PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Construction Law dated November 26, 2003;

Pursuant to Decision No. 169/2003/QĐ-TTg dated August 12, 2003 of the Prime Minister approving the Project on Reforming Management Methods and Modernizing Administrative Offices of the State Administrative System for Phase I (2003 - 2005);

Considering the proposal of the Minister of Construction,

DECISION:

Article 1. Scope of Regulation and Applicability

This Decision stipulates the requirements for planning construction of administrative offices at all levels, including the following objects:

1. Administrative office of the Ministry level.

2. Administrative office of the provincial level.

3. Administrative office of the district level.

4. Administrative office of the commune level.

Article 2. General Requirements for Planning Construction

The planning of administrative offices at all levels shall be carried out according to the principle of centralization and must meet the following requirements:

1. In accordance with functions, tasks, and usage requirements.

2. In accordance with natural conditions and socio-economic conditions of each region and locality.

3. To overcome the scattered and fragmented state of administrative offices.

4. To facilitate transactions and implementation of policies and laws of the State by the people, organizations, and agencies.

5. To create a favorable working environment for cadres and civil servants, enhancing the effectiveness of state management, meeting the requirements of industrialization, modernization, and integration of the country.

Article 3. Requirements for Location and Area of Construction Land

1. In accordance with approved urban planning.

2. The area of construction land must be appropriate to the needs of use and land conditions of each locality.

3. Convenient transportation.

4. Infrastructure in the area must be ensured, with modern and synchronized communication facilities.

5. Meeting environmental sanitation requirements.

6. Possibility for future expansion.

Article 4. Requirements for Master Plan Layout

1. The master plan layout must have a modern architectural spatial structure, reasonable building density, harmonizing with the architectural landscape of the area, contributing to the urban architectural face.

2. Buildings must be arranged with setback distances.

3. Within the compound, internal roads, parking lots, gardens, and green spaces must be reasonably arranged, creating conditions for buildings to connect with the natural environment and facilitating fire trucks' access in case of fire or explosion incidents.

4. The compound must have surrounding fences, gates, and security rooms to ensure safety.

5. Planning should encourage multi-story construction to save land.

Article 5. Specific Requirements for Planning New Construction

1. For administrative offices of the Ministry level:

a) Arranged separately or concentrated in a zone comprising several agencies with functional links;

b) The location for construction must be adjacent to urban traffic routes.

2. For administrative offices of the provincial level, depending on specific local conditions, the planning and construction of public offices should follow the direction:

a) People's Committees and People's Councils should be located in the city center, within the same compound, with gardens, greenery, and exterior design to create a cohesive architectural ensemble harmonious with the area's landscape, forming the administrative center of the city;

b) Specialized agencies, which have functional links, should form a combined agency and be located within the same compound or at different locations in the city, forming a centralized administrative zone.

3. For administrative offices of the district level:

a) Located in the city center, including People's Committee, People's Council, and other specialized agencies within the same compound, forming a combined agency, creating the administrative center of the city;

b) Specialized agencies in separate blocks, located around but not within the same compound as the People's Committee and People's Council;

c) Pay attention to the master plan layout of the building complex to create a square as the city center.

4. For administrative offices of the commune level, the workplace includes the Party Committee, People's Council, People's Committee, and mass organizations, located in the city center, with a convenient position for local government management:

a) Commune-level administrative offices should be planned together with cultural works and other functional spaces, facilitating infrastructure arrangement and creating a dignified architectural cluster, representing the face of the commune;

b) Administrative offices of townships and towns, People's Committees and People's Councils should be located within the same compound, with convenient parking areas for organizations and individuals to conduct transactions and work.

Article 6. Specific requirements for planning existing government offices

1. Existing administrative state offices at all levels, if located conveniently, with sufficient area and meeting technical infrastructure requirements, shall be retained and upgraded according to modernization needs.

2. Administrative state offices at all levels that were taken over after 1954 and 1975, or constructed in the late 1950s and 1960s, which lack sufficient construction land area, are scattered, located inconveniently, and do not meet technical infrastructure requirements, shall be newly constructed as centralized administrative zones according to the approved planning scheme by the competent authority.

Article 7. Responsibilities of relevant agencies

1. The Ministry of Planning and Investment shall take the lead and coordinate with the Ministry of Finance to balance and allocate investment capital for the construction, repair, renovation, and modernization of central-level administrative state offices, and provide targeted support to local budgets for the construction, repair, renovation, and modernization of administrative state offices at the local level.

2. The Ministry of Construction shall take the lead and coordinate with relevant ministries and sectors to monitor, inspect, and urge the implementation of construction, renovation, and modernization of administrative state offices according to planning requirements, serving the modernization of administrative state offices at all levels.

3. The Ministry of Finance shall coordinate with the Ministry of Planning and Investment to balance and allocate sufficient funds for the construction, renovation, and modernization of administrative state offices at all levels, inspect and monitor annual capital usage, and compile and report to the Government.

4. The Ministry of Natural Resources and Environment shall monitor and coordinate with relevant agencies to plan land reserves for the deployment of centralized administrative zones, serving the modernization of administrative state offices at all levels.

5. People's Committees of provinces and centrally-administered cities shall proactively allocate capital for the construction, renovation, and modernization of administrative state offices at the local level within the annual state budget estimate.

6. Ministries, ministerial-level agencies, agencies under the Government, and People's Committees of provinces and centrally-administered cities shall review existing government offices under their management, compare them with planning requirements for constructing administrative state offices at all levels, propose solutions towards new construction or renovation and modernization, and report to the Government before December 31, 2007.

Article 8. Effective Date

This Decision shall take effect fifteen days from the date of publication in the Official Gazette.

THE MINISTERS, HEADS OF GOVERNMENT-LEVEL MINISTRIES, HEADS OF GOVERNMENT-LEVEL AGENCIES, AND CHAIRMEN OF PROVINCE AND CITY PEOPLE'S COMMITTEES DIRECTLY UNDER THE CENTRAL GOVERNMENT SHALL BE RESPONSIBLE FOR ENFORCING THIS DECISION./.
