CIRCULAR

REGULATIONS ON THE DEVELOPMENT, ISSUANCE, AND IMPLEMENTATION OF NATIONAL STANDARDS AND TECHNICAL SPECIFICATIONS IN THE MILITARY AND DEFENSE SECTOR

BASED ON DECREE NO. 68/2006/QH11 ON NATIONAL STANDARDS AND TECHNICAL SPECIFICATIONS, AMENDED AND ENHANCED BY LAWS NO. 70/2025/QH15;

BASED ON DECREE NO. 22/2026/NĐ-CP OF THE GOVERNMENT REGULATING DETAILS OF CERTAIN ARTICLES AND MEASURES FOR ORGANIZATIONAL AND GUIDANCE IMPLEMENTATION OF LAWS ON NATIONAL STANDARDS AND TECHNICAL SPECIFICATIONS;

BASED ON DECREE NO. 01/2022/NĐ-CP OF THE GOVERNMENT REGULATING FUNCTIONS, TASKS, POWERS, AND ORGANIZATIONAL STRUCTURE OF THE MINISTRY OF DEFENSE, AMENDED BY DECREE NO. 03/2025/NĐ-CP;

IN ACCORDANCE WITH THE RECOMMENDATION OF THE CHIEF STAFF COMMANDER;

THE MINISTER OF DEFENSE ISSUES THIS CIRCULAR REGULATING THE DEVELOPMENT, ISSUANCE, AND IMPLEMENTATION OF NATIONAL STANDARDS AND TECHNICAL SPECIFICATIONS IN THE MILITARY AND DEFENSE SECTOR.

CHAPTER I

GENERAL PROVISIONS

Article 1. Scope of Application

This Circular stipulates the planning, development, assessment, issuance, and implementation of national standards, national technical specifications, and basic standards in the military and defense sector, as well as the responsibilities of relevant agencies and units.

Article 2. Applicability

This Circular applies to all agencies and units involved in planning, development, assessment, issuance, and implementation of national standards, national technical specifications, and basic standards in the military and defense sector.

Article 3. Definitions

1. National standard in the military and defense sector (hereinafter referred to as TCVN/QS) is a standard issued by the Minister of Defense according to his authority within the scope of national administrative management under the Ministry of Defense.

2. National technical specification in the military and defense sector (hereinafter referred to as QCVN/BQP) is a technical specification issued by the Minister of Defense according to his authority within the scope of national administrative management under the Ministry of Defense.

3. Basic standard in the military and defense sector (hereinafter referred to as TCQS) is a standard issued by the heads of agencies, units directly subordinate to the Ministry of Defense, directly subordinate to the General Staff Command, or specialized bureaus according to their authority within the scope of military and defense management assigned.

4. Adoption of international standards, regional standards, or foreign standards as national standards in the military and defense sector is the issuance of a national standard in the military and defense sector with content fully equivalent or substantially equivalent after modification compared to the corresponding international, regional, or foreign standard.

5. National Standards Measurement Quality Agency refers to departments, offices, and quality assurance assistants within agencies and units directly subordinate to the Ministry of Defense, directly subordinate to the General Staff Command, or specialized bureaus.

Article 4. General Requirements for Developing Standards and Technical Specifications

1. Enhance the effectiveness of management and quality control over military equipment, armaments, products, defense items in various procurement, production, repair, improvement, and operational states; related military and defense service activities.

2. Ensure military and national security, safety, human health, environmental protection, rights, and interests of relevant agencies, units, and individuals as stipulated by law.

3. Adhere to the principle of consensus-based work through open and democratic discussion among relevant agencies and units.

4. Based on scientific and technological progress, innovation, digital transformation, practical experience, current needs, and development trends of the military; international standards, regional standards, foreign standards with similar characteristics that are compatible with international treaties to which Vietnam is a party.

5. Prioritize the development of standards and technical specifications for groups of objects with similar technical characteristics and management requirements.

6. Ensure the unity, coordination, and feasibility of the system of standards and technical specifications in the military and nation.

7. In cases where international, regional, or foreign standards are cited for technical requirements, the drafting agency must ensure that the original language version and the Vietnamese translation of the referenced document are available and bear responsibility for the content of the Vietnamese translation.

8. Encourage the development of TCVN/QS based on the adoption of international, regional, or foreign standards suitable to Vietnam's conditions and military-specific characteristics.

Article 5. Types of National Standards, Technical Standards, and Basic Standards in the Field of Military and Defense

1. National standards in the field of military and defense include one or a combination of the following types:

a) Fundamental standard that specifies characteristics and general requirements applicable to a wide range or contains common provisions for a specific area within military and defense operations;

b) Terminology standard that defines terms, definitions, and symbols used in various branches and specialties of the Armed Forces;

c) Technical requirement standard that stipulates indicators, level indicators, and requirements for weapons equipment, products, defense items, and defense works;

d) Method standard that specifies sampling methods, measurement methods, testing methods, inspection methods, analytical methods, and appraisal methods for levels, indicators, and requirements of weapons equipment, products, defense items, and defense works;

d) Labeling, packaging, transportation, and storage standard that stipulates requirements for labeling, packaging, transportation, and storage of weapons equipment, products, defense items;

e) Comprehensive standard that specifies technical requirements, testing methods, inspection methods, and labeling, packaging, transportation, and storage requirements for weapons equipment, products, defense items;

g) Quality grading standard that stipulates requirements for documentation, history, usage time, synchronization, and corresponding technical indicators for each quality grade of weapons equipment, defense products, and defense works.

2. Technical standards in the field of military and defense include:

a) General technical standards that specify safety, technical, and management requirements applicable to objects specified in Clause 1 of Paragraph 7 of this Circular;

b) Based on specific purposes and management requirements, agencies and units may propose additional types of standards suitable for the specialized field of management assigned by the Minister of National Defense.

3. Basic standard includes: Standards as stipulated in points c, d, e of Clause 1 of this Article.

Based on the scale of operations, specific purposes, and management requirements, agencies and units may decide to supplement other types of standards that ensure compliance with their own management requirements.

Article 6. Scope, Basis for Developing TCVN/QS

1. The scope of development of TCVN/QS includes:

a) Weapons equipment, defense products, and defense works;

b) Terminology in various branches and specialties of the Armed Forces;

c) Measurement, inspection, testing, sampling methods for weapons equipment, defense products, and defense works;

d) Specific fields or processes within military and defense operations;

d) Other objects within military and defense activities.

2. The basis for developing TCVN/QS includes one or more of the following:

a) International standards, regional standards, foreign standards;

b) Standards or technical documents from manufacturers or combat capabilities of weapons equipment, defense products, and defense works approved by the Minister of National Defense and Chief of General Staff;

c) Approved design documents for defense products marked with "B" in accordance with regulations of the Ministry of National Defense;

d) Results of scientific research and technological advancements, innovation, digital transformation;

d) Results of evaluations, trials, inspections, and tests.

3. Acceptance of international standards, regional standards, or foreign standards as TCVN/QS is subject to the existence of an appropriate object in accordance with the provisions of Clause 1 of this Article and compliance with the requirements specified in Article 4 of this Circular.

Article 7. Scope and Basis for the Development of QCVN/BQP

1. The scope for developing QCVN/BQP includes:

a) Armaments, equipment, defense products; defense works;

b) Labor safety and hygiene concerning armaments, equipment, defense products, defense works;

c) Labor safety of machinery, equipment, materials with stringent requirements for labor safety specifically used for defense purposes, military-specific purposes;

d) Security and defense in the military and national security fields.

2. The basis for developing QCVN/BQP includes one or more of the following:

a) National standards;

b) Military and national defense sector national standards;

c) International, regional, foreign standards;

d) Results of scientific research and technological progress, innovation, digital transformation;

e) Results of evaluation, testing, inspection.

Article 8. Scope, Requirements, Basis for the Development of TCQS

1. The scope for developing TCQS includes:

a) Various spare parts, components, details, materials and other products to ensure coordination in support of the production, repair, improvement process of armaments;

b) Special armaments used at units.

2. Requirements include:

a) Shall not conflict with QCVN/BQP, TCVN/QS and relevant legal provisions;

b) Must be in line with the level of scientific and technological progress, meet the requirements for management, production, repair at units.

3. The basis for developing TCQS includes one or more of the following:

a) Results of scientific research and technological advancement, innovation experience, needs, practical capabilities of units; national standards, international, regional, foreign standards are encouraged to be used in the development or acceptance as TCQS;

b) Design documents of the object for which TCQS is being developed approved by competent authorities with a grade A or above according to the regulations of the Ministry of Defense;

c) Technical documentation and user manuals for the object, establishing standards.

Article 9. Development of a Database on Standards and Technical Specifications

1. The database on standards and technical specifications is a unified, modern, integrated digital foundation serving state management work on standards and technical specifications in the military and national defense fields and providing information support for agencies and units within the Ministry of Defense.

2. The database on standards and technical specifications must meet requirements for development, application, dissemination, management of standards and technical specifications; ensure stable and continuous operation; ensure security and information safety, protect agency, unit, individual data; facilitate data collection, updating, adjustment, retrieval, utilization.

3. Data on standards and technical specifications include the following information:

a) Military and national defense sector national standards;

b) Military and national defense sector base standards;

c) National technical regulations in the military and national defense fields;

d) National, international, regional, foreign standards accepted or recognized within the Armed Forces;

e) Technical documents and other related information.

Article 10. Scope, Method and Measures of Application of Standards and Technical Regulations

1. Scope of application:

a) National Standards/Technical Specifications (TCVN/QS) are applied compulsorily in the military and defense sector;

b) National Technical Standards (TCQS) are applied compulsorily within the scope prescribed by the issuing authority;

c) National Construction Standards/Bulletin of the Ministry of Defense (QCVN/BQP) are applied compulsorily throughout the national territory;

d) International standards, regional standards, and foreign technical regulations may be voluntarily adopted; in cases where necessary, they may be implemented at the request of the competent authority.

2. Method of application:

a) Direct application: National Standards/Technical Specifications are directly applied without going through an intermediate document or material;

b) Indirect application: National Standards/Technical Specifications are applied through an intermediate document or material.

3. Measures of application:

a) Promoting, disseminating, guiding, and training on the application of standards and technical regulations to relevant parties;

b) Strengthening activities to evaluate compliance with national standards and technical regulations;

c) Organizing research and investigation to apply international standards, regional standards, or foreign technical regulations that are suitable for military and defense tasks in Vietnam. Investment plans will be formulated to meet the requirements of international, regional, or foreign technical regulations as anticipated.

Chapter II

FORMULATION AND APPROVAL OF CONSTRUCTION PLANS FOR TCVN/QS, QCVN/BQP, TCQS

Article 11. Formulation and Approval of Five-Year and Annual Construction Plans for TCVN/QS

1. The Bureau of Standards-Measurement-Quality shall take the lead in formulating plans for the construction of TCVN/QS over a five-year period and annually, in conjunction with relevant agencies and units.

a) The five-year plan must meet the development needs of the military, state management requirements, tasks assigned by the Minister of National Defense, and practical needs within the Ministry of National Defense;

b) The annual plan shall be consistent with the five-year plan. The annual plan includes new construction, revision, supplementation, replacement, or abolition of TCVN/QS.

2. Five-Year Construction Plan for TCVN/QS:

a) The content of the plan includes: Field, target audience; type of standard; number of standards; implementation time; funding sources. The five-year construction plan shall be carried out in accordance with the provisions set forth in Appendix I attached to this Circular;

b) By the end of the second quarter of the final year of the five-year period, subordinate agencies and units of the Ministry of National Defense shall formulate the next five-year plan for their assigned fields or specialties and submit it to the Bureau of Standards-Measurement-Quality for consolidation;

c) Based on the development direction of the Ministry of National Defense, the Bureau of Standards-Measurement-Quality shall formulate a five-year construction plan for TCVN/QS, seeking opinions from relevant agencies and units; within 20 days from the receipt of the five-year construction plan application, all agencies and units must submit their written comments to the Bureau of Standards-Measurement-Quality for consolidation and completion of the report for submission to the Chief of General Staff for decision;

d) The five-year plan shall be reviewed, adjusted, or supplemented according to proposals from relevant agencies and units in writing or urgent tasks assigned by the Minister of National Defense or the Chief of General Staff.

Adjustments and supplements to the five-year construction plan shall follow the procedures specified at points a and b of this clause.

3. Annual Construction Plan for TCVN/QS:

a) The content of the plan includes: Name of the standard to be constructed; implementation time; method of construction (acceptance of international, regional, or foreign standards; new construction; revision and supplementation); specify the name and number of the standard or document as the basis for construction; budget estimate and funding sources; lead agency for construction, cooperating agencies. The content of the annual TCVN/QS construction plan shall be carried out in accordance with the provisions set forth in Appendix II attached to this Circular;

b) By the second quarter each year, based on the five-year construction plan for TCVN/QS, needs for new construction, revision, supplementation, replacement, or abolition; results of periodic reviews of TCVN/QS, subordinate agencies and units of the Ministry of National Defense and the General Staff shall submit their annual construction plans to the Bureau of Standards-Measurement-Quality.

Based on the five-year and annual construction plans from various agencies and units, the Bureau of Standards-Measurement-Quality shall formulate an annual construction plan for TCVN/QS;

c) The Bureau of Standards-Measurement-Quality shall study, consolidate, complete, and prepare a report for submission to the Chief of General Staff for decision;

d) Implementation of the annual plan

Based on the annual construction plan for TCVN/QS from the Ministry of National Defense, heads of agencies and units shall organize its implementation.

e) Adjustment and supplementation of plans

By October 1st each year, agencies and units shall submit a written request to adjust or supplement the annual construction plan for TCVN/QS to the Bureau of Standards-Measurement-Quality for consolidation and reporting to the Chief of General Staff for decision.

4. In cases where TCVN/QS is constructed through expedited procedures, agencies and units shall submit a written request to the Bureau of Standards-Measurement-Quality for consolidation and reporting to the competent authority for decision.

Article 12. Preparation and Approval of Five-Year and Annual Construction Plans for QCVN/BQP

1. The preparation and approval of five-year and annual construction plans for QCVN/BQP shall be carried out in accordance with the provisions set forth in Article 11 of this Circular.

The contents of the construction plans for QCVN/BQP shall be implemented in accordance with the provisions stipulated in Appendices I and II attached to this Circular.

2. Construction plans for QCVN/BQP must seek the opinion of the Ministry of Science and Technology before issuance; notify the Ministry of Science and Technology after issuance to entities not falling under the category of state secrets.

3. In cases where QCVN/BQP is developed through a streamlined procedure, relevant agencies and units shall submit a document requesting approval to the General Administration of Standards-Measurement-Quality for reporting to the competent authority for decision-making.

Article 13. Preparation and Approval of Annual Construction Plans for TCQS

1. The General Administration of Standards-Measurement-Quality, in conjunction with relevant agencies, shall undertake the preparation and submission for approval of annual construction plans for TCQS.

The contents of the construction plan for TCQS include: Name of the standard to be developed; time frame for implementation; method of development (acceptance of international standards, regional standards or foreign standards; new development; revision and supplementation); budget estimate and funding sources.

2. Heads of agencies and units directly under the Ministry of National Defense, directly under the General Staff Department, and heads of specialized bureaus shall approve the construction plan for TCQS and simultaneously submit the Construction Plan for TCQS to the General Administration of Standards-Measurement-Quality.

Chapter III

PROCEDURE FOR DEVELOPMENT, REVIEW, AND ISSUANCE OF TCVN/QS, QCVN/BQP, AND TCQS

Article 14. Procedure for Development, Review, and Issuance of TCVN/QS

1. Development of TCVN/QS

a) Formation of the Compilation Committee

Based on the construction plan for TCVN/QS, the head of the agency or unit directly under the Ministry of National Defense, General Staff Department, specialized bureau, or the head of an agency or unit tasked with the primary responsibility for developing TCVN/QS shall establish a Compilation Committee. The composition of the Compilation Committee includes: the Head of the Committee as the head of the specialized bureau or the head of the relevant management agency when authorized; members of the Compilation Committee are specialists in the subject matter and personnel from related agencies and units.

b) Duties of the Compilation Committee

Develop a draft TCVN/QS according to the format specified in Appendix III attached to this Circular, report to the General Administration of Standards-Measurement-Quality for review and approval;

Organize an assessment of the current status, research technical documents; conduct tests and trials (if applicable) to determine the content, indicators, and technical requirements of the subject matter or field being developed TCVN/QS, and carry out the development of TCVN/QS;

Finalize TCVN/QS (accompanied by a draft explanation and reference materials), report to the head of the agency or unit for seeking comments from relevant agencies and units within the Ministry of National Defense and experts (if applicable) according to the format specified in Appendix V attached to this Circular;

Study, synthesize, explain, and incorporate feedback according to the format specified in Appendix VI attached to this Circular; organize a specialized meeting (if necessary); complete TCVN/QS.

c) The head of the agency or unit responsible for establishing the Acceptance Committee: The Chairperson is the head of the agency or unit primarily responsible for developing TCVN/QS, or an authorized subordinate unit. The Secretary of the Committee is a staff member from the General Administration of Standards-Measurement-Quality under the chairing agency.

Members participating in the committee include representatives from the Compilation Committee, management agencies, research institutions, production and repair units, using units, and experts (if applicable).

d) The Compilation Committee shall explain, incorporate feedback from the commenting agency or unit, and the Acceptance Committee, finalize TCVN/QS, prepare a file in accordance with the provisions of paragraph 2 of Article 23 of this Circular, send it to the General Administration of Standards-Measurement-Quality for review on completeness and validity, and the results of the review shall be recorded in a minutes document;

e) The Compilation Committee shall finalize TCVN/QS, prepare a file based on the minutes of the review; report to the head of the agency or unit for submission to the General Administration of Standards-Measurement-Quality for review.

2. Review and Issuance of TCVN/QS

a) The General Administration of Standards-Measurement-Quality shall examine the file of TCVN/QS submitted for review; if the file does not meet the requirements specified in paragraph 2 of Article 23 of this Circular, it must issue a document requesting the agency or unit primarily responsible for developing TCVN/QS to complete.

Within ten working days from the receipt of a valid file, establish an Acceptance Committee for reviewing the TCVN/QS. The composition of the committee includes: the Chairperson is the head of the General Administration of Standards-Measurement-Quality; the Secretary of the Committee is a staff member from the General Administration of Standards-Measurement-Quality under the chairing agency; members participating in the committee include representatives from relevant agencies and units, and experts (if applicable).

The review content shall be conducted in accordance with the provisions of Article 18 of the Law on Standards and Technical Specifications and Article 4 of this Circular.

The Acceptance Committee shall operate under a collective decision-making principle and must have at least two-thirds of its members present. The conclusion of the committee is adopted if at least three-quarters of the members agree (members who are absent will base their evaluation on comments and assessments of the draft TCVN/QS sent in advance).

The minutes of the review by the Acceptance Committee shall be sent to the agency or unit primarily responsible for developing TCVN/QS and relevant agencies.

b) Within fifteen days from receipt of the minutes, the Compilation Committee shall study, incorporate feedback, explain, finalize TCVN/QS, prepare a file, report to the head of the agency or unit primarily responsible for developing TCVN/QS for submission to the General Administration of Standards-Measurement-Quality;

c) The General Administration of Standards-Measurement-Quality shall prepare a draft Circular on issuing the standard and submit it to the Legal Bureau/Ministry of National Defense for review; coordinate with the Compilation Committee, relevant agencies, and units primarily responsible for developing TCVN/QS to study and finalize the file of TCVN/QS, report to the Chief of General Staff for submission to the Minister of National Defense for issuance in accordance with regulations.

Article 15. Procedure for Developing, Reviewing, and Issuing TCVN/QS under Expedited Procedures

1. The development, review, and issuance of TCVN/QS may be conducted under expedited procedures in the following cases:

a) TCVN/QS is applicable in situations requiring urgent measures for disaster prevention and control, disease prevention and control, fire and explosion prevention, and national security protection;

b) TCVN/QS is cited in legal documents or technical standards that are to be issued under expedited procedures.

2. Development of TCVN/QS

a) The agencies and units shall develop the draft TCVN/QS in accordance with points (a) and (b) of paragraph 1 of Article 14 of this Circular, and organize the collection of opinions from relevant agencies and units within the Ministry of Defense and experts. The period for collecting opinions shall not exceed ten days;

b) The Compilation Office shall prepare the TCVN/QS file in accordance with paragraph 3 of Article 23 of this Circular and submit it to the Standards-Measurement-Quality Agency under the agency or unit responsible for developing the TCVN/QS. The office shall report to the head of the agency or unit, who will forward it to the Department of Standards-Measurement-Quality for review.

3. Reviewing and Issuing TCVN/QS

a) The Department of Standards-Measurement-Quality shall conduct the review of the TCVN/QS file in accordance with paragraph 2 of Article 14 of this Circular within seven days from the receipt of a valid file;

b) Within seven days from the receipt of the Review Minutes, the Compilation Office shall study, accept, explain, and finalize the TCVN/QS. It shall prepare the file, submit it to the head of the agency or unit responsible for developing the TCVN/QS, who will forward it to the Department of Standards-Measurement-Quality;

c) The Department of Standards-Measurement-Quality shall prepare a draft Circular on issuing the standard and send it to the Legal Department of the Ministry of Defense for review. It shall cooperate with the Compilation Office, the agency or unit responsible for developing the TCVN/QS, to study and finalize the file of the TCVN/QS, report to the Chief of General Staff for submission to the Minister of Defense for issuance in accordance with regulations.

Article 16. Technical Legal Review of TCVN/QS

1. Based on the development plan for TCVN/QS, the Department of Standards-Measurement-Quality shall take the lead and cooperate with the agencies or units developing TCVN/QS to prepare a plan and conduct a technical legal review of TCVN/QS where the content and technical indicators are based on research, testing, and experimentation results. The review will assess the suitability of key and fundamental technical indicators against actual conditions to confirm the feasibility and advancement of TCVN/QS.

2. The scope of work for the technical legal review includes:

a) Developing a program and preparing files for the review;

b) Preparing necessary conditions for the review;

c) Conducting inspections and tests on technical indicators;

d) Agreeing and approving the results of the technical legal review;

e) Finalizing the file of the technical legal review.

3. The Technical Legal Review Committee for TCVN/QS consists of: the Chairman is the head of the Department of Standards-Measurement-Quality, the Secretary is a staff member from the Department of Standards-Measurement-Quality, Deputy Chairmen and Technical Team Leaders, members are representatives from measurement quality institutions, technical institutions conducting inspections and tests on technical indicators, relevant agencies or units, and experts (if any).

The Committee shall establish a Technical Sub-committee to assist it.

The Committee operates according to the principle of collective decision-making, voting by majority, and must have at least two-thirds (2/3) of the Committee members participating.

4. The time for conducting the technical legal review is after the Compilation Office completes the TCVN/QS and it has been inspected at the agency or unit responsible for developing the TCVN/QS level.

5. The results of the technical legal review serve as a basis for the Compilation Office, the agency or unit responsible for developing the TCVN/QS to complete the document.

Article 17. Procedure for Development, Review, and Issuance of QCVN/BQP

1. The procedure for developing QCVN/BQP shall be carried out in accordance with the provisions set forth in Clause 1, Article 14 of this Decree. The draft plan for development of QCVN/BQP is specified in Appendix IV attached to this Decree.

The dossier for QCVN/BQP submitted for review shall comply with the provisions set forth in Clause 2, Article 24 of this Decree.

2. Reviewing the dossier and issuing QCVN/BQP

a) The procedure for reviewing the dossier of QCVN/BQP shall be carried out in accordance with Point a, Clause 2, Article 14 of this Decree;

b) Within fifteen days from the date of receipt of the Minutes of the Review Board, the Compilation Office shall study, absorb, explain, and finalize QCVN/BQP, prepare the dossier, and submit it to the agency or unit in charge of developing QCVN/BQP for submission to the Bureau of Standards-Measurement-Quality;

c) The Bureau of Standards-Measurement-Quality shall review the dossier of QCVN/BQP, seek comments from the Ministry of Science and Technology;

d) After receiving the comments from the Ministry of Science and Technology, the Bureau of Standards-Measurement-Quality shall take charge, coordinate with the Compilation Office, the agency or unit in charge of developing QCVN/BQP to study, explain, absorb the comments, finalize QCVN/BQP; prepare the draft Circular for issuance of QCVN/BQP for submission to the Legal Bureau/Ministry of National Defense for review; and take charge, coordinate with the Compilation Office, the agency or unit in charge of developing QCVN/BQP to study, complete the dossier of QCVN/BQP for reporting to the Chief of General Staff for presentation to the Minister of National Defense for issuance in accordance with regulations.

3. For objects falling under the list of state secrets managed by the Ministry of National Defense, the provisions set forth in Clause 1 and Clause 2 hereof and Article 28 of Decree No. 22/2026/NĐ-CP of the Government shall be applied.

Article 18. Procedure for Development, Review, and Issuance of QCVN/BQP under Expedited Procedures

1. QCVN/BQP may be developed, reviewed, and issued in accordance with expedited procedures in the following cases:

a) In case of emergency as stipulated by laws on states of emergency; when there is an urgent requirement due to reasons such as national defense, security, national interests, disaster prevention and control, disease prevention and control, fire and explosion; other urgent situations to address issues arising in practice;

b) When it is necessary to amend immediately to be consistent with newly issued technical standards or legal documents.

2. The procedure for developing QCVN/BQP shall be carried out in accordance with the provisions set forth in Clause 2, Article 15 of this Decree.

3. Reviewing the dossier and issuing QCVN/BQP

a) The Bureau of Standards-Measurement-Quality shall organize the review of the dossier of QCVN/BQP within seven days from the date of receipt of a valid dossier, in accordance with the provisions set forth in Clause 3, Article 15 of this Decree. The dossier for QCVN/BQP is reviewed in accordance with the provisions set forth in Clause 3, Article 24 of this Decree;

b) Within seven days from the date of receipt of the Minutes of Review, the Compilation Office shall study, absorb, explain, and finalize QCVN/BQP, prepare the dossier, and submit it to the head of the agency or unit in charge of developing QCVN/BQP for submission to the Bureau of Standards-Measurement-Quality;

c) The Bureau of Standards-Measurement-Quality shall review the dossier of QCVN/BQP and seek comments from the Ministry of Science and Technology;

d) The Bureau of Standards-Measurement-Quality shall prepare the draft Circular for issuance of QCVN/BQP for submission to the Legal Bureau/Ministry of National Defense for review; coordinate with the Compilation Office, the agency or unit in charge of developing QCVN/BQP to study, complete the dossier of QCVN/BQP, report to the Chief of General Staff for presentation to the Minister of National Defense for issuance in accordance with regulations.

Article 19. Procedure for Drafting and Issuing Technical Standards Documents (TCQS)

1. Drafting TCQS

a) Based on the annual plan for drafting TCQS, the head of the competent agency or unit shall lead the drafting process by establishing a Draft Compilation Committee to draft the TCQS;

b) The tasks of the Draft Compilation Committee include:

Compiling the outline for drafting TCQS and reporting it to the head of the competent agency or unit for submission to the heads of other agencies or units for review and approval. The review panel must include a representative from the Bureau of Standards-Measurement-Quality;

Based on the content of the outline, organize an assessment of the current situation, study technical documents; conduct tests and trials (if necessary) to determine the contents, indicators, and technical requirements of the subject or field for drafting TCQS and carry out the drafting process;

After completing the TCQS (accompanied by a draft explanation and reference materials), the Draft Compilation Committee reports to the head of the competent agency or unit for soliciting comments from relevant agencies or units and experts (if any);

Study, summarize, explain, and adopt comments; organize a specialized meeting (if necessary); complete the TCQS, prepare files, and submit them to the head of the competent agency or unit for organizing the Technical Review Committee;

The composition of the Technical Review Committee includes: the Chairman is the head of the agency or unit issuing the TCQS or an authorized subordinate agency or unit head. The Secretary of the Committee is a staff member from the Bureau of Standards-Measurement-Quality; members include representatives from the Draft Compilation Committee, the Bureau of Standards-Measurement-Quality, management agencies, research agencies, production and repair units, using units, and experts (if any);

Explain and adopt comments from the Technical Review Committee, complete the TCQS, prepare files in accordance with paragraph 2 of Article 25 of this Circular to be submitted to the Bureau of Standards-Measurement-Quality for reviewing the TCQS file.

2. Reviewing the TCQS File

The Bureau of Standards-Measurement-Quality organizes a review of the TCQS file regarding its completeness and validity. If the TCQS file does not meet the requirements specified in paragraph 2 of Article 25 of this Circular, it must issue a written request for the Draft Compilation Committee to complete it. The results of the review are recorded in a minutes.

3. Issuing TCQS

The Bureau of Standards-Measurement-Quality prepares the TCQS file according to paragraph 3 of Article 25 of this Circular, reports to the head of the subordinate agency or unit under the Ministry of National Defense, directly under the General Staff Department, and the heads of specialized bureaus for issuance, and reports to the Bureau of Standards-Measurement-Quality for monitoring and management.

Chapter IV

TECHNICAL PRESENTATION AND TCQS FILE FOR TCVN/QS, QCVN/BQP

Section 1. TECHNICAL PRESENTATION OF TCVN/QS, QCVN/BQP

Article 20. Presentation of the Content of TCVN/QS

1. Designation of National Standards in Military and Defense Fields

a) The designation for national standards in military and defense fields consists of an abbreviation "TCVN/QS", followed by the standard number, year of issuance, separated by a colon (:), placed after the abbreviation TCVN/QS.

Example: TCVN/QS 2295:2025 is the designation for a national standard in military and defense fields with the standard number 2295, issued in 2025.

b) The Bureau of Standards-Measurement-Quality manages and assigns numbers to TCVN/QS.

2. In cases where a national standard in military and defense fields is entirely equivalent to an international standard, the designation for the national standard includes both the designation for the national standard in military and defense fields and the international standard designation enclosed in parentheses (()), separated by a space.

Example: TCVN/QS 2300:2025 (ISO 6507:2023) is the designation for a national standard in military and defense fields with the standard number 2300, based on full acceptance of the international standard ISO 6507:2023, issued in 2025.

The designation for national standards in military and defense fields shall be presented as follows on the cover page:

The part above includes the standard symbol as prescribed in Clause 1 of this Article;

The part below includes the full symbol of the international standard fully accepted as a national standard in the field of military and defense;

Example: Symbol TCVN/QS 2300:2025 ISO 6507:2023

3. The symbol for the national standard in the field of military and defense, when replacing, includes the number of the standard being replaced, the year of issuance of the national standard in the field of military and defense that replaces it, separated by a colon (:) and placed after the TCVN/QS symbol.

Example: TCVN/QS 729 issued in 2025 to replace TCVN/QS 729:2017 is denoted as TCVN/QS 729:2025.

4. In the case where a national standard in the field of military and defense replaces multiple national standards or part of another national standard in the field of military and defense, then the replacing national standard takes a new number.

5. The symbol for the amendment of the national standard in the field of military and defense includes the word "SỬA ĐỔI" followed by the sequence number of the amendment and the year of issuance, separated by a colon (:) standing before the symbol of the standard being amended.

Example: SỬA ĐỔI 1: 2025 TCVN/QS 801:2009 is the symbol for the first amendment of TCVN/QS 801:2009, issued in 2025.

6. The presentation and expression of the content of TCVN/QS shall be carried out in accordance with the provisions of National Standard TCVN 1-2:2025, Construction of Standards - Part 2: Provisions on Presentation and Expression of National Standard Content.

Article 21. Presentation and expression of QCVN/BQP content

1. The symbol for the technical standard in the field of military and defense

a) Abbreviation QCVN, number, year of issuance of the standard, and abbreviation BQP. Number and year of issuance are separated by a colon (:) and placed after the abbreviation QC VN; the abbreviation BQP is placed after the year of issuance and separated by a forward slash (/).

Example: QCVN 16:2025/BQP is the symbol for the technical standard in the field of military and defense with number 16, issued in 2025.

b) The Bureau of Standards-Measurement-Quality manages and assigns numbers to QCVN/BQP.

2. The presentation and expression of the content of QCVN/BQP shall be carried out in accordance with the current guiding documents.

Article 22. Presentation and expression of TCQS content

1. The symbol for the basic standard in the field of military and defense

a) Abbreviation TCQS, number, year of issuance of the standard, and name of the agency or unit responsible for developing the standard. Number and year of issuance are separated by a colon (:) and placed after the abbreviation TCQS; the name of the agency or unit responsible for developing the standard is abbreviated according to the provisions in the establishment document of the competent authority, placed after the year of issuance and separated by a forward slash (/).

Example: TCQS 68:2020/BCHH is the symbol for the basic standard in the field of military and defense with number 68, developed and issued by the Chemical Corps in 2020.

b) The Bureau of Standards-Measurement-Quality of agencies or units under the Ministry of Defense, directly under the General Staff, specialized bureaus manage and assign numbers to TCQS.

2. The presentation and expression of the content of TCQS shall be carried out in accordance with the provisions of National Standard TCVN 1-2:2025, Construction of Standards - Part 2: Provisions on Presentation and Expression of National Standard Content.

Article 2. DOCUMENTS FOR TCVN/QS, QCVN/BQP, TCQS

Article 23. Documents for TCVN/QS

1. The documents for TCVN/QS include:

a) The defense plan for the development of TCVN/QS;

b) The outline for the development of TCVN/QS;

c) Copies of reference materials used in the development of TCVN/QS;

d) Summary, explanation, and record of received comments; copies of comments from relevant agencies and units on TCVN/QS;

d) Minutes of the acceptance inspection of TCVN/QS by the lead agency;

e) Draft TCVN/QS after acceptance inspection;

g) Technical legal review documents (if applicable);

h) Review document from the Standards-Measurement-Quality Agency of the lead agency for TCVN/QS;

i) Request for review document from the lead agency for TCVN/QS;

k) Minutes and review documents from the Quality-Standardization-Measurement Bureau; legal review documents from the Legal Bureau of the Ministry of Defense;

l) Explanation, record of received comments, and revised draft TCVN/QS after receiving and addressing the review comments;

m) Proposal for issuing Circular on TCVN/QS;

n) Draft Circular on TCVN/QS.

2. The documents for requesting review of TCVN/QS shall comply with the provisions set forth in points a, b, c, d, d, e, g, and i of paragraph 1 of this Article.

3. The documents for approving issuance of TCVN/QS shall comply with the provisions set forth in points k, l, m, and n of paragraph 1 of this Article.

4. The documents for requesting cancellation of TCVN/QS include:

a) TCVN/QS proposed for cancellation;

b) Request document from the lead agency for TCVN/QS to cancel TCVN/QS, accompanied by an explanation (reasons, legal basis, scientific basis);

c) Comments and related documents from relevant agencies and units during the review process (if applicable).

5. The documents for storing TCVN/QS include the Circular on TCVN/QS and other documents as specified in paragraph 1 of this Article. The TCVN/QS documents are stored at the Quality-Standardization-Measurement Bureau and relevant agencies according to the legal provisions on storage.

Article 24. Documents for QCVN/BQP

1. The documents for QCVN/BQP include:

a) Defense plan for the development of QCVN/BQP;

b) Outline for the development of QCVN/BQP;

c) Copies of reference materials used in the development of QCVN/BQP;

d) Summary and record of received comments; copies of comments from relevant agencies and units on QCVN/BQP;

d) Minutes of the acceptance inspection of QCVN/BQP by the lead agency;

e) Draft QCVN/BQP after acceptance inspection;

g) Review document from the Standards-Measurement-Quality Agency;

h) Request for review document from the lead agency for QCVN/BQP;

i) Minutes and review documents from the Quality-Standardization-Measurement Bureau; comments from the Ministry of Science and Technology; legal review documents from the Legal Bureau of the Ministry of Defense;

k) Explanation, record of received comments, and revised draft QCVN/BQP after addressing the review comments;

l) Proposal for issuing Circular on QCVN/BQP;

m) Draft Circular on QCVN/BQP.

2. The documents for requesting review of QCVN/BQP shall comply with the provisions set forth in points a, b, c, d, d, e, g, and h of paragraph 1 of this Article.

3. The documents for approving issuance of QCVN/BQP shall comply with the provisions set forth in points i, k, l, and m of paragraph 1 of this Article.

4. The documents for requesting cancellation of QCVN/BQP include:

a) QCVN/BQP proposed for cancellation;

b) Request document from the lead agency for QCVN/BQP to cancel QCVN/BQP, accompanied by an explanation (reasons, legal basis, scientific basis);

c) Comments and related documents from relevant agencies and units during the review process (if applicable).

5. The documents for storing QCVN/BQP include the Circular on QCVN/BQP and other documents as specified in paragraph 1 of this Article. The QCVN/BQP documents are stored at the Quality-Standardization-Measurement Bureau and relevant agencies according to the legal provisions on storage.

Article 25. Technical Regulation Approval File (TCQS)

1. The TCQS approval file includes:

a) The approved construction plan of the technical regulation;

b) The construction proposal for the technical regulation;

c) Copies of documents serving as the basis for constructing the technical regulation;

d) Summary document and copies of comments from relevant agencies and units on the technical regulation;

d) Minutes of the acceptance inspection by the agency or unit that led to the construction of the technical regulation;

e) Documents explaining and accepting comments, as well as a finalized draft of the technical regulation after acceptance inspection;

g) Inspection documents from the Standard-Measurement-Quality Agency;

h) Proposal for issuing the technical regulation;

i) Draft of the issued technical regulation.

2. The TCQS approval file for issuance is submitted in accordance with points d, e, g and h of paragraph 1 of this Article.

3. The file for requesting cancellation of a technical regulation includes:

a) The technical regulation to be cancelled;

b) Results of periodic review and recommendations from the reviewing agency or unit;

c) Opinions of relevant agencies and units on cancelling the technical regulation during the review process (if applicable);

d) Proposal for cancellation of the technical regulation by the Standard-Measurement-Quality Agency;

d) Other related documents (if applicable).

4. The file for storage of a technical regulation includes all documents and materials as specified in paragraph 1 of this Article.

5. The Standard-Measurement-Quality Agency is responsible for storing the TCQS approval file in accordance with legal provisions on document retention.

6. The Standard-Measurement-Quality Agency is responsible for sending the issuance decision and issued technical regulation to the Quality Measurement Standards Bureau.

Chapter V

REVIEW, AMENDMENT, SUPPLEMENTATION, REPLACEMENT, CANCELLATION, NOTIFICATION OF TCVN/QS, QCVN/BQP, TCQS

Article 26. Review, Amendment, Supplementation, Replacement, Cancellation of TCVN/QS

1. Review of TCVN/QS:

a) TCVN/QS is reviewed every five years or earlier if necessary from the date of issuance;

b) The Quality Measurement Standards Bureau shall lead and coordinate with subordinate agencies and units under the Ministry of Defense, and the General Staff Department to review TCVN/QS according to the list specified in point a of paragraph 1 of this Article when compiling and approving the annual construction plan for TCVN/QS.

2. Amendment, Supplementation, Replacement of TCVN/QS:

a) Amendments, supplements, and replacements of TCVN/QS are included in the plan as per the provisions of Paragraph 11 of this Decree;

b) The amendment, supplementation, and replacement of TCVN/QS shall be carried out according to the procedures specified in Paragraph 14 of this Decree.

3. Cancellation of TCVN/QS:

The cancellation of TCVN/QS is based on the results of the review of TCVN/QS, as per the provisions of paragraph 1 of this Article, and shall be carried out as follows:

a) Subordinate agencies and units under the Ministry of Defense and the General Staff Department prepare and submit the file requesting cancellation of TCVN/QS in accordance with the provisions of Paragraph 4 of Article 23 of this Decree for review by the Quality Measurement Standards Bureau;

b) The review of the request to cancel a national standard is conducted according to the provisions of Article 18 of the Law on Standards and Technical Regulations, and Article 4 of this Decree;

c) The Quality Measurement Standards Bureau compiles the file for reporting to the Chief of General Staff for decision by the Minister of Defense.

Article 27. Review, Amendment, Supplementation, Replacement, Cancellation of QCVN/BQP

The review and request for amendment, supplementation, replacement or cancellation of QCVN/BQP are carried out in accordance with the provisions of Article 26 of this Decree.

Article 28. Review, Amendment, Supplementation, Replacement, Cancellation of TCQS

1. Review of TCQS:

a) TCQS is reviewed every five years or earlier if necessary from the date of issuance;

b) The Quality Measurement Standards Bureau shall lead and coordinate with relevant agencies and units to review TCQS in accordance with point a of paragraph 1 of this Article when compiling and approving the annual construction plan for TCQS.

2. Amendment, Supplementation, Replacement of TCQS:

a) Amendments, supplements, and replacements of TCQS are included in the annual plan according to the provisions of Paragraph 13 of this Decree;

b) The amendment, supplementation, and replacement of TCQS shall be carried out according to the procedures specified in Paragraph 19 of this Decree.

3. Cancellation of TCQS:

The cancellation of TCQS is based on the results of the review of TCQS as per paragraph 1 of this Article and shall be carried out as follows:

a) Agencies and units prepare and submit the file requesting cancellation of TCQS in accordance with Paragraph 3 of Article 25 of this Decree to the Quality Measurement Standards Bureau for examination;

b) The Quality Measurement Standards Bureau examines the request to cancel the technical regulation; reports to the head of the agency or unit under the Ministry of Defense, General Staff Department, and specialized bureau for decision on cancellation.

Article 29. Procedure and Process for Correcting Military Standards and Technical Regulations

1. If military standards or technical regulations in the field of national defense are found to contain errors regarding the basis for issuance, typographical errors, or errors in format or technical presentation, they must be corrected. Such corrections shall not alter the content of the original standard or regulation, nor shall they misapply any authority or content of the standard or regulation.

2. Authority to Correct: The agency or individual with the authority to issue a military standard or technical regulation may correct such standards or regulations.

3. Procedure for Correcting Military Standards and Technical Regulations (TCVN/QS, QCVN/BQP): Upon discovery of errors in TCVN/QS and QCVN/BQP, the competent agency or unit under the Ministry of National Defense, the General Staff Department, or a specialized bureau responsible for standards, measurement, and quality must report the content to be corrected to the Bureau of Standards, Measurement, and Quality; the Bureau of Standards, Measurement, and Quality shall review and verify the errors needing correction, report to the Commander of the General Staff Department for approval, and have the Minister of National Defense sign a decision to correct TCVN/QS and QCVN/BQP.

4. Procedure for Correcting Technical Regulations (TCQS): Upon discovery of errors in TCQS, the TCQS drafting committee shall report the corrections needed to the competent agency or unit under the Ministry of National Defense, the General Staff Department, or a specialized bureau. The Bureau of Standards, Measurement, and Quality shall review and verify the errors needing correction, report back to the Commander of the relevant agency or unit for approval, who will sign a decision to correct TCQS.

Article 30. Notification, Publication, and Distribution of Military Standards and Technical Regulations

1. The Bureau of Standards, Measurement, and Quality:

a) Notify the issuance and abolition of TCVN/QS and QCVN/BQP to relevant agencies and units in writing and publish on military and national defense journals;

b) Print and transfer TCVN/QS and QCVN/BQP upon request from all military agencies and units, as well as in other necessary cases;

c) Coordinate with relevant agencies and units to organize the dissemination and guidance of the application of TCVN/QS, QCVN/BQP and related standards;

d) Publish a list of TCVN/QS and QCVN/BQP every three years.

2. The Bureau of Standards, Measurement, and Quality shall:

a) Print, transfer, and guide the application of TCQS to agencies and units within its jurisdiction;

b) Compile and notify TCQS issued to the Bureau of Standards, Measurement, and Quality and relevant agencies and units.

Chapter VI

EXPENSES FOR DEVELOPING MILITARY STANDARDS AND TECHNICAL REGULATIONS

Article 31. Funding Sources

1. Funds are allocated from the annual state budget of each agency or unit for activities related to developing military standards and technical regulations.

2. Funds are allocated from the national science, technology, innovation, and digital transformation budgets for standardization activities and technical regulation activities.

3. Additional legal income may be used to supplement operational funds.

4. The development of military standards and technical regulations is a functional task assigned to each agency or unit. Within the budget allocated by competent authorities, based on annual plans for developing standards and technical regulations, heads of agencies or units are responsible for allocating funds to plan, review, convert, develop, and approve standards and technical regulations in line with mission timelines.

Article 32. Budgeting, Management, Utilization, and Final Accounting of Funds

The budgeting, management, utilization, and final accounting of funds for the establishment of standards and technical regulations shall be carried out in accordance with the provisions of laws on budgeting, implementation, and final accounting of state finances by the State and the Ministry of National Defense.

Chapter VII

RESPONSIBILITIES OF ORGANIZATIONS AND UNITS

Article 33. General Staff

1. To provide advice to the Minister of National Defense for the management of the state in relation to national standards and technical regulations in the military field, and to direct work on their development, submission to the Minister of National Defense for issuance as Vietnamese National Standards (TCVN) or Vietnamese Ministry of National Defense Technical Regulations (QCVN/BQP), applicable in the military and defense fields.

2. To direct the Department of Standardization-Measurement-Quality Control to manage, guide all organizations and units under its jurisdiction on the development, issuance, and application of standards and technical regulations in the military and defense fields.

Article 34. Department of Standardization-Measurement-Quality Control

1. To advise the Chief of General Staff on implementing state management over national standards and technical regulations in the military and defense fields.

2. To take the lead, coordinate with relevant organizations and units to develop plans for the establishment of Vietnamese National Standards (TCVN) or Vietnamese Ministry of National Defense Technical Regulations (QCVN/BQP); to direct and guide business operations related to standardization work; to organize the review of draft TCVN/QCVN/BQP in accordance with regulations.

3. To annually organize the dissemination, publicity, training on standardization and technical regulation activities; to inspect the activities in the field of standards and technical regulations at all units under its jurisdiction, compile reports for the Chief of General Staff and the Minister of National Defense.

4. To take the lead in organizing the development, management, operation, and updating of the database on standards and technical regulations within the Ministry of National Defense.

5. To cooperate with relevant agencies to conduct inspections and handle violations of laws related to the establishment, issuance, and application of national standards and technical regulations in the military and defense fields.

Article 35. Organizations and Units Directly Subordinate to the Ministry of National Defense, General Staff, Specialized Departments, and Office of the Chief of the Presidential Guard

1. To develop and implement the application of standards and technical regulations to ensure and maintain quality for objects specified in Articles 6, 7, and 8 of this Circular.

2. To take the lead in organizing the development of standards and technical regulations as stipulated in this Circular and relevant regulatory documents; to be responsible before the Minister of National Defense for the content of issued standards and technical regulations.

3. To carry out information, publicity, dissemination activities on the application of standards and technical regulations and related activities for subordinate organizations and units.

4. The Office of the Chief of the Presidential Guard to register QCVN/BQP number with the Department of Standardization-Measurement-Quality Control.

Article 36. Defense Production, Repair Units, and Military Service Providers

1. To develop, apply, and publish conformance to national standards and technical regulations for defense products produced, repaired, improved; related military services provided by the unit.

2. To promptly report any non-conformities encountered during the application of QCVN/BQP, TCVN/QS, TCQS to the lead drafting agency and the Department of Standardization-Measurement-Quality Control for suggestions on amendments, supplements, or replacements.

Article 37. Standards-Measurement-Quality Agency

1. Subject to the business guidance of the Department of Standards-Measurement-Quality; advise the head of the agency or unit on matters concerning the development, issuance, and implementation of standards and technical regulations within its scope of management.

2. Coordinate with agencies and units to propose a plan for developing Vietnamese National Standards (VNS) / Technical Specifications (TS), Military-Defense Quality Control Standards (QCVN/BQP); prepare, submit for approval, and guide the implementation of such plans.

3. Direct and guide the business of developing standards and technical regulations for agencies and units according to their level of authority.

4. Examine draft standard and technical regulation files in accordance with the provisions of this Circular.

5. Report to the Department of Standards-Measurement-Quality on the implementation of plans for developing standards and technical regulations as per regulations. Compile a report listing agencies, units, and individuals within its own organization who have outstanding achievements in research and participation in the development of standards and technical regulations to recommend them for priority consideration for science and technology awards and other relevant legal awards.

Chapter VIII

CONDITIONS OF IMPLEMENTATION

Article 38. Effective Date

This Circular takes effect from May 7, 2026, and replaces Circular No. 25/2020/TT-BQP dated March 7, 2020, issued by the Minister of National Defense concerning the development, issuance, and implementation of standards and technical regulations in the military and defense sectors.

Article 39. Implementation Responsibilities

1. The Chief of General Staff and heads of agencies and units are responsible for implementing this Circular.

2. The Director of the Department of Standards-Measurement-Quality is responsible for supervising, inspecting, and guiding the implementation of this Circular./.
