CIRCULAR

REGULATIONS ON PROCEDURES AND FORMALITIES FOR EVALUATION AND RECOGNITION OF COMMUNES AND WARD SUITABLE FOR CHILDREN

Pursuant to Decree No. 186/2007/ND-CP dated December 25, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor, Invalids and Social Affairs;
Pursuant to Decision No. 37/2010/QD-TTg dated April 22, 2010 of the Prime Minister promulgating the criteria for communes and wards suitable for children;
The Ministry of Labor, Invalids and Social Affairs hereby stipulates the procedures and formalities for evaluation and recognition of communes and wards suitable for children as follows:

PART I
GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

Article 1. This Circular stipulates the procedures and formalities for evaluation and recognition of communes and wards suitable for children.

b) Agencies, organizations, and individuals related to the procedures and formalities for evaluation and recognition of communes and wards suitable for children.

The organization of evaluation and recognition of communes and wards suitable for children must ensure the following principles:

Article 2. Implementation Principles

Article 2. 1. It must ensure transparency, fairness, democracy, and compliance with regulations.

2. The People's Committee of communes and wards shall organize the evaluation, the People's Committee of districts, counties, provincial cities, centrally governed cities (hereinafter referred to as district level) shall review and recognize, and this shall be conducted once a year.

3. There must be participation from relevant departments and local mass organizations.

Article 3. Certificate of Recognition of Communes and Wards Suitable for Children

The Certificate of Recognition of Communes and Wards Suitable for Children shall be uniformly used nationwide (Model No. 3 - A4 landscape size: width 29.7 cm, height 21 cm).

PROCEDURES AND FORMALITIES FOR EVALUATION AND RECOGNITION OF COMMUNES AND WARDS SUITABLE FOR CHILDREN

Chapter II
Article 4. Procedures for Evaluation and Recognition of Communes and Wards Suitable for Children

1. At the commune and ward level

1.1. To evaluate communes and wards suitable for children, the Chairman of the People's Committee of communes and wards shall direct departments under their management to report on the implementation of the indicators prescribed in Article 3 of Decision No. 37/2010/QD-TTg according to the functions of each department, specifically as follows:

- The Civil Officer of Justice and Household Registration reports on the implementation of Indicator 2.

- The Head of the Health Station reports on the implementation of Indicators 10, 12, 13, 14, 15, and 19.

- The Principal of the Secondary School reports on the implementation of Indicators 16, 20, 21, and 22.

- The Chief of the Public Security Police Station reports on the implementation of Indicators 5, 6, 7, 8, and 9.

- Requests the Secretary of the Ho Chi Minh Communist Youth Union to report on the implementation of Indicators 23 and 25.

- Representatives of residential wards, villages, and hamlets report on the implementation of Indicators 17, 18, and 24.

- The specialized Civil Officer of Social Affairs responsible for Labor, Invalids, and Social Affairs or the staff member assigned to handle child-related work has the responsibility to:

+ Report on the implementation of Indicators 1, 3, 4, and 11 according to the functions of the Labor, Invalids, and Social Affairs sector;

+ Summarize and report on the implementation of the indicators of all sectors according to the criteria for communes and wards suitable for children.

1.2. Establish an Evaluation Council at the commune and ward level to assess the implementation of the criteria for communes and wards suitable for children as stipulated in Decision No. 37/2010/QD-TTg:

- The composition of the Evaluation Council at the commune and ward level includes:

+ The Chair of the Council is the Chairman or Vice-Chairman of the People's Committee of communes and wards;

+ The Standing Member of the Council is the specialized Civil Officer of Social Affairs responsible for Labor, Invalids, and Social Affairs or the staff member assigned to handle child-related work;

+ Members include representatives from various sectors and mass organizations at the commune and ward level: Principal of the Secondary School; Head of the Health Station; Chief of the Public Security Police Station; Civil Officer of Justice and Household Registration; Chairman of the Vietnam Fatherland Front; Secretary of the Ho Chi Minh Communist Youth Union; Chairman of the Vietnam Women's Union; Chairman of the Vietnam Farmers' Union;

In addition, depending on actual circumstances, the Chair may decide to add members representing other organizations and mass organizations.

- Tasks of the Evaluation Council at the commune and ward level:

+ Assess the implementation of the indicators as stipulated in Decision No. 37/2010/QD-TTg and determine the points achieved for each indicator;

+ Meetings of the Council must be recorded in minutes and have conclusions by the Chairman of the commune and ward on whether they meet the criteria for communes and wards suitable for children;

+ If the standard score as prescribed in Article 4 of Decision No. 37/2010/QD-TTg is reached, proceed with the formalities to request the People's Committee at the district level to consider and recognize communes and wards suitable for children. The application file is sent to the Department of Labor, Invalids, and Social Affairs at the district level.

2.1. The Department of Labor, Invalids, and Social Affairs is responsible for:

- Receiving all files submitted by the People's Committee of communes and wards.

- Reviewing the files, summarizing, reporting to the People's Committee at the district level, and proposing the establishment of a Review Council at the district level. After the Review Council at the district level evaluates and agrees to recognize communes and wards meeting the criteria for suitability for children, complete the recognition file for communes and wards suitable for children.

2.2. The People's Committee at the district level establishes a Review Council at the district level to evaluate and recognize communes and wards meeting the criteria for suitability for children.

- The composition of the Review Council at the district level includes:

+ The Chair of the Council is the Chairman or Vice-Chairman of the People's Committee at the district level;

+ The Standing Member of the Council is the Chief of the Department of Labor, Invalids, and Social Affairs;

+ Members include representatives from various sectors and mass organizations: Education and Training; Culture, Sports, and Tourism; Health; Public Security; Justice; Vietnam Fatherland Front; Ho Chi Minh Communist Youth Union; Vietnam Women's Union; Vietnam Farmers' Union.

- Tasks of the Review Council at the district level:

+ Examine the reports, assess the implementation of the indicators as stipulated in Decision No. 37/2010/QD-TTg and determine the points achieved for each indicator;

+ Review reports, assess the implementation of indicators pursuant to Decision No. 37/2010/QĐ-TTg and determine the number of points achieved for each indicator;

+ The meeting of the Council must be recorded in minutes and have a conclusion from the Chairman of the District Council on whether the commune meets the criteria for communes suitable for children;

+ If the commune meets the standard points as prescribed for communes suitable for children, a Petition shall be prepared to request the Chairman of the People's Committee at the district level to decide on recognition and award according to Decision No. 37/2010/QĐ-TTg.

Article 5. Documentation for Evaluation and Recognition of Communes Suitable for Children

1. Documentation at the Commune Level

- A letter requesting the People's Committee at the district level to recognize the commune as suitable for children.

- Minutes of the Council Meeting at the commune level regarding the evaluation of the commune as suitable for children (Model No. 1).

- Report on the assessment of the implementation of the standards for communes suitable for children (Model No. 2).

2. Documentation at the District Level

- Report on the review of the Labor, Invalids and Social Affairs Office regarding the achievement of indicators and scores of communes according to Article 3 of Decision No. 37/2010/QĐ-TTg.

- Minutes of the Council Meeting at the district level regarding the recognition of communes suitable for children.

- Petition of the Labor, Invalids and Social Affairs Office to the People's Committee at the district level to establish the Council for Review at the district level.

- Petition of the Council for Review at the district level to request the Chairman of the People's Committee at the district level to issue a decision recognizing communes suitable for children.

- Decision of the Chairman of the People's Committee at the district level recognizing and rewarding communes suitable for children, accompanied by a certificate of recognition.

Article 6. Timeframe for Evaluation and Recognition of Communes Suitable for Children

The evaluation of communes suitable for children at the commune level shall be carried out and completed with documentation before December 1st each year.

The recognition of communes suitable for children at the district level shall be carried out and completed with procedures before December 20th each year.

Article 7. Information and Reporting

1. At the district level

Before December 22nd each year, the Labor, Invalids and Social Affairs Office shall compile and report to the Department of Labor, Invalids and Social Affairs on the situation of implementing the construction of communes suitable for children.

2. At the provincial level

Before December 30th each year, the Department of Labor, Invalids and Social Affairs shall compile and report to the Ministry of Labor, Invalids and Social Affairs for compilation and reporting to the Prime Minister.

Chapter III
IMPLEMENTING PROVISIONS

Article 8. Responsibility for Implementation

People's Committees at all levels are responsible for directing the implementation of this Circular and allocating funds according to the provisions of Decision No. 37/2010/QĐ-TTg.

Article 9. Implementation Provisions

1. This Circular takes effect 45 days from the date of issuance.

2. During the implementation process, if any difficulties arise, units are requested to promptly reflect them to the Ministry of Labor, Invalids and Social Affairs for research and resolution./.
