JOINT CIRCULAR

Guidelines on functions, tasks, powers, and organizational structure for work with invalids, martyrs, and those who have rendered meritorious service under local labor, invalids, and social affairs authorities 烈士和由当地劳动-伤残军人和社会事务机关管理的有功人员 

Implementing Article 4 of Decision No. 727/TTg dated September 4, 1997 of the Government Prime Minister, the Ministry of Labor - Invalids and Social Affairs and the Government Organizational and Cadre Department issue guidelines on the functions, tasks, powers, and organizational structure for work with invalids, martyrs, and those who have rendered meritorious service under local labor, invalids, and social affairs authorities at all levels as follows:

 I. GENERAL PROVISIONS:

1. The People's Committee of provinces and centrally governed cities (collectively referred to as provinces) shall establish specialized organizations responsible for work with invalids, martyrs, and those who have rendered meritorious service under the Labor - Invalids and Social Affairs sector based on the current Veterans' Policy Office or Social Welfare Office to perform state management functions and organize the implementation of activities in the field of invalids, martyrs, and those who have rendered meritorious service according to the regulations of the State and the guidance of the Ministry of Labor - Invalids and Social Affairs.

2. The specialized organization responsible for work with invalids, martyrs, and those who have rendered meritorious service at the provincial level is the Veterans' Martyrs and Meritorious Persons Office under the Provincial Labor - Invalids and Social Affairs Department.

3. The tasks of work with invalids, martyrs, and those who have rendered meritorious service at the district, urban district, town level (collectively referred to as district level) are undertaken by the Labor - Invalids and Social Affairs Office or the Organizational Labor - Invalids and Social Affairs Office at the district level without having a separate specialized organization.

4. The tasks of work with invalids, martyrs, and those who have rendered meritorious service at the commune, ward, town level (collectively referred to as commune level) are undertaken by the Commune People's Committee.

5. The number of staff positions in the specialized organization responsible for work with invalids, martyrs, and those who have rendered meritorious service is determined by the Provincial People's Committee within the total number of staff positions of the province, based on the volume of work assigned, funding sources, the number of beneficiaries, and administrative area.

II. TASKS, POWERS, AND STAFF ORGANIZATION FOR WORK WITH INVALIDS, MARTYRS, AND THOSE WHO HAVE RENDERED MERITORIOUS SERVICE IN LOCALITIES:

1. Tasks and powers of the Veterans' Martyrs and Meritorious Persons Office under the Provincial Labor - Invalids and Social Affairs Department.

a. Tasks and powers:

Develop long-term and annual programs and plans in the field of invalids, martyrs, and those who have rendered meritorious service under the responsibility of the Provincial Labor - Invalids and Social Affairs Department to be submitted to the Provincial People's Committee for approval, organize their implementation, and guide and inspect the execution of these programs and plans.

Assist the Director of the Department in guiding, inspecting, and reviewing procedures for confirming beneficiaries of preferential policies; organize their implementation and coordinate with relevant competent authorities to implement quotas, standards, and systems for beneficiaries.

Organize the storage of files, lists, statistics, consolidation, and adjustment of benefits for invalids, martyrs, and those who have rendered meritorious service according to regulations; implement regular and annual reporting; guide and inspect the compilation of beneficiary lists at the district and commune levels.

Prepare plans for allocating funds within the field of invalids, martyrs, and those who have rendered meritorious service to be submitted to the Director of the Department, and participate in settling accounts for these funds at the local level according to current regulations.

Monitor and inspect the implementation of preferential benefit payments and the use of funds for this field at the local level.

Respond to collective and individual complaints regarding the implementation of policies and systems in the field of invalids, martyrs, and those who have rendered meritorious service within their authority.

Compile lists and memorial diagrams at martyrs' cemeteries; guide the construction, repair, upgrading of martyrs' graves, martyrs' cemeteries, monuments, memorials, and name plaques; assign and monitor the management of these facilities; provide information about graves; organize and guide visits to graves and martyrs' cemeteries.

Coordinate with relevant agencies to conduct surveys and search for the remains of martyrs.

Monitor and inspect the implementation of policies and systems for invalids, war invalids, relatives of martyrs, and those who have rendered meritorious service at local care, rehabilitation, treatment, and functional recovery facilities; assist the Director of the Department in coordinating with sectors and mass organizations in propaganda, mobilization, and building movements to care for invalids, families of martyrs, and those who have rendered meritorious service at the local level.

Assist the Director of the Department in summarizing, concluding, and drawing lessons from the implementation of policies for invalids, martyrs, and those who have rendered meritorious service; organize guidance and coordination in implementing training programs to improve professional expertise for cadres and civil servants engaged in this work at the local level.

b. Staff organization:

The Veterans' Martyrs and Meritorious Persons Office under the Provincial Labor - Invalids and Social Affairs Department has one Director and one to two Deputy Directors.

Based on the tasks stipulated in Point 5, Section I above, the Provincial Labor - Invalids and Social Affairs Department will allocate personnel to the Veterans' Martyrs and Meritorious Persons Office. The staffing of the office is included in the overall staffing of the Provincial Labor - Invalids and Social Affairs Department.

2. Tasks and powers concerning work with invalids, martyrs, and those who have rendered meritorious service of the Labor - Invalids and Social Affairs Office or the Organizational Labor - Invalids and Social Affairs Office at the district level.

a. Tasks and powers:

Develop long-term, annual, quarterly, and monthly programs and plans for work with invalids, martyrs, and those who have rendered meritorious service according to the guidance of the Provincial Labor - Invalids and Social Affairs Department and the directives of the District People's Committee; organize the implementation of approved programs and plans.

Guide, inspect, and review files and procedures for confirming beneficiaries of preferential policies to be submitted to the competent authority for decision.

Compile and manage lists of beneficiaries, conduct statistics, consolidate, adjust benefits for beneficiaries, implement regular reporting systems, and guide the compilation of beneficiary lists at the commune level.

Organize the disbursement of preferential benefits and funds for the disabled veterans,烈士和有功人员领域的工作经费;按照国家现行财政制度的规定进行结算。

Respond to and resolve complaints from organizations and individuals regarding policies and benefits for disabled veterans,烈士和有功人员;根据权限处理。

Compile lists of martyrs' graves, memorial diagrams at martyrs' cemeteries, guide the construction, repair, and upgrading of martyrs' graves, martyrs' cemeteries, monuments, and name plaques for martyrs, guide the management and maintenance of these commemorative works at the county level; report information and organize visits to martyrs' graves and cemeteries according to the guidance of the Department of Labor, Invalids, and Social Affairs.

Coordinate with relevant agencies within the county to conduct surveys and search for the remains of martyrs. Assist the County People's Committee in coordinating with departments and mass organizations to carry out propaganda, competitions, and the establishment of models and movements to care for disabled veterans, families of martyrs, and people with contributions in the county.

Conduct mid-term and final reviews, draw lessons learned in the field of disabled veterans,烈士和有功人员;train staff at the commune level according to the guidance of the Department of Labor, Invalids, and Social Affairs and the directives of the County People's Committee.

b. Organizational staffing:

The number of dedicated staff members responsible for work related to disabled veterans,烈士和有功人员 in the Department of Labor, Invalids, and Social Affairs or the Personnel Organization Department must ensure the completion of assigned tasks.

3. The tasks of implementing policies for disabled veterans,烈士和有功人员 at the commune level shall be stipulated by the County People's Committee and guided by the Department of Labor, Invalids, and Social Affairs.

III. IMPLEMENTATION

1. The Director of the Department of Labor, Invalids, and Social Affairs, together with the Head of the Civil Service Organization Committee, shall promptly submit to the Chairman of the Provincial People's Committee on the organization and staffing for work related to disabled veterans,烈士和有功人员 at the local level as prescribed in this Circular.

2. The Director of the Department of Labor, Invalids, and Social Affairs needs to review the functions and responsibilities of the Disabled Veterans Office under the Department to supplement and improve them to ensure the completion of assigned tasks and the implementation of policies in a normal and continuous manner, especially the payment of preferential allowances to people with contributions.

The reorganization and staffing for work related to disabled veterans,烈士和有功人员 at all levels must be completed before January 31, 1998, and a report submitted to the Joint Ministry. During the implementation of this Circular, if there are difficulties, they should be reported to the Joint Ministry for consideration and resolution..
