OF THE CHAIRMAN OF THE GOVERNMENT OF THE DEMOCRATIC REPUBLIC OF VIETNAM
NO. 227 DATED November 28, 1946
THE CHAIRMAN OF THE GOVERNMENT OF THE DEMOCRATIC REPUBLIC OF VIETNAM
Considering the need to establish regulations for mandatory legal reports throughout Vietnam;
Upon the proposal of the Minister of Interior and the Minister of Justice;
ENACTS:
Article 1. Throughout the territory of Vietnam, all legal and judicial reports required by law or necessary to publish procedures or contracts in order to make them effective must be published in one of the newspapers authorized to publish such announcements within the jurisdiction of the High Courts; if published otherwise, it shall be deemed invalid.
Article 2. Each year during the first ten days of December, the Minister of Interior issues a decree establishing for the following year:
1) A list of newspapers authorized to publish legal and judicial reports within the jurisdiction of each High Court, after consultation with the Minister of Justice and the Administrative Committee.
2) The cost of publishing legal and judicial reports.
Article 3. All legal reports pertaining to a single procedure that have begun publication in one newspaper must be completed in that same newspaper.
Article 4. Legal reports must be written in Vietnamese; an additional translation or summary in a foreign language may also be published immediately below the Vietnamese version of the report.
Article 5. A private individual who publishes a legal report may request to publish a summary of that announcement in the Vietnam Official Gazette, clearly stating the key points of the announcement, the number and date of publication of the newspaper carrying the announcement.
The cost for publishing in the Vietnam Official Gazette is also determined annually by the Minister of Interior.
Article 6. Newspapers wishing to publish legal reports must submit an application to the Ministry of Interior through the Administrative Committee before November 15 each year. Additionally, they must guarantee regular publication and distribution of at least 500 issues: In exceptional cases, the Minister of Interior may grant permission mid-year if these two conditions are met.
Article 7. The Ministers of Interior and Justice shall implement this Decree-Law accordingly./.
