CIRCULAR

ISSUING ECONOMIC AND TECHNICAL STANDARDS FOR THE PREPARATION OF FLOOD CONTROL PLANS FOR RIVER SECTORS WITH LEVEES AND LEVEE REGULATION PLANS

Pursuant to the Law on Dikes dated November 29, 2006;

BASED ON THE LAW AMENDING AND COMPLEMENTING CERTAIN PROVISIONS OF THE LAW ON NATURAL DISASTER PREVENTION AND CONTROL AND THE LAW ON LEVEES, dated June 17, 2020;

Pursuant to the Planning Law dated November 24, 2017;

BASED ON THE LAW AMENDING one AND COMPLEMENTING CERTAIN PROVISIONS OF 37 LAWS RELATED TO PLANNING, dated November 20, 2022; 2018;

Pursuant to the Government Decree NUMBER 1105/2022/ND-CP dated December 22, 2022 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development; BASED ON THE DECREENUMBER 113 /2007/ND-CP dated June 28, 2007 of the Government detailing and guiding the implementation of certain provisions of the Law on Levees; BASED ON THE DECREE NUMBER 53/2019/ND-CP dated June 17, 2019 of the Government stipulating detailed procedures for planning, reviewing, approving, and adjusting water conservancy plans; levee regulation plans; flood control plans for river sectors withlevees;

BASED ON THE DECREE NUMBER 05/2022/ND-CP dated January 7, 2022 amending and supplementing certain provisions of the Decree Number 53/2019/ND-CP dated June 17, 2019 of the Government; BASED ON THE DECREE NUMBER 32/2019/ND-CP dated April 10, 2019 of the Government stipulating the assignment of tasks, ordering or tendering for the provision of public products and services funded from the State budget's regular revenue;PURSUANT TO THE PROPOSAL OF THE DIRECTOR GENERAL OF THE NATIONAL NATURAL DISASTER PREVENTION AND CONTROL AGENCY;

THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT ISSUES THIS CIRCULAR ON ECONOMIC AND TECHNICAL STANDARDS FOR THE PREPARATION OF FLOOD CONTROL PLANS FOR RIVER SECTORS WITH LEVEES AND LEVEE REGULATION PLANS. ATTACHED TO THIS CIRCULAR ARE THE ECONOMIC AND TECHNICAL STANDARDS FOR THE PREPARATION OF FLOOD CONTROL PLANS FOR RIVER SECTORS WITH LEVEES AND LEVEE REGULATION PLANS.

THIS CIRCULAR SHALL TAKE EFFECT FROM FEBRUARY 15, 2023.

1. HEADS OF UNITS UNDER THE MINISTRY OF AGRICULTURE AND RURAL DEVELOPMENT AND ASSOCIATED ORGANIZATIONS AND INDIVIDUALS ARE RESPONSIBLE FOR IMPLEMENTING THIS CIRCULAR.

2. DURING THE APPLICATION OF THE ECONOMIC AND TECHNICAL STANDARDS, IF THERE ARE ANY DIFFICULTIES, OBSTACLES, OR NEW PROVISIONS GENERATED, THEY ARE REQUESTED TO REPORT TO THE MINISTRY OF AGRICULTURE AND RURAL DEVELOPMENT FOR TIMELY SYNTHESIS, ADJUSTMENT, AND SUPPLEMENTATION./.natural disasters;

The Minister of Agriculture and Rural Development issues the Circular on Economic and Technical Standards for Planning Flood Control for Dike-Protected River Sections and Dike Management Planning;flood control for dike-protected river sections and dike management planning.

Article 1. The Economic and Technical Standards for Planning Flood Control for Dike-Protected River Sections and Dike Management Planning are hereby attached to this Circular.

Article 2. This Circular takes effect from February 15, 2023.

Article 3. Implementation Organization

1. Heads of units under the Ministry of Agriculture and Rural Development and relevant agencies, organizations, and individuals are responsible for implementing this Circular.

2. During the application of economic and technical standards, if there are difficulties, obstacles, or new regulations arise, please report to the Ministry of Agriculture and Rural Development for timely consolidation, adjustment, and supplementation./.
