JOINT CIRCULAR

Regulations on code numbers and standards for the position titles of public secondary school teacherssession number

Pursuant to the Civil Servant Law dated November 15, 2010;

Pursuant to Decree No. 29/2012/NĐ-CP dated April 12, 2012 of the Government on recruitment, utilization, and management of civil servants;

Pursuant to Decree No. 204/2004/ND-CP dated December 14, 2004 of the Government on salary system for cadres, civil servants, public officials, and armed forces; Decree No. 17/2013/ND-CP dated December 19, 2013 of the Government amending and supplementing certain articles of Decree No. 204/2004/ND-CP dated December 14, 2004 of the Government on salary system for cadres, civil servants, public officials, and armed forces;

Pursuant to Decree No. 32/2008/NĐ-CP dated March 19, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;

Pursuant to Decree No. 58/2014/ND-CP dated June 16, 2014 of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Home Affairs,

The Minister of Education and Training and the Minister of Home Affairs issue this Joint Circular regulating code numbers, standards for position titles, and appointment and classification of salaries according to position titles of public secondary school teachers.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

1. This Joint Circular regulates code numbers, standards for position titles, and appointment and classification of salaries according to position titles of public secondary school teachers in public general education schools, regular education schools, and special education schools within the national education system that have secondary education levels (hereinafter referred to collectively as public secondary schools).

2. This Joint Circular applies to public secondary school teachers in public secondary schools within the national education system.

Article 2. Code Numbers and Classification of Position Titles of Public Secondary School Teachers

The position titles of public secondary school teachers in public secondary schools within the national education system include:

1. Public Secondary School Teacher Grade I - Code Number: V.07.04.10

2. Public Secondary School Teacher Grade II - Code Number: V.07.04.11

3. Public Secondary School Teacher Grade III - Code Number: V.07.04.12

Article 3. General Standards for Professional Ethics of Public Secondary School Teachers

1. Having a sense of self-improvement in professional ethics, raising a sense of responsibility, maintaining personal integrity, honor, and reputation as a teacher; serving as a model for students;

2. Loving, treating students fairly and respecting their personalities; protecting legitimate rights and interests of students; uniting and helping colleagues.

3. Other professional ethics standards for teachers as prescribed in the Education Law and the Civil Servant Law.

Chapter II

STANDARDS FOR POSITION TITLES OF PUBLIC SECONDARY SCHOOL TEACHERS

Article 4. Public Secondary School Teacher Grade I - Code Number V.07.04.10

1. Tasks

In addition to the duties of a Secondary School Teacher Grade II, a Secondary School Teacher Grade I must perform the following duties:

a) Participating in editing, compiling, and developing training programs and materials for secondary school teachers and students;

b) Leading specific training activities, thematic seminars at the school or participating in scientific research topics and experience-sharing initiatives at the district level or higher;

c) Participating in guiding, evaluating, and reviewing colleagues' experience-sharing initiatives and applied educational science research projects at the district level or higher;

d) Participating in professional inspection and supervision work for secondary school teachers at the district level or higher;

đ) Participating in the jury of excellent teacher teaching competitions or excellent class advisor competitions or excellent team leader competitions at the district level or higher.

e) Participating in organizing and evaluating student competitions at the district level or higher.

2. Qualification requirements for education and training

a) Holding a bachelor's degree in education or a relevant field corresponding to the subject taught and having a vocational training certificate for secondary school teachers;

b) Possessing foreign language proficiency level 3 as prescribed in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014 of the Ministry of Education and Training promulgating the six-level foreign language proficiency framework for Vietnam or holding a certificate in ethnic languages for positions requiring the use of ethnic languages;

For foreign language teachers, the second foreign language proficiency must reach level 3 as prescribed in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014 of the Ministry of Education and Training promulgating the six-level foreign language proficiency framework for Vietnam;

c) Possessing basic information technology skills as prescribed in Circular No. 03/2014/TT-BTTTT dated March 11, 2014 of the Ministry of Information and Communications stipulating the standard for information technology skills;

d) Holding a training certificate for public secondary school teachers Grade I.

3. Professional Qualification Standards

a) Proactively promoting and mobilizing colleagues to implement policies, guidelines, laws of the Party and State, and regulations and requirements of the sector and locality regarding secondary education;

b) Guiding colleagues to implement secondary education plans and programs;

c) Creatively applying and evaluating the application of knowledge about education and adolescent psychology in the practical education of secondary school students by colleagues;

d) Flexibly applying knowledge about domestic and international economics, culture, and society to guide secondary school students' career choices;

đ) Actively and proactively coordinating with colleagues, parents of students, and the community to enhance the effectiveness of secondary school student education;

e) Having the ability to creatively apply and disseminate experience-sharing initiatives or applied educational science research products at the district level or higher;

g) Having the ability to guide the evaluation of secondary school students' scientific and technological products;

h) Being recognized as a grassroots labor hero or excellent teacher or excellent class advisor or excellent team leader at the district level or higher;

i) A civil servant promoted from the position title of public secondary school teacher Grade II to public secondary school teacher Grade I must have held the position title of public secondary school teacher Grade II or equivalent for at least six years, including at least one year in the position title of public secondary school teacher Grade II.

Article 5. Secondary School Teacher Grade II - Code V.07.04.11

1. Tasks

In addition to the duties of secondary school teacher grade III, secondary school teacher grade II must also perform the following duties:

a) Serve as a lecturer or demonstrate teaching at secondary school teacher training classes or trial new models and methods;

b) Guide student teachers in practical pedagogical training when assigned;

c) Chair the content of training and specialized activities within the subject department;

d) Write innovative experiences; participate in evaluating and approving innovative experiences, applied educational scientific research topics of colleagues from the school level upwards;

đ) Participate in professional inspection work for secondary school teachers from the school level upwards;

e) Participate in the examination board for excellent teacher competitions, excellent class advisors, and excellent team leaders from the school level upwards;

g) Participate in organizing and evaluating student competitions at the secondary school level from the school level upwards.

2. Qualification requirements for education and training

a) Hold a bachelor's degree in education or a relevant field corresponding to the subject taught and have a secondary school teacher vocational training certificate;

b) Have a foreign language proficiency level of level 2 as stipulated in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014, issued by the Ministry of Education and Training on the six-level foreign language proficiency framework for Vietnam, or have a certificate in ethnic languages for positions requiring the use of ethnic languages;

For foreign language teachers, the second foreign language proficiency level must reach level 2 as stipulated in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014, issued by the Ministry of Education and Training on the six-level foreign language proficiency framework for Vietnam;

c) Possessing basic information technology skills as prescribed in Circular No. 03/2014/TT-BTTTT dated March 11, 2014 of the Ministry of Information and Communications stipulating the standard for information technology skills;

d) Hold a secondary school teacher grade II vocational training certificate.

3. Professional Qualification Standards

a) Be well-versed in the Party and State policies, laws, regulations, and requirements of the industry and locality regarding secondary education;

b) Effectively implement plans and programs for secondary education;

c) Flexibly apply and guide colleagues in applying knowledge about education and age-specific psychology to the practical education of secondary students;

d) Effectively apply knowledge about economics, culture, and society in career counseling for secondary students;

đ) Actively collaborate with colleagues, parents of students, and the community to enhance the effectiveness of secondary student education;

e) Possess the ability to effectively utilize, evaluate, or guide colleagues in writing innovative experiences and applied educational scientific research products at the school level and above;

g) Possess the ability to evaluate scientific and technological research products of secondary students;

h) Be recognized as a grassroots labor model, excellent teacher, excellent class advisor, or excellent team leader at the school level and above;

i) A staff member promoted from the position of secondary school teacher grade III to secondary school teacher grade II must have held the position of secondary school teacher grade III or equivalent for at least 06 (six) years, including at least 01 (one) year in the secondary school teacher grade III professional rank and having graduated from a bachelor's degree in education or a relevant field corresponding to the subject taught for at least 01 (one) year.

Article 6. Secondary School Teacher Grade III - Code V.07.04.12

1. Tasks

a) Teaching and educating according to the secondary school education program and plan;

b) Participating in identifying and nurturing talented students and tutoring underperforming students at the secondary school level;

c) Applying initiatives, experiences, and results of applied educational scientific research into practical teaching and student education, and making teaching aids and equipment for secondary schools;

d) Reforming teaching methods and assessing learning outcomes towards promoting students' initiative, positivity, ability formation, and self-study methods at the secondary school level;

đ) Completing training programs; self-studying and self-improving to refine moral character and enhance professional skills; participating in specialized activities;

e) Participating in psychological counseling and career guidance for secondary school students and their parents;

g) Participating in universalizing secondary education;

h) Coordinating with class advisors, other teachers, the Ho Chi Minh Communist Youth Union, families, and related social organizations to organize and guide educational activities for secondary school students;

i) Organizing for secondary school students to participate in creative experience activities and competitions;

k) Performing other tasks assigned by the school principal.

2. Qualification requirements for education and training

a) Having a college degree in education or a relevant field and a vocational training certificate for secondary school teachers;

b) Having a foreign language proficiency level of Level 1 as prescribed in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014 issued by the Ministry of Education and Training on the six-level foreign language proficiency framework for Vietnam, or having a certificate in ethnic languages for positions requiring the use of ethnic languages;

For foreign language teachers, the second foreign language proficiency level must reach Level 1 as prescribed in Circular No. 01/2014/TT-BGDĐT dated January 24, 2014 issued by the Ministry of Education and Training on the six-level foreign language proficiency framework for Vietnam;

c) Having computer skills meeting the basic standard for information technology usage as prescribed in Circular No. 03/2014/TT-BTTTT dated March 11, 2014 issued by the Ministry of Information and Communications on the Standard for Information Technology Usage Skills;

3. Professional Qualification Standards

a) Understanding the Party's policies, State laws, regulations, and requirements of the industry and locality regarding secondary education;

b) Implementing the secondary education program and plan;

c) Knowing how to apply knowledge of pedagogy and age-specific psychology in the practical education of secondary school students;

d) Knowing how to apply knowledge of economics, culture, and society in career counseling for secondary school students;

đ) Knowing how to coordinate with colleagues, parents, and the community to improve the effectiveness of secondary school student education;

e) Possessing the ability to apply or write initiatives, experiences, and applied educational scientific research;

g) Possessing the ability to guide students in scientific and technical research;

Chapter III

GUIDELINES FOR APPOINTMENT AND SALARY GRADING BY PROFESSIONAL TITLES

Article 7. Principles for appointment and salary classification according to occupational titles for civil servants

1. The appointment to the occupational title specified in this Joint Circular must be based on the current position, responsibilities, and professional qualifications of the civil servant, as stipulated in Article 8 of this Joint Circular;

2. When appointing from the current civil service rank to the occupational title of secondary school teacher corresponding to the rank, it shall not be combined with salary grade promotion or occupational title rank advancement;

Article 8. Cases for Appointment to Professional Titles

Civil servants who have been appointed to the ranks of secondary school teachers as prescribed in Decision No. 202/TCCP-VC dated June 8, 1994 of the Minister, Head of the Government Organization-Civil Service Department on the issuance of professional standards for civil service ranks in the education and training sector (hereinafter referred to as Decision No. 202/TCCP-VC); Decision No. 61/2005/QĐ-BNV dated June 15, 2005 of the Minister of Home Affairs on the issuance of temporary occupational titles and codes for some civil service ranks in the education and training sector, culture-information sector (hereinafter referred to as Decision No. 61/2005/QĐ-BNV) are now appointed to the occupational title of secondary school teacher as prescribed in this Joint Circular, as follows:

1. Appointing to the occupational title of secondary school teacher Grade I (code V.07.04.10) for civil servants currently holding the senior secondary school teacher rank (code 15.112);

2. Appointing to the occupational title of secondary school teacher Grade II (code V.07.04.11) for civil servants currently holding the secondary school teacher main rank (code 15a.201);

3. Appointing to the occupational title of secondary school teacher Grade III (code V.07.04.12) for civil servants currently holding the secondary school teacher rank (code 15a.202);

Article 9. Salary Grading Method

1. The occupational titles of secondary school teachers prescribed in this Joint Circular shall apply the Professional and Vocational Salary Scale for State-owned Enterprise Staff (Scale 3) issued together with Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on the salary system for civil servants, public officials, staff members, and armed forces personnel (hereinafter referred to as Decree No. 204/2004/NĐ-CP) as follows:

a) The occupational title of secondary school teacher Grade I shall apply the salary coefficient of type A2, group A2.2 (from salary coefficient 4.00 to salary coefficient 6.38);

b) The occupational title of secondary school teacher Grade II shall apply the salary coefficient of type A1 (from salary coefficient 2.34 to salary coefficient 4.98);

c) The occupational title of secondary school teacher Grade III shall apply the salary coefficient of type A0 (from salary coefficient 2.10 to salary coefficient 4.89).

2. The assignment of salary grades to the occupational titles of civil servants as stipulated in Clause 1 of this Article for civil servants who have been assigned salary grades under the middle school teacher ranks as prescribed in Decision No. 202/TCCP-VC; Decision No. 61/2005/QĐ-BNV; Decree No. 204/2004/NĐ-CP; Point 3 Section II Circular Joint No. 81/2005/TTLT-BNV-BTC dated August 10, 2005 of the Ministry of Home Affairs and the Ministry of Finance guiding the implementation of the transition from old salary scales to new ones for certain ranks of civil servants and civil servants newly allocated to categories within the water resources, education and training, culture - information, health, and market management sectors shall be carried out as follows:

Civil servants appointed to the occupational title of middle school teacher whose salary grade coefficient is the same as that of the old rank shall be assigned the same salary grade and percentage (%) of seniority allowance exceeding the ceiling (if any) currently enjoyed at the old rank (including the time for considering promotion to the next salary grade or enjoying the seniority allowance exceeding the ceiling if any at the old rank) to the new occupational title.

Example: Ms. Nguyen Thi E was assigned to the middle school teacher rank (code 15a.202), grade 4, salary coefficient 3.03 since February 1, 2013. Now she has been appointed by the competent authority to the occupational title of middle school teacher class III (code V.07.04.12) and will be assigned grade 4, salary coefficient 3.03 of the middle school teacher class III occupational title from the date of signing the decision; the time for considering promotion to the next salary grade will be calculated from February 1, 2013.

3. Promotion of middle school teachers' civil servants shall be implemented after being appointed to the middle school teacher position as prescribed in this Circular and implementing salary assignment according to the guidance provided in Clause 1 Section II Circular No. 02/2007/TT-BNV dated May 25, 2007 of the Ministry of Home Affairs guiding salary assignment when upgrading ranks, transferring ranks, and transferring types of civil servants.

Chapter IV

IMPLEMENTING PROVISIONS

Article 10. Effective Date

1. This Circular takes effect from November 3, 2015.

2. Abolish the vocational standards of the middle school teacher rank in the education and training sector as prescribed in Decision No. 202/TCCP-VC dated June 8, 1994 of the Minister, Head of the Government Organizational Structure - Cadre Department regarding the issuance of vocational standards for various ranks of civil servants in the education and training sector.

3. Abolish the provisions on occupational titles and code numbers of middle school teacher civil servant ranks in Decision No. 61/2005/QĐ-BNV dated February 15, 2005 of the Minister of the Ministry of Home Affairs regarding the temporary issuance of occupational titles and code numbers for some ranks of civil servants in the education and training, culture - information sectors.

4. Abolish the provisions on the list of middle school teacher civil servant ranks in the list of civil servant and civil servant ranks issued together with Decision No. 78/2004/QĐ-BNV dated November 3, 2004 of the Minister of the Ministry of Home Affairs.

Article 11. Application Provisions

1. Civil servants who have been appointed to the middle school teacher ranks as prescribed in Decision No. 202/TCCP-VC; Decision No. 61/2005/QĐ-BNV, now appointed to the occupational title of middle school teacher as prescribed in this Circular, the competent authority managing and using civil servants shall create conditions for civil servants to supplement the remaining criteria of the middle school teacher occupational title appointed.

2. Civil servants who have been appointed to the middle school teacher rank but not yet up to standard (code 15c.208) as prescribed in Decision No. 61/2005/QĐ-BNV until the effective date of this Circular and do not meet the conditions and criteria for appointment to the middle school teacher occupational title class III shall be retained and their current rank benefits maintained for a period not exceeding five (5) years from the effective date of this Circular. For middle school teachers currently holding the middle school teacher rank but not yet up to standard (not having a college degree) code 15c.208 until the effective date of this Circular, under 55 years old for males and under 50 years old for females, the competent authority managing and using civil servants must arrange for civil servants to study and improve their qualifications to meet the criteria of the middle school teacher occupational title class III. If the civil servant meets the criteria and conditions for the middle school teacher occupational title class III, the authority using the civil servant shall report to the managing authority for consideration and decision on appointment to the middle school teacher occupational title class III. In case the civil servant is sent to study to improve qualifications but does not participate in the study or fails to meet the requirements, the authority using the civil servant shall report to the managing authority to consider reassignment to another job or implement staff reduction.

Article 12. Implementation Organization

1. This Circular serves as the basis for the recruitment, use, and management of middle school teachers in public middle schools within the national education system.

2. Private middle schools may apply the provisions of this Circular to recruit, use, and manage middle school teachers.

3. The heads of public middle schools directly managing and using civil servants shall be responsible for:

a) Reviewing the positions in the unit, developing plans for appointing the occupational title of middle school teacher in middle schools under their management authority, submitting them to the competent authority for examination and decision or deciding according to the delegated authority;

b) Appointing the occupational title for middle school teachers under their management to corresponding occupational titles in public middle schools according to the authority or delegated authority after the plan for appointing the occupational title has been approved by the competent authority.

4. Ministries, agencies equivalent to ministries, agencies under the Government, People's Committees of provinces and centrally-administered cities are responsible for:

a) Directing units under their management to implement the appointment of occupational titles and salary assignment for civil servants who are middle school teachers in public middle schools.

b) Approve the plan for appointing occupational titles and determining salaries for civil servants who are secondary school teachers in public secondary schools under their management, transferring from the current civil servant rank to the corresponding secondary school teacher occupational title as stipulated in this Joint Circular; resolve any issues arising during the appointment of occupational titles and determination of salaries within their authority;

c) Decide on the appointment of occupational titles and determination of salaries for civil servants who are secondary school teachers under their management to the corresponding secondary school teacher occupational title in public secondary schools within their authority;

d) Report the results of the appointment of occupational titles and determination of salaries for civil servants who are secondary school teachers in public secondary schools under their management to the Ministry of Education and Training and the Ministry of Home Affairs;

Article 13. Responsibility for Implementation

1. The Minister, the Head of a ministry-level agency, the Head of an agency under the Government; the Chairman of the People's Committee of a province or centrally governed city shall be responsible for implementing this Joint Circular;

2. In case of any difficulties during implementation, they are requested to reflect these issues to the Ministry of Education and Training for consolidation and coordination with the Ministry of Home Affairs to examine and resolve them./.
