Guidelines for Implementing Policies on Waiving and Reducing Tuition Fees for Students Receiving Policy Benefits Studying at Non-Public Educational Institutions
Who Are Currently Enrolled in Non-Public Educational and Training Establishments

Pursuant to Decree No. 28/CP dated April 29, 1995 of the Government detailing and guiding the implementation of certain provisions of the Ordinance on Preferential Treatment for Persons Engaging in Revolutionary Activities, Martyrs, and Families of Martyrs, War Invalids, and Those Contributing to the Revolution; on November 2, 1999, the Ministry of Labor - Invalids and Social Affairs, the Ministry of Finance, and the Ministry of Education and Training jointly issued Circular No. 26/1999/TTLT/BLDTBXH-BTC-BGDĐT guiding the implementation of preferential policies in education and training.
Now, in accordance with the policy encouraging socialization in the field of education and training under Decree No. 73/1999/NĐ-CP dated August 19, 1999 of the Government, following the consensus expressed in Document No. 1608/KHTC dated March 8, 2001 from the Ministry of Education and Training; the Ministry of Finance and the Ministry of Labor - Invalids and Social Affairs hereby issue guidelines for implementing policies on waiving and reducing tuition fees for students receiving policy benefits who are currently enrolled at non-public educational institutions (hereinafter referred to as non-public schools) as follows:
1. Objectives:
- The policy of waiving and reducing tuition fees applies to Heroes of the Armed Forces, Heroes of Labor; war invalids, persons treated as war invalids; children of martyrs, children of war invalids (including children of war invalids type B recognized before December 31, 1993 and currently receiving monthly allowances), children of persons treated as war invalids, children of war invalids (including children of war invalids with a loss of working capacity between 41% and 60% recognized before December 31, 1994 and currently receiving monthly allowances) studying at non-public schools (hereinafter referred to as students) who meet the conditions to be recognized as beneficiaries of preferential policies as stipulated in Articles 64 and 65 of Decree No. 28/CP dated April 29, 1995 of the Government.
- Students and pupils who are children of war invalids, children of war invalids, children of persons treated as war invalids among the aforementioned beneficiaries have completed the procedures to enjoy the benefit or are currently enjoying the benefit of waiving or reducing tuition fees during their studies, if their father or mother dies while they are still war invalids, war invalids, or persons treated as war invalids, they will continue to enjoy the preferential treatment if they continue their studies.
- The policy of waiving and reducing tuition fees does not apply to the following students:
+ Students currently studying at schools and educational establishments that follow non-formal education methods.
+ Students who have already received preferential treatment at one university and now continue to study another major at a different university.
+ Students in postgraduate programs.
+ Overseas Vietnamese students.
2. Implementation Method of the Policy on Waiving and Reducing Tuition Fees for Students Studying at Non-Public Schools:
a- Students pay tuition fees according to the general regulations of the school applicable to students outside the policy beneficiary category.
b- The Department of Labor - Invalids and Social Affairs (including centers for the care of severely disabled war invalids under the management of the Ministry of Labor - Invalids and Social Affairs) base on the files they manage, the application form for allowance (Form I), the confirmation form of the school where the student is studying (Form 2A for education sector or Form 2B for training sector), a copy of the student's birth certificate, and other related documents to reissue the portion of tuition fees that the student is entitled to waive or reduce according to the regulations.
For students who are children of war invalids currently still serving in the military or police, the Department of Labor - Invalids and Social Affairs at the district where the student's household registration is located bases on the application form for allowance (Form I) confirmed by the police or military unit managing the file and implementing the payment of allowances and subsidies for war invalids, along with other relevant documents as mentioned above, to reissue the portion of tuition fees that the student is entitled to waive or reduce.
c- The level of tuition fees serving as the basis for the State to provide support for tuition fees for students studying at non-public schools is as follows:
- For the education and training sector managed by localities, it is the level of tuition fees set by the People's Committee of provinces and centrally-administered cities.
- For schools in the central management training sector, it is the highest level within the framework of tuition fees for public schools in the same sector, specifically as follows.
+ Vocational School: VND 120,000/month;
+ Secondary Technical School: VND 100,000/month;
+ College: VND 150,000/month;
+ University: VND 180,000/month.
d- Level of tuition fee support:
- 50% of tuition fees for students eligible for reduced tuition fees;
- 100% of tuition fees for students eligible for waived tuition fees.
This tuition fee support is provided annually and paid in two semesters:
- Semester I is paid in November or December each year.
- Semester II is paid in April or May each year.
3. Procedures for Establishing Application Files for Allowances:
Students who are policy beneficiaries must submit the following documents to the Department of Labor - Invalids and Social Affairs (or the Department of Organizational Labor and Social Affairs) at the district level where the file is managed and allowances are implemented, or where the student has permanent residence (for students whose parents are still serving in the military or police):
+ Application form for allowance (Form I);
+ Confirmation form (Form 2A or 2B) issued by the school where the student is studying for each semester.
+ A copy of the student's birth certificate.
Departments of Labor - Invalids and Social Affairs at all levels implement the procedures for establishing application files for disbursing the portion of waived or reduced fees for students according to the regulations stipulated in Joint Circular No. 26/1999/TTLT/BLDTBXH-BTC-BGDĐT dated November 2, 1999 of the Ministry of Labor - Invalids and Social Affairs, the Ministry of Finance, and the Ministry of Education and Training.
4. Source of Funding for Allowance Support:
- The funding for supporting students eligible for waived or reduced tuition fees as stipulated in this Circular is guaranteed by the Central Budget.
- The management, budget preparation, disbursement, and settlement procedures are carried out according to current regulations.
The budget expenditure for 2001 increases due to the implementation of the policy of exempting and reducing tuition fees for students currently studying at non-state schools arranged in the social security budget estimate that has been announced.
- Directing the Department of Information and Communications to advise on management, plan formulation, and implementation after approval by the Provincial People's Committee;
This Circular takes effect from January 1, 2001.
The Department of Labor - Invalids and Social Affairs shall base on the provisions of this Circular to coordinate with financial agencies, Treasury, Education and Training departments to organize the payment of allowances fully and accurately according to the prescribed recipients.
Other regulations regarding educational and training benefits continue to be implemented in accordance with the joint Circular No. 26/1999/TTLT/BLDTBXH-BTC-BGDĐT dated November 2, 1999 issued by the Ministry of Labor - Invalids and Social Affairs, Ministry of Finance, and Ministry of Education and Training.
Any difficulties encountered during the implementation process should be promptly reported for the joint ministries to consider and resolve./.
