Circular No. 22/2016/TT-BXD abolishes in whole or in part legal normative documents issued by the Ministry of Construction or jointly issued by the Ministry of Construction concerning conditions for investment and business operations.

Repealing in whole or in part legal normative documents containing provisions on conditions for business investment

issued by the Ministry of Construction or jointly issued

Pursuant to the Law on Legislative Regulatory Documents dated June 22, 2015;

Pursuant to the Investment Law dated November 26, 2014;

Pursuant to Decree No. 34/2016/NĐ-CP dated May 14, 2016 of the Government detailing certain provisions and implementing measures of the Law on Legislative Regulatory Documents;

Pursuant to Decree No. 118/2015/NĐ-CP dated November 12, 2015 of the Government detailing and guiding the implementation of certain articles of the Investment Law;

Pursuant to Decree No. 62/2013/NĐ-CP dated June 25, 2013 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Construction;

At the proposal of the Director of the Legal Department;

The Minister of Construction issues this Circular to repeal in whole or in part legal normative documents containing provisions on conditions for business investment issued by the Ministry of Construction or jointly issued.

Article 1. Repealing in whole legal normative documents containing provisions on conditions for business investment

1. Repeal Circular Jointly Issued No. 1529/1998/TTLT/BKHCNMT-BXD dated October 17, 1998 of the Ministry of Science, Technology, and Environment and the Ministry of Construction guiding environmental protection in the use of asbestos in the production of building materials and construction.

2. Repeal Circular No. 11/2007/TT-BXD dated December 11, 2007 of the Minister of Construction guiding the implementation of certain articles of Decree No. 124/2007/NĐ-CP dated July 31, 2007 of the Government on the management of construction materials.

3. Repeal Decision No. 27/2000/QĐ-BXD dated December 8, 2000 of the Minister of Construction promulgating regulations on conditions for construction business.

4. Repeal Directive No. 02/2008/CT-BXD dated March 27, 2008 of the Minister of Construction regarding rectification and strengthening measures to ensure labor safety and hygiene in construction units.

Article 2. Repealing in part legal normative documents containing provisions on conditions for business investment

1. Repeal Article 6 of Circular No. 12/2009/TT-BXD dated June 24, 2009 of the Minister of Construction guiding detailed procedures for issuing construction practice certificates.

2. Repeal Article 8 of Circular No. 22/2009/TT-BXD dated July 6, 2009 of the Minister of Construction detailing conditions of capacity in construction activities.

3. Repeal Article 3 of Circular No. 25/2009/TT-BXD dated July 29, 2009 of the Minister of Construction guiding training and supervision in project management and construction supervision.

4. Repeal Article 3 of Circular No. 05/2010/TT-BXD dated May 26, 2010 of the Minister of Construction guiding training and certification for construction valuation engineers.

5. Repeal Article 5 of Circular No. 21/2010/TT-BXD dated December 16, 2010 of the Minister of Construction guiding conformity assessment and declaration of conformity for construction products and materials.

6. Repeal Article 4 of Circular No. 01/2011/TT-BXD dated January 27, 2011 of the Minister of Construction guiding strategic environmental assessment in urban planning and construction projects.

7. Repeal Article 7 of Circular No. 03/2011/TT-BXD dated April 6, 2011 of the Minister of Construction guiding inspection, appraisal, and certification of structural safety and quality compliance for construction works.

8. Repeal Clause 1, Article 1 and Clause 2, Article 2 of Circular No. 06/2011/TT-BXD dated June 21, 2011 of the Minister of Construction amending and supplementing certain provisions on administrative procedures in the construction sector, architectural planning, and implementing Resolution No. 55/NQ-CP dated December 14, 2010 on simplifying administrative procedures within the scope of the Ministry of Construction's management functions.

9. Repeal Point c, Article 2 of Circular No. 06/2013/TT-BXD dated May 13, 2013 of the Minister of Construction guiding urban design content.

10. Repeal Clause 1, Article 28 of Circular No. 02/2016/TT-BXD dated February 15, 2016 of the Minister of Construction promulgating the Regulation on Management and Use of Apartment Buildings.

Article 3. Effectiveness

1. This Circular takes effect from the date of signature.

2. Relevant agencies, organizations, and individuals shall be responsible for implementing this Circular./.
