CIRCULAR
Regulations on quality management for polyvinyl chloride insulated wires and cables with rated voltage up to and including 450/750V

Pursuant to the Law on Product Quality and Commodities dated November 21, 2007;
Pursuant to Decree No. 28/2008/NĐ-CP dated March 14, 2008, promulgated by the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology;
Pursuant to Decree No. 132/2008/NĐ-CP dated December 31, 2008 of the Government detailing implementation of certain provisions of the Product Quality Law;
Pursuant to Circular No. 21/2009/TT-BKHCN dated September 30, 2009, issued by the Minister of Science and Technology, setting national technical regulations QCVN 4:2009/BKHCN on safety for electrical and electronic equipment;
The Minister of Science and Technology hereby promulgates regulations on quality management for polyvinyl chloride insulated wires and cables with rated voltage up to and including 450/750V as follows:
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Circular stipulates quality management for polyvinyl chloride insulated wires and cables with rated voltage up to and including 450/750V (hereinafter referred to as PVC insulated wires and cables), as specified in the national technical regulation QCVN 4:2009/BKHCN on safety for electrical and electronic equipment issued together with Circular No. 21/2009/TT-BKHCN dated September 30, 2009, by the Minister of Science and Technology.
Article 2. Applicability
Article 1. This Circular applies to the following entities:
a) Organizations and individuals producing, importing, and trading in PVC insulated wires and cables;
b) Organizations designated to conduct conformity assessment for electrical and electronic equipment according to national technical regulation QCVN 4:2009/BKHCN;
c) State management agencies related to product and commodity quality.
2. This Circular does not apply to:
a) PVC insulated wires and cables already installed in electrical equipment;
b) Wires and cables insulated with materials other than PVC.
Chapter II
QUALITY MANAGEMENT FOR PVC INSULATED WIRES AND CABLES
Article 3. Quality Management Measures
1. All types of PVC insulated wires and cables must be managed in accordance with the provisions of national technical regulation QCVN 4:2009/BKHCN.
2. For PVC insulated wires and cables with conductor cross-sectional area within the range specified in the corresponding national standard in national technical regulation QCVN 4:2009/BKHCN, conformity assessment must be conducted according to national technical regulation QCVN 4:2009/BKHCN. Determination of nominal values for PVC insulated wires and cables as stipulated in this Clause for conformity assessment according to national technical regulation QCVN 4:2009/BKHCN shall be carried out in accordance with the technical document on methods for determining nominal values for polyvinyl chloride insulated wires and cables with rated voltage up to and including 450/750V, issued by the General Bureau of Standards, Metrology, and Quality Control.
3. PVC insulated wires and cables must comply with labeling requirements set forth in the corresponding national standards in national technical regulation QCVN 4:2009/BKHCN and the laws on product labeling before being put into circulation on the market.
Article 4. Conditions for PVC Insulated Wires and Cables Circulating on the Market
PVC insulated wires and cables circulating on the market must comply with product labeling requirements under the laws on product labeling; they must have been certified as compliant and marked with the compliance mark (CR) in accordance with the laws on standards and technical regulations, and laws on product and commodity quality.
Chapter III
RESPONSIBILITIES OF ORGANIZATIONS, INDIVIDUALS, AND ADMINISTRATIVE AUTHORITIES
Article 5. Responsibilities of Organizations and Individuals
1. Adherence to quality management regulations for PVC insulated wires and cables as stipulated in this Circular and relevant laws.
2. Conducting inventory and reporting on the remaining quantity of PVC insulated wires and cables in accordance with the guidance provided by the Provincial or Municipal Standardization, Metrology, and Quality Control Bureau where the organization or individual has registered their business operations. The deadline for completing the inventory and report is March 1, 2013.
3. Subject to inspection and supervision regarding product and commodity quality in accordance with the laws.
Article 6. Responsibilities of Management Authorities
1. Responsibilities of the General Bureau of Standards, Metrology, and Quality Control
a) Organizing information dissemination, publicity, and training on quality management for PVC insulated wires and cables as stipulated in this Circular.
b) Issuing technical documents on methods for determining nominal values for polyvinyl chloride insulated wires and cables with rated voltage up to and including 450/750V for conformity assessment for PVC insulated wires and cables as stipulated in Clause 2, Article 3 of this Circular.
c) Conducting inspections, audits, and handling violations of laws concerning PVC insulated wires and cables in accordance with this Circular and other current relevant regulations.
2. Responsibilities of the Provincial or Municipal Standardization, Metrology, and Quality Control Bureau
a) Accepting registration and managing declarations of conformity for PVC insulated wires and cables produced by organizations and individuals; accepting applications for quality inspection of PVC insulated wires and cables imported by organizations and individuals.
b) Guiding organizations and individuals producing, importing, and trading in PVC insulated wires and cables to conduct inventory and report on the remaining quantity of PVC insulated wires and cables as stipulated in Clause 2, Article 3 of this Circular; conducting inventory, compiling, and reporting to the Department of Science and Technology and the General Bureau of Standards, Metrology, and Quality Control by March 15, 2013.
c) Guiding organizations and individuals producing and importing to handle and submit documents to designated conformity assessment organizations for guidance on conducting conformity assessments according to national technical regulation QCVN 4:2009/BKHCN and affixing the compliance mark (CR) for PVC insulated wires and cables as stipulated in Clause 2, Article 3 of this Circular, based on the inventory quantity as stipulated in Clause 2, Article 5 of this Circular.
d) Organizing and coordinating with inspection, market management, and police authorities to inspect the quality of PVC insulated wires and cables in their jurisdiction in accordance with this Circular and other current relevant regulations.
Chapter IV
IMPLEMENTATION
Article 7. Effective Date
This Circular takes effect from February 1, 2012.
Article 8. Transitional Provisions
1. As of March 1, 2013, PVC insulated wires and cables not specifically defined in the corresponding national standards in national technical regulation QCVN 4:2009/BKHCN shall not be produced or imported.
2. From January 1, 2014, insulated wires and cables with plastic PVC sheathing whose nominal cross-sectional area of the conductor is not specifically mentioned in the corresponding national standards in the National Technical Regulation QCVN 4:2009/BKHCN shall not be circulated in the market.
Article 9. Implementation Organization
1. The Standardization, Measurement, and Quality Control Department is responsible for guiding and organizing the implementation of this Circular.
2. In cases where legal normative documents and national technical regulations referred to in this Circular are amended, supplemented, or replaced, they shall be implemented according to the new documents.
3. During implementation, if there are any difficulties, agencies, organizations, and individuals shall promptly report to the Ministry of Science and Technology for consideration and resolution.
