PRIME MINISTER

Based on the Law on the Organization of the Government dated December 25, 2001;

Based on the Labor Code dated June 23, 1994; the Law Amending and Supplementing Certain Provisions of the Labor Code dated April 2, 2002; the Law Amending and Supplementing Certain Provisions of the Labor Code dated June 29, 2006;

Considering the proposal of the Minister of Labor, Invalids and Social Affairs,

DECISION:

Article 1. Approves the National Program on Occupational Safety and Health for the period 2011-2015 with the following main contents:

I. OBJECTIVES OF THE PROGRAM

1. General objectives:

Improving working conditions, reducing labor environmental pollution; preventing occupational accidents and occupational diseases; caring for workers' health; raising awareness and ensuring compliance with laws on occupational safety and health, ensuring physical safety and lives of workers, state property, enterprise property, contributing to sustainable national development.

2. Specific Objectives:

a) On average annually reduce by 5% the frequency of fatal occupational accidents in mining, construction, electricity usage, metal production, and chemical production industries;

b) On average annually increase by 5% the number of establishments organizing regular health check-ups for workers, increase by 5% the number of workers diagnosed with occupational diseases during health checks, increase by 3% the number of establishments monitored for labor environmental conditions;

c) On average annually increase by 2,000 small and medium enterprises effectively applying the occupational safety and health management system;

d) Annually over 40,000 people engaged in occupations and jobs with strict requirements for occupational safety and health; 10,000 people engaged in heavy, toxic, and dangerous jobs; 40,000 staff involved in occupational safety and health at enterprises will be supported in occupational safety and health training;

đ) By 2015, over 1,000 craft villages, 5,000 cooperatives, and 30,000 small and medium enterprises will be disseminated appropriate information on occupational safety and health;

e) 100% of workers confirmed to have suffered occupational accidents or occupational diseases will receive health care and functional recovery services;

g) 100% of fatal occupational accident cases will be investigated and resolved;

II. CONTENTS OF THE PROGRAM'S ACTIVITIES

1. Activities to enhance capacity and effectiveness of state management on occupational safety and health, including:

a) Reviewing, amending, and supplementing regulatory legal documents on occupational safety and health;

b) Training and supporting equipment to enhance the capacity of inspection and quality control systems, inspection, supervision, and monitoring systems on occupational safety and health;

c) Studying and drafting the Occupational Safety and Health Law;

d) Building mechanisms and policies to promote socialization of occupational safety and health activities;

đ) Building and improving the occupational safety and health database;

e) Completing and implementing models of occupational safety and health management in enterprises with high risks of occupational accidents and occupational diseases;

g) Continuing to build and implement the Compensation Fund for Occupational Accidents and Diseases Project;

2. Advisory, technical support, and preventive investment activities against occupational accidents in enterprises with high risks of occupational accidents in the mineral extraction, mineral processing, metal production, chemical production, and construction sectors; improving working conditions in small and medium enterprises, agricultural production areas, and rural trades;

3. Prevention and control of occupational diseases, health care for workers at workplaces, including:

a) Implementing models for the prevention and control of common occupational diseases;

b) Supporting equipment, upgrading, and building new facilities for examination, treatment, and functional recovery for workers suffering from occupational accidents and occupational diseases;

c) Training diagnostic, appraisal, treatment, and functional recovery skills for workers suffering from occupational accidents and occupational diseases;

d) Supporting equipment and training skills for labor environmental monitoring;

đ) Providing medical labor services to enterprises and facilities to organize health care for workers at workplaces;

4. Activities to raise awareness and responsibility of employers, workers, and the community, including:

a) Supporting equipment, building, and upgrading training centers on occupational safety and health;

b) Standardizing training programs and materials on occupational safety and health;

c) Establishing trainer standards; supporting the expansion of networks of trainers and communicators on occupational safety and health;

d) Implementing training and propaganda for employers and workers on occupational safety and health;

đ) Incorporating occupational safety and health content into teaching at vocational training institutions, secondary specialized schools, colleges, and universities;

e) Enhancing the effectiveness of mass movements in occupational safety and health work;

5. Research and application of science and technology in labor protection, occupational safety and health in industries and trades with high risks of occupational accidents and occupational diseases, including coal mining and processing; metallurgy, fertilizers; chemicals, construction, and other relevant industries and trades;

6. Inspection, supervision, interim review, final evaluation, and reporting on the activities of the Project and Program;

III. IMPLEMENTATION SOLUTIONS FOR THE PROGRAM

1. Regarding policies and mechanisms:

a) Encouraging enterprises to contribute resources and implement activities to improve working conditions and care for workers' health;

b) Supporting enterprises and facilities participating in pilot projects and applying advanced occupational safety and health management systems, building a culture of labor safety;

c) Encouraging the development and socialization of advisory, inspection, training, and education services on occupational safety and health;

d) Strengthening coordination between state agencies assigned tasks and enterprises, agencies, organizations, and individuals participating in the implementation of the Program;

đ) Promoting the integration of the National Program on Occupational Safety and Health with employment programs; poverty reduction; workplace HIV/AIDS prevention; climate change resistance; environmental protection, and related programs.

e) Promote the synchronous operation of monitoring and evaluation systems for the implementation of the Program;

g) Encourage the participation of citizens and organizations in activities of the Program.

2. On sources of funding for implementing the Program:

a) The State budget is expected to be VND 730 billion, of which the central budget is VND 680 billion and the local budget is VND 50 billion. Approve in principle five Projects and activities of the Program listed in the Appendix attached hereto.

The central budget ensures the funding for the implementation of the Program under the tasks of ministries and central agencies included in the annual budget approved by the competent authority.

The local budget ensures the funding for the activities of the Program under the tasks of local agencies and units according to the classification of the State Budget Law.

Annually, based on objectives and tasks, ministries and central agencies and localities implementing the Program shall prepare the budget estimate for the Program's expenses and submit it to the Ministry of Finance for review and consolidation into the state budget estimate, and report to the competent authority for examination and decision in accordance with the State Budget Law;

b) Funding contributions from enterprises, organizations, and individuals participating in the Program; sponsorship from domestic and foreign organizations;

c) Other lawful sources.

3. On management and administration:

a) The Ministry of Labor, Invalids and Social Affairs shall establish a Steering Committee for the Program comprising representatives from the Ministries of Labor, Invalids and Social Affairs, Health, Agriculture and Rural Development, Industry and Trade, Construction, Education and Training, National Defense, Information and Communications, Public Security, Planning and Investment, and Finance to advise the Minister of Labor, Invalids and Social Affairs on directing, supervising, guiding, urging relevant ministries, sectors, and localities to implement the Program's activities;

b) The Minister of Labor, Invalids and Social Affairs shall establish a working group for the Steering Committee; guide localities to establish management bodies for the Program at the local level.

c) The leading agency of the Project shall establish a Project Management Board;

d) Enterprises shall develop occupational safety and health programs and plans in their annual plans consistent with the characteristics of their operations, production, and business.

4. On information and publicity:

a) Strengthen communication, education, and training activities on occupational safety and health for employers, workers, and the community through diverse and appropriate forms;

b) Continue to innovate and improve the effectiveness of the National Week on Occupational Safety and Health and Fire Prevention annually.

5. On international cooperation:

Expand international cooperation activities in the field of training, exchange of experts on occupational safety and health, support for investment in equipment for healthcare, rehabilitation of labor functions, and diagnosis and treatment of occupational diseases.

IV. IMPLEMENTATION

1. The Ministry of Labor, Invalids and Social Affairs shall be responsible for:

a) Taking the lead and coordinating with relevant agencies to build overall plans, annual plans, and guide the organization and implementation of the Program;

b) Directing and supervising the implementation of the Program;

c) Organizing the implementation of assigned Projects;

d) Proposing recommendations to the Prime Minister to direct ministries, central agencies, and localities to implement the Program's objectives and contents;

đ) Regularly or urgently compiling and reporting to the Prime Minister and competent authorities on the implementation status of the Program annually.

2. The Ministry of Planning and Investment shall have the responsibility:

a) Balance the funds to implement the Program;

b) Guide localities to integrate the National Program on Occupational Safety and Health with other related programs.

3. The Ministry of Finance shall be responsible:

a) Allocate funds for the implementation of the Program in the annual budget estimates of central agencies and localities in accordance with the laws on the state budget;

b) Guide the management and use of funds for the implementation of the Program; coordinate with the Ministry of Labor, Invalids and Social Affairs to inspect and supervise the implementation of the Program.

4. Central agencies leading the Project shall be responsible for:

a) Organizing the construction and approval of the Project after reaching a consensus with the Ministry of Labor, Invalids and Social Affairs;

b) Annually, based on proposals from Project implementation agencies, prepare plans, budget estimates, and measures to implement the Project and submit them to the Ministries of Planning and Investment, Finance, and Labor, Invalids and Social Affairs;

c) Manage the implementation of the Project; regularly or urgently report the Project's implementation status to the Ministry of Labor, Invalids and Social Affairs for consolidation and reporting to the Prime Minister.

5. Request the Vietnam General Confederation of Labor, Vietnam Chamber of Commerce and Industry, Vietnam Federation of Trade Unions, Vietnam Farmers' Union, and Vietnam Society of Safety Science and Technology to participate and cooperate in organizing and implementing the Program.

6. Provincial People's Committees under the central government shall be responsible for:

a) Based on the Program's objectives and activities, build the local occupational safety and health program for the period 2011-2015;

b) Proactively coordinate with relevant ministries and agencies to implement the Program's Projects and activities;

c) Manage the implementation of the Program at the local level; regularly or urgently report to the Ministry of Labor, Invalids and Social Affairs on the implementation status of the Program.

Article 2. This Decision takes effect from the date of issuance.

Article 3. Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairpersons of provincial People's Committees, and Chairpersons of municipal People's Committees directly under the central government shall be responsible for implementing this Decision.
