THE GOVERNMENT
Pursuant to the Government Organization Law dated September 30, 1992;
Pursuant to Resolution No. 20/1998/QH10 dated December 2, 1998 of the National Assembly;
At the proposal of the Minister of Labor, Invalids and Social Affairs, the Minister of Defense, the Minister of Public Security, the Minister of Finance, and the Minister, Head of the Civil Service and Cadre Organization Board of the Government,
DECREE:
Article 1.
1. The subjects entitled to benefits under this Decree include:
Military personnel and cadres of Party agencies, State agencies, Vietnam Fatherland Front and its member organizations, and social organizations receiving state budget salaries when going to battlefields B, C, K during the period of fighting against America to save the country without direct dependents;
Officers and cadres who went to build the 559 road before the implementation of the salary system in 1960;
Military personnel and cadres who were dispatched by the Party to stay in the South to continue revolutionary activities after the Geneva Agreement in 1954 (including cadres who had been evacuated but could not go due to objective conditions and stayed in the South to continue revolutionary activities);
Military personnel and cadres dispatched by the Party to perform international missions in Laos and Cambodia after the Geneva Agreement in 1954.
2. The subjects specified in Clause 1 of this Article, if deceased prior to the effective date of this Decree, their dependents shall be entitled to benefits as prescribed in this Decree.
3. The one-time benefit based on years of service and combat shall be calculated as follows: For each year of service and combat at the battlefield, the subjects mentioned in Clause 1 of this Article shall receive VND 500,000 (five hundred thousand dong). The minimum one-time benefit for those with less than two years of service is VND 1,000,000 (one million dong) per person.
Article 2. This Decree takes effect fifteen days from the date of issuance and replaces Decree No. 95/CP dated December 23, 1995 of the Government.
Article 3. The Minister of Labor, Invalids and Social Affairs shall take the lead and coordinate with the Minister of Finance, the Minister, Head of the Civil Service and Cadre Organization Board of the Government to guide the implementation of this Decree.
The Ministry of Defense and the Ministry of Public Security shall be responsible for reviewing the subjects and organizing the implementation of this Decree for officers, non-commissioned officers, and soldiers receiving salaries within the armed forces as stipulated in Article 1 of this Decree.
During the implementation process, the relevant ministries and sectors within their respective responsibilities shall cooperate with the Central Organization Department to implement the provisions of this Decree.
Article 4. The Minister, the head of a ministry equivalent to a ministry, the head of a government agency, and the Chairman of the People's Committee of provinces and centrally-administered cities are responsible for enforcing this Decree.
