Amending and supplementing certain provisions of Circular No. 10/2012/TT-BNNPTNT dated February 22, 2012 of the Ministry of Agriculture and Rural Developmenton issuing the List of Plant Protection Products Permitted for Use, Restricted Use, and Prohibited Use in Vietnam On the basis of Decree No. 01/2008/NĐ-CP dated January 3, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development and Decree No. 75/2009/NĐ-CP dated September 10, 2009 of the Government amending Article 3 of Decree No. 01/2008/NĐ-CP dated January 3, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;On the basis of Circular No. 38/2010/TT-BNNPTNT dated June 28, 2010 of the Ministry of Agriculture and Rural Development on the management of plant protection products;

The Minister of Agriculture and Rural Development issues this Circular to amend and supplement certain provisions of Circular No. 10/2012/TT-BNNPTNT dated February 22, 2012 on issuing the List of Plant Protection Products Permitted for Use, Restricted Use, and Prohibited Use in Vietnam.
Pursuant to Decree No. 33/2005/NĐ-CP of the Government dated March 15, 2005 detailing and guiding the implementation of certain provisions of the Veterinary Law, and Decree No. 119/2008/NĐ-CP dated November 28, 2008 amending and supplementing certain provisions of Decree No. 33/2005/NĐ-CP;
Amending and supplementing certain contents of Circular No. 10/2012/TT-BNNPTNT dated February 22, 2012 on issuing the List of Plant Protection Products Permitted for Use, Restricted Use, and Prohibited Use in Vietnam includes:
Considering the proposal of the Director of the Plant Protection Department;
1. Amending the name of the organization applying for registration, trade name, method of recording active ingredient content, object of registration, and active ingredient content (Annex 1 attached).
Article 1. 2. Official registration: seven cases (including one insecticide, two fungicides, one herbicide, one plant growth regulator, one termite control product, one wood preservative) into the List of Plant Protection Products Permitted for Use in Vietnam (Annex 2 attached).
3. Supplementary registration: three hundred fifteen cases (including one hundred forty-three insecticides, one hundred twenty-four fungicides, thirty-one herbicides, nine plant growth regulators, five molluscicides, two termite control products, one adjuvant (spread agent)) into the List of Plant Protection Products Permitted for Use in Vietnam (Annex 3 attached).
Export and import of plant protection products under this Circular shall be carried out in accordance with Decree No. 12/2006/NĐ-CP dated January 23, 2006 of the Government detailing the implementation of the Law on Trade regarding international trade activities and agency, purchase, sale, processing, and transit of goods with foreign countries and Circular No. 88/2011/TT-BNNPTNT dated December 28, 2011 of the Ministry of Agriculture and Rural Development guiding the implementation of Decree No. 12/2006/NĐ-CP dated January 23, 2006 of the Government detailing the implementation of the Law on Trade regarding international trade activities and agency, purchase, sale, processing, and transit of goods with foreign countries in the fields of agriculture, forestry, and fisheries.
This Circular takes effect from July 20, 2012./.
Article 2. The export and import of plant protection chemicals under this Circular shall be carried out in accordance with Decree No. 12/2006/NĐ-CP dated January 23, 2006 of the Government detailing the implementation of the Law on Trade regarding international trade activities and related agency, purchase, sale, processing, and transit of goods with foreign countries, and Circular No. 88/2011/TT-BNNPTNT dated December 28, 2011 of the Ministry of Agriculture and Rural Development guiding the implementation of Decree No. 12/2006/NĐ-CP dated January 23, 2006 of the Government detailing the implementation of the Law on Trade regarding international trade activities and related agency, purchase, sale, processing, and transit of goods with foreign countries in the fields of agriculture, forestry, and fisheries.
Article 3. The Director of the Plant Protection Department, the Head of the Ministry's Office, the Heads of units under the Ministry, and related organizations and individuals are responsible for implementing this Circular.
Article 4. This Circular takes effect from July 20, 2012./.
