Regulations on conditions for operating antique appraisal and practicing cultural heritage conservation, repair, and restoration

Decree No. 61/2016/ND-CP dated July 1, 2016 of the Government stipulates conditions for operating antique appraisal and practicing cultural heritage conservation, repair, and restoration, which took effect from July 1, 2016, amended and supplemented by:

Decree No. 31/2024/ND-CP dated March 15, 2024 of the Government amending and supplementing certain articles of Decree No. 01/2012/ND-CP, Decree No. 61/2016/ND-CP, and Decree No. 36/2019/ND-CP, which took effect from March 15, 2024.

Pursuant to the Law on Government Organization dated June 19, 2015;

Pursuant to the Cultural Heritage Law dated June 29, 2001 and the Law Amending and Supplementing Certain Provisions of the Cultural Heritage Law dated June 18, 2009;

Pursuant to the Urban Planning Law dated June 17, 2009; Pursuant to the Construction Law dated June 18, 2014;

Pursuant to the Investment Law dated November 26, 2014;

At the proposal of the Minister of Culture, Sports and Tourism;

The Government promulgates this Decree stipulating conditions for operating antique appraisal and practicing cultural heritage conservation, repair, and restoration.^[1]

Chapter I. GENERAL PROVISIONS

Article 1. Scope of Regulation

This Decree stipulates conditions for operating antique appraisal and practicing cultural heritage conservation, repair, and restoration.

Article 2. Applicability

This Decree applies to organizations and individuals participating in antique appraisal activities; organizations and individuals practicing cultural heritage conservation, repair, and restoration (hereinafter referred to collectively as heritage repair practice) within the territory of Vietnam, and other related organizations and individuals.

Article 3. Explanation of Terms

In this Decree, the following terms are understood as follows:

1. Antique appraisal is an activity carried out by an organization with authority under the law on cultural heritage to determine the age, historical, cultural, scientific, aesthetic value, and other scientific issues related to the appraised object.

2. Heritage repair practice includes:

a) Practice of preparing heritage repair plans;

b) Practice of preparing heritage repair project proposals, economic-technical reports on heritage repair, and heritage repair design;

c) Practice of implementing heritage repair works;

d) Practice of supervising heritage repair construction.

Chapter II. OPERATING ANTIQUE APPRAISAL

Article 4. Conditions for operating antique appraisal

An antique appraisal business must meet the following conditions:

1. Having a warehouse for storing and preserving appraised objects.

2. Having equipment and means suitable for the appraisal field registered.

3. Having reference materials on antiques to support antique appraisal activities.

4. Having at least three antique appraisal experts in various fields as guided by the Ministry of Culture, Sports and Tourism.

Article 5. Authority to issue, reissue, and revoke the Certificate of Compliance with Conditions for Operating Antique Appraisal

The Director of the Department of Culture, Sports and Tourism or the Director of the Department of Culture and Sports has the authority to issue, reissue, and revoke the Certificate of Compliance with Conditions for Operating Antique Appraisal for antique appraisal businesses with headquarters within their jurisdiction.

Article 6. Procedures and formalities for issuing the Certificate of Compliance with Conditions for Operating Antique Appraisal

1.^[2] An antique appraisal business shall submit directly or send via postal service or electronic environment one set of application documents to the competent authority as stipulated in Article 5 of this Decree. The application package includes:

a) Application form according to Model No. 01 attached to this Decree;

b) List accompanied by scientific curriculum vitae according to Model No. 02 attached to this Decree and copies of diplomas and certificates of the experts;

c) Copies of employment decisions or labor contracts between the antique appraisal business and the experts;

d) List of equipment and means for conducting appraisals.

2. Within fifteen working days from the date of receiving complete application documents as prescribed, the Director of the Department of Culture, Sports and Tourism or the Director of the Department of Culture and Sports shall be responsible for examining and deciding to issue the Certificate of Compliance with Conditions for Operating Antique Appraisal according to Model No. 03 attached to this Decree, and simultaneously report to the Minister of Culture, Sports and Tourism. In case of refusal, a written response with reasons must be provided.

Article 7. Reissuing the Certificate of Eligibility for Business in Antique Appraisal

1. The Certificate of Eligibility for Business in Antique Appraisal shall be reissued in the following cases:

a) Lost or damaged;

b) There is a change in information recorded in the previously issued Certificate of Eligibility for Business in Antique Appraisal.

2. Procedures for reissuing the Certificate of Eligibility for Business in Antique Appraisal:

a) The antique appraisal business entity shall submit directly or send via postal service or through an electronic environment^[3] one set of documents to the authority specified in Article 5 of this Decree. The dossier includes:

- A request form according to Form No. 04 attached to this Decree;

- The original Certificate of Eligibility for Business in Antique Appraisal that has been issued for cases where the certificate is damaged or there is a change in information;

In cases where there is a change in information recorded in the previously issued Certificate of Eligibility for Business in Antique Appraisal, copies of relevant documents related to the change in information must also be sent.

b) Within five working days from the date of receiving the complete dossier as prescribed, the Director of the Department of Culture, Sports and Tourism or the Director of the Department of Culture and Sports shall examine and decide on reissuing the Certificate of Eligibility for Business in Antique Appraisal, while reporting to the Minister of Culture, Sports and Tourism. If refusal is made, it must be notified in writing with clear reasons provided.

Article 8. Revocation of the Certificate of Eligibility for Business in Antique Appraisal

1. The Certificate of Eligibility for Business in Antique Appraisal shall be revoked in the following cases:

a) The antique appraisal business entity no longer meets the conditions stipulated in this Decree;

b) The antique appraisal business entity is dissolved or voluntarily ceases its antique appraisal activities;

c) The antique appraisal business entity engages in violations of the law during its antique appraisal activities, which are proposed for revocation of the Certificate of Eligibility for Business in Antique Appraisal by competent state authorities in accordance with laws on administrative offenses;

d) Other cases of revocation as prescribed by law.

2. Within five working days from the date of issuance, the Director of the Department of Culture, Sports and Tourism or the Director of the Department of Culture and Sports who issued the Certificate of Eligibility for Business in Antique Appraisal shall notify the antique appraisal business entity of the Decision to revoke, while reporting to the Minister of Culture, Sports and Tourism.

3. An antique appraisal business entity whose Certificate of Eligibility for Business in Antique Appraisal has been revoked may only be considered for reissuance of the Certificate of Eligibility for Business in Antique Appraisal after six months from the date of revocation, except where otherwise provided by law. The procedures and formalities for requesting issuance of the Certificate of Eligibility for Business in Antique Appraisal after revocation shall be carried out as prescribed for new issuance.

Chapter III. PRACTICING THE TRADE OF MAINTAINING HERITAGE SITES

Section 1. TRADE LICENSE FOR MONUMENT CONSERVATION

CERTIFICATE OF PRACTICE IN MONUMENT CONSERVATION

Article 9. Conditions for Issuing the Certificate of Practice in Monument Conservation

The Certificate of Practice in Monument Conservation (hereinafter referred to as the Certificate of Practice) shall be issued to individuals who meet the specific conditions for each case as follows:

1. Certificate of Practice in Planning Monument Conservation:

a) Hold a Certificate of Practice in Building Design Planning;

b) Have completed a training program on monument conservation knowledge as prescribed by the Minister of Culture, Sports and Tourism.

2. Certificate of Practice in Developing Monument Conservation Projects, Economic and Technical Reports on Monument Conservation, and Monument Conservation Designs:

a) Hold a Certificate of Practice in Building Design Planning;

a) Hold a Certificate of Practice in Building Design;

3. Certificate of Practice in Monument Conservation Construction:

a) Hold a Certificate of Practice in Building Design Planning;

a) Hold a Certificate of Practice in Building Design or have a bachelor's degree or higher in construction-related fields;

4. Certificate of Practice in Supervising Monument Conservation Construction:

a) Hold a Certificate of Practice in Building Design Planning;

Article 10. Competence to Issue, Reissue, and Revoke the Professional Practice Certificate

The Director of the Department of Culture, Sports and Tourism or the Director of the Department of Culture and Sports shall have the authority to issue, reissue, and revoke the Professional Practice Certificate as stipulated in Article 9 of this Decree.

Article 11. Procedures for Issuing the Professional Practice Certificate

1. Individuals may submit directly, send via postal service, or transmit through electronic means^[4] one set of application files to the competent authority as specified in Article 10 of this Decree. The application file includes:

a) Application form according to Form No. 05 attached to this Decree;

b) A copy of the Professional Practice Certificate for design planning construction, construction design practice, construction project supervision practice, or a university degree or higher in relevant majors such as construction and architecture related to the proposed professional practice activities as stipulated in point a, Clause 1, point a, Clause 2, point a, Clause 3, and point a, Clause 4 of Article 9 of this Decree;

c) A copy of the certificate or certification of participation in a heritage conservation knowledge enhancement program;

d) Two color photographs measuring 3x4 cm taken within the year of application.

2. Within five working days from the date of receipt of the application file as prescribed, the Director of the Department of Culture, Sports and Tourism or the Director of the Department of Culture and Sports shall be responsible for reviewing and requesting additional information if the file is incomplete or not in compliance.

3. Within five working days from the date of receiving a complete and valid application file, the Director of the Department of Culture, Sports and Tourism or the Director of the Department of Culture and Sports shall be responsible for examining and deciding to issue the Professional Practice Certificate according to Form No. 06 attached to this Decree, while simultaneously reporting to the Minister of Culture, Sports and Tourism. In case of refusal, a written response must be provided with clear reasons.

4. The Professional Practice Certificate is valid for a period of five years.

Article 12. Reissuing the Professional Practice Certificate

1. The Professional Practice Certificate shall be reissued in the following cases:

a) Supplementing the scope of professional practice;

b) Expiration of validity;

c) Loss or damage.

2. Procedures for Reissuing the Professional Practice Certificate:

a) Individuals may submit directly, send via postal service, or transmit through electronic means^[5] one set of application files to the competent authority as specified in Article 10 of this Decree. The application file includes:

- Application form according to Form No. 07 attached to this Decree;

- Original Professional Practice Certificate that has been issued for cases of supplementing the scope of professional practice or expiration of validity or damage;

- Two color photographs measuring 3x4 cm taken within the year of reapplication;

For cases of supplementing the scope of professional practice already recorded in the previously issued Professional Practice Certificate, copies of certificates or certifications as stipulated in points b and c, Clause 1 of Article 11 of this Decree must be submitted along with the application file.

b) For cases of reissuing the Professional Practice Certificate due to expiration of validity or damage, within five working days from the date of receiving a complete and valid application file, the Director of the Department of Culture, Sports and Tourism or the Director of the Department of Culture and Sports shall examine and decide to reissue the Professional Practice Certificate, while simultaneously reporting to the Minister of Culture, Sports and Tourism. In case of refusal, a written response must be provided with clear reasons.

c) For cases of reissuing the Professional Practice Certificate due to loss or supplementing the scope of professional practice, the issuance period shall be carried out as prescribed for new issuance.

3. The content and validity period of the reissued Professional Practice Certificate shall be recorded as follows:

a) For cases of supplementing the scope of professional practice, the supplementary scope of professional practice shall be recorded according to the validity period of the previous Professional Practice Certificate;

b) For cases of expiration, the content and validity period recorded in the Professional Practice Certificate shall be carried out as prescribed for new issuance;

c) For cases of loss or damage, the content and validity period shall be recorded according to the previous Professional Practice Certificate.

Article 13. Revocation of Professional Practice Certificate

1. The Professional Practice Certificate shall be revoked in the following cases:

a) Conducting preservation, repair, and restoration activities of cultural heritage sites beyond the scope permitted by the Professional Practice Certificate;

b) Failing to comply with laws on cultural heritage, construction, and other relevant laws;

c) Renting, lending, or allowing others to use the Professional Practice Certificate;

d) Arbitrarily erasing or altering the Professional Practice Certificate;

đ) Other cases of revocation as prescribed by law.

2. Within five working days from the date of revocation, the Director of the Department of Culture, Sports and Tourism or the Director of the Department of Culture and Sports who issued the Professional Practice Certificate shall notify the violator organization or individual of the revocation decision and simultaneously report to the Minister of Culture, Sports and Tourism.

3. An individual whose Professional Practice Certificate has been revoked may only be considered for issuance of a new Professional Practice Certificate six months after the date of revocation, except where otherwise provided by law. The procedures and formalities for requesting issuance of a new Professional Practice Certificate after revocation shall be carried out in accordance with the provisions applicable to new issuance.

Section 2. CERTIFICATE OF ELIGIBILITY FOR PROFESSIONAL PRACTICE IN THE REPAIR OF CULTURAL HERITAGE SITES

Article 14. Conditions for Issuance of Certificate of Eligibility for Professional Practice in Repair of Cultural Heritage Sites

A Certificate of Eligibility for Professional Practice in Repair of Cultural Heritage Sites (hereinafter referred to as the Professional Practice Certificate) shall be issued to an organization when it meets all conditions specified for each specific case as follows:

1. Professional Practice Certificate for Planning the Repair of Cultural Heritage Sites:

a) Legally established;

b) Meeting the conditions for professional practice in designing construction planning as prescribed by laws on construction;

c) Having at least two individuals holding a Professional Practice Certificate for Planning the Repair of Cultural Heritage Sites.

2. Professional Practice Certificate for Preparing Repair Projects of Cultural Heritage Sites, Economic and Technical Reports on Repair of Cultural Heritage Sites, and Designing Repair of Cultural Heritage Sites:

a) Legally established;

b) Meeting the conditions for professional practice in designing construction as prescribed by laws on construction;

c) Having at least three individuals holding a Professional Practice Certificate for Preparing Repair Projects of Cultural Heritage Sites, Economic and Technical Reports on Repair of Cultural Heritage Sites, and Designing Repair of Cultural Heritage Sites.

3. Professional Practice Certificate for Construction of Repair of Cultural Heritage Sites:

a) Legally established;

b) Meeting the conditions for organizational capacity in construction as prescribed by laws on construction;

c) Having at least three individuals holding a Professional Practice Certificate for Construction of Repair of Cultural Heritage Sites.

4. Professional Practice Certificate for Consulting Supervision of Construction of Repair of Cultural Heritage Sites:

a) Legally established;

b) Meeting the conditions for organizational capacity in consulting supervision of construction as prescribed by laws on construction;

c) Having at least two individuals holding a Professional Practice Certificate for Supervision of Construction of Repair of Cultural Heritage Sites.

Article 15. Authority to Issue, Reissue, and Revoke Professional Practice Certificates

The Director of the Department of Culture, Sports and Tourism or the Director of the Department of Culture and Sports has the authority to issue, reissue, and revoke Professional Practice Certificates for organizations engaged in the repair of cultural heritage sites located within their jurisdiction.

Article 16. Procedures and Formalities for Issuance of Professional Practice Certificates

1.^[6] An organization requesting issuance of a Professional Practice Certificate shall submit directly or send through postal service or via electronic means one set of application files to the person authorized under Article 15 of this Decree. The application file includes:

a) Application form according to Model No. 08 attached to this Decree;

b) A list of individuals holding the Professional Practice Certificate as stipulated in point c Clause 1, point c Clause 2, point c Clause 3, and point c Clause 4 of Article 14 of this Decree, accompanied by copies of the Professional Practice Certificates.

2. Within five working days from the date of receipt of the application file as prescribed, the Director of the Department of Culture, Sports and Tourism or the Director of the Department of Culture and Sports shall be responsible for reviewing and requesting additional information if the file is incomplete or not in compliance.

3. Within ten working days from the date of receipt of complete and valid application files, the Director of the Department of Culture, Sports and Tourism or the Director of the Department of Culture and Sports shall be responsible for examining and deciding to issue the Professional Practice Certificate according to Model No. 09 attached to this Decree, and simultaneously report to the Minister of Culture, Sports and Tourism. In case of refusal, a written response must be given stating the reasons.

4. The Professional Practice Certificate is valid for a period of five years.

Article 17. Reissuing the Practice Certificate

1. The Practice Certificate shall be reissued in the cases specified for reissuing the Practice License as provided in Clause 1, Article 12 of this Decree.

2. Procedures and formalities for reissuing the Practice Certificate:

a) An organization shall submit directly, send through postal service, or transmit via electronic means^[7] one set of documents to the competent authority as stipulated in Article 15 of this Decree. The documents include:

- Application form according to Form No. 07 attached to this Decree;

- The original Practice Certificate that has been issued for the case of supplementing practice content or when the Practice Certificate has expired or become damaged;

In the case of supplementing practice content already recorded in the previously issued Practice Certificate, the applicant must attach copies as prescribed in Points b and c, Clause 1, Article 16 of this Decree.

b) For the case of reissuing an expired or damaged Practice Certificate, within five working days from the date of receiving complete valid documents, the Director of the Department of Culture, Sports and Tourism or the Director of the Department of Culture and Sports shall examine and decide on reissuing the Practice Certificate, while reporting to the Minister of Culture, Sports and Tourism. If the application is rejected, it must be notified in writing with specific reasons stated.

c) For the case of reissuing a lost Practice Certificate or supplementing practice content, the issuance period shall be carried out according to the provisions applicable to new issuance.

3. The content and validity period of the reissued Practice Certificate shall be recorded as prescribed for the Practice License as provided in Clause 3, Article 12 of this Decree.

Article 18. Revocation of the Practice Certificate

The revocation of the Practice Certificate shall be carried out in accordance with the provisions regarding the revocation of the Practice License as stipulated in Article 13 of this Decree.

Chapter IV. IMPLEMENTING PROVISIONS ^[8]

Article 19. Transitional Provisions

The Business Condition Certificate for Antique Appraisal, the Practice License, and the Practice Certificate issued by competent state authorities before the effective date of this Decree shall continue to be used until their expiration.

Article 20. Effective Date

This Decree takes effect from July 1, 2016.

Article 21. Responsibility for Implementation

1. The Minister of Culture, Sports and Tourism shall guide and implement this Decree.

2. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, and Chairpersons of provincial People's Committees within their respective duties and powers shall be responsible for implementing this Decree.
