Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to Resolution No. 32/2007/NQ-CP dated June 29, 2007 of the Government on urgent measures to curb traffic accidents and traffic congestion;

Pursuant to Resolution No. 88/NQ-CP dated August 24, 2011 of the Government on strengthening the implementation of key measures to ensure traffic order and safety;

Pursuant to Decision No. 34/2007/QĐ-TTg dated March 12, 2007 of the Prime Minister promulgating the Regulation on the establishment, organization, and operation of inter-ministerial coordination bodies;

Considering the proposals of the Minister of Transport, the Minister of Home Affairs, and the Minister of Public Security,

DECISION:

Article 1. Position and Functions of the National Traffic Safety Committee

1. The National Traffic Safety Committee is an inter-ministerial coordination body with the function of directing and assisting the Prime Minister in directing the Ministries, sectors, and localities in implementing national strategies and projects on ensuring traffic order and safety, and inter-ministerial solutions to ensure traffic order and safety throughout the country.

2. The National Traffic Safety Committee may use a seal bearing the National Emblem.

Article 2. Tasks and Authorities of the National Traffic Safety Committee

1. To study and propose to the Prime Minister plans for organizing the implementation of national strategies and projects, inter-ministerial cooperation solutions on ensuring traffic order and safety to enhance effectiveness and synchronization in traffic order and safety work. Guide the Ministries, sectors, and localities to coordinate in implementation after approval.

2. Assist the Prime Minister in directing and managing inter-ministerial and inter-local activities to address sudden and complex issues related to traffic order and safety nationwide that require focused handling.

3. Assist the Prime Minister in inspecting and urging the Ministries, sectors, and localities to implement Government Decrees, Resolutions, decisions, documents, and directives of the Prime Minister concerning traffic order and safety or approved inter-ministerial measures.

4. Direct and develop plans for propaganda and dissemination of laws on ensuring traffic order and safety for the Ministries, sectors, and localities to organize and implement.

5. Guide the Provincial Traffic Safety Committees in implementing plans and solutions to ensure traffic order and safety within their jurisdiction; inspect the implementation by relevant sectors and localities or at important transportation nodes. Propose or directly resolve local recommendations to handle situations and incidents to ensure traffic safety and prevent congestion.

6. Direct the enhanced coordination between traffic police and traffic inspectors in patrolling, supervising, inspecting, and handling violations of laws on ensuring traffic order and safety in areas with complex traffic order and safety conditions and increasing traffic accidents.

7. Aggregate and periodically or urgently report to the Prime Minister on traffic order and safety conditions; promptly report major traffic accidents; assess causes and immediate remedial measures; promptly propose measures to prevent similar accidents from occurring.

8. Study, evaluate, and recommend competent authorities to amend, supplement, or issue new mechanisms, policies, and regulatory documents on ensuring traffic order and safety.

9. Direct the development and promotion of models and exemplary practices in traffic order and safety work.

10. Implement international cooperation in the field of ensuring traffic order and safety and minimizing losses caused by traffic accidents.

11. Carry out commendation and reward work for collectives and individuals with outstanding achievements in traffic order and safety activities according to the law.

12. Perform other tasks assigned by the Prime Minister.

Article 3. Organization of the National Traffic Safety Committee

1. Chairman, Vice Chairmen, and Members:

a) Chairperson of the Committee: Deputy Prime Minister of the Government;

b) Permanent Vice Chairperson: Minister of Transport;

c) Vice Chairman: Deputy Minister of Public Security;

d) A specialized Vice Chairman appointed by the Prime Minister.

đ) Members of the Committee:

- Deputy Minister of Transport;

- Deputy Minister of Defense;

- Deputy Minister of Health;

- Deputy Minister of Justice;

- Deputy Minister of Finance;

- Deputy Minister of Education and Training;

- Deputy Minister of Information and Communications;

- Deputy Director of the Government Office;

- Deputy Director General of Vietnam Television;

- Deputy Director General of Voice of Vietnam Radio;

Invite the Vice Chairman of the Vietnam Fatherland Front Central Committee and the Secretary of the Communist Youth Central Committee to join the Committee as members.

2. Based on the provisions of Clause 1 of this Article, heads of relevant agencies shall nominate persons to participate in the Committee for decision by the Deputy Prime Minister - Chairman of the Committee.

3. The Standing Board of the National Traffic Safety Committee: is a permanent operating body of the Committee to directly direct the implementation of decisions, directives, and management of the Committee Chairman, short-term and long-term programs and plans, notifications of conclusions on the implementation of traffic order and safety tasks of the Committee, and other tasks assigned by the Committee Chairman.

The Standing Board consists of:

a) Chairman: Minister of Transport;

b) Deputy Chairman: Deputy Minister of Public Security;

c) Specialized Vice Chairman serves as Deputy Chairman;

đ) Deputy Chairman: Deputy Minister of Transport;

đ) Members of the Standing Board: Leaders at the level of General Department, Bureau, Division of the Ministry of Transport, Ministry of Public Security, Ministry of Education and Training, Ministry of Health, Ministry of Information and Communications, Voice of Vietnam Radio, Vietnam Television, and leaders of the Office of the National Traffic Safety Committee. Additional members of the Standing Board are decided by the Deputy Chairman - Chairman of the Standing Board.

4. Permanent Office and Office of the National Traffic Safety Committee.

a) The Ministry of Transport is the permanent office of the National Traffic Safety Committee;

b) The Office of the National Traffic Safety Committee includes: Director of the Office, Deputy Directors of the Office, including one Deputy Director who is a leader at the Bureau level seconded from the Ministry of Public Security, and staff assistants.

Article 4. Working Regime of the National Traffic Safety Committee

1. The National Traffic Safety Committee operates under a regime that emphasizes individual responsibility of its members towards the Chairman of the Committee.

2. The National Traffic Safety Committee convenes regularly once every quarter. When necessary, the Chairman may convene extraordinary meetings.

3. Members of the National Traffic Safety Committee and the Standing Board work on a concurrent basis and are entitled to concurrent allowance as prescribed by the State.

4. The Chairman of the National Traffic Safety Committee promulgates the Operational Regulations of the Committee, assigns specific tasks and responsibilities to each member of the Committee; specifies the establishment, tasks, powers, and operational regulations of the Standing Board.

Article 5. Permanent Office and Subordinate Agencies of the National Traffic Safety Committee

1. The Ministry of Transport serves as the permanent office of the Committee, responsible for ensuring the operational conditions of the Committee, utilizing subordinate agencies and units under the Ministry to carry out the tasks of the National Traffic Safety Committee.

2. The Office of the National Traffic Safety Committee acts as a specialized agency assisting the National Traffic Safety Committee and the Standing Board. The Office's headquarters is located at the Ministry of Transport and is directly managed and directed by the Minister of Transport - Vice Chairman of the Committee.

The Office of the National Traffic Safety Committee has legal personality, possesses its own seal and bank account, and is a budgetary unit level II. The tasks, powers, staffing, and operating expenses of the Office are determined by the Minister of Transport - Vice Chairman of the Committee.

Article 6. Position and functions of the Provincial Traffic Safety Committee, Municipality under the Central Government

1. The Provincial Traffic Safety Committees under centrally governed cities are inter-departmental coordinating organizations with the function of assisting the Chairmen of provincial People's Committees under centrally governed cities in directing the coordination of measures to ensure traffic order and safety and to alleviate traffic congestion within their jurisdictions.

2. The Provincial Traffic Safety Committee, Municipality under the Central Government shall be entitled to use its own seal and open an account at the State Treasury in accordance with the provisions of the law.

Article 7. Tasks and Authorities of the Provincial Traffic Safety Committee, Municipality under the Central Government

1. Propose to the provincial People's Committees under centrally governed cities:

- Plans and measures for coordinating among departments, sectors, and local authorities at all levels in implementing solutions to ensure traffic order and safety and to alleviate traffic congestion;

- Policies for establishing Traffic Safety Boards at districts, counties, and cities under provinces where traffic order and safety situations are complex to effectively coordinate in traffic safety assurance work.

2. Assist the Chairmen of provincial People's Committees under centrally governed cities in directing and urging the coordinated activities of relevant sectors, organizations, and mass organizations in the field of traffic order and safety assurance and traffic congestion alleviation within their jurisdictions.

3. Widely disseminate among all strata of the people within their jurisdictions the provisions of laws, directives of the Government and Prime Minister, and regulations of related ministries and sectors concerning traffic safety assurance work.

4. Report urgently to the provincial People's Committees under centrally governed cities and the National Traffic Safety Committee about particularly serious accidents occurring within their jurisdictions; take the lead in addressing and minimizing the consequences caused by traffic accidents, determine the causes, and promptly propose preventive measures; implement regular or ad hoc reporting on traffic order and safety, traffic accidents, and traffic congestion situations.

5. Define the system, scope of responsibility of member agencies and each member of the Committee; define the functions, tasks, authorities, and responsibilities of the Committee Office.

6. Carry out other tasks assigned by the Chairman of the Provincial People's Committee, Municipality under the Central Government.

Article 8. Components and Supporting Agencies of the Provincial Traffic Safety Committee

1. The Chairman, Vice Chairmen, and Members of the Provincial Traffic Safety Committee:

a) Chairman: The Chairman of the People's Committee of the province or centrally governed city;

b) Permanent Vice Chairman: Director of the Department of Transportation;

c) Vice Chairman: Deputy Director of the Public Security of the province or centrally governed city;

d) Members of the Provincial Traffic Safety Committee are leaders of relevant departments, bureaus, and sectors of the locality. The Chairman of the People's Committee - Chairman of the Provincial Traffic Safety Committee decides on the composition of the members of the Provincial Traffic Safety Committee.

2. The permanent agency of the Provincial Traffic Safety Committee is the Department of Transportation.

3. Office of the Provincial Traffic Safety Committee (Committee Office):

a) The Committee Office is a specialized agency assisting the Provincial Traffic Safety Committee, including: Head of the Office, Deputy Head of the Office, and some staff members. The number of civil servants working in the Committee Office is determined based on job positions according to the law. When necessary, the Head of the Office may request the Chairman to supplement civil servants from member agencies;

b) The Committee Office is located at the Department of Transportation; it uses the seal of the Provincial Traffic Safety Committee;

c) Tasks, powers, staffing, and operating funds of the Committee Office are decided by the Chairman of the Provincial Traffic Safety Committee.

Article 9. Working Regime of the Provincial and Central City Traffic Safety Board

1. The Provincial and Central City Traffic Safety Board shall convene regular meetings once every quarter. In case of urgent tasks, the Chairman may call for extraordinary meetings.

2. Members of the Provincial Traffic Safety Committee work on a part-time basis, emphasizing their responsibilities before the Chairman. Members receive allowances for part-time work as prescribed.

3. The Chairman of the Provincial and Central City Traffic Safety Board shall issue the Operational Regulations of the Board, assign tasks, and specify responsibilities for each member.

Article 10. Operating Expenses

1. Source of funds: Operating funds of the National Traffic Safety Committee, Provincial Traffic Safety Committees are guaranteed from the following sources:

a) State budget (central and local budgets) as stipulated by law;

b) Support and aid from organizations and individuals both domestically and internationally for traffic safety activities and other sources of income as prescribed by law.

2. The Ministry of Finance takes the lead and coordinates with the Ministry of Transport to guide the management and use of funds for traffic order and safety to be consistent with the tasks of ensuring traffic order and safety at the central and local levels.

Article 11. Effectiveness and Responsibility for Implementation

1. This Decision takes effect from the date of issuance and replaces Decision No. 35/2010/QĐ-TTg dated April 8, 2010, of the Government Chairman regarding the establishment of the National Traffic Safety Committee and Provincial Traffic Safety Committees; abolishes previous regulations inconsistent with this Decision.

2. The Chairman of the National Traffic Safety Committee, Minister of Home Affairs, Ministers, Heads of Ministries equivalent to ministries, Heads of government agencies, Chairmen of the People's Committees of provinces and centrally governed cities, and Heads of related agencies and organizations are responsible for implementing this Decision./.
