Based onLaw on Standards and Technical Regulations No. 68/2006/QH11 amended and supplemented by Law No. 35/2018/QH14 and Law No. 70/2025/QH15;

Based on Decree No. 22/2026/NĐ-CP of the Government detailing certain provisions and measures to organize, guide implementation of the Law on Standards and Technical Regulations;

Based on Decree No.40/2025/NĐ-CP of the Government regulating functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade amended by Decree No. 109/2025/NĐ-CP, Decree No. 193/2025/NĐ-CP;

In accordance with a proposal from Director General of the Innovation and Green Transformation Industrial Promotion Bureau;, The Minister of Industry and Trade promulgates this Decree

regulating activities of construction,applying national standards and technical regulations of the Ministry of Industry and Trade Chapter I GENERAL PROVISIONS, Article 1. Scope of application This Decree regulates activities of construction and the application of national standards and technical regulations by the Ministry of Industry and Trade. Article 2. Applicability.

This Decree applies to units under the Ministry of Industry and Trade and other organizations and individuals related thereto.

Article 3. Funding for construction, application, and dissemination of national standards and technical regulations

1. The sources of funding for activities of construction, application, and dissemination of national standards and technical regulations by the Ministry of Industry and Trade include: state budget funds for science, technology, innovation, and digital transformation for standardization activities; other state budget funds approved by competent authorities in accordance with annual budget forecasts; voluntary support from organizations and individuals both within and outside the country and other sources as provided by law.

2. Funding for drafting the Decree to issue national technical regulations is allocated from the state budget assigned for legislative text drafting tasks.

Funding for research, surveying, evaluation of scientific bases and practical cases to serve the development of national technical regulations may be considered for allocation from the state budget for science, technology, innovation, digital transformation and other sources as provided by law.

3. Expenditure items, budgets, and final accounts of funds from various funding sources shall be carried out in accordance with relevant laws.

Article 4. Principles for determining the objects of national standardization and technical regulation activities of the Ministry of Industry and Trade

1. The fields of national standards and technical regulations under the responsibility of the Ministry of Industry and Trade, as assigned by the Government in Decree No. 40/2025/NĐ-CP amended by Decree Nos. 109/2025/NĐ-CP and 193/2025/NĐ-CP and related regulatory documents.
2. The construction and issuance of national technical regulations by the Ministry of Industry and Trade shall comply with the principles stipulated in Article 26a of Law No. 68/2006/QH11 amended by Laws Nos. 35/2018/QH14 and 70/2025/QH15.

In case of overlapping or overlap regarding the objects of national technical regulations among units under the Ministry of Industry and Trade, the Minister of Industry and Trade shall decide on the unit to take the lead in drafting and submitting for issuance of the national technical regulation.

Article 4. Principles for Determining the Scope of National Standardization and Technical Standards Activities of the Ministry of Industry and Trade

1. The fields of national standards and technical standards subject to the management responsibility of the Ministry of Industry and Trade, as assigned by the Government in Decree No. 40/2025/NĐ-CP, amended and supplemented by Decree No. 109/2025/NĐ-CP, Decree No. 193/2025/NĐ-CP, and related regulatory documents.

2. The formulation and issuance of national technical standards by the Ministry of Industry and Trade shall comply with the principles stipulated in Article 26a of Law No. 68/2006/QH11, amended and supplemented by Law No. 35/2018/QH14 and Law No. 70/2025/QH15.
In the event of overlapping or intersecting scope of technical standards between units under the Ministry of Industry and Trade, the Minister of Industry and Trade shall decide which unit will be responsible for formulating and submitting the national technical standard for issuance.

Article 5. Database on Standards, Metrology, and Quality of the Ministry of Industry and Trade

1. The database on standards, metrology, and quality of the Ministry of Industry and Trade includes information as specified in Clause 3, Article 10 of Decree No. 22/2026/NĐ-CP and is updated and shared into the national database on standards, metrology, and quality.

2. Units under the Ministry shall promptly share and update data into the national database on standards, metrology, and quality in accordance with regulations.

Article 6. International Cooperation on Standards and Technical Specifications

1. International cooperation on standards and technical specifications is carried out in accordance with the provisions of the law on standards and technical specifications.

2. Based on practical experience in state management in the field, units under the Ministry responsible for the sector or field shall study and propose content for international cooperation on standards and technical specifications.

Article 7. Mutual Recognition Agreements and Unilateral Recognition of Conformity Assessment Results

1. Mutual recognition agreements and unilateral recognition of conformity assessment results are implemented in accordance with the provisions of Article 40 and Article 41 of Decree No. 22/2026/NĐ-CP and relevant legal provisions.

2. Units under the Ministry responsible for the sector or field propose and organize the implementation of mutual recognition agreements and unilateral recognition of conformity assessment results in accordance with the provisions of Article 40 and Article 41 of Decree No. 22/2026/NĐ-CP and relevant legal provisions.

Chapter II ESTABLISHMENT AND IMPLEMENTATION OF NATIONAL STANDARDS (TCVN)

Article 8. National Standards Development Plan

1. The national standards development plan for each year, five-year period, supplementation, and amendment is prepared in accordance with the provisions of the law on standards and technical specifications and this Circular.
Timeframe for preparing the national standards development plan as follows:

a) The five-year plan is prepared in the year preceding the first year of the planning period;

b) The annual plan is prepared before December 1st each year, and may be revised or supplemented by June 30th of the implementation year.

2. Based on the National Standards Strategy, sectoral development requirements, management needs, and documents from competent authorities, units under the Ministry, scientific and technological organizations, and other organizations and individuals submit proposals for national standards in accordance with the five-year and annual plans to the Ministry of Industry and Trade (through the Bureau of Innovation, Green Transformation, and Industrial Promotion).

3. The Bureau of Innovation, Green Transformation, and Industrial Promotion reviews and approves according to legal provisions; compiles a proposal for the national standards development plan and reports to the leadership of the Ministry for signature in a document sent to the Ministry of Science and Technology proposing the national standards development plan of the Ministry of Industry and Trade for consolidation and examination.
The proposal for the five-year national standards development plan and the proposal for the annual national standards development plan are prepared in accordance with the provisions at point b, paragraph 1, Article 13 of Decree No. 22/2026/NĐ-CP and relevant legal provisions.

Article 9. Development, Proposal for Review, and Publication of National Standards

1. The procedure and process for developing a draft national standard are as follows:

a) A draft national standard is developed in accordance with the provisions at points a, b, c, paragraph 1, Article 14 of Decree No. 22/2026/NĐ-CP and relevant regulations;

b) In cases where a draft national standard is developed through a simplified procedure:
The Minister decides on the application of the simplified procedure for national standards led by the Ministry of Industry and Trade based on the proposal from the lead unit, with input from the Bureau of Innovation, Green Transformation, and Industrial Promotion.
The lead units implement the simplified procedure in accordance with Article 23 of Decree No. 22/2026/NĐ-CP and relevant regulations;

c) For national standards involving state secrets, development is carried out in accordance with the provisions at Article 24 of Decree No. 22/2026/NĐ-CP and relevant regulations.

2. Presentation and expression of the content of the draft national standard are conducted in accordance with the provisions of the law on standards and technical specifications relevant to this matter.

3. Proposal for review, publication of national standards

a) After completing the research and development of the draft national standard as per the approved plan, the lead drafting unit submits the review application for the draft national standard to the Ministry of Industry and Trade (through the Bureau of Innovation, Green Transformation, and Industrial Promotion);

b) The Bureau of Innovation, Green Transformation, and Industrial Promotion takes the lead in coordinating with relevant units under the Ministry to review the draft national standard; reports to the leadership of the Ministry for signature in a document transferred to the Ministry of Science and Technology for review;

c) In cases where further refinement of the draft national standard is required based on the review, the drafting unit responsible has the duty to revise and complete the application within 70 days from the date of notification of the review to resubmit to the Bureau of Innovation, Green Transformation, and Industrial Promotion for review, reporting to the leadership of the Ministry for signature in a document transferred to the Ministry of Science and Technology for publication;

d) In cases where a draft national standard is developed through a simplified procedure, the lead drafting unit proposes the application for review and publication of the national standard according to points a, b, and c of this clause;

e) In cases where a draft national standard is developed involving state secrets, the lead drafting unit submits the review application for the draft national standard to the Bureau of Innovation, Green Transformation, and Industrial Promotion for review in accordance with the provisions of the law on standards and technical specifications and relevant legal provisions.
The lead drafting unit for a draft national standard involving state secrets finalizes the application according to the review comments, transfers it to the Bureau of Innovation, Green Transformation, and Industrial Promotion for reporting to the leadership of the Ministry for examination and publication.
The Bureau of Innovation, Green Transformation, and Industrial Promotion notifies the Ministry of Science and Technology regarding the publication of the national standard.

4. Draft National Standards Application Files
Units tasked with drafting a draft national standard prepare an application file for review of the draft national standard and are responsible for its content, specifically:

a) The application file for review of the draft national standard in accordance with point c, paragraph 1, Article 14 of Decree No. 22/2026/NĐ-CP;

b) The application file for review of the draft national standard through a simplified procedure in accordance with point c, paragraph 2, Article 23 of Decree No. 22/2026/NĐ-CP.

c) The dossier for review and the dossier for publication of national standards (TCVN) concerning objects falling under the list of state secrets shall be carried out in accordance with the provisions at point c, point d clause 2 Article 24 Decree No. 22/2026/NĐ-CP.

Article 10. Correction, Review, Evaluation of the Effectiveness of Applying TCVN, Amending, Supplementing, Abolishing, Replacing TCVN

1. The correction, review, evaluation of the effectiveness of applying TCVN, amendment, supplementation, abolition, replacement shall be carried out in accordance with the provisions at Article 17, Article 18, Article 19, Article 20, and Article 21 Decree No. 22/2026/NĐ-CP and relevant provisions.

2. The Bureau of Innovation, Green Transformation and Promotional Industry shall take the lead in coordinating with units under the Ministry to organize review and evaluation of the effectiveness of applying TCVN developed by the Ministry of Industry and Trade.
The results of the review and evaluation serve as a basis for proposing amendments, supplements, abolition or replacement of TCVN.

Article 11. Publicity and Guidance on Applying National Standards

1. The Bureau of Innovation, Green Transformation and Promotional Industry shall take the lead in coordinating with units under the Ministry, relevant agencies, organizations, and individuals to develop a plan for publicity and guidance on applying TCVN developed by the Ministry of Industry and Trade or TCVN related to the areas of state management of the Ministry of Industry and Trade and submit it to the Minister for examination and approval before December 31 each year.

2. The Bureau of Innovation, Green Transformation and Promotional Industry shall organize the implementation of the plan after its approval.

Chapter III DEVELOPMENT, ISSUANCE AND IMPLEMENTATION OF NATIONAL TECHNICAL REGULATIONS (QCVN)

Article 12. Plan for Developing QCVN

1. Time for preparation and approval of the plan:

a) The five-year plan for developing QCVN is prepared and approved before December 15 of the year preceding the start of the five-year plan;

b) The annual plan for developing QCVN is prepared and approved before December 15 of the year prior to its implementation.

2. Based on strategic plans, master plans, development directions in sectors or fields, instructions from competent authorities, and management requirements, units under the Ministry shall submit proposals for the development plan of QCVN to the Bureau of Innovation, Green Transformation and Promotional Industry for consolidation and examination according to regulations.
The format of the five-year plan for developing QCVN and the annual plan for developing QCVN of the Ministry of Industry and Trade are specified in the annexes attached to this Circular.

3. The Bureau of Innovation, Green Transformation and Promotional Industry shall report the draft development plan of QCVN to the leadership of the Ministry for examination and send it for written comments to relevant agencies, organizations, and individuals according to the provisions at Article 26 Decree No. 22/2026/NĐ-CP.

4. The Bureau of Innovation, Green Transformation and Promotional Industry shall take the lead in coordinating with units under the Ministry to handle comments and complete the draft development plan of QCVN before reporting it to the leadership of the Ministry for examination and approval of the development plan.
After approval, the Bureau of Innovation, Green Transformation and Promotional Industry shall cooperate with the Bureau of E-commerce and Digital Economy to publicly post the development plan of QCVN of the Ministry of Industry and Trade on the National Database of Standards, Metrology, and Quality and send it to the People's Daily for publication on the Ministry’s electronic information portal within 30 days from the date of approval.

5. Based on practical implementation of the approved plan and management requirements, units under the Ministry shall submit proposals for adjustment or supplementation of the development plan of QCVN to the Bureau of Innovation, Green Transformation and Promotional Industry according to this provision.

Article 13. Drafting of QCVN

1. The procedure and process for drafting a draft QCVN shall be carried out in accordance with the provisions at points (a), (b) and (c) of Clause 1, Article 27 of Decree No. 22/2026/NĐ-CP and relevant laws.

2. The drafting of a draft QCVN shall be carried out in accordance with the expedited procedure

a) The Minister decides to apply the expedited procedure for specific drafts of QCVN based on the report and proposal from the lead unit, the opinion of the Office of Innovation, Green Transformation, and Industrial Promotion, and the opinion of the Ministry of Science and Technology during the process of formulating the plan for QCVN.

b) The drafting of a draft QCVN in accordance with the expedited procedure shall be carried out in accordance with the provisions at Clause 1, Article 29 of Decree No. 22/2026/NĐ-CP and relevant laws.

3. The procedure and process for drafting a draft QCVN for objects falling under the category of state secrets shall be carried out in accordance with the provisions at Clause 2, Article 28 of Decree No. 22/2026/NĐ-CP and relevant laws.

4. The report on the assessment of the impact of a draft QCVN shall be carried out in accordance with the provisions at Clause 6, Article 27 of Decree No. 22/2026/NĐ-CP.

Article 14. Review of the Draft QCVN File

1. The lead unit responsible for drafting a draft QCVN shall submit a request for review of the draft QCVN file to the Legal Affairs Division to take charge and organize the review process. The contents of the submitted file for review are in accordance with the provisions at Clause 3, Article 17 of Circular No. 47/2025/TT-BCT and the provisions at point (d) of Clause 1, Article 27 of Decree No. 22/2026/NĐ-CP.

2. The Legal Affairs Division shall send a document requesting the Office of Innovation, Green Transformation, and Industrial Promotion to propose members of the Review Committee for the draft QCVN file before reporting to the Department Leadership for approval of the decision establishing the Review Committee within seven days from the date of receipt of a valid submitted file.
The composition of the Review Committee for the draft QCVN file shall ensure compliance with the provisions at point (d) of Clause 1, Article 27 of Decree No. 22/2026/NĐ-CP, including: the Chairperson of the Committee, members as prescribed, and the Secretary of the Committee. Members of the drafting team for the draft QCVN shall not be members of the Review Committee.

3. The Review Committee shall conduct a review of two contents: The Director of the Office of Innovation, Green Transformation, and Industrial Promotion shall preside over the review of the draft QCVN file in accordance with the provisions at Article 33 of Law No. 68/2006/QH11 as amended by Laws Nos. 35/2018/QH14 and 70/2025/QH15. The Director of the Legal Affairs Division shall preside over the review of the draft circular promulgating QCVN in accordance with the provisions of laws on the issuance of normative legal documents. The Secretary of the Review Committee for the review of the draft QCVN file is a civil servant from the Office of Innovation, Green Transformation, and Industrial Promotion. The Secretary of the Review Committee for the review of the draft circular promulgating QCVN is a civil servant from the Legal Affairs Division.
In case the draft QCVN is drafted by the Office of Innovation, Green Transformation, and Industrial Promotion, the Legal Affairs Division shall report to the Minister who will designate an entity to review the draft QCVN file.
The results of the review of each content are recorded in a minutes of review. The Legal Affairs Division is responsible for the minutes of review of the draft circular promulgating QCVN, and the Office of Innovation, Green Transformation, and Industrial Promotion is responsible for the minutes of review of the draft QCVN file.

4. Based on the minutes at Clause 3 hereof, the Legal Affairs Division shall compile, prepare a report on the review, and send it to the lead unit responsible for drafting the draft QCVN for study, acceptance, revision, and finalization of the draft QCVN.

Article 15. Seeking Opinions from the Ministry of Science and Technology

The lead unit in drafting the draft QCVN shall complete the draft QCVN file according to the conclusions of the Review Board and report, submit for approval by the leader responsible at the Ministry to sign a document seeking opinions from the Ministry of Science and Technology. The submission process for seeking opinions is carried out in accordance with point (d) clause 1 Article 27 Decree No. 22/2026/NĐ-CP and related provisions.

Article 16. Completing the draft QCVN file and submitting it for issuance

1. The lead unit in drafting the draft QCVN shall review, absorb, and complete the QCVN file according to the review comments of the Review Board on the draft QCVN, the comments from the Ministry of Science and Technology, and report, submit for approval by the leader responsible at the Ministry in accordance with legal provisions governing the preparation and issuance of normative legal documents.
The submission process for issuing the QCVN is carried out in accordance with point (g) clause 1 Article 27 Decree No. 22/2026/NĐ-CP.

2. During the process of completing the draft QCVN, any reservations regarding the review comments from the Review Board on the draft QCVN and the comments from the Ministry of Science and Technology must be clearly stated in the Proposal for Issuing the QCVN.

Article 17. Presentation and Expression of the Content of the Draft QCVN

The presentation and expression of the content of the draft QCVN are carried out in accordance with relevant legal provisions.

Article 18. Amending, Supplementing, Abolishing, Replacing, and Correcting QCVN

1. Amendments, supplements, abolition, replacement, and correction of QCVN shall be carried out in accordance with the provisions of Articles 32, 33, 34, and 36 Decree No. 22/2026/NĐ-CP.

2. The sequence and procedures for amending and supplementing QCVN are carried out in accordance with the sequence and procedures for drafting and issuing QCVN as stipulated in Articles 12, 13, 14, 15, and 16 of this Circular.

3. The lead unit in drafting QCVN shall be responsible for reviewing and proposing to the leader at the Ministry regarding corrections and abolition of QCVN in accordance with legal provisions.
The results of correcting and abolishing QCVN are reported to the Office of Innovation, Green Transformation, and Industrial Promotion to compile and update on the National Database of Standards, Metrology, and Quality.

Article 19. Registration, Publicity, and Guidance for Applying QCVN

1. The lead units in drafting QCVN shall notify the Office of Innovation, Green Transformation, and Industrial Promotion about the QCVN that have been signed and issued by the leader at the Ministry to compile and submit to the Ministry of Science and Technology for registration in accordance with Article 35 Decree No. 22/2026/NĐ-CP.

2. The Office of Innovation, Green Transformation, and Industrial Promotion shall be responsible for formulating a plan for publicity and guidance on the application of national technical standards drafted by the Ministry of Industry and Trade, in coordination with relevant units within the ministry, agencies, organizations, and individuals, and submit it to the Minister for examination and approval before December 31 each year.
The lead units in drafting QCVN shall implement the approved plan related to the content assigned after its approval.

Article 20. Drafting Files and Archiving of Draft QCVN

1. The draft QCVN file is compiled according to regulations, including: the file for seeking opinions on the draft QCVN; the file for reviewing the draft QCVN; and the file for issuing the QCVN.

2. Archiving shall be as follows:

a) The lead unit in drafting shall retain all files related to seeking opinions, requesting review, and issuing the QCVN;

b) The Office of Innovation, Green Transformation, and Industrial Promotion retains the file for reviewing the QCVN.

3. The retention period of the file is in accordance with current legal provisions.

Article 21. Management and Assignment of QCVN Numbers

1. The Innovation and Green Transformation Bureau manages and assigns numbers to QCVNs under the Ministry of Industry and Trade.

2. Units responsible for drafting QCVNs submit documents to the Innovation and Green Transformation Bureau requesting assignment of QCVN numbers after the leadership of the Ministry signs and promulgates the QCVN.

3. The Ministry's Office issues a Circular on the issuance of QCVNs following receipt of the number assignment document from the Innovation and Green Transformation Bureau.

Article 22. Review and Evaluation of the Effectiveness of QCVN Implementation

1. The unit responsible for drafting QCVNs organizes periodic reviews and evaluations of the effectiveness of QCVN implementation every five years or sooner as necessary, from the date of promulgation.

2. Evaluations of the effectiveness of QCVN implementation are conducted in accordance with Article 31 of Decree No. 22/2026/NĐ-CP.

Chapter IV IMPLEMENTATION ORGANIZATION

Article 23. Responsibilities of Units under the Ministry of Industry and Trade

1. The Innovation and Green Transformation Bureau

a) Takes the lead in coordinating with units within the ministry and relevant agencies to develop and submit programs, plans, and regulatory documents related to standards and technical regulations under the management responsibilities of the Ministry of Industry and Trade;

b) Acts as the focal point for advising the Minister of Industry and Trade on unified management of the national standard system, including national technical regulations developed and issued by the ministry; manages and assigns numbers to QCVNs of the Ministry of Industry and Trade;

c) Takes the lead in coordinating with units within the ministry to develop and submit a five-year plan for drafting QCVNs to the minister; compiles proposals for the ministry's TCVN (National Standard) plans, submits them to the Ministry of Science and Technology for consolidation and approval; develops and submits approved plans for promoting and applying TCVNs, QCVNs, and implements according to the approved plans;

d) Takes the lead in reviewing draft QCVNs and draft TCVNs listed in the national security list as per this Circular and relevant laws and regulations;

d) Takes the lead in drafting and submitting for approval the issuance, revision, supplementation, replacement, abolition, or correction of TCVNs and QCVNs under its management domain and other domains as assigned by the leadership of the ministry; is responsible for the content of TCVNs and QCVNs drafted by the bureau that fall within the national regulatory management responsibilities assigned; takes the lead in reviewing and evaluating the effectiveness of applying TCVNs developed by the ministry; reviews and evaluates the effectiveness of QCVNs developed by the bureau;

e) Manages and guides activities related to conformity assessment and declaration of conformity for entities under its management domain according to legal provisions;

g) Acts as the focal point in guiding people's committees at provincial and municipal levels in organizing registration of industry-specific conformity assessment activities within the ministry’s regulatory scope; implements inspections of administrative procedures related to the ministry’s regulatory scope as stipulated by Decree No. 22/2026/NĐ-CP and this Circular, which are carried out by people's committees at provincial and municipal levels;

h) Acts as a focal point in coordinating with units within the ministry for compiling and managing data on standards, metrology, and quality;

i) Proposes allocation of funds from national budget sources related to science, technology, innovation, and digital transformation for activities related to national standards and technical regulations under the ministry’s purview;

k) Takes the lead in researching and proposing to the minister of industry and trade agreements on mutual recognition of conformity assessment results and unilateral recognition of such results within the management domain;

l) Performs other tasks as specifically assigned by the leadership of the ministry; focal point for international cooperation in the field of standards and technical regulations under the ministry.

2. The Legal Affairs Department
Takes the lead in reviewing draft QCVN Circulars according to this Circular and legal provisions on issuing regulatory documents.

3. Units within the Ministry

a) Takes the lead in proposing five-year and annual plans for drafting TCVNs, QCVNs in their assigned management domains and submits them to the Innovation and Green Transformation Bureau for consolidation and reporting to the minister for examination and approval; reviews and evaluates the effectiveness of applying QCVNs according to regulations;

b) Takes the lead in drafting and submitting for approval the issuance, revision, supplementation, replacement, abolition, or correction of TCVNs, QCVNs under their assigned management domains;

c) Is responsible for the content of TCVNs drafted by the unit and the content of QCVNs for entities under national regulatory responsibilities according to functions and duties;

d) Manages and guides activities related to conformity assessment and declaration of conformity according to technical regulations for entities under their assigned management domains as per legal provisions;

d) Provides information, updates data on standards, metrology, and quality relevant to the unit's regulatory responsibilities into the National Database on Standards, Metrology, and Quality in accordance with regulations;

e) Takes the lead in researching and proposing to the minister of industry and trade agreements on mutual recognition of conformity assessment results and unilateral recognition of such results within their management domain;

g) Cooperates with the Innovation and Green Transformation Bureau in implementing legal provisions related to standards and technical regulations;

h) Receives and processes information alerts from other countries regarding products, goods under national regulatory responsibilities that do not meet standards or technical regulations and relevant provisions;

i) Performs other tasks as assigned.

4. The Department of E-commerce and Digital Economy

a) Acts as the lead bureau for the Ministry of Industry and Trade in connecting and ensuring the operation of the National Database on Standards, Metrology, and Quality according to delegated authority.

b) Cooperates with the Innovation and Green Transformation Bureau in guiding units within the ministry in using and updating, sharing data according to regulations.

5. The Multilateral Trade Policy Department
The person in charge shall coordinate negotiations and implement contents related to economic international integration within international organizations and free trade agreements (FTA) and international treaties that regulate technical standards and specifications.

6. Department of Foreign Market Development

a) Coordinate the collection of foreign technical standard information at the request of units under the Ministry to serve the research, development, and application of national technical standards and specifications within the scope of management by the Ministry of Industry and Trade;

b) Coordinate with units under the Ministry to study, propose, and report to the Minister of Industry and Trade on the signing of mutual recognition agreements and unilateral recognition of evaluation results in the field of state administration managed by the Ministry of Industry and Trade.

7. Department of Export-Import
The focal point for communication and inquiry regarding technical standards within the framework of the World Trade Organization's Agreement on Technical Barriers to Trade.

Article 24. Responsibilities of Organizations and Individuals in Drafting TCVN, QCVN

Organizations and individuals entrusted by the Ministry of Industry and Trade with the research, review, evaluation, and drafting of TCVN, QCVN shall be responsible for:

1. Implementing according to the provisions of this Circular.

2. Being responsible for the content, schedule, and use of research funds for the drafting of TCVN, QCVN in accordance with regulations.

Article 25. Enforceability

1. This Circular shall come into force on April 29, 2026.

2. The Circular No. 46/2014/TT-BCT dated December 3, 2014, of the Minister of Industry and Trade concerning activities related to the development and application of national technical standards and specifications of the Ministry of Industry and Trade shall cease to be effective from the date this Circular comes into force.

Article 26. Implementation Responsibility

1. Heads of units under the Ministry of Industry and Trade and other relevant organizations and individuals are responsible for organizing and implementing this Circular.

2. In case any legal documents cited in this Circular are amended, supplemented, or replaced, implementation shall be carried out according to the amended, supplemented, or replacement document.

3. During the implementation process, if any issues arise or ambiguities occur, organizations and individuals should promptly report in writing to the Ministry of Industry and Trade (through the Office of Innovation, Green Transformation, and Industrial Promotion) for guidance or consideration of amendments or supplements.
