECTIVE

ON THE TASKS TO BE PERFORMED TO IMPLEMENT DECREE NO. 43-CP OF JUNE 22, 1993 OF THE GOVERNMENT ON TEMPORARY SOCIAL INSURANCE REGIME

On June 22, 1993, the Government issued Decree No. 43/CP on the temporary social insurance regime. This is one of the important issues of the renovation program, closely related to the obligations and rights of workers, but its implementation over the past ten months has been slow. To urgently implement this Decree, the Prime Minister issues the following directives:

1. Establish a preparatory board for implementing Decree No. 43/CP dated June 22, 1993 of the Government, headed by a comrade from the Organization-Cadre Department of the Government, and with representatives having authority from the State Planning Commission, Ministry of Finance, Ministry of Labor, Invalids and Social Affairs, and the General Confederation of Trade Unions of Vietnam as members.

The preparatory board shall have the task of preparing to submit to the Prime Minister for issuance the following decisions:

- Decision of the Prime Minister on the establishment of the social insurance organization system of Vietnam along with its charter of organization and operation;

- Decision of the Prime Minister on the Board of Management of the social insurance organization of Vietnam, its members, and functions and responsibilities of the board;

- Decision of the Prime Minister on the Audit Board, its members, and responsibilities of the board;

- Plan for organizing and staffing based on unifying the current social insurance organizations under the Ministry of Labor, Invalids and Social Affairs and the General Confederation of Trade Unions of Vietnam;

- Decision of the Prime Minister on the organizational structure and staffing of the social insurance system of Vietnam;

- Decision of the Prime Minister on the comprehensive inspection of assets, capital, debts, and personnel of the social insurance organizations under the Ministry of Labor, Invalids and Social Affairs and the General Confederation of Trade Unions of Vietnam.

2. By the end of the fourth quarter of 1994, the Ministry of Labor, Invalids and Social Affairs and the General Confederation of Trade Unions of Vietnam shall be responsible for directing subordinate social insurance organizations to complete the transfer of their capital, assets, debts, and personnel to the newly established social insurance organization according to Decree No. 43-CP.

3. Starting from January 1, 1995, the social insurance organization of Vietnam will officially operate and be responsible for implementing the social insurance regimes for workers as stipulated in Decree No. 43-CP.

4. Relevant sectors and levels need to promptly issue circulars guiding the regimes prescribed in Decree No. 43-CP. In the short term, the collection and payment of social insurance benefits will continue through existing organizations until the social insurance system of Vietnam officially commences operations.

5. The Prime Minister requests the preparatory board and relevant ministries and sectors to urgently complete the above tasks according to the schedule set out and report monthly on the progress of work carried out; at the same time, they must reflect new issues arising for the Prime Minister's knowledge to resolve./.
