Regarding the establishment and improvement of the National Traffic Safety Committee and the Provincial Traffic Safety Committees under the Central Government
PRIME MINISTER
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to Resolution No. 32/2007/NQ-CP dated June 29, 2007 of the Government on urgent measures to curb traffic accidents and traffic congestion;
Pursuant to Decision No. 34/2007/QĐ-TTg dated March 12, 2007 of the Prime Minister promulgating the Regulation on the establishment, organization, and operation of inter-ministerial coordination bodies;
Considering the proposal of the Minister of Transport, concurrently Chairman of the National Traffic Safety Committee,
DECISION:
Article 1. Position and functions of the National Traffic Safety Committee
1. The National Traffic Safety Committee is an inter-ministerial coordination body with the function of assisting the Prime Minister in researching, directing, and coordinating among ministries, sectors, and localities to implement the national program on traffic safety and inter-sectoral solutions to ensure traffic order and safety throughout the country.
2. The Committee may use a seal bearing the State Emblem.
Article 2. Tasks and powers of the National Traffic Safety Committee
1. Propose to the Prime Minister directions and inter-sectoral solutions to ensure traffic order and safety; guide relevant sectors and localities to coordinate in implementing these solutions after approval.
2. Assist the Prime Minister in directing and coordinating among ministries, sectors, and localities to resolve issues related to ensuring traffic order and safety.
3. Urge ministries, sectors, and localities to implement Government resolutions, directives from the Prime Minister, or approved inter-sectoral measures.
4. Take the lead or cooperate in disseminating and popularizing laws and regulations on ensuring traffic order and safety to gradually enhance the self-discipline of traffic participants in complying with the law.
5. Guide provincial Traffic Safety Committees in implementing programs and solutions to ensure traffic order and safety within their jurisdictions; coordinate and urge relevant sectors and localities to implement inter-sectoral measures; inspect the implementation of these measures by relevant sectors and localities or at key transportation nodes.
6. Direct the coordination of activities between police forces and traffic inspectors nationwide in patrolling, controlling, and handling violations according to the law on ensuring traffic order and safety.
7. Summarize and periodically or urgently report to the Prime Minister on the situation of traffic order and safety; promptly report major traffic accidents regarding damage, initial causes, immediate remedial measures, emergency cooperation efforts to limit damage, and propose timely measures to prevent similar accidents.
Periodically report to the Prime Minister on the activities of the Committee.
8. Recommend competent agencies to develop, amend, and supplement mechanisms, policies, and regulatory documents on ensuring traffic order and safety.
9. Direct the development and promotion of models and exemplary practices in traffic order and safety work.
10. Implement international cooperation in the field of ensuring traffic order and safety and minimizing losses caused by traffic accidents.
11. Carry out commendation and reward work for collectives and individuals with outstanding achievements in ensuring traffic order and safety according to the law.
12. Perform other tasks assigned by the Prime Minister.
Article 3. Members of the National Traffic Safety Committee
1. Chairman of the Committee: Minister of Transport.
2. Vice-Chairman of the Committee: Deputy Minister of Public Security.
3. Standing member and Secretary-General of the Committee: Director General or equivalent appointed by the Ministry of Transport.

- Deputy Minister of Education and Training;
- Deputy Minister of Information and Communications;
- Deputy Director of the Government Office;
- Deputy Director General of Vietnam Television;
- Deputy Director General of Voice of Vietnam Radio;
- Director General of Technical General Department - Ministry of Defense;
- Director General of Vietnam Highway Administration - Ministry of Transport;
- Director General of Police Administration for Social Order and Safety - Ministry of Public Security;
- Chief of Highway Traffic Police Corps, Police Administration for Social Order and Safety - Ministry of Public Security;
- Chief of Waterway Police Corps, Police Administration for Social Order and Safety - Ministry of Public Security;
- Chief of Motor Vehicle Bureau, Technical General Department - Ministry of Defense;
- Chief of Civil Aviation Authority of Vietnam - Ministry of Transport;
- Chief of Vietnam Maritime Administration - Ministry of Transport;
- Chief of Vietnam Inland Waterways Administration - Ministry of Transport;
- Chief of Vietnam Railway Administration - Ministry of Transport;
- Inspector General of the Ministry of Transport;
Invite the Vice-Chairman of the Central Committee of the Vietnam Fatherland Front and the Secretary of the Central Youth Union of Ho Chi Minh Communist Youth to join the National Traffic Safety Committee.
The Prime Minister appoints the Chairman and Vice-Chairman of the Committee.
5. Heads of agencies specified in Clause 4 of this Article shall appoint representatives to serve as members of the National Traffic Safety Committee, which shall be submitted by the Chairman of the Committee for consideration and decision by the Prime Minister.
Article 4. Working regime of the National Traffic Safety Committee
1. The National Traffic Safety Committee operates on a collective basis, with decisions made by majority vote.
2. The National Traffic Safety Committee convenes regular meetings every quarter. When necessary, the Chairman may convene extraordinary meetings.
3. Members of the National Traffic Safety Committee operate on a concurrent basis and are entitled to concurrent allowances as prescribed by the State.
4. The Chairman of the National Traffic Safety Committee promulgates the operational regulations of the Committee; working regulations, tasks, powers, and responsibilities of concurrent members and standing members; and provisions on the functions, tasks, and powers of the Secretariat.
Article 5. Permanent agency and Secretariat of the National Traffic Safety Committee
1. The Ministry of Transport serves as the permanent agency of the National Traffic Safety Committee, responsible for ensuring the conditions for the Committee's operations.
2. The National Traffic Safety Committee has a permanent office; the permanent office of the Committee is a specialized agency of the Committee responsible for performing tasks assigned by the Chairman of the Committee.
3. The permanent office of the National Traffic Safety Committee is located at the Ministry of Transport, with a Director and Deputy Director, including one leader at the General Department level seconded from the Ministry of Public Security; specialized civil servants and civil servants working under the secondment system from member agencies of the National Traffic Safety Committee.
The permanent office of the National Traffic Safety Committee is a budget unit at level II, entitled to use its own seal and open an account at the State Treasury.
4. The operating expenses of the permanent office of the National Traffic Safety Committee are guaranteed by the state budget according to the approved budget by the Chairman of the Committee.
5. The staffing of the permanent office of the National Traffic Safety Committee is allocated by the Ministry of Home Affairs within the total administrative staffing of the Ministry of Transport.
Article 6. Position and functions of the provincial traffic safety board
1. The provincial traffic safety board is a multi-sector coordination organization, with the function of assisting the Chairman of the Provincial People's Committee in directing the coordination of measures to ensure traffic order and safety and to alleviate traffic congestion within their jurisdiction.
2. The provincial traffic safety board is entitled to use its own seal; it may open an account at the State Treasury in accordance with the provisions of the law.
Article 7. Tasks and powers of the provincial traffic safety board
1. Propose to the provincial People's Committee, the municipal People's Committee directly under the Central Government plans and measures to coordinate among departments and local authorities at all levels in implementing measures to ensure traffic order and safety and to alleviate traffic congestion within their jurisdiction.
2. Assist the Chairman of the provincial People's Committee, the municipal People's Committee directly under the Central Government in directing and urging the coordinated activities of sectors, organizations, and mass organizations in the field of ensuring traffic order and safety and alleviating traffic congestion within their jurisdiction.
3. Promote widely among all strata of the people the regulations of the law, directives of the Prime Minister, and regulations of relevant ministries and sectors concerning traffic order and safety work.
4. Report urgently to the provincial People's Committee and the National Traffic Safety Committee about particularly serious accidents occurring within their jurisdiction resulting in three or more deaths on the spot; take the lead in addressing and minimizing the consequences caused by traffic accidents, determine the causes, and promptly propose preventive measures; implement regular or emergency reporting systems regarding traffic order and safety, traffic accidents, and traffic congestion within their jurisdiction.
5. Define the duty system and scope of responsibility of member agencies and each member of the board; define the functions, tasks, powers, and responsibilities of the board's office.
6. Perform other tasks assigned by the Chairman of the provincial People's Committee and as stipulated by law.
Article 8. Members and assisting agencies of the provincial traffic safety board
1. Board Chair: Chairman of the provincial People's Committee.
2. Deputy Chairs: Director of the Department of Transport and Director of the Provincial Police, municipal police directly under the Central Government.
In areas with complex traffic order and safety situations, the Chairman of the provincial People's Committee may assign a Vice Chairman of the People's Committee to concurrently serve as the permanent Deputy Chair or appoint a dedicated Deputy Chair to manage operations.
3. The Chairman of the provincial People's Committee decides on the composition of the provincial traffic safety board. The Chairman of the district People's Committee coordinates with the provincial traffic safety board and decides on the establishment of the district traffic safety board in accordance with the traffic order and safety situation within their jurisdiction and to ensure effective operation.
4. The office of the provincial traffic safety board is a specialized agency assisting the board, with a dedicated member serving as the Director, Deputy Director, specialized civil servants, and civil servants seconded from member agencies of the traffic safety board. The number of specialized civil servants and seconded civil servants in the office and the agency hosting the office is decided by the Chairman of the provincial traffic safety board based on proposals from Deputy Chairs and the Director of the Department of Home Affairs. The office uses the seal of the traffic safety board.
The office of the provincial traffic safety board is responsible for preparing the budget for the board's operating expenses and submitting it to the competent authority for approval.
Article 9. Working regime of the provincial traffic safety board
1. The provincial traffic safety board convenes regular meetings once every quarter. When urgent tasks arise, the Chair may call for extraordinary meetings.
2. Members of the provincial traffic safety board work on a concurrent basis and are entitled to receive allowances for concurrent positions as prescribed by the State.
3. The Chairman of the provincial traffic safety board issues the operational regulations of the board, assigns tasks, and specifies the specific responsibilities of each member.
Article 10. Operating expenses
The operating expenses of the National Traffic Safety Committee and the provincial traffic safety boards are guaranteed by the state budget according to the current budget classification; from sources of funding, grants, and international organization support; and other income sources as prescribed by law.
Article 11. Effectiveness and Responsibility for Implementation
1. This Decision takes effect from May 25, 2010; replacing Decision No. 917/1997/QĐ-TTg dated October 29, 1997 of the Prime Minister on the establishment of the National Traffic Safety Committee; abolishing previous regulations that conflict with this Decision.
2. The Minister of Home Affairs, the Chairman of the National Traffic Safety Committee, ministers, heads of ministerial-level agencies, heads of government-affiliated agencies, Chairmen of provincial People's Committees, municipal People's Committees directly under the Central Government, heads of related agencies and organizations are responsible for implementing this Decision./.
