Pursuant to the Law on Government Organization dated June 19, 2015;

Pursuant to Decision No. 34/2007/QĐ-TTg dated March 12, 2007 of the Government Chairman promulgating the Regulation on the establishment, organization, and operation of inter-ministerial coordination organizations;in the sector;

At the proposal of the Minister of Transport;

The Government Chairman issues this Decision on the organization and operation of the National Traffic Safety Committee and Provincial and Central City Traffic Safety Committees.

PART I

ORGANIZATION AND ACTIVITIES

OF THE NATIONAL TRAFFIC SAFETY COMMITTEE

Article 1. Position and Functions

1. The National Traffic Safety Committee is an inter-ministerial coordination organization with the function of assisting the Government Chairman in directing ministries, sectors, and localities in implementing national strategies, projects, and inter-ministerial solutions for ensuring traffic order and safety and developing nationwide traffic safety care measures.

2. The National Traffic Safety Committee may use a seal bearing the National Emblem.

Article 2. Tasks and Authorities

1. Study and propose to the Government Chairman plans for organizing and implementing national strategies, projects, and inter-ministerial cooperation solutions for ensuring traffic order and safety to enhance effectiveness and synchronization in traffic order and safety work. Guide ministries, sectors, and localities to coordinate in implementation after approval.

2. Assist the Government Chairman in directing and managing inter-ministerial activities among ministries, sectors, and localities to address and mitigate the consequences of particularly serious traffic accidents, urgent and complex issues related to traffic order and safety throughout the country.

3. Assist the Government Chairman in inspecting and urging ministries, sectors, and localities to implement government directives, the Government Chairman's instructions, national strategies and projects, and inter-ministerial solutions for ensuring traffic order and safety.

4. Provide guidance on tasks and build plans for propaganda and dissemination of laws on ensuring traffic order and safety for ministries, sectors, and localities to organize and implement.

5. Guide Provincial and Central City Traffic Safety Committees in implementing plans and solutions for ensuring traffic order and safety within their jurisdictions; inspect the implementation by relevant sectors and localities. Propose or directly resolve local recommendations to handle situations and incidents to ensure traffic safety and prevent traffic congestion.

6. Coordinate with the National Committee for Disaster Prevention and Control and Search and Rescue to direct rescue and relief operations and mitigate the consequences of particularly serious traffic accidents on expressways, national railways, and national inland waterways.

7. Coordinate with provincial and central city People's Committees to direct rescue and relief operations and mitigate particularly serious traffic accidents and congestion; promptly propose measures to prevent similar accidents and congestion from occurring.

8. Build regular or ad hoc reports on traffic order and safety conditions to the Government Chairman, or reports on traffic order and safety by the Government to the National Assembly; direct analysis, evaluation, determination of causes of traffic accidents and congestion nationwide, and recommend competent authorities to amend, supplement, or issue new mechanisms, policies, regulatory legal documents, and solutions for ensuring traffic order and safety.

9. Direct the development and promotion of models and exemplary practices in traffic order and safety work.

10. International cooperation in the field of ensuring traffic order and safety.

11. Direct the research and application of new scientific and technological results in the field of ensuring traffic order and safety.

12. Recommend and implement commendation and reward work for collectives and individuals with outstanding achievements in traffic order and safety activities.

13. Mobilize non-budgetary resources to support traffic accident victims in mitigating consequences, integrating into the community, and continuing to develop.

14. Perform other tasks assigned by the Government Chairman.

Article 3. Organization of the National Traffic Safety Committee

1. Chairperson and Vice Chairpersons

a) Chairperson of the Committee: Deputy Prime Minister of the Government;

b) Permanent Vice Chairperson: Minister of Transport;

c) Specialized Vice Chairperson appointed by the Head of the Government;

d) Vice Chairperson: Deputy Minister of Public Security.

2. Members of the National Traffic Safety Committee

a) Permanent members are Deputy Ministers of the Ministries of Transport, Health, Finance, Information and Communications, and Deputy Director of the Government Office;

b) Members are leaders of the Ministries and agencies: Defense, Education and Training, Justice, Construction, Vietnam Television, Voice of Vietnam Radio, Vietnam News Agency;

c) Invite leaders of the Central Committee of the Vietnam Fatherland Front, People's Newspaper, Communist Youth Central Committee Ho Chi Minh, Vietnam Women's Union, Vietnam Farmers' Association, Vietnam Veterans' Association to serve as members of the National Traffic Safety Committee.

3. Based on the provisions of point d clause 1 and clause 2 of this Article, the head of the agency or organization related shall appoint persons to participate in the National Traffic Safety Committee and submit to the Ministry of Transport for consolidation and presentation to the Prime Minister for decision; assign units to be the main liaison for traffic safety work of the agency or organization.

Article 4. Standing Office and Secretariat of the Committee

1. The Ministry of Transport is the standing office of the National Traffic Safety Committee, responsible for ensuring the operational conditions of the Committee, utilizing subordinate agencies and units under the Ministry to carry out the tasks of the National Traffic Safety Committee.

2. Secretariat of the National Traffic Safety Committee

a) The Secretariat of the National Traffic Safety Committee is a specialized agency assisting the National Traffic Safety Committee; it has legal personality, its own seal, account, and is a budget unit at level II; the Secretariat's headquarters is located within the Ministry of Transport and directly managed and directed by the Minister of Transport - Permanent Vice Chairperson of the Committee. The duties and powers of the Secretariat are stipulated by the Chairperson of the National Traffic Safety Committee.

b) The Secretariat of the National Traffic Safety Committee has a Secretary-General and Deputy Secretary-Generals, including one Deputy Secretary-General who is a leader of the Traffic Police Department, Ministry of Public Security, seconded and other specialists providing assistance.

c) The staffing and operating funds of the Secretariat of the National Traffic Safety Committee are allocated within the total annual staffing and funding assigned to the Ministry of Transport.

Article 5. Working System of the Committee

1. The National Traffic Safety Committee operates under a system emphasizing individual responsibility of committee members before the Chairperson of the Committee.

2. The National Traffic Safety Committee convenes regularly once every quarter; when necessary, the Chairperson may convene extraordinary meetings.

3. Members of the National Traffic Safety Committee operate on a part-time basis and are entitled to part-time allowances as prescribed by law.

4. The Chairperson of the National Traffic Safety Committee promulgates the Operational Regulations of the Committee, assigns specific tasks and responsibilities to each member of the Committee.

Chapter II

ORGANIZATION AND OPERATIONS OF THE PROVINCE AND CITY DIRECTLY UNDER THE CENTRAL GOVERNMENT TRAFFIC SAFETY BOARDS

TRAFFIC SAFETY BOARDS OF PROVINCES AND CITIES DIRECTLY UNDER THE CENTRAL GOVERNMENT

Article 6. Position and functions of the Provincial Traffic Safety Committee, Municipality under the Central Government

1. The Provincial Traffic Safety Committee, Municipality under the Central Government is an inter-sectoral coordinating organization with the function of assisting the Chairman of the Provincial People's Committee, Municipality under the Central Government to direct the coordination in implementing measures to ensure traffic order and safety and to alleviate traffic congestion within their jurisdiction.

2. The Provincial Traffic Safety Committee, Municipality under the Central Government shall be entitled to use its own seal and open an account at the State Treasury in accordance with the provisions of the law.

Article 7. Tasks and Authorities of the Provincial Traffic Safety Committee, Municipality under the Central Government

1. Propose to the Provincial People's Committee, Municipality under the Central Government

a) Plans and measures for coordinating among departments, sectors, and local authorities in implementing solutions to ensure traffic order and safety and to alleviate traffic congestion.

b) Policies to strengthen the District-level Traffic Safety Committees to effectively carry out traffic order and safety assurance work.

2. Assist the Chairman of the Provincial People's Committee, Municipality under the Central Government in directing and urging the coordination of activities among sectors, organizations, and mass organizations in the field of ensuring traffic order and safety and alleviating traffic congestion within their jurisdiction.

3. Widely disseminate throughout all social strata within their jurisdiction the regulations of the law, directives of the Government and Prime Minister, and relevant ministries and sectors concerning traffic order and safety assurance work.

4. Report promptly to the Provincial People's Committee, Municipality under the Central Government and the National Traffic Safety Committee on particularly serious traffic accidents occurring within their jurisdiction; coordinate in directing rescue, relief operations, mitigating consequences caused by traffic accidents, directing competent agencies to determine causes and timely propose preventive measures; implement regular reporting systems (monthly, quarterly, annually) or ad hoc reports on traffic order and safety, traffic accidents, and traffic congestion situations.

5. Define the system, scope of responsibility of member agencies and each member of the Committee; define the functions, tasks, authorities, and responsibilities of the Committee Office.

6. Carry out other tasks assigned by the Chairman of the Provincial People's Committee, Municipality under the Central Government.

Article 8. Composition and Supporting Agencies of the Provincial Traffic Safety Committee, Municipality under the Central Government and District-level Traffic Safety Committee

1. Chairperson, Vice-Chairpersons, members of the Provincial Traffic Safety Committee, Municipality under the Central Government

a) The Chairperson is the Chairman of the Provincial People's Committee, Municipality under the Central Government.

b) The Permanent Deputy Chairperson: Director of the Department of Transport; based on actual conditions and specific characteristics of the locality, the Chairman of the Provincial People's Committee - Chairperson of the Provincial Traffic Safety Committee may assign a Deputy Chairman of the Provincial People's Committee as the Permanent Deputy Chairperson.

c) The Deputy Chairperson is the Deputy Director of the Public Security Department of the Province, Municipality under the Central Government.

d) The Specialized Deputy Chairperson: For provinces, municipalities under the Central Government with a population of two million people or more and complex traffic order and safety situations, the Chairman of the Provincial People's Committee - Chairperson of the Provincial Traffic Safety Committee may appoint a specialized Deputy Chairperson of the Provincial Traffic Safety Committee.

đ) Members of the Provincial Traffic Safety Committee, Municipality under the Central Government are Deputy Directors of Departments, equivalent leadership positions of local sectors and mass organizations; the Head of the Provincial Traffic Safety Committee Office is a specialized member. The Chairman of the Provincial People's Committee - Chairperson of the Provincial Traffic Safety Committee decides on the composition of the members of the Provincial Traffic Safety Committee, Municipality under the Central Government.

2. Composition, tasks, and authorities of the District-level Traffic Safety Committee: The Chairman of the Provincial People's Committee - Chairperson of the Provincial Traffic Safety Committee stipulates the tasks, authorities, and composition of the District-level Traffic Safety Committee to ensure effective operation.

3. Standing agencies of the Provincial Traffic Safety Committee and the District-level Traffic Safety Committee

a) The Department of Transport is the standing agency of the Provincial Traffic Safety Committee, Municipality under the Central Government, responsible for ensuring the operational conditions of the Committee.

b) The Chairman of the District People's Committee specifies the standing agency and promulgates the operating regulations of the District-level Traffic Safety Committee.

4. Office of the Provincial Traffic Safety Committee, Municipality under the Central Government (Committee Office)

a) The Committee Office is a specialized agency assisting the Provincial Traffic Safety Committee, Municipality under the Central Government. Personnel of the Committee Office includes the Head of the Office, Deputy Heads of the Office, and some specialists.

b) The staffing of the Committee Office is administrative staffing; based on actual conditions, the Chairman of the Provincial People's Committee - Chairperson of the Provincial Traffic Safety Committee assigns dispatched civil servants or concurrently serving civil servants from member agencies to perform duties at the Committee Office.

c) The Committee Office is located at the Department of Transport or at another location determined by the Chairman of the Provincial People's Committee, Municipality under the Central Government.

d) The tasks, authorities, and staffing of the Committee Office are decided by the Chairperson of the Provincial Traffic Safety Committee, Municipality under the Central Government.

đ) The Committee Office uses the seal and account of the Provincial Traffic Safety Committee; it is responsible for preparing the annual budget for the Committee's operations, submitting it for approval by the competent authority in accordance with the law.

Article 9. Working Regime of the Provincial and Central City Traffic Safety Board

1. The Provincial and Central City Traffic Safety Board shall convene regular meetings once every quarter. In case of urgent tasks, the Chairman may call for extraordinary meetings.

2. Members of the Provincial and Central City Traffic Safety Board shall work on a part-time basis, emphasizing their responsibilities to the Chairman. Members shall be entitled to part-time allowances as prescribed.

3. The Chairman of the Provincial and Central City Traffic Safety Board shall issue the Operational Regulations of the Board, assign tasks, and specify responsibilities for each member.

Chapter III

IMPLEMENTATION

Article 10. Operating Expenses

1. The operating expenses of the National Traffic Safety Committee, the Provincial and Central City Traffic Safety Board shall be funded from the State budget (central and local budgets), contributions, grants, and other sources of funds as stipulated by law.

2. The Ministry of Finance shall take the lead and coordinate with the Ministry of Transport to guide the mobilization and management of non-budgetary resources to support traffic accident victims in overcoming consequences, integrating into society, and continuing development.

Article 11. Effective Date

1. This Decision shall take effect from August 10, 2017.

2. This Decision replaces Decision No. 57/2011/QĐ-TTg dated October 18, 2011 of the Government Chairman regarding the reinforcement of the National Traffic Safety Committee and the Provincial and Central City Traffic Safety Boards.

Article 12. Responsibility for Implementation

The Chairman of the National Traffic Safety Committee, Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairmen of provincial and central city People's Committees, Heads of related agencies and organizations are responsible for implementing this Decision./.
