THE MINISTER OF HEALTH

  Pursuant to Decree No. 188/2007/NĐ-CP dated December 27, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Health;

  Pursuant to Decree No. 179/2004/NĐ-CP dated October 21, 2004 of the Government stipulating state management over product quality;

  Pursuant to Decision No. 140/2007/QĐ-TTg dated August 24, 2007 of the Prime Minister promulgating the operational regulations of Mo Cay Border Economic Zone, Tay Ninh Province;

  Pursuant to Decision No. 236/QĐ-TTg dated February 26, 2008 of the Prime Minister on the establishment and definition of the functions of the Management Board of Mo Cay Border Economic Zone, Tay Ninh Province;

  Considering the proposal of the People's Committee of Tay Ninh Province at Document No. 1956/UBND-KTTH dated May 19, 2008 regarding the delegation of cosmetic inspection functions within the Industrial Trade Zone of Mo Cay Border Economic Zone, Tay Ninh Province;

  Considering the proposal of the Director of the Drug Administration Department,

DECISION:

Article 1. The Ministry of Health delegates to the Management Board of Mo Cay Border Economic Zone, Tay Ninh Province the function of managing cosmetics within the Industrial Trade Zone of Mo Cay Border Economic Zone, Tay Ninh Province.

Article 2. The Management Board of Mo Cay Border Economic Zone, Tay Ninh Province shall coordinate with the Department of Health of Tay Ninh Province to organize guidance, inspection, and supervision of cosmetic business activities within the Industrial Trade Zone of Mo Cay Border Economic Zone, Tay Ninh Province.

The Management Board of Mo Cay Border Economic Zone, Tay Ninh Province shall be responsible for coordinating with provincial authorities and relevant agencies in effectively implementing anti-smuggling measures, combating the sale of smuggled goods, and illegal trade in cosmetics related to the operations of Mo Cay Border Economic Zone, Tay Ninh Province.

Article 3. Organizations and individuals engaged in cosmetic business within the Industrial Trade Zone of Mo Cay Border Economic Zone, Tay Ninh Province must declare their cosmetic quality standards to the Management Board of Mo Cay Border Economic Zone, Tay Ninh Province and commit to full responsibility for the quality of cosmetics they sell.

Article 4. The introduction of cosmetics from the Industrial Trade Zone of Mo Cay Border Economic Zone, Tay Ninh Province into other functional zones within Mo Cay Border Economic Zone, Tay Ninh Province and the domestic market for business purposes must comply with the Cosmetic Management Regulations issued together with Decision No. 48/2007/QĐ-BYT dated December 31, 2007 of the Minister of Health and other relevant legal documents.

Article 5. The Standard Measurement Quality Control Department shall be responsible for organizing and guiding the implementation of the Regulations adopted herein.

Article 6. The Heads of the Ministry of Health’s Office, the Inspectorate of the Ministry of Health, the Director of the Drug Administration Department, the Directors of the Health Departments of Tay Ninh Province, and the Head of the Management Board of Mo Cay Border Economic Zone, Tay Ninh Province are responsible for enforcing this Decision./.
