Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Urban Planning Management Charter issued together with Decree No. 91/CP dated August 17, 1994 of the Government;

Considering the proposal of the Chairman of the People's Committee of Dong Nai Province at Report No. 1146/TT.UBT dated March 24, 2003, and the Minister of Construction at Report No. 49/TTr-BXD dated July 28, 2003,

Pursuant to …;:

Article 1. Approving the Adjustment of the Master Plan for the City of Bien Hoa, province of Dong Nai to the year 2020 with the main contents as follows:

1. Scope of the master plan adjustment:

The scope of the master plan adjustment includes the entire administrative boundaries of the city of Bien Hoa (comprising 23 wards and 3 communes) with a total area of 154.66 km2 (15,466 ha).

2. Nature:

- It is an important industrial center and transportation hub for the Ho Chi Minh City metropolitan area, the Southeastern region, and the Southern key economic zone.

- It is the political, economic, cultural, service, scientific and technological center, and transportation hub of the province of Dong Nai.

- It has a significant position regarding security and defense.

3. Population Scale:

a) Current status in 2002: the total population of the city was 508,438 people, including 476,452 people in the urban area.

b) Forecast for 2010: the total population of the city will be 645,000 people, including 615,000 people in the urban area.

c) Forecast for 2020: the total population of the city will be 830,000 people, including 800,000 people in the urban area.

4. Scale of construction land:

a) Current status in 2002: the land area for urban construction was approximately 6,253 ha with a standard of 123 m2/person, including residential land of 3,297.82 ha with a standard of 65 m2/person.

b) By 2010: the land area for urban construction will be approximately 8,132 ha with a standard of 126 m2/person, including residential land of 4,128 ha with a standard of 64 m2/person.

c) By 2020: the land area for urban construction will be approximately 9,966 ha with a standard of 120 m2/person, including residential land of 5,013 ha with a standard of 60.4 m2/person.

5. Orientation for urban spatial and architectural landscape development:

a) Direction of city development: to exploit and enhance the efficiency of existing urban construction land, combining expansion and development mainly towards the north, northwest, and along both sides of the Dong Nai River to create harmonious connections between the city of Bien Hoa and Ho Chi Minh City and neighboring provinces.

b) Functional zoning:

- Residential areas with an area of about 2,357 ha comprising 8 zones:

+ Old central area including: wards Thanh Binh, Hoa Binh, Quyet Thang, Quang Vinh, Trung Dung, Buu Long.

+ Zones along National Highway 15 including: wards Thong Nhat, Tan Tien, Tan Mai, Tam Hiep.

+ Zones along expressway including: wards Tam Hoa, Binh Da, An Binh, Long Binh, Long Binh Tan.

+ Zones along National Highway 1 east of the city including: wards Tan Hiep, Tan Binh, Tan Hoa, Ho Nai.

+ Zones north of National Highway 1 including: wards Trang Dai and Tan Phong.

+ Cu Lao Hiep Hoa zone.

+ Zones on the right bank of the Dong Nai River and south of National Highway 1A including: wards Buu Hoa and Tan Van.

+ Zones on the right bank of the Dong Nai River adjacent to Binh Duong including: communes Tan Hạnh and Hoa An.

- Industrial and warehouse zones with a scale of about 1,300 ha:

+ Bien Hoa Industrial Zone 1 with a scale of 335 ha.

+ Bien Hoa Industrial Zone 2 with a scale of 365 ha.

+ Long Binh Industrial Zone (LOTECO) with a scale of 100 ha.

+ Amata Industrial Zone (Phase I and II) with a scale of 340 ha.

+ Relocating industrial and small-scale handicraft enterprises causing pollution from residential areas into concentrated industrial zones. Constructing and developing small-scale industrial clusters with a total area of about 160 ha far from residential areas and ensuring environmental protection through spatial organization and greenery measures. To address land for the city center's development and thoroughly resolve environmental issues, from now until 2010, conditions must be prepared to implement the relocation of production facilities in Thong Nhat ward. Cease quarry operations at Hoa An, Tan Van, and Tan Han quarries. Ensure that there will be no more polluting production facilities in residential areas after 2010.

- Urban center system: with a scale of about 482 ha, including:

+ Provincial administrative center maintaining its current location with a scale of about 67 ha.

+ City administrative, cultural, commercial, tourism, and residential center with a scale of about 55 ha, initially and in the future 150 ha located on the axis from Vuon Mit intersection to Cu Lao commune Hiep Hoa.

+ Comprehensive commercial, international trading, and regional service center with a scale of about 100 ha located at Cu Lao commune Hiep Hoa.

+ City-level commercial service center with a scale of about 130 ha, including Cora commercial center (Vung Tau intersection); Bien Hoa commercial center (Bien Hoa market); Tan Binh commercial center (Sat market); Amata commercial center (intersection of Dong Khoi road and Hanoi expressway); National Highway 15 commercial center, Hoa An commercial center (National Highway 1K).

+ Regional centers: including Tan Hiep, Tan Mai, Tam Hoa, Long Binh Tan, Tan Binh, Tan Hạnh, Buu Hoa, Tan Phong, Gate 11 and public centers in residential zones with a scale of about 90 ha.

- Specialized centers with a scale of about 367 ha, including:

+ Educational and training center including universities and vocational training with a scale of about 236 ha, of which 101 ha are existing educational and training facilities and 135 ha newly constructed located in Long Binh Tan ward and An Hoa commune, Long Thanh district (150 ha) and Trang Dai ward (35 ha).

+ Medical and health resort center with a scale of about 96 ha, of which about 36 ha are existing medical facilities and 60 ha newly constructed including the Dong Nai General Hospital on Dong Khoi street, International Hospital, Ethnic Medicine Hospital, Rehabilitation Institute, specialized and emergency medical centers.

+ Dong Nai Sports Complex with a scale of about 47.75 ha located in Tan Hiep ward.

- Security and defense zones with a scale of 3,566.8 ha maintained their size and location.

The exploitation and use of these zones must comply with the national defense land use planning. the Prime Minister.

- Green space, water surface, and park system with an area of about 1,762 ha, including 581 ha of city park green space and green space within residential zones and 1,181 ha of tourist and ecological park green space, including:

+ Hiep Hoa Cu Lao Ecological Tourist Park with a scale of 240 ha.

+ Buu Long Tourist Park with a scale of 203 ha.

+ Suoi Mai Lake Park with a scale of 250 ha.

+ Tan Van Cu Lao Tourist Park with a scale of 65 ha.

+ Ba Xe Cu Lao Tourist Park with a scale of 21 ha.

+ Hoa An Park with a scale of 202 ha (converted from the quarry area).

||| The green park along the Cái River and Dong Nai River has a width of 20 to 30 meters with a scale of approximately 200 hectares. Additionally, more green isolation belts will be arranged around the airport and military zones with a width of about 30 meters.

||| - Development reserve and urban peripheral area: includes Thạnh Phú commune, Bình Hòa commune, Bình Lợi commune, Tân Bình commune, Tân Thiện commune (Vĩnh Cửu district), Hố Nai commune (Thống Nhất district), Phước Tân commune, An Hòa commune (Long Thành district) will be studied in the proposal for expanding administrative boundaries to ensure the scale and function of the suburban area of a large city.

c) Regarding architecture and urban landscape:

||| - Restricted development zone (inner city area): reduce building density, increase green space area, and raise average building height;

||| - Landscape area: no construction, preserve nature along both sides of the Dong Nai River and Cái River: ensure isolation buffer zones for landscape protection along the river, low building heights combined with green space;

||| - New development zone: develop modern architecture, high-rise buildings with reasonable setbacks combined with green spaces along main traffic axes and in new residential areas;

||| - Cu Lao Hiệp Hòa area: exploit the unique river and canal landscape, the new center of the city ensuring integration with nature and ecology;

6. Orientation for the development of technical infrastructure:

a) Transportation

- Roadways:

||| Improve and construct an urban transportation network with a system of ring roads combined with radial roads.

||| Ring roads include:

|||. Ring Road 1: along the Cái River;

|||. Ring Road 2: Hanoi Expressway - Đồng Khởi Road, Nguyễn Văn Trỗi Road (National Highway 1K), Provincial Route 16;

|||. Ring Road 3: New National Highway 1 south of the city connecting the northeastern ring road through Thạnh Phú, crossing Đồng Nai River via Provincial Route 24 to Tân Uyên (Binh Duong Province) and linking to the newly constructed western ring road from Tân Thạnh to Provincial Route 16 to Tân Uyên;.

||| Radial roads include:

|||. Radial Road 1: from the intersection at Vườn Mít to Cu Lao Hiệp Hòa;

|||. Radial Road 2: from Đồng Khởi Road to Cu Lao Hiệp Hòa;

|||. Radial Road 3: expand and upgrade National Highway 15 from the intersection at Tam Hiệp to the intersection at Trần Quốc Toản Road connecting to Cu Lao Hiệp Hòa;

- Railways

||| Shift railway tracks southward parallel to the new National Highway 1;

||| Construct a tram line based on existing railway lines, connecting the line along the Hanoi Expressway, along the Cái River, and linking with public bus routes;

||| Bridges: upgrade the current Hóa An Bridge and build a new Hóa An Bridge, Thường Tân Bridge, four bridges connecting to Cu Lao Hiệp Hòa;

||| Transportation hubs: at intersections between ring roads and national highways, expressways using different types of interchanges. At intersections between major urban streets; widen co-planar intersections, design central green islands and directional islands;

b) Technical preparation for land:

||| Land leveling solutions:

||| + Construction level Hxd > 2.1m (according to the elevation of the 1/10,000 map - Mui Nai system);

||| + Excavation and filling volume approximately 14,418,000 cubic meters;

||| Drainage: main catchment areas include Suối Săn Máu, Suối Linh, Suối Chùa, Suối Bà Lúa, Suối Cầu Quan, and some small catchments draining naturally into the Dong Nai River according to natural topography;

c) Water supply:

||| Water supply standards: 150 liters/person/day (2010) and 165 liters/person/day (2020);

||| Water demand: 2020: 360,000 cubic meters/day;3||| Water source: Thiện Tâm water plant (300,000 cubic meters/day), Biên Hòa water plant (36,000 cubic meters/day), Long Bình water plant (30,000 cubic meters/day);

||| Electricity consumption:3||| + Residential electricity: short term (2010): 151,000 kW; long term (2020): 415,000 kW;3||| + Industrial electricity: short term (2010): 275,000 kW; long term (2020): 325,000 kW;3||| Total electricity load: short term (2010): 448,650 kW; long term (2020): 802,250 kW;

d) Power supply:

||| Power sources: upgrade and increase capacity of existing substations 110/220 KV: Long Bình, Đồng Nai, Biên Hòa, Tân Mai 1; construct new substations Tân Mai 2, Tân Hòa (for residential use), Amata, Loteco (for industrial parks);

||| e) Wastewater drainage and environmental sanitation:

||| - Standards: collect wastewater amounting to about 80-90% of the water supply flow;

||| Solid waste: 0.8-1.0 kg/person/day with total household waste reaching about 450-500 tons/day by 2020;

||| - Wastewater treatment: divide into 14 wastewater drainage areas. Construct a centralized treatment plant in Long Bình Tân ward with a capacity of 80,000 cubic meters/day-night and several smaller plants with capacities ranging from 5,000 to 15,000 cubic meters/day-night for the area north of National Highway 1;

||| - Waste management:

||| + Short term (2010): use the landfill in Trảng Dài ward;

||| + Long term (2020): construct a new landfill in Long Thành district;

||| - Cemeteries:3||| + Short term (2010): cemetery with a scale of 32 hectares located in Long Bình ward;3||| + Long term (2020): construct crematoriums and cemeteries in Hố Nai 3 commune with a scale of 40 hectares;

||| 7. Measures to protect the environment of the Cái River, Dong Nai River, and concentrated industrial zones:

||| - Limit sand extraction in the Dong Nai River section passing through the city to prevent riverbank erosion and damage to Cu Lao Hiệp Hòa;

||| - Plant trees along both banks of the Dong Nai River and Cái River with a minimum width of 20-30 meters to ensure environmental protection and create riverside landscapes;

||| - Reduce building heights and densities along both banks of the river, combining with additional green spaces and open areas to regulate urban air quality;

||| - Manage and ensure compliance with tree planting standards, treat various types of waste in concentrated industrial zones according to Vietnamese construction standards and relevant laws;

||| 8. Initial construction planning and priority investment programs and projects:

||| a) Invest in constructing and completing infrastructure development projects for Biên Hòa I Industrial Zone, Biên Hòa II Industrial Zone, Amata Phase I and II, and Loteco; relocate production facilities causing pollution out of the city, implement clusters of medium and small-scale industries and handicrafts;

||| b) Vigorously invest in constructing residential areas based on developing complete new urban areas with infrastructure;

||| c) Develop detailed planning and implement investment construction of the new city administrative center in Thống Nhất ward;

||| d) Renovate the existing central area in conjunction with upgrading residential areas and technical infrastructure systems;

||| e) Invest in constructing administrative management facilities and social and technical infrastructure, creating conditions to promote and form commercial and service centers, linked with urban renovation and development, meeting the needs of residents in an industrial city.

8. Planning for the initial construction phase and priority investment programs and projects:

a) Investment in constructing and completing infrastructure development projects for Biên Hoà I Industrial Zone, Biên Hoà II Industrial Zone, Amata Phase I and II, and Loteco; relocating production facilities causing pollution out of the city, implementing industrial clusters and small-medium traditional craft industries.

b) Vigorously investing in building residential areas based on developing new urban zones with complete infrastructure.

c) Preparing detailed planning and implementing investment in constructing a new administrative center of the city in Thống Nhất Ward.

d) Renovating the existing central area in conjunction with upgrading residential areas and technical infrastructure systems.

đ) Investing in constructing administrative management facilities and social and technical infrastructure to create conditions for promoting and forming concentrated commercial and service centers, linked with urban renovation and development, meeting the needs of the city's industrial residents.

e) Investment and solicitation of investment for renovation and new development of green areas, parks, recreational zones, and eco-tourism areas. The city aims to achieve a ratio of 4 square meters of green space per person by 2010.

Article 2. Direct the People's Committee of Dong Nai Province:

a) Approve the design dossier for adjusting the overall urban planning of Bien Hoa City until 2020.

b) Announce to the public for their knowledge, inspection, and implementation; organize the implementation of the plan in accordance with the law.

c) Issue regulations on architectural management according to the overall urban planning of Bien Hoa City until 2020.

d) Coordinate with relevant ministries and sectors to establish, review detailed plans, specialized construction plans, and implement urban development projects in accordance with the law.

Article 3. This Decision takes effect fifteen days after its publication in the Official Gazette..

The Chairman of the People's Committee of Dong Nai Province, Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, and related organizations are responsible for implementing this Decision./.
