Pursuant to Decree No. 15/CP dated March 2, 1993 of the Government on the tasks, powers, and responsibilities for management of ministries and ministerial-level agencies;
Pursuant to the Prime Minister's Decision No. 853/1997/CT-TTg dated October 11, 1997 on combating smuggling under new circumstances;
Pursuant to Decree No. 04/1999/NĐ-CP dated January 30, 1999 of the Government on fees and charges under the State budget;
Pursuant to Article 13, Article 14 of the Regulations on the organizational system, specialized inspection, dispute resolution, and fees and charges for plant protection and quarantine work issued together with Decree No. 92/CP dated November 27, 1993 of the Government guiding the implementation of the Ordinance on Plant Protection and Quarantine;
After reaching consensus with the Ministry of Agriculture and Rural Development and upon the proposal of the Director General of the General Department of Taxation,
DECISION:
Article 1.- Issuing this Decision the Table of Fees and Charges for Plant Protection and Quarantine.
Fees and charges for plant protection and quarantine shall be collected in Vietnamese Dong. In cases where the prescribed rates are denominated in US Dollars (USD), they shall be converted to Vietnamese Dong at the exchange rate published by the State Bank of Vietnam at the time of collection; If foreign organizations or individuals wish to pay fees and charges in foreign currency, they may pay in USD according to the prescribed rates.
Article 2.- The entities subject to the payment of fees and charges for plant protection and quarantine as stipulated in Article 1 of this Decision are organizations and individuals authorized by competent state agencies to carry out plant protection and quarantine activities in accordance with the law, except for the following cases that are exempt from paying such fees and charges:
1. Quarantine of personal items containing plant products for use during travel.
2. Quarantine of floral bouquets and wreaths for diplomatic ceremonies when entering or leaving the country.
3. Quarantine of small consignments of plant seeds for research and scientific and technical exchanges (not for commercial purposes) as decided by the Minister of Agriculture and Rural Development.
For the service of controlling harmful organisms in plant resources at cooperatives under the Law on Cooperatives, separate regulations will apply.
Article 3.- The agencies collecting fees and charges for plant protection and quarantine are entitled to retain a portion of the collected fees and charges before remitting them to the State Budget to support plant protection and quarantine activities and the organization of fee and charge collection, based on the approved budget, after obtaining written agreement from the same-level financial authority; however, the maximum retention rate shall not exceed 80% (eighty percent) of the collected fees and charges; the remaining amount (at least 20%) must be remitted to the state budget.
The agencies collecting fees and charges for plant protection and quarantine are responsible for organizing the collection, declaration, payment, management, and settlement of fees and charges for plant protection and quarantine in accordance with the provisions of Circular No. 54/1999/TT-BTC dated May 10, 1999 of the Ministry of Finance guiding the implementation of Decree No. 04/1999/NĐ-CP dated January 30, 1999 of the Government on fees and charges within the State Budget.
Article 4.- This Decision takes effect 15 days after its date of signature. All provisions regarding fees and charges for plant protection and quarantine that conflict with this Decision are hereby abolished.
Article 5.- Organizations and individuals subject to the payment of fees and charges for plant protection and quarantine, units assigned the task of organizing the collection of such fees and charges, and related agencies are responsible for implementing this Decision.

- Costs for traveling to sampling sites and inspecting objects subject to KDTV shall be added to the inspection fee according to actual reasonable expenses.
- Fees shall be collected based on the analysis and identification criteria applied.
- Planting, monitoring, and quarantine inspection of imported plant varieties in nurseries for one variety according to actual costs.
c- Consignments weighing more than 500 (tons, m3)3are divided into lots according to ship holds or warehouses for quarantine inspection and charging KDTV fees, or additional KDTV fees for the remaining part (document fees remain unchanged for the entire consignment) with the KDTV fees of the 500 (tons, m3) lot.3).
d- Foreign organizations and individuals, and overseas Vietnamese residents (excluding foreign-invested enterprises in Vietnam) shall pay an additional 100% of the collection rates under this annex.
e- The supervision fee for the inspection and treatment of objects subject to plant quarantine shall be calculated at 30% of the collection rates under this annex.
