Regulations on the level of collection, collection system, payment, management, and use of fees for exploiting and using meteorological and hydrological data, water and air environment

Regarding the use of fees and charges

Based on Decree No. 57/2002/NĐ-CP dated June 3, 2002, of the Government detailing the implementation of the Law on Fees and Charges;

Based on the Ordinance on Exploitation and Protection of Meteorological and Hydrological Engineering Works issued by the Standing Committee of the National Assembly on December 2, 1994;

Based on Decree No. 24/2006/NĐ-CP dated March 6, 2006, amending and supplementing some articles of Decree No. 57/2002/NĐ-CP dated June 3, 2002, of the Government detailing the implementation of the Law on Fees and Charges;

Pursuant to Decree No. 118/2008/NĐ-CP dated November 27, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

Pursuant to the proposal of the Ministry of Natural Resources and Environment at Circular No. 4248/BTNMT-TC dated October 25, 2008;

The Ministry of Finance stipulates the level of collection, collection system, payment, and use of fees for exploiting and using meteorological and hydrological data, water and air environment collected from fixed meteorological and hydrological observation stations and survey points managed by the National Centre for Hydro-meteorological Forecasting under the Ministry of Natural Resources and Environment as follows:

I. GENERAL PROVISIONS

1. This Circular applies to the collection, payment, management, and use of fees for exploiting and using meteorological and hydrological data, water and air environment collected from fixed meteorological and hydrological observation stations and survey points managed by the National Centre for Hydro-meteorological Forecasting under the Ministry of Natural Resources and Environment.

2. Organizations and individuals who exploit and use meteorological and hydrological data, water and air environment at the National Centre for Hydro-meteorological Forecasting under the Ministry of Natural Resources and Environment are the fee payers as prescribed in this Circular.

3. No fees shall be collected for the exploitation and use of meteorological and hydrological data, water and air environment for the following purposes:

a) Announcements on state mass media serving common needs of society;

b) Serving national defense and security needs;

c) Exchanging information with foreign countries and international organizations according to international treaties to which the Socialist Republic of Vietnam has signed or joined.

II. SPECIFIC PROVISIONS

1. The level of fees for exploiting and using meteorological and hydrological data, water and air environment is specifically defined in the attached Table of Fee Levels for Exploiting and Using Meteorological and Hydrological Data, Water and Air Environment issued together with this Circular.

2. Fees for exploiting and using meteorological and hydrological data, water and air environment are part of the state budget revenue. The unit providing meteorological and hydrological data, water and air environment is the fee-collecting unit entitled to retain 70% (seventy percent) for the following uses:

a) Payment for individuals directly performing work, services, and collecting fees: salaries, wages, allowances, contributions as prescribed, excluding salary costs for officials and civil servants already receiving state budget salaries according to prescribed regulations;

b) Direct expenses for fee collection such as office supplies, office materials, telephone, electricity, water, travel expenses, administrative expenses; printing (buying) declaration forms, permits, according to current standards and norms;

c) Expenses for purchasing, regular maintenance, major repairs of assets, machinery, equipment directly serving fee collection activities;

3. The fee-collecting unit is responsible for remitting 30% (thirty percent) of the collected fees into the state budget according to the chapters, types, items, and sub-items of the current State Budget Classification.

III. IMPLEMENTATION ORGANIZATION

1. This Circular takes effect 45 days from the date of signature.

2. Other contents related to the collection, payment, management, use, payment receipts, publicizing the fee collection system for exploiting and using meteorological and hydrological data, water and air environment not specified in this Circular shall be implemented in accordance with the guidance provided in Circular No. 63/2002/TT-BTC dated July 24, 2002; Circular No. 45/2006/TT-BTC dated May 25, 2006, amending and supplementing Circular No. 63/2002/TT-BTC dated July 24, 2002, of the Ministry of Finance guiding the implementation of legal provisions on fees and charges; and Circular No. 60/2007/TT-BTC dated June 14, 2007, of the Ministry of Finance guiding the implementation of the Law on Tax Administration.

3. During the implementation process, if there are any difficulties, agencies, organizations, and individuals are requested to promptly report to the Ministry of Finance for research and supplementary guidance./.
