REGARDING THE ASSIGNMENT OF TASKS TO RESOLVE OBSTACLES AND PETITIONS FROM INDIVIDUALS, ORGANIZATIONS, AND ENTERPRISES CONCERNING ADMINISTRATIVE PROCEDURES

PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to Resolution No. 38-CP dated May 4, 1994 of the Government on the reform of administrative procedures in handling citizens' and organizations' affairs;
Pursuant to Decree No. 18/2003/NĐ-CP dated February 20, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Government Office;
Based on the implementation of Decision No. 23/2005/QĐ-TTg dated January 26, 2005 of the Prime Minister on the establishment of the Inter-Ministerial Working Group to resolve obstacles and petitions from enterprises concerning administrative procedures;
Considering the proposal of the Minister, Head of the Government Office,

DECISION:

Article 1. The Government Office shall assist the Prime Minister in receiving and processing obstacles and petitions from individuals, organizations, and enterprises regarding administrative procedures.

Article 2. Specific tasks and powers of the Government Office in receiving and processing obstacles and petitions from individuals, organizations, and enterprises regarding administrative procedures:

1. Receiving and processing obstacles and petitions from individuals, organizations, and enterprises regarding administrative procedures within the jurisdiction of the Government and the Prime Minister for examination and resolution.

2. Requesting and urging ministries, ministerial-level agencies, government agencies, and provincial people's committees to promptly and properly resolve obstacles and petitions from individuals, organizations, and enterprises regarding administrative procedures within their respective jurisdictions.

3. Identifying and requesting competent state agencies to thoroughly resolve administrative procedures that have been arbitrarily added by management agencies at all levels, causing difficulties for individuals, organizations, and restricting business activities of enterprises in all economic sectors.

4. Having the authority to independently work with ministries, ministerial-level agencies, government agencies, people's committees at all levels, individuals, organizations, enterprises, and business associations when examining and resolving issues related to administrative procedures.

5. Organizing research on obstacles and petitions from individuals, organizations, and enterprises regarding administrative procedures to propose to the Government, the Prime Minister, ministries, ministerial-level agencies, government agencies, and provincial people's committees to examine and amend or abolish administrative procedures that are no longer suitable for reality and hinder business operations of enterprises and the public.

6. Periodically compiling and reporting to the Prime Minister every quarter on the situation and results of resolving obstacles and petitions from individuals, organizations, and enterprises regarding administrative procedures handled by the Government Office, ministries, ministerial-level agencies, government agencies, and provincial people's committees.

Article 3. Responsibilities of Ministers, Heads of ministerial-level agencies, Heads of government agencies, and Chairpersons of provincial people's committees in receiving and processing obstacles and petitions from individuals, organizations, and enterprises regarding administrative procedures:

1. Directly overseeing the receipt and thorough resolution of obstacles and petitions from individuals, organizations, and enterprises regarding administrative procedures within their respective jurisdictions and areas of responsibility.

2. Promptly and thoroughly resolving obstacles and petitions from individuals, organizations, and enterprises regarding administrative procedures within the prescribed time limits.

3. Strictly dealing with civil servants under their management who engage in corruption, causing difficulties, or delays in implementing administrative procedures for individuals, organizations, and enterprises.

4. Organizing research on obstacles and petitions from individuals, organizations, and enterprises regarding administrative procedures to examine and amend or abolish administrative procedures that are no longer suitable for reality and hinder business operations of enterprises and the public within their respective jurisdictions or proposing to the Government and the Prime Minister for examination and amendment or abolition.

5. Regularly reporting before the 20th day of the last month of each quarter to the Prime Minister on the situation and results of resolving obstacles and petitions from individuals, organizations, and enterprises regarding administrative procedures.

Article 4. The Standard Measurement Quality Control Department shall be responsible for organizing and guiding the implementation of the Regulations adopted herein.

Ministers, Heads of ministerial-level agencies, Heads of government agencies, and Chairpersons of provincial people's committees are responsible for enforcing this Decision.

The Government Office shall assist the Prime Minister in urging and inspecting the implementation of this Decision.
