for honey production and business

Pursuant to Decree No. 33/2005/NĐ-CP dated March 15, 2005 of the Government detailing the implementation of certain provisions of the Animal Health Ordinance;
Pursuant to Decree No. 01/2008/NĐ-CP dated January 3, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

The Ministry of Agriculture and Rural Development hereby stipulates the veterinary hygiene inspection and supervision for honey production and business as follows:
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation and Applicability
2. Applicability:
This Circular specifies the inspection and supervision of honey production and business, including the establishment of inspection and supervision plans, their implementation, inspection systems, the use of veterinary drugs and feed for beekeeping, handling violations, and the allocation of responsibilities among agencies in organizing and implementing these measures.

Chapter II
VETERINARY HYGIENE INSPECTION AND SUPERVISION
Article 2. Establishment of Plans and Implementation
1. Plan Establishment:
The Department of Animal Health shall lead the establishment of annual inspection and supervision plans and submit them to the Ministry of Agriculture and Rural Development for approval and funding to implement the plan.
2. Implementation:
After the plan has been approved by the Ministry of Agriculture and Rural Development and funding has been provided, the Department of Animal Health shall organize the implementation of inspections, supervision, and sample analysis, while reporting to the Ministry of Agriculture and Rural Development on the results of inspections, supervision, and sample analysis conducted, the plan for the following year, and notifying relevant authorities of importing countries when required. inspection, supervision, and sample analysis; at the same time report to the Ministry of Agriculture and Rural Development the results of the inspection, supervision, and sample analysis conducted, the plan for the following year's implementation, and notify the competent authorities of the importing country when requested.
3. Article 3. Timeframe for Inspection, Supervision, and Sample Collection for Analysis
1. During February to April and October to December each year, the Department of Animal Health shall organize inspections, supervision, and collection of honey and bee feed samples at honey production and business establishments and bee feed production facilities.
2. The number and types of samples collected for analysis shall be according to the established plan. In cases of necessity, sampling and inspection may be carried out unexpectedly.
Article 4. Agencies Responsible for Sample Collection and Analysis
The Central Veterinary Hygiene Inspection Center I shall carry out the collection and analysis of harmful residues such as Chloramphenicol, Nitrofurans, Streptomycin, Tylosin, Tetracycline, and other residues according to the established plan.
Article 5. Regulations on Sample Collection and Analysis
Sample collection, the quantity of samples, and residue analysis indicators shall be conducted according to the annual plan attached.
Article 6. Regulations on Retention of Analysis Results
Analysis results shall be retained by the analyzing agency and sent to relevant agencies.
Article 7. Provisions on sampling for export quarantine of consignments
Sampling for export quarantine of consignments shall be carried out in accordance with the provisions on export quarantine.
The number of samples taken for analysis depends on the volume of the export consignment.
Analysis criteria are based on the requirements of the importing country.
Quarantine records are kept at the quarantine authority.
If residues are found in the consignment, the analysis results must be immediately reported to the production and business establishments concerned and appropriate measures for handling shall be implemented in accordance with the regulations.
Article 8. Provisions on annual plan formulation
The annual plan sent to importing countries, the implementation of supervision, the number of samples analyzed, the processing of sample analysis, and the annual reporting of results to importing countries shall be carried out by relevant authorities and units as stipulated in Chapter VI of this regulation.
Chapter III
INSPECTION AND SUPERVISION SYSTEM
Article 9. The inspection and supervision system for animal health hygiene in beekeeping and honey processing to ensure animal health hygiene quality includes:
1. The Animal Health Department.
2. Regional Animal Health Authorities.
3. Central Animal Health Inspection Centers I and II.
4. Provincial Animal Health Departments in beekeeping areas.
Article 10. Subjects subject to inspection and supervision of honey production and processing activities:
1. Enterprises producing and trading in honey.
2. Beekeeping facilities.
3. Facilities producing bee feed.
Article 11. The inspection and supervision system, according to its tasks and powers, performs assigned tasks to ensure a closed-loop monitoring system from production to transportation, initial processing, and processing.
Article 12Production and trading enterprises of honey and bee feed production are subject to inspection and supervision by the inspection and supervision authority and must comply with the requirements of inspection and supervision during production and trading.
Chapter IV
USE OF VETERINARY DRUGS AND FEED IN
BEEKEEPING
Article 13Only facilities producing veterinary drugs that meet Good Manufacturing Practice (GMP) standards are allowed to register for the production of veterinary drugs in beekeeping. Labels of veterinary drugs used in beekeeping must contain all required information, including the specific components, indications for bee diseases, and usage instructions.
Article 14Organizations and individuals engaged in beekeeping for export, in addition to complying with legal regulations on the use of veterinary drugs and feed in beekeeping, must also comply with the requirements of the importing country.
Article 15. Only veterinary drugs listed in the permitted drug catalog issued by the Ministry of Agriculture and Rural Development may be used to prevent and treat bee diseases, and such drugs must be prescribed by a veterinarian (with a valid practice certificate). Veterinary drugs must be purchased from authorized drug retail stores.
Article 16When using drugs, strict adherence to the disease indications for bees on the label and the manufacturer's instructions is required. Beekeeping facilities must maintain records of bee disease outbreaks and treatment manuals. Antibiotics listed as prohibited in beekeeping are strictly forbidden.
Article 17. Importing, producing, trading, and using veterinary drugs containing harmful antibiotics and chemicals to prevent and treat bee diseases is prohibited.
Article 18. Feed for beekeeping must clearly state its composition, usage method, production date, and expiration date. Bee feed can only be circulated with permission from the competent authority. Mixing antibiotics and hormones into bee feed is strictly prohibited.
Chapter V
HANDLING VIOLATIONS
Article 19. Handling of honey not meeting standards during inspection and supervision
1. During honey sample analysis, if mandatory animal health hygiene indicators exceed permissible limits, the Central Animal Health Inspection Center I will proceed as follows:
a) Immediately inform the honey production and trading enterprise of the analysis results.
b) Require the enterprise to apply appropriate corrective measures.
c) Immediately suspend the export of honey from violating enterprises.
Conduct an investigation of honey production facilities that fail to meet animal health hygiene food standards, and based on this, require the application of necessary measures to eliminate these causes; honey production facilities that fail to meet standards must suspend honey exports until the new honey harvest season; exports may resume only after the cause of non-compliance has been identified and effective remedial measures have been recognized.
d) Report the sample analysis results to the Animal Health Department and notify relevant authorities to coordinate inspections and supervision.
2. The Animal Health Department directs related agencies to conduct audits and inspections within one year for facilities violating regulations.
Article 20In cases where exported consignments are found to contain harmful residues, residues exceeding permissible limits, or incorrect origins by the importing country, the consignment owner or production unit must report to the Animal Health Department to coordinate with relevant authorities and the importing country to discuss measures for handling the consignment; the consignment owner must bear all costs associated with the consignment's handling.
Chapter VI
IMPLEMENTATION
Article 21. Responsibilities of the Animal Health Department
1. Guide provincial animal health agencies related to beekeeping to monitor and supervise the production and use of veterinary drugs in beekeeping.
2. Coordinate with the Vietnam Beekeeping Association and honey production and trading companies to train and guide beekeepers on the proper use of veterinary drugs in beekeeping.
3. Guide the handling of violations in the use of prohibited antibiotics in beekeeping.
4. Monitor the activities of organizations, units, and enterprises producing and trading exported honey within the monitoring system.
5. Coordinate with the Vietnam Beekeeping Association to propose organizing annual inspections; if an enterprise meets the requirements stipulated, it will be permitted to produce and trade exported honey.
6. Compile information, analyze and adjust activities to meet set requirements.
7. Propose adjustments and handling of violations related to honey production, trading, and export.
8. Summarize the annual plan, report on the implementation results, adjustments, and handling of violations related to honey production, trading, and export for importing countries.
Article 22. Responsibilities of the Vietnam Beekeeping Association
The Vietnam Beekeeping Association shall coordinate with the Animal Health Department and relevant agencies:
1. Establish and update files and codes for bee farms and honey production and trading companies for export.
2. Organize training and guidance for honey production and trading companies for export and bee farms to implement HACCP, GMP, VietGAP programs, and regulations and guidelines for honey production, trading, and beekeeping, to meet the hygiene requirements for exported honey as required by importing countries and ensure food safety for consumers.
3. Handle violations in beekeeping and honey trading.
Article 23. Responsibilities of Regional Animal Health Agencies
1. Carry out inspection and supervision tasks regarding honey production, trading, and export from honey production and trading facilities under their jurisdiction.
2. Conduct quarantine and issue export quarantine certificates for honey according to the importing country's requirements.
3. Implement adjustment and handling activities for violations during honey production, trading, and export, and the use of veterinary drugs in beekeeping and bee feed processing.
4. Report activity results to the Department of Animal Health and inform other related parties.
Article 24. Responsibilities of Provincial Animal Health Agencies where Honey is Produced
1. Monitor and supervise the production and use of veterinary drugs in beekeeping within their jurisdiction.
2. Coordinate with agencies and units under the Animal Health Department to inspect and supervise honey production and trading facilities within their jurisdiction.
2. Punish violations in the use of prohibited antibiotics in beekeeping according to the law.
Article 25. Responsibilities of Central Veterinary Sanitation Inspection Centers I and II
1. Central Veterinary Sanitation Inspection Center I: Develop inspection plans, conduct annual inspections, sampling, and analysis according to plans announced to importing countries; compile and report data to the Animal Health Department after sampling rounds; implement programs to raise awareness among beekeepers and promote good agricultural practices (GAHP); establish files for honey production and trading companies for export and store related information and data.
2. Central Veterinary Sanitation Inspection Center II: Participate in inspections of bee farms and honey trading facilities for export and disseminate and guide beekeepers and honey traders to apply measures to ensure veterinary hygiene for honey as assigned by the Animal Health Department.
Article 26. Regarding export honey production and trading companies
1. Comply with good manufacturing practices for honey (GMP).
2. Conduct sampling and send samples for analysis according to the annual plan.
3. Maintain records to track and monitor the origin of each batch for tracing purposes.
4. Participate with competent authorities in inspecting and supervising honey production at related facilities.
5. Organize training to enhance knowledge for beekeepers and honey traders; exchange information to promptly address and handle violations during the production process.
6. Report the activities of the unit, any violations, their handling, and relevant information to related organizations and units.
Article 27. Responsibilities of beekeeping establishments
1. Comply with good beekeeping practices (GAHP).
2. Do not use prohibited antibiotics in beekeeping.
3. Only use veterinary drugs that have been approved by the Ministry of Agriculture and Rural Development.
4. Regularly report the situation of bee diseases and honey production to relevant agencies for handling.
5. Maintain a list tracking each bee colony for tracing purposes.
Chapter VII
IMPLEMENTING PROVISIONS
Article 28. Effective date
This Circular takes effect 45 days from the date of signature./.
