DECREE
OF THE CHAIRMAN OF THE GOVERNMENT OF THE DEMOCRATIC REPUBLIC OF VIETNAM
NUMBER 226 OF NOVEMBER 28, 1946
PRESIDENT OF THE VIETNAM DEMOCRATIC REPUBLICIC GOVERNMENT
PURSUANT TO THE DECREE OF MARCH 27, 1946 ON THE ORGANIZATION OF THE SOCIAL WELFARE DEPARTMENT;
PURSUANT TO THE DECREE OF MAY 3, 1946 ON THE ORGANIZATION OF MINISTRIES;
PURSUANT TO THE DECREE OF MAY 8, 1946 ON THE ESTABLISHMENT OF LABOR AUTHORITIES THROUGHOUT VIETNAM;
PURSUANT TO THE DECREE OF NOVEMBER 20, 1946 DISSOLVING THE CENTRAL LABOR HOUSE;
PURSUANT TO THE REQUEST OF THE MINISTER OF LABOR;
After the Council of Ministers has agreed,
ISSUES THE DECREE:
ARTICLE 1. The Ministry of Labor shall consist of the Office, the Legal Department, the Inspection and Administrative Department, and the Advisory Board.
ARTICLE 2. The Office shall be headed by the Director of the Office and shall have the following duties:
- Directly assist the Minister,
- Receive, examine, and distribute official documents,
- Collect files, press materials, and books of the Ministry,
- Recruit, manage, and supervise employees within the Ministry and dependent labor authorities, maintain personnel records, and handle employee salaries,
- Assist with the accounting of the Ministry:
Prepare budgets for personnel and materials - oversee the purchase and management of books, press materials, office supplies, and equipment of the Ministry - manage advance funds and reception funds.
ARTICLE 3. The Legal Department shall be headed by a Director and shall have the following duties:
- Draft laws, decrees, ordinances, and directives to implement labor regulations;
- Study international laws to apply and supplement the Vietnamese Labor Code;
- Interpret labor regulations when there are difficulties in their implementation;
- Examine draft decrees and resolutions sent by other Ministries;
- Examine from a legal perspective disputes between employers and workers.
ARTICLE 4 The Inspection and Administrative Department shall be headed by a Chief Inspector and shall have the following duties:
- Manage and supervise labor inspectors and local labor authorities;
- Supervise enterprises regarding the implementation of labor regulations;
- Mediate strikes and disputes between employers and workers;
- Report on inspections and propose necessary amendments to labor regulations;
- Compile statistics related to the labor system;
- Handle administrative matters and miscellaneous tasks outside the scope of the Legal Department and the Office.
ARTICLE 5. The Minister of Labor may establish a board to provide advice to the Minister on labor issues.
ARTICLE 6. Any decree or provision of a decree that contradicts this Decree shall be abolished.
ARTICLE 7. The Minister of Labor and the Minister of Finance shall be responsible for implementing this Decree./.
