Decision No. 48/2007/QĐ-BYT of the Minister of Health on issuing the Regulation on Cosmetic Management, replacing and abolishing some old regulations. This regulation applies to cosmetic manufacturing and trading enterprises and state management agencies.

THE MINISTER OF HEALTH
Pursuant to Decree No. 49/2003/NĐ-CP dated May 15, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Health;
Pursuant to Ordinance No. 18/1999/PL-UBTVQH10 dated December 24, 1999 of the Standing Committee of the National Assembly on Product Quality;
Pursuant to Decree No. 179/2004/NĐ-CP dated October 21, 2004 of the Government on State Management of Product Quality;
Pursuant to Decree No. 89/2006/NĐ-CP dated August 30, 2006 of the Government on Product Labeling;
Pursuant to Decree No. 24/2003/NĐ-CP dated March 13, 2003 of the Government detailing the implementation of the Advertising Ordinance;
On the basis of Decree No. 12/2006/NĐ-CP dated January 23, 2006 of the Government detailing the implementation of the Law on Trade regarding international trade activities and agency purchase, sale, processing, and transit of goods with foreign countries;
Pursuant to the ASEAN Harmonization System Agreement on Cosmetic Management dated September 2, 2003;
On the proposal of the Director of the Vietnam Drug Administration Bureau,
DECISION:
Article 1. The attached Decision issues the "Regulations on Cosmetic Management".
Article 2. This Decision takes effect fifteen days from the date of publication in the Official Gazette and revokes Decision No. 35/2006/QĐ-BYT dated November 10, 2006 of the Minister of Health on the issuance of "Regulations on Cosmetic Management", Decision No. 13/2007/QĐ-BYT dated January 30, 2007 of the Minister of Health amending Article 2 of Decision No. 35/2006/QĐ-BYT dated November 10, 2006 of the Minister of Health on the issuance of "Regulations on Cosmetic Management" and Decision No. 3113/1999/QĐ-BYT dated October 11, 1999 of the Minister of Health on the issuance of bacterial and fungal limit standards and skin irritation testing methods.
This Decision supersedes provisions on cosmetic information and advertising directly affecting human health issued together with Decision No. 2557/2002/QĐ-BYT dated July 4, 2002 of the Minister of Health on the issuance of "Regulations on Information and Advertising for Drugs Used by Humans and Cosmetics Directly Affecting Human Health"; provisions on labeling of cosmetics directly affecting human health issued together with Circular No. 14/2001/TT-BYT dated June 26, 2001 of the Ministry of Health guiding the labeling of drugs and cosmetics directly affecting human health; and provisions on the export and import of cosmetics issued together with Circular No. 06/2006/TT-BYT dated May 16, 2006 of the Ministry of Health guiding the export and import of drugs and cosmetics.
Article 3. The Heads of the Office, Inspectorate General of the Ministry of Health, Director of the Vietnam Drug Administration Bureau, heads of units under the Ministry, directors of provincial and centrally-administered city health departments, and heads of sectoral health units are responsible for implementing this Decision./.
