BASED ON Decree No. 25/CP dated May 23, 1993 of the Government temporarily regulating the new salary system for civil servants, administrative and public service officials, and armed forces personnel;
BASED ON Decision No. 243/CP dated June 25, 1979 of the Council of Ministers (now the Government) on the organization and staffing of general education schools;
BASED ON Decree No. 90/CP dated November 24, 1993 of the Government on the structure framework of the national education system;
BASED ON Circular No. 5742/KTTH dated October 10, 1995 of the Prime Minister on resolving the allowance system for teachers serving as team leaders for the Ho Chi Minh Pioneer Youth in general education schools.
The Joint Department of Organization and Staff of the Government, Ministry of Education and Training, Ministry of Finance, and Central Committee of the Youth Communist Ho Chi Minh League guide the selection and utilization of teachers serving as total team leaders for the Ho Chi Minh Pioneer Youth in general education schools as follows:

I. OBJECTS, SELECTION CRITERIA, AND APPOINTMENT OF TEACHERS AS TOTAL TEAM LEADERS

1. Objects and criteria:

Teachers from schools aged between 18 and 35 who meet the following criteria shall be selected and appointed as total team leaders in general education schools.

1.1. Possess good moral qualities and serve as role models (if still within the age range for developing members, they must be members of the Youth Communist Ho Chi Minh League).

1.2. Have enthusiasm and talent for organizing social activities, understanding about the league and teams, sufficient health... and know how to mobilize students, social forces, and all people to participate in the work of the team.

1.3. Hold a teaching qualification certificate (secondary teacher training, college of education, university of education).

For mountainous provinces, highland areas, remote regions, islands, and isolated areas, the requirement is to hold a teaching qualification certificate (as stipulated by the Ministry of Education and Training regarding the training of teaching staff for mountainous provinces, highland areas, remote regions, and islands).

1.4. Have been trained or received vocational training in youth league and team work.

2. Appointment of teachers as total team leaders:

Based on the selection objects and criteria, the school principal, together with the Youth Communist Ho Chi Minh League organization of the school, will jointly propose to the District Education and Training Office (or City Education and Training Bureau) for review according to the management level of civil servants and officials.

The District Education and Training Office or City Education and Training Bureau will issue a decision appointing teachers as total team leaders after reaching a consensus with the County Youth League Committee (or City Youth League Committee).

II. WORKING SYSTEM AND STAFFING OF TEACHERS SERVING AS TOTAL TEAM LEADERS

1. The term of appointment for teachers serving as total team leaders is at least five years.

2. Full-time total team leaders are exempted from teaching cultural subjects. Part-time total team leaders must participate in teaching a certain number of hours or sessions as follows:

- Substitute for sick or maternity leave teachers.

- Or may teach the required number of periods for one class (or several classes) in their subject.

If due to a shortage of teachers or professional requirements, the school principal assigns full-time or part-time total team leaders to teach beyond their regular duties, the additional hours or sessions taught will be counted as overtime and compensated according to the current overtime pay regulations.

3. Teaching load of teachers serving as total team leaders:

All primary schools, lower secondary schools (grades 1-9), and upper secondary schools (grades 10-12):

3.1. In highland, island, and remote areas:

- Schools with more than 19 classes: Full-time total team leaders do not teach. If full-time total team leaders are assigned to teach, the hours or sessions taught will be compensated according to the current overtime pay regulations.

- Schools with 10 to 19 classes: Part-time total team leaders teach three periods per week in middle schools or three sessions per week in primary schools.

3.2. In other areas:

- Schools with 28 or more classes: Full-time total team leaders do not teach. If middle school teachers are assigned to teach four periods per week or primary school teachers are assigned to teach one session per week, the hours or sessions taught will be compensated according to the current overtime pay regulations.

- Schools with 18 to 27 classes: Part-time total team leaders teach eight periods per week in middle schools or two sessions per week in primary schools.

- Schools with fewer than 18 classes: Part-time total team leaders teach ten periods per week in middle schools or three sessions per week in primary schools.

4. Staffing of teachers serving as total team leaders:

Each primary school, middle school, lower secondary school, and upper secondary school (only counting the number of middle school classes) can appoint one teacher as a full-time or part-time total team leader for the Ho Chi Minh Pioneer Youth. The staffing of teachers serving as total team leaders is specified as follows:

4.1. In highland, island, and remote areas:

- Schools with more than 19 classes: One full-time teacher serving as a total team leader is allocated.

- Schools with 19 classes or fewer implement the part-time system.

4.2. In other areas:

- Schools with 28 or more classes allocate one teacher position.

- Schools with 18 to 27 classes allocate staffing equivalent to three-quarters of a teacher position.

- Schools with fewer than 18 classes allocate staffing equivalent to half a teacher position.

III. POLICY REGIME FOR TEACHERS SERVING AS TOTAL TEAM LEADERS

1. Policy regime:

Teachers appointed as total team leaders in general education schools (including both full-time and part-time positions) enjoy the following benefits:

1.1. Receive responsibility allowances based on the following coefficients:

- Teachers serving as total team leaders in grade I schools receive a responsibility allowance coefficient of 0.30 times the minimum wage.

- The head teacher in charge of the Team at a grade II school shall receive a responsibility allowance equivalent to 0.20 times the minimum wage.

- The head teacher in charge of the Team at a grade III school shall receive a responsibility allowance equivalent to 0.10 times the minimum wage.

When ceasing to be in charge of the Team, such allowance shall not be received.

The determination of the school grade for calculating the responsibility allowance for the position of head teacher in charge of the Team shall be based on Section I of Circular No. 10/GD-ĐT dated July 29, 1994 issued by the Ministry of Education and Training.

1.2. Teachers shall have their salaries classified and shall enjoy allowances and other benefits as teachers (annual leave, summer vacation, attendance at professional training courses, provision of office supplies...).

1.3. They shall enjoy award systems similar to those for teachers and titles agreed upon between the Central Committee of the Ho Chi Minh Communist Youth Union and the Ministry of Education and Training.

- Outstanding head teachers in charge of the Team at various levels shall be considered equivalent to outstanding teachers at the same level and may be awarded Teacher Medals, Medals for the Young Generation, and other medals of the Ho Chi Minh Communist Youth Union.

1.4. In addition to the above regulations, depending on specific conditions in each locality, additional policies and benefits may be considered to facilitate the activities of head teachers in charge of the Team, such as organizing annual visits and exchanges of advanced experiences, providing material conditions for their activities...

2. Employment policy:

2.1. Teachers appointed as head teachers who perform their duties well shall be rewarded; if they violate discipline, they shall be dealt with according to current regulations.

2.2. After completing their duties as head teachers, schools shall be responsible for reassigning them to their original teaching positions.

2.3. During their tenure as head teachers, teachers shall participate in regular training and upgrading courses organized by the Ministry of Education and Training and the Ho Chi Minh Communist Youth Union.

IV. IMPLEMENTATION

1. Provincial People's Committees, Departments of Education and Training, Departments of Finance and Prices, and Provincial Youth Unions shall assist the People's Committees of centrally governed cities and provinces in implementing this Circular.

2. Starting from the 1995-1996 academic year, localities shall review the team of teachers in charge of the Team in general education schools and select candidates for the next five years who meet the required standards. For teachers currently in charge of the Team over 35 years old with experience, good health, and no replacement available, they may be retained for up to five years.

Where there is no teacher in charge of the Team or where the existing teacher has not been trained in youth work, localities must select teachers within the age range who meet the criteria set out in Section I of this Circular and request the Department of Education and Training and the Provincial Youth Union to provide vocational training before officially appointing them.

In mountainous, island, and remote areas due to a shortage of teachers, if localities have assigned trained and experienced members to be in charge of the Team, they should plan to provide pedagogical training within two years so that no teachers in charge of the Team remain untrained. From now on, non-teachers shall not be employed as head teachers in charge of the Team in schools.

The funds for implementing the responsibility allowance system for teachers in charge of the Team and for retraining and vocational training shall come from the regular budget of the education and training sector annually.

This Circular shall take effect from January 1, 1996, and all previous regulations inconsistent with this Circular shall be nullified. Any issues arising during implementation should be reported to the Inter-Ministerial Joint Office - Personnel Bureau of the Government, the Ministry of Education and Training, the Ministry of Finance, and the Central Committee of the Ho Chi Minh Communist Youth Union for prompt resolution.
