DECREE
Amending and supplementing Article 5 of Decree No. 22/2019/NĐ-CP dated February 25, 2019 on complaints and handling of complaints in the People's Public Security
of the Government provisions on denunciation and handling of denunciations in the People's Public Security
Pursuant to the Law on Government Organization No. 63/2025/QH15;
Pursuant to the Law on Complaints No. 25/2018/QH14, amended and supplemented by the Enterprise Law No. 59/2020/QH14;
Pursuant to the Law on the People's Public Security No. 37/2018/QH14, amended and supplemented by Law No. 21/2023/QH15;
The Government promulgates this Decree on regulations regarding entry, exit, and residence policies for foreigners at the International Financial Center in Vietnam.
The Government promulgates this Decree amending and supplementing Article 5 of Decree No. 22/2019/NĐ-CP dated February 25, 2019 of the Government on complaints and handling of complaints in the People's Public Security.
Clause 4 of Article 61. Amend and supplement Point d of Clause 2 of Article 24 as follows: Article 5 of Decree No. 22/2019/NĐ-CP dated February 25, 2019 of the Government on complaints and handling of complaints in the People's Public Security
1. Amend Clause 1 of Article 5 as follows:
"1. The Chief of Police of Commune, the Chief of Police of Ward, the Chief of Police of Special Administrative Zone (collectively referred to as the Chief of Police at the commune level), the Chief of Police Station and equivalent shall handle denunciations against police officers under their direct management, except for Deputy Chiefs of Police at the commune level, Deputy Chiefs of Police Station and equivalent; handle denunciations against units under their direct management."
2. Repeal Clause 2 of Article 5.
3. Amend and supplement Clause 4 of Article 5 as follows:
"4. The Director of Provincial Public Security shall handle denunciations against Heads of Departments, Deputy Heads of Departments, Heads, Deputy Heads of equivalent units at the departmental level within the Provincial Public Security, Chiefs of Police at the commune level, Deputy Chiefs of Police at the commune level, Chiefs of Police Station, Deputy Chiefs of Police Station and equivalent; handle denunciations against units under their direct management."
4. Amend Clause 11 of Article 5 as follows:
"11. The person authorized to handle denunciations in the People's Public Security as stipulated in Clause 4, 5, 6 of this Article shall handle denunciations within the jurisdiction of the Head of the subordinate public security agency when there is evidence indicating that the handling of denunciations violates the law seriously or shows signs of lack of objectivity. The basis for determining serious violation of the law, signs of lack of objectivity in handling denunciations shall be in accordance with the detailed regulations provided in the Decree detailing certain provisions and organizational measures for implementing the Law on Denunciation."
Article 2. Effective Date
This Decree takes effect from the date of signature.
Article 3. Responsibility for Implementation
The Minister, the Heads of Ministries, the Heads of Government Agencies, the Chairpersons of Provincial People's Committees, Municipal People's Committees directly under the Central Government, and related agencies, organizations, and units are responsible for implementing this Decree./.
