DECISION OF THE PRIME MINISTER
On advisory, critical review, and social appraisal activities of the Vietnam Association for Science and Technology Associations
THE PRIME MINISTER
Pursuant to the Government Organization Law dated December 25, 1992;
Pursuant to the Law on Science and Technology dated June 9, 2000;
Pursuant to Directive No. 14/2000/CT-TTg dated August 1, 2000 of the Prime Minister on implementing measures to enhance and improve the effectiveness of the activities of the Vietnam Association for Science and Technology Associations;
To promote the role, responsibility, and utilize the intellectual potential and contributions of the Vietnam Association for Science and Technology Associations (hereinafter referred to as the Association) in providing advisory, critical review, and social appraisal services for socio-economic development projects of the State in fields related to the Association's activities;
Considering the proposal of the Ministry of The Minister of Planning and Investment,
DECISION:
Article 1. General Provisions.
1. The subjects implementing the advisory, critical review, and social appraisal tasks under this Decision are the Association and its member associations (central sector science and technology associations and provincial-level science and technology associations).
2. The entities requesting advisory, critical review, and social appraisal services from the Association and its member associations are Ministries, ministerial-level agencies, government agencies, and People's Committees of provinces and centrally-administered cities (hereinafter collectively referred to as agencies).
3. The objects of advisory, critical review, and social appraisal are policies, programs, projects, and plans concerning socio-economic development, education and training, science, technology, and the environment (collectively referred to as plans) that are complex, prioritized, key, or multi-sectoral, developed, implemented, or submitted for approval by agencies.
4. The purpose of the Association and its member associations' advisory, critical review, and social appraisal activities is to provide agencies requesting such services with additional scientific bases and independent, objective arguments in proposing, developing, reviewing, approving, or implementing plans.
5. The nature of the Association and its member associations' advisory, critical review, and social appraisal activities is non-profit, not professional activity, and reflects the responsibility of the scientific and technological intellectuals participating in contributing their expertise to state activities.
6. Advisory is an activity assisting with knowledge, experience, providing information, references, analyses, evaluations, and recommendations in proposing, developing, or reviewing and approving plans.
7. Critical review is an activity providing information, references, analyses, evaluations of feasibility, and recommendations regarding the suitability of plan contents with objectives and initial constraints or current conditions.
8. Social appraisal is an activity monitoring the implementation of plans, promptly providing analyses, evaluations, and recommendations on organizational implementation, objectives, contents, or quality of plans..
Article 2. Implementation forms. The Association and its member associations' advisory, critical review, and social appraisal activities are carried out in the following forms:
1. Agencies request advisory, critical review, or social appraisal services from the Association or its member associations for plans within their approval authority or those submitted for higher-level approval.
2. The Association and its member associations proactively propose advisory, critical review, and social appraisal tasks for plans of interest, organize implementation, and submit recommendations to relevant agencies and authorities for consideration.
Article 3. Responsibilities of agencies requesting advisory, critical review, and social appraisal services:
1. Proactively request advisory, critical review, or social appraisal services from the Association and its member associations for plans as specified in Clause 3, Article 1..
2. Provide timely and complete necessary information and materials, ensure favorable conditions regarding funding and use of facilities (if agreed upon) for the Association or its member associations to carry out requested tasks.
3. Handle all recommendations in advisory, critical review, or social appraisal documents of the Association and its member associations. These documents are compiled into project files submitted for approval by competent authorities.
Article 4. Responsibilities of the Association and its member associations:
1. Implement appropriate organizational measures to gather leading experts and excellent specialists from member associations and related organizations to perform advisory, critical review, and social appraisal tasks for requested plans with high quality. 2. Ensure requirements for content, progress, independence, objectivity, and truthfulness of advisory, critical review, and social appraisal report contents.
3. Bear legal responsibility for advisory, critical review, and social appraisal contents and recommendations proposed.
4. Manage, keep confidential (if required), and secure technical means (if assigned to use) of project files provided, and return them after completing requested tasks.
Financial regulations.
Article 5. Cơ The principle for determining funds for the Association and its member associations' advisory, critical review, and social appraisal activities is non-profit. The Ministry of Finance shall issue guidelines to implement this principle.
This Decision takes effect 15 days after the date of signing. The Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of People's Committees of provinces and centrally-administered cities are responsible for enforcing this Decision, and the Central Committee of the Vietnam Association for Science and Technology Associations shall coordinate in its implementation./.
Article 6. This Decision shall take effect fifteen days after the date of signature.
Article 7. MinistriesThe Heads of Ministries, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of People's Committees of provinces and centrally governed cities shall be responsible for implementing this Decision, and the Chairman of the Central Committee of the Vietnam Association for Science and Technology shall cooperate in its implementation./.
