Pursuant to Decree No. 19/2005/NĐ-CP dated February 28, 2005 of the Government stipulating conditions, procedures for establishment and operation of employment service organizations;

Pursuant to Decree No. 43/2006/NĐ-CP dated June 25, 2006 of the Government stipulating autonomy and responsibility for the implementation of tasks, organizational structure, staffing, and finance for public service units;

Considering the proposal of the Director of the Department of Labor - Vocational Training.

Article 1. Issued along with this Decision are the "Regulations on Assessing the Level of Completion of Tasks by Employment Service Centers".

Article 2. The Regulations on Assessing the Level of Completion of Tasks by Employment Service Centers are intended to evaluate and classify the ability to complete assigned tasks of Employment Service Centers, serving as a basis for assigning performance targets and staffing levels, and financial quotas for activities of Employment Service Centers.

Article 3. The Standard Measurement Quality Control Department shall be responsible for organizing and guiding the implementation of the Regulations adopted herein.

Article 4. Heads of agencies that issued decisions to establish Employment Service Centers, heads of directly managing agencies of Employment Service Centers, and Directors of Employment Service Centers are responsible for implementing this Decision.

REGULATIONS

ON THE ASSESSMENT OF THE LEVEL OF COMPLETION OF TASKS BY EMPLOYMENT SERVICE CENTERS

(Attached to Decision No. 22/2007/QĐ-BLĐTBXH dated September 6, 2007 of the Ministry of Labor - Invalids and Social Affairs)

I. OBJECTIVES AND REQUIREMENTS

- To serve as a basis for comments and classification of the level of completion of tasks by Employment Service Centers, ensuring uniform state management over methods of assessing the level of completion of employment service tasks, helping staff at Employment Centers to have guidance to improve operational efficiency;

- To determine the operational capacity of Employment Centers, serving as a basis for competent authorities to assign performance targets, staffing, and funding for activities of Employment Centers;

- To provide a basis for implementing reward and incentive systems for material and spiritual benefits for collective bodies of Employment Center staff, timely motivating both groups and individuals to strive to complete assigned tasks and to propose improvements to enhance operational efficiency of the center.

II. CONTENT OF ASSESSMENT

1. Basis for evaluation:

- Annual plans and tasks assigned by competent authorities to Employment Centers and actual results of their operations according to each assigned task;

- Compliance with Party policies, State laws;

- Implementation of legal provisions on employment services and regulations stipulated in Decree No. 43/2006/NĐ-CP dated April 25, 2006 of the Government regarding autonomy and responsibility for organizational structure, staffing, and finance for public service units;

- Implementation of democratic regulations at the grassroots level as stipulated in Decree No. 71/1998/NĐ-CP dated September 8, 1998 of the Government on the issuance of democratic regulations in the operation of agencies;

- Coordination and operational capacity of Party organizations and mass organizations within Employment Centers;

- Competence and moral character of Employment Center staff;

- Recognized initiatives, improvements, proposals, and application of scientific and technological advancements to enhance operational efficiency of Employment Centers.

2. Assessment criteria:

a) Quantity criteria:

- Number of people receiving counseling (including individual and group counseling);

- Number of people placed in jobs, supplied, and recruited by Employment Centers based on employers' requirements;

- Number of times market labor information is collected and provided by Employment Centers.

b) Quality criteria:

- Ratio of counseling sessions conducted in accordance with legal provisions out of total counseling sessions;

- Ratio of job placements, labor supply, and recruitment resulting in stable employment (for at least 12 months or until the end of a fixed-term contract);

- Ratio of accurate and timely collection/provision of market labor information out of total collection/provision of market labor information.

c) Other criteria.

III. METHODS OF ASSESSMENT

1. Scoring assessment criteria:

a) Counseling activities:

- In terms of quantity:

+ Exceeding 120% of the plan: 10 points

+ Exceeding 115% but not exceeding 120% of the plan: 9 points

+ Exceeding 110% but not exceeding 115% of the plan: 8 points

+ Exceeding 105% but not exceeding 110% of the plan: 7 points

+ Exceeding 101% but not exceeding 105% of the plan: 6 points

+ Meeting 100% of the plan: 5 points

In cases where Employment Centers fail to meet 100% of the plan, 1 point will be deducted for every 5% shortfall from the plan.

- In terms of quality: 1 point will be deducted for every 5% of counseling sessions that do not comply with legal provisions.

b) Job placement and labor supply activities:

- In terms of quantity:

+ Exceeding 120% of the plan: 10 points

+ Exceeding 115% but not exceeding 120% of the plan: 9 points

+ Exceeding 110% but not exceeding 115% of the plan: 8 points

+ Exceeding 105% but not exceeding 110% of the plan: 7 points

+ Exceeding 101% but not exceeding 105% of the plan: 6 points

+ Meeting 100% of the plan: 5 points

In cases where Employment Centers fail to meet 100% of the plan, 1 point will be deducted for every 5% shortfall from the plan.

In terms of quality: 1 point will be deducted for every 5% of job placements, labor supply, and recruitment that do not result in stable employment.

c) Activities related to collecting and providing market labor information:

- In terms of quantity:

+ Exceeding 120% of the plan: 10 points

+ Exceeding 115% but not exceeding 120% of the plan: 9 points

+ Exceeding 110% but not exceeding 115% of the plan: 8 points

+ Exceeding 105% but not exceeding 110% of the plan: 7 points

+ Exceeding 101% but not exceeding 105% of the plan: 6 points

+ Meeting 100% of the plan: 5 points

In cases where Employment Centers fail to meet 100% of the plan, 1 point will be deducted for every 5% shortfall from the plan.

- In terms of quality:

1 point will be deducted for every 5% of market labor information collected or provided that is inaccurate or untimely.

d) Other criteria:

- Serving as a model in complying with Party policies, State laws;

- Internal unity, consistent struggle against corruption, close cooperation between Party organizations, administrative bodies, and mass organizations within Employment Centers, good working relationships with relevant units. Employment Center staff have good moral character, with no personnel being disciplined at or above the warning level;

- Proper implementation of regulations stipulated in Decree No. 19/2005/NĐ-CP dated February 28, 2005 of the Government on conditions and procedures for establishing and operating employment service organizations and guiding documents; Decree No. 43/2006/NĐ-CP dated April 25, 2006 of the Government on autonomy and responsibility for task implementation, organizational structure, staffing, and finance for public service units and guiding documents.

- Achieve a level of task completion or above in training and vocational education activities, as stipulated by laws on vocational education for centers that organize such activities, and other tasks assigned by the center's management agency, as assessed by the direct managing agency of the center;

The level of customer satisfaction with services provided by the center (through feedback numbers and customer surveys organized by the center), without causing complaints or accusations regarding the center’s services;

- Comply with legal regulations on recruitment, employment of officials, civil servants, workers, labor systems, wages, and social insurance for workers;

- Effectively implement democratic regulations at the workplace;

- Have vibrant and continuous scientific and technological progress movements with various rich and practical forms;

2. Method of calculating points:

The direct managing agency of the center calculates the total score of the center by scoring each criterion of advisory activities (with a coefficient of 3), job placement and labor supply (with a coefficient of 4), and labor market information (with a coefficient of 3). The calculation formula is as follows:

D = Advisory Points x 3 + Job Placement & Labor Supply Points x 4 + Labor Market Information Points x 3

3. Levels of task completion assessment for the center:

There are four levels of task completion assessment for the center, including: Excellent task completion, good task completion, satisfactory task completion, and unsatisfactory task completion;

a) The center achieves excellent task completion when it meets the following criteria:

Meets all requirements stated in Section d, Point 1 of this Regulation;

Has a total evaluation score of 90 points or higher. No component score should be below 5. If there is a component score below 5, the ranking will be reduced by one level;

- Has innovative ideas, improvements, or proposals recognized and rated well by the Science Council and the main management agency;

b) The center achieves good task completion when it meets the following criteria:

Meets all requirements stated in Section d, Point 1 of this Regulation;

- Has a total evaluation score from 70 to less than 90 points. No component score should be below 5. If there is a component score below 5, the ranking will be reduced by one level;

c) The center achieves satisfactory task completion when it meets the following criteria:

- Meets all requirements stated in Section d, Point 1 of this Regulation;

Has a total evaluation score from 50 to less than 70 points. No component score should be below 5. If there is a component score below 5, the ranking will be reduced to unsatisfactory task completion;

d) The center does not achieve task completion when it fails to meet any of the criteria stated in Section d, Point 1 or has a total evaluation score below 50 points;

IV. IMPLEMENTATION

1. At the beginning of each planning year, the Center's Board of Directors registers with the direct managing agency about the level of task completion the center aims to achieve during the year, along with measures to reach the registered level of task completion;

2. Annually, the direct managing agency of the center organizes reviews and evaluates the level of task completion of the center. Reviews and evaluations are conducted based on fair, transparent, democratic, accurate, and timely principles, assessing the effectiveness of the collective work and officials of the center, considering both quantity and quality aspects. The review and evaluation process must be completed no later than October 31 of the year following the planning year;

3. The direct managing agency of the center is responsible for reporting the results of the review and evaluation to the agency issuing the decision to establish the center no later than February 15 of the year following the planning year for consolidation. Based on specific conditions and circumstances of the unit, propose or recommend to competent authorities appropriate reward levels for different degrees of task completion and penalties for centers that fail to complete their tasks, aiming to motivate and encourage officials and the center's collective to actively engage in work and study, striving for high efficiency and quality in the center's operations;

4. Centers that achieve excellent and good task completion are eligible for consideration for commendation and award titles within the industry and agency. Procedures for reviewing commendation and award titles follow legal regulations on commendation and awards and the industry and agency's commendation and award regulations;

5. No later than February 25 each year, the agency issuing the decision to establish the center compiles and reports the results of the task completion assessment of centers under its management to the Ministry of Labor, Invalids, and Social Affairs.
