RESOLUTION
Regarding functions, tasks, powers, and organizational structure
of the National Assembly Office
THE STANDING COMMITTEE OF THE NATIONAL ASSEMBLY
On the basis of the Constitution of the Socialist Republic of Vietnam;
On the basis of The Law on the Organization of the National Assembly No. 57/2014/QH13 has been amended and supplemented with some articles according to Law No. 65/2020/QH14;
RESOLUTION:
Article 1. Functions of the National Assembly Office
The Office of the National Assembly is an administrative body with the function of providing comprehensive advisory services and support to the National Assembly, the Standing Committee of the National Assembly, the President of the National Assembly, Vice Presidents of the National Assembly, the Secretary-General of the National Assembly, the Ethnic Council, the Committees of the National Assembly, the Bureaus under the Standing Committee of the National Assembly, and National Assembly deputies.
Article 2. Tasks and powers of the National Assembly Office
1. Organizing services for sessions of the National Assembly and meetings of the Standing Committee of the National Assembly; implementing the work program and other activities of the National Assembly, the Standing Committee of the National Assembly, the Secretary-General of the National Assembly, the Ethnic Council, the Committees of the National Assembly, and the Bureaus under the Standing Committee of the National Assembly.
2. Advising and supporting the National Assembly, the Standing Committee of the National Assembly, the Ethnic Council, and the Committees of the National Assembly in legislative work; supporting the Standing Committee of the National Assembly in interpreting the Constitution, laws, and ordinances.
3. Advising and supporting the National Assembly in deciding fundamental policies on economic and social issues, state budget, important national projects, defense, security, foreign affairs, ethnic policies, religious policies of the State, and the organization and personnel matters of state agencies within the jurisdiction of the National Assembly.
4. Advising and supporting the National Assembly in exercising supreme supervision over compliance with the Constitution, laws, and resolutions of the National Assembly; supervising the activities of the President of the State, the Standing Committee of the National Assembly, the Government, the Supreme People's Court, the Supreme People's Procuracy, the National Election Council, the State Audit Agency, and other agencies established by the National Assembly. Advising and supporting the Standing Committee of the National Assembly in supervising the implementation of the Constitution, laws, resolutions of the National Assembly, ordinances, and resolutions of the Standing Committee of the National Assembly; supervising the activities of the Government, the Supreme People's Court, the Supreme People's Procuracy, and the State Audit Agency. Advising and supporting the supervision activities of the Ethnic Council and the Committees of the National Assembly.
5. Advising and supporting the Ethnic Council, the Committees of the National Assembly, and the Bureaus under the Standing Committee of the National Assembly according to their assignments, assisting the Standing Committee of the National Assembly in supervising and guiding the activities of People's Councils at all levels.
6. Advising and supporting the Ethnic Council, the Committees of the National Assembly, and the Bureaus under the Standing Committee of the National Assembly according to their assignments, assisting the Standing Committee of the National Assembly in determining the organizational structure, staffing, and establishing policies and systems for the People's Courts, People's Procuracies, the State Audit Agency, agencies under the Standing Committee of the National Assembly, and the Office of the National Assembly; policies and systems for National Assembly deputies; personnel matters within the jurisdiction of the Standing Committee of the National Assembly; the establishment, dissolution, merger, division, adjustment of territorial boundaries, and administrative restructuring below provincial and centrally-administered city levels; organizing public consultations as prescribed by law.
7. Assisting the Standing Committee of the National Assembly in coordinating work with the President of the State, the Government, the Central Steering Committee of the Vietnam Fatherland Front, the Supreme People's Court, the Supreme People's Procuracy, the State Audit Agency, and related agencies and organizations.
8. Coordinating with the Office of the National Election Council in advising and supporting election work for National Assembly deputies and People's Councils at all levels.
9. Advising and supporting the external affairs work of the National Assembly, the Standing Committee of the National Assembly, the Secretary-General of the National Assembly, the Ethnic Council, the Committees of the National Assembly, and the Bureaus under the Standing Committee of the National Assembly.
10. Advising and supporting the activities of the President of the National Assembly, Vice Presidents of the National Assembly, members of the Standing Committee of the National Assembly, and specialized representatives of the Ethnic Council, the Committees of the National Assembly, the Bureaus under the Standing Committee of the National Assembly, and the Office of the National Assembly.
11. Advising and supporting the Ethnic Council, the Committees of the National Assembly, and the Bureaus under the Standing Committee of the National Assembly according to their assignments, implementing citizen reception, complaint and denunciation letter handling, and processing; supporting the Standing Committee of the National Assembly in supervising the resolution of citizen complaints and denunciations and compiling opinions and suggestions from voters sent to the National Assembly.
12. Advising and drafting reports on the work of the Ethnic Council, the Committees of the National Assembly, and the Bureaus under the Standing Committee of the National Assembly.
13. Managing information, press, publishing, library, museum, information technology application, and digital transformation work of the National Assembly, the Standing Committee of the National Assembly, and the Office of the National Assembly.
14. Managing the operating funds of the National Assembly. Ensuring material infrastructure and other conditions for the operation of the National Assembly, the Standing Committee of the National Assembly, the Secretary-General of the National Assembly, the Ethnic Council, the Committees of the National Assembly, agencies under the Standing Committee of the National Assembly, and National Assembly deputies. Organizing and managing technical facilities, assets of the agency.
15. Organizing administrative, archival, security, and reception work for the National Assembly, the Standing Committee of the National Assembly, the Secretary-General of the National Assembly, the Ethnic Council, the Committees of the National Assembly, the Bureaus under the Standing Committee of the National Assembly, and the Office of the National Assembly.
16. Issuing documents within its authority; consolidating legal normative documents and codifying legal norms in legal normative documents issued by the National Assembly and the Standing Committee of the National Assembly as prescribed by law; consulting and supporting National Assembly deputies in drafting proposals for laws and ordinances, perfecting files for law and ordinance construction proposals to be submitted to the Standing Committee of the National Assembly and the National Assembly for consideration and inclusion in the Law and Ordinance Construction Program based on the requirements of National Assembly deputies; creating conditions for National Assembly deputies to propose laws and ordinances, draft laws and ordinances, and submit law and ordinance projects.
17. Implementing recruitment, management, and utilization of civil servants, officials, and contractual workers of the Office of the National Assembly.
18. Implementing inspection, supervision, complaint and denunciation resolution, violation handling, anti-corruption, and anti-waste measures as prescribed by law.
19. Implementing scientific research and international cooperation.
20. Assisting the Secretary-General of the National Assembly in performing the following tasks:
The National Assembly, the Standing Committee of the National Assembly, the Secretary-General of the National Assembly, the National Ethnic Council, the Committees of the National Assembly, the Boards under the Standing Committee of the National Assembly, and the Office of the National Assembly.
16. Issue documents within their authority; consolidate regulatory legal documents and codify legal provisions in regulatory legal documents issued by the National Assembly and the Standing Committee of the National Assembly in accordance with the law; advise and support National Assembly deputies in drafting petitions regarding laws and ordinances, perfecting the dossier for proposing to draft laws and ordinances according to regulations to submit to the Standing Committee of the National Assembly and the National Assembly for consideration and inclusion in the Law and Ordinance Construction Program at the request of National Assembly deputies; create conditions for National Assembly deputies to petition regarding laws and ordinances, propose to draft laws and ordinances, and submit draft laws and ordinances.
17. Implement recruitment, management, and utilization of civil servants, public officials, and contractual employees of the Office of the National Assembly.
18. Carry out inspection, supervision, complaint resolution, accusation handling, violation processing, anti-corruption, and anti-passivity activities; practice thrift and combat waste in accordance with the law.
19. Conduct scientific research and international cooperation.
20. Assist the Secretary-General of the National Assembly in performing the following tasks:
a) Advise the National Assembly Chairperson, the Standing Committee of the National Assembly on the proposed work program of the National Assembly, the Standing Committee of the National Assembly; on the procedures and processes for conducting activities of the National Assembly, the Standing Committee of the National Assembly. Assist the National Assembly Chairperson, the Standing Committee of the National Assembly to maintain contact with National Assembly deputies;
b) Advise and assist the Standing Committee of the National Assembly in managing the general operations of the National Assembly, ensuring compliance with the Rules of Procedure of the National Assembly sessions, the Working Regulations of the Standing Committee of the National Assembly;
c) Advise and assist the Standing Committee of the National Assembly in directing, coordinating, and coordinating the activities of the National Ethnic Councils, the Committees of the National Assembly;
Direct the bureaus, departments, units providing advisory and support services generally, and coordinate with the permanent offices of the National Ethnic Councils, the Committees of the National Assembly, the Heads of Departments under the Standing Committee of the National Assembly to direct the units directly providing advisory and support services to the National Ethnic Councils, the Committees of the National Assembly, the Departments under the Standing Committee of the National Assembly to assign civil servants to participate in supporting other units within the Office of the National Assembly to perform specific tasks at each time point in a timely manner to meet the requirements of the National Assembly, the Standing Committee of the National Assembly;
The National Assembly performs tasks at specific times to promptly meet the work requirements of the National Assembly and the Standing Committee of the National Assembly;
d) Propose improvements to the working system of the National Assembly, the Standing Committee of the National Assembly, the National Ethnic Councils, the Committees of the National Assembly, the Departments under the Standing Committee of the National Assembly, and the specialized activities of National Assembly deputies according to the directives of the Standing Committee of the National Assembly;
The National Assembly, the National Ethnic Council, the Committees of the National Assembly, the Boards under the Standing Committee of the National Assembly, and full-time National Assembly deputies operate according to the directives of the Standing Committee of the National Assembly;
e) Prepare reports on the work of the National Assembly, the Standing Committee of the National Assembly; reports assigned by the Standing Committee of the National Assembly, the National Assembly Chairperson, the Deputy Chairpersons of the National Assembly;
f) Supervise the preparation and ensure the procedures for submitting projects, proposals, reports, and presentations from relevant agencies and organizations to the National Assembly, the Standing Committee of the National Assembly;
g) Coordinate with the permanent offices of the National Ethnic Councils, the Committees of the National Assembly, and relevant agencies and organizations to draft resolutions on matters assigned by the National Assembly, the Standing Committee of the National Assembly. Organize the publication of resolutions of the National Assembly, the Standing Committee of the National Assembly;
h) Perform the duties of spokesperson for the National Assembly, the Standing Committee of the National Assembly;
i) Organize secretarial functions during National Assembly sessions, Standing Committee of the National Assembly meetings, specialized meetings of National Assembly deputies; collect and synthesize opinions of National Assembly deputies;
j) Other duties of the Secretary-General of the National Assembly;
21. Perform other tasks as prescribed by law or assigned by the National Assembly, the Standing Committee of the National Assembly, the National Assembly Chairperson, the Deputy Chairpersons of the National Assembly;
Article 3Establish, reorganize, or dissolve bureaus, departments, units;
1. The National Assembly Office may establish departments, bureaus, and units equivalent to department level and public service organizations.
Bureaus, departments, units equivalent to bureau level within the Office of the National Assembly that have multiple areas of work or special characteristics may establish rooms and units equivalent to room level;
The People's Representative Newspaper may establish Departments and units equivalent; Departments and units equivalent with multiple areas of work or special characteristics may establish rooms;
Vietnam National Assembly Television may establish rooms and units equivalent to room level;
2. The Standing Committee of the National Assembly decides to establish, reorganize, or dissolve bureaus, departments, units equivalent to bureau level, public service units under the Office of the National Assembly; decide the number of Departments and units equivalent under the People's Representative Newspaper; decide the maximum number of rooms and units equivalent to room level under bureaus, departments, public service units under the department and rooms, units equivalent to room level under the People's Representative Newspaper, Vietnam National Assembly Television;
The Office of the National Assembly; decides the number of Boards and equivalent units under the People's Representative Newspaper; decides the maximum number of departments and equivalent department-level units under bureaus, public service units under bureaus, and departments and equivalent department-level units under the People's Representative Newspaper and Vietnam National Assembly Television.
3. The Director of the Office of the National Assembly decides to establish, reorganize, or dissolve Departments and units equivalent under the People's Representative Newspaper, rooms and units equivalent to room level under bureaus, departments, public service units under the department and rooms, units equivalent to room level under the People's Representative Newspaper, Vietnam National Assembly Television, ensuring not to exceed the number specified in this Resolution;
Article 4. Organizational structure of the Office of the National Assemblyorganizational structure of the Office of the National Assembly
1. Bureaus directly providing advisory and support services to the National Ethnic Councils, the Committees of the National Assembly include:
a) Ethnic Affairs Bureau;
b) Legal Bureau;
c) Judicial Bureau;
d) Economic Bureau;
e) Financial and Budget Bureau;
f) Defense and Security Bureau;
g) Culture, Education Bureau;
h) Social Bureau;
i) Science, Technology, and Environment Bureau;
j) Foreign Relations Bureau;
2. Bureaus, units equivalent to bureau level directly providing advisory and support services to the Departments under the Standing Committee of the National Assembly include:
a) Petitions Bureau;
b) Deputies' Work Bureau;
c) Training Center for Elected Representatives;
3. Bureaus, departments, units equivalent to bureau level providing general advisory and support services include:
a) Secretariat Bureau;
b) Consolidation Bureau;
c) Oversight Support Bureau;
d) Organization and Cadres Bureau;
e) Administrative Bureau;
The internal organizational structure of the Administrative Bureau shall not exceed three rooms;
e) The Planning and Finance Division;
f) Information Bureau;
g) National Assembly Library;
h) Computing Bureau;
The internal organizational structure of the Computing Bureau shall not exceed three rooms and units equivalent to room level;
i) Protocol and International Cooperation Bureau;
The internal organizational structure of the Protocol and International Cooperation Bureau shall not exceed three rooms;
j) Management Bureau I;
The internal organizational structure of Management Bureau I shall not exceed six rooms, units equivalent to room level, and one public service unit which is the National Assembly Guest House in Hanoi;
k) Management Bureau II;
The internal organizational structure of Management Bureau II shall not exceed three rooms, units equivalent to room level, and one public service unit which is the National Assembly Guest House in Ho Chi Minh City;
l) Management Bureau III;
The internal organizational structure of Management Bureau III shall not exceed three rooms, units equivalent to room level, and one public service unit which is the National Assembly Guest House in Da Nang;
m) Party and Mass Organizations Office;
4. Public service units include:
a) The People's Representative Newspaper;
The internal organizational structure of the People's Representative Newspaper shall have six Departments and units equivalent to Department level; not exceeding five rooms under Departments and units equivalent to Department level;
b) Vietnam National Assembly Television;
The internal organizational structure of Vietnam National Assembly Television shall not exceed fifteen rooms and units equivalent to room level;
Article 5. Directive and management work
1. The Director of the Office of the National Assembly is the head of the Office of the National Assembly, leading the work of the Office of the National Assembly; responsible before the National Assembly, the Standing Committee of the National Assembly for the work of the Office of the National Assembly;
Deputy Directors of the Office of the National Assembly assist the Director of the Office
The National Assembly fulfills tasks assigned by the Director of the National Assembly Office; is responsible before the Standing Committee of the National Assembly, the Director of the National Assembly Office, and before the law for the fulfillment of assigned tasks.
2. The Standing Committee of the National Ethnic Council, the Standing Committees of the National Assembly's Committees, and the Heads of the Committees under the Standing Committee of the National Assembly are responsible to the Standing Committee of the National Assembly regarding the contents of work as stipulated in Clause 1 of Article 6, Clause 2 and Clause 3 of Article 7, and Clause 1 of Article 8 of this Resolution.
3. Department heads, bureau chiefs, equivalent unit chiefs, and directors of public service establishments manage their respective departments, bureaus, units, and establishments. They assist department heads, bureau chiefs, equivalent unit chiefs, and directors of public service establishments with one or more deputy chiefs according to functions, tasks, and actual conditions and characteristics of the departments, bureaus, and units.
The average number of deputy chiefs for the heads of departments, bureaus, and equivalent units does not exceed three persons per unit. The Director of the National Assembly Office decides on the specific number for each unit after consulting the National Assembly Leadership.
The number of deputy chiefs for the heads of the People's Representative Newspaper and Vietnam National Assembly Television does not exceed three persons per unit.
4. Section chiefs, equivalent unit chiefs, and directors of public service establishments under bureaus manage and implement the work of their sections, equivalent units, and public service establishments under bureaus; only in cases of real necessity will deputy chiefs be arranged to assist section chiefs and equivalent unit chiefs.
The number of deputy positions for division heads and heads of units equivalent to division level shall be implemented in accordance with the law.
The number of deputy chiefs for the heads of public service establishments under bureaus does not exceed three persons per unit.
Article 6. Functions a) Providing testimonies and expert opinions for the case for which they have been summoned; duties, and leadership and direction of work of departments, bureaus, and units
1. The Director of the National Assembly Office collaborates with the Standing Committee of the National Ethnic Council, the Standing Committees of the National Assembly's Committees, and the Heads of the Committees under the Standing Committee of the National Assembly to define the functions, tasks, and authorities of departments and units directly advising and assisting the National Ethnic Council, the National Assembly's Committees, and the Committees under the Standing Committee of the National Assembly.
The Standing Committee of the National Ethnic Council, the Standing Committees of the National Assembly's Committees, and the Heads of the Committees under the Standing Committee of the National Assembly directly direct the work of departments and units directly advising and assisting the National Ethnic Council, the National Assembly's Committees, and the Committees under the Standing Committee of the National Assembly.
2. The Director of the National Assembly Office defines the functions, tasks, and directs the work of departments, bureaus, and equivalent units providing general advisory and assistance services, and public service establishments under the National Assembly Office.
Article 7. Organizational and Cadre Work
1. The Director of the National Assembly Office is appointed, relieved of duty, dismissed, allowed to resign, or relieved from duty by the Standing Committee of the National Assembly upon the proposal of the National Assembly Chairman.
Deputy Directors of the National Assembly Office are appointed, relieved of duty, dismissed, allowed to resign, or relieved from duty by the Standing Committee of the National Assembly upon the proposal of the Director of the National Assembly Office.
2. The Director of the National Assembly Office decides on the recruitment, transfer, assignment, rotation, training, development, evaluation, classification, commendation, reward, punishment, and implementation of regulations and policies for civil servants and officials within his/her authority; appoints, reappoints, relieves of duty, allows to resign, or relieves from duty leaders and managers for positions from deputy section chief upwards in departments, bureaus, units, and public service establishments under the National Assembly Office.
The Director of the National Assembly Office consults and agrees with the Standing Committee of the National Ethnic Council, the Standing Committees of the National Assembly's Committees, and the Heads of the Committees under the Standing Committee of the National Assembly before deciding on the above matters concerning personnel in departments and units directly advising and assisting the National Ethnic Council, the National Assembly's Committees, and the Committees under the Standing Committee of the National Assembly.
The Director of the National Assembly Office decides on the hierarchical management of officials in public service establishments according to the provisions of the law.
3. The Standing Committee of the National Ethnic Council, the Standing Committees of the National Assembly's Committees, and the Heads of the Committees under the Standing Committee of the National Assembly cooperate with the Director of the National Assembly
Office in managing civil servants in departments and units directly advising and assisting the National Ethnic Council, the National Assembly's Committees, and the Committees under the Standing Committee of the National Assembly.
Article 8. Financial and asset management work
1. The Standing Committee of the National Assembly, the Standing Committees of the National Assembly's Committees, and the Heads of agencies under the Standing Committee of the National Assembly decide on the use of funds and assets allocated and equipped to the National Assembly's Ethnic Council, the National Assembly's Committees, and agencies under the Standing Committee of the National Assembly in accordance with the provisions of the law.
2. The National Assembly Office implements financial and asset management operations in accordance with the provisions of the law.
Article 9. Effective Date
1. This Resolution shall take effect from the date of its adoption.
2. Resolution No. 417/2003/NQ-UBTVQH11 dated October 1, 2003 of the Standing Committee of the National Assembly on the functions, tasks, powers, and organizational structure of the National Assembly Office, and Resolution No. 618/2013/UBTVQH13 dated July 10, 2013 of the Standing Committee of the National Assembly amending and supplementing certain articles of Resolution No. 417/2003/NQ-UBTVQH11 dated October 1, 2003 shall cease to be effective from the date this Resolution takes effect.
3. Resolution No. 816/2009/UBTVQH12 dated July 28, 2009 of
the Standing Committee of the National Assembly on upgrading and renaming the People's Representative Newspaper shall cease to be effective from the date the Director of the National Assembly Office issues a Decision on the functions, tasks, powers, and organizational structure of the People's Representative Newspaper.
This Resolution was adopted by the Standing Committee of the National AssemblySocialist Republic of Vietnam National Assembly, 15th term adopted on July 12, 2022.
