CIRCULAR
Regulations on the scope of exclusive postal services

Pursuant to the Law on Postal Services dated June 17, 2010;

Pursuant to Decree No. 187/2007/NĐ-CP dated December 25, 2007 stipulating the functions, tasks, powers, and organizational structure of the Ministry of Information and Communications; Decree No. 50/2011/NĐ-CP dated June 24, 2011 of the Government amending Decree No. 187/2007/NĐ-CP dated December 25, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Information and Communications;

Considering the proposal of the Director of the Postal Department;

The Minister of Information and Communications hereby promulgates regulations on the scope of exclusive postal services,

Article 1. Scope of exclusive postal services

1. The scope of exclusive postal services includes providing letter services with an address for delivery, with individual weight up to 02 kilograms (kg) at a lower rate than:

a) 8,000 Vietnamese dong per piece for domestic letter service and for letters received from abroad for transportation and delivery in Vietnam;

b) 150,000 Vietnamese dong per piece for international letter service accepted in Vietnam for transportation and delivery abroad.

2. The scope of exclusive postal services shall be gradually reduced and terminated according to the schedule set forth by

Article 2. Responsibilities for Implementation

1. Enterprises providing universal postal services:

a) Shall provide services within the scope of exclusive postal services as prescribed in Article 1 of this Circular and other relevant laws;

b) Must separately monitor and report to the Ministry of Information and Communications on the results of providing services within the scope of exclusive postal services.

2. Other enterprises providing postal services:

a) Shall not violate the provisions on the scope of exclusive postal services as stipulated in Article 1 of this Circular in any form;

b) Must ensure that the postage rates for all weight levels (including value-added tax) for letters with an address for delivery, with individual weight up to 02 kilograms (kg), provided by the enterprise must be higher than the postage rates specified in Clause 1 of Article 1 of this Circular.

3. Organizations and individuals have the responsibility to promptly notify the competent postal authority when they discover violations of the provisions on the scope of exclusive postal services.

Article 3. Effectiveness

1. This Circular takes effect from February 3, 2013.

2. Abolish Decision No. 04/2007/QĐ-BTTTT dated September 14, 2007 of the Minister of Information and Communications on exclusive services for Vietnam Post.

3. The Head of the Office, the Director of the Postal Department, the Heads of agencies and units under the Ministry of Information and Communications, the General Directors of enterprises providing universal postal services, the General Directors/Managers of enterprises providing postal services, and organizations and individuals related thereto are responsible for implementing this Circular.

4. During implementation, if there are difficulties, organizations and individuals shall promptly reflect them to the Ministry of Information and Communications for guidance or review, amendment, and supplementation./.
