Pursuant to Decree No. 32/2008/NĐ-CP dated March 19, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;

Pursuant to Decree No. 75/2006/NĐ-CP dated August 2, 2006, of the Government detailing and guiding the implementation of certain provisions of the Education Law; Decree No. 31/2011/NĐ-CP dated May 11, 2011, of the Government amending and supplementing certain provisions of Decree No. 75/2006/NĐ-CP dated August 2, 2006, of the Government detailing and guiding the implementation of certain provisions of the Education Law; Decree No. 07/2013/NĐ-CP dated January 9, 2013, of the Government amending Point b Clause 13, Article 13 of Decree No. 31/2011/NĐ-CP dated May 11, 2011, of the Government amending and supplementing certain provisions of Decree No. 75/2006/NĐ-CP dated August 2, 2006, of the Government detailing and guiding the implementation of certain provisions of the Education Law;

The Minister of Education and Training issues this Circular amending and supplementing certain articles of the Regulation on managing Vietnamese citizens studying abroad promulgated together with Circular No. 10/2014/TT-BGDĐT dated April 11, 2014, issued by the Minister of Education and Training.

At the proposal of the Director of the Department of International Training;

The Minister of Education and Training issues this Circular providing regulations on the organization of training, examination, testing, and issuing certificates for vocational counseling services for studying abroad,

PART I

GENERAL PROVISIONS

Article 1. Scope of regulation and applicable subjectsRegulation and scope of application

1. This document stipulates the organization of training, examination, testing, and issuing certificates for vocational counseling services for studying abroad.

2. This document applies to teacher training colleges, normal universities, educational management academies, education management officer schools, educational institutions assigned tasks of training, examination, testing, and issuing certificates for vocational counseling services for studying abroad, and organizations and individuals related to these activities.

Article 2. Vocational Counseling Services for Studying Abroad Training

1. Vocational counseling services for studying abroad training is the organization of training, examination, testing, and issuing certificates for vocational counseling services for studying abroad for Vietnamese citizens, foreign nationals engaged in vocational counseling services for studying abroad activities, and other entities with a need for training to enhance their knowledge, expertise, and vocational skills in vocational counseling services for studying abroad.

2. The organization of training, examination, testing, and issuing certificates for vocational counseling services for studying abroad shall be carried out according to the training program for vocational counseling services for studying abroad issued by the Ministry of Education and Training.

Article 3. Educational Institutions for Vocational Counseling Services for Studying Abroad Training

Educational institutions for vocational counseling services for studying abroad training are teacher training colleges, normal universities, educational management academies, education management officer schools, and educational institutions assigned by the Minister of Education and Training the task of training, examination, testing, and issuing certificates for vocational counseling services for studying abroad (hereinafter referred to as educational institutions).

Chapter II

ORGANIZATION OF VOCATIONAL COUNSELING SERVICES FOR STUDYING ABROAD TRAINING

Article 4. Responsibilities of the Parties Involved in the Collaboration, amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CP Training organization

Educational institutions assigned the task of training, examination, testing, and issuing certificates for vocational counseling services for studying abroad as stipulated in Article 3 of this Circular shall implement the organization of vocational counseling services for studying abroad training according to regulations issued by the Ministry of Education and Training.

Article 5. Competence, Application Forms, Procedures for Assigning Tasks of Training, Examination, Testing, and Issuing Certificates for Vocational Counseling Services for Studying AbroaddevelopmentInspection, examination, and issuance of certificates for training in educational counseling services

1. Competence:

The Minister of Education and Training or the person authorized decides to assign tasks of training, examination, testing, and issuing certificates for vocational counseling services for studying abroad to educational institutions as stipulated in Article 3 of this Circular.

2. Application Forms:

The application form for assigning tasks of training, examination, testing, and issuing certificates for vocational counseling services for studying abroad includes:

a) A request for assignment of the task of organizing training, examination, testing, and issuing certificates for vocational counseling services for studying abroad;

b) An application for the task of training, examination, testing, and issuing certificates for vocational counseling services for studying abroad, including the following contents: reasons for applying, the capacity of the educational institution, the curriculum vitae of lecturers and speakers, training programs and plans, teaching materials, and accompanying evidence.

3. Procedures:

a) Educational institutions applying for the task of training, examination, testing, and issuing certificates for vocational counseling services for studying abroad must submit the application form as prescribed in Clause 2 of this Article to the Department of International Education within 30 working days from the date of receipt of all application forms. Within 30 working days from the date of receiving all application forms, the Department of International Education will present the Minister of Education and Training to issue a decision assigning the task of training, examination, testing, and issuing certificates for vocational counseling services for studying abroad.

b) In case of rejection, within 15 working days from the date of receipt of all application forms, the Department of International Education has the responsibility to reply in writing to the educational institution, clearly stating the reasons for rejection.

Article 6. Lecturers and Reporters

Lecturers and reporters participating in vocational training for educational counseling services include lecturers under the permanent staff, contractual, or visiting lecturer positions at educational institutions; invited guests and experts from state management agencies, diplomatic missions, international education and training organizations, and educational counseling service providers with teaching experience or relevant work experience as required.

Article 7. Students

1. Students participating in the vocational training course for educational counseling services include:

a) Vietnamese and foreign individuals engaged in educational counseling services;

b) Individuals seeking to enhance their knowledge and professional skills in organizing and implementing educational counseling services activities.

2. Foreign students participating in the vocational training course for educational counseling services must have a Vietnamese language proficiency certificate for foreigners according to current regulations.

Article 8. Application Registration Documents

The registration documents for participation in the vocational training course for educational counseling services shall be stipulated by the educational institution assigned the task of training, examination, testing, and issuing certificates for vocational training in educational counseling services according to current regulations.

Chapter III

ORGANIZATION OF EXAMINATION, TESTING, AND ISSUANCE OF CERTIFICATES FOR VOCATIONAL TRAINING IN EDUCATIONAL COUNSELING SERVICES

Article 9. Organization of Examination and Testing

The organization of examinations and tests shall be conducted as follows:

1. At the end of each topic in the vocational training program for educational counseling services, there will be a test lasting a minimum of 60 minutes. At the end of the vocational training course, there will be a final exam lasting a minimum of 90 minutes.

2. The scores for the end-of-topic tests and the final exam at the end of the vocational training course will be graded on a scale of 10 points, with a score below 5 points being considered unsatisfactory.

3. Students who ensure attendance in at least 80% of the scheduled class time for each topic are eligible to take the end-of-topic test. Students who achieve a score of 5 points or higher in all end-of-topic tests are eligible to take the final exam at the end of the vocational training course.

4. Students are permitted to retake the end-of-topic test or the final exam twice if they fail to meet the requirements.

Article 10. Issuance of Certificates for Vocational Training in Educational Counseling Services

1. Students who achieve a score of 5 points or higher in all end-of-topic tests and the final exam at the end of the vocational training course are eligible to receive a certificate for vocational training in educational counseling services.

2. Educational institutions assigned the task of training, examination, testing, and issuing certificates for vocational training in educational counseling services issue certificates to students.

3. The management and issuance of certificates for vocational training in educational counseling services shall be carried out in accordance with the Regulations on Diplomas and Certificates of the National Education System.

Chapter IV

IMPLEMENTATION

Article 11. Reporting and Archiving Administrative Procedure: Recognition of forest tree planting seed sources

1. Reporting:

After each session of vocational training, examination, testing, and issuance of certificates for vocational training in educational counseling services, the educational institution shall report to the Ministry of Education and Training (through the Department of International Education Cooperation) according to the regulations.

2. Archiving:

a) Educational institutions are responsible for establishing and archiving records after each session of vocational training, examination, testing, and issuance of certificates for vocational training in educational counseling services in accordance with current laws on archiving to serve the inspection and supervision work of competent state authorities.

b) The archived records include: admission files, student lists (name, date of birth, professional qualifications, contact address, place of residence); instructor and reporter lists (name, date of birth, professional qualifications, workplace, contact address), list of students receiving certificates, test questions, answers, test results, examination processing records, Decision on issuing certificates, original books with signatures of certificate recipients for each vocational training course.

Article 12. Inspection and supervisiondevelopmentInspection

1. The Ministry of Education and Training’s Inspectorate shall take the lead and coordinate with the Overseas Training Department and relevant units to conduct inspections and supervision of activities related to training, examination, testing, and issuing certificates for counseling services abroad.

2. The Overseas Training Department shall be responsible for inspecting educational institutions in their implementation of objectives, contents, management organization of training, examination, testing, and issuing certificates for counseling services abroad.

3. Departments of Education and Training shall be responsible for inspecting educational institutions under the People's Committees of provinces and cities within their jurisdictions in their implementation of objectives, contents, management organization, testing, and issuing certificates for counseling services abroad.

Article 13. Effective Date

This Circular takes effect from August 12, 2013./.
